It is a circus which suits the Swamis and MSA in business. Why can't Pakis celebrate 26/11 as theey feel it is a strategic strike and boast about thier contacts in India

Lakhvi detention: Pakistani court okays in camera hearing - IANS, The Hindu
The Islamabad High Court (IHC) on Monday accepted the Pakistani government’s application for an in-camera hearing to submit records on the detention of Zaki-ur Rahman Lakhvi, the alleged mastermind of the 26/11 Mumbai terror attack.

Earlier, two different petitions had been submitted by the federal government and the Federal Investigation Agency (FIA) in the Supreme Court, which referred them to the IHC, Dawn online reported.

The Supreme Court also asked the IHC to review its December 30 decision to grant Lakhvi conditional release.

The FIA petition challenged the December 18 decision of an anti-terrorism court (ATC) in Islamabad granting Lakhvi bail.

However, the federal government had extended his detention in the Adiala Jail under the Maintenance of Public Order ordinance.

Lakhvi has been behind bars since February 19, 2009, after an FIR was registered with the FIA’s Special Investigation Unit (SIU) for allegedly training terrorists and facilitating the Nov 26-29, 2008 Mumbai attacks in which 166 people, many of them foreigners, were killed and hundreds injured.

Prosecutors in Mumbai attacks case to be replaced - DAWN
The government has decided to replace special prosecutors in the Mumbai attacks case.

The decision has been taken following widespread criticism against the government after Zakiur Rehman Lakhvi, the alleged mastermind of the Mumbai attack, was granted bail by an Anti-Terrorism Court (ATC).

A senior government official, on condition of anonymity, told Dawn that the government had begun the process of headhunting for special prosecutors.


According to him, the government has contacted criminal law experts and some senior lawyers with experience in the criminal proceedings.

He said India and some other countries took strong exception to granting of bail to Lakhvi, only a couple of days after the December 16 terrorist attack on Army Public School, Peshawar. This forced the government to detain Lakhvi under the Maintenance of Public Order (MPO).

In November 2008 Mumbai attacks, 166 people were killed.

The Pakistani government took Lakhvi and some other suspects into custody in February 2009 for ‘facilitating’ the attacks.

Special Investigation Unit (SIU) of the Federal Investigation Agency (FIA) registered a First Information Report (FIR) against Lakhvi and six other alleged abettors.

In August 2009, Chaudhry Zulfiqar Ali was appointed special prosecutor in the case. Later, Advocate Mohammad Azhar Chaudhry was also appointed senior prosecutor.

Government has approached criminal law experts and some senior lawyers for the position

After the murder of Chaudhry Zulfiqar on May 3, 2013, the FIA handed over the job to Abuzar Hasnain Pirzada.

The prosecutors in the Mumbai attacks case were receiving threats which they kept reporting to the concerned quarters, sources said.


When contacted, senior prosecutor Azhar Chaudhry said the government could change the prosecutors. However, he expressed ignorance in this regard.

In a recent appeal filed in the Islamabad High Court (IHC) against granting of bail to Lakhvi, the prosecutors said: “The fact remained that being the prosecution in such cases has been the most difficult job in our country for the last many years.”

It further states, “Even in this case, the prosecutors have been receiving threats on their cellphones during the proceedings which were duly conveyed to the concerned authorities. The witnesses are also not protected and were reluctant to depose against the accused persons in the given situation.”

The said appeal seeking cancellation of post-arrest bail to Lakhvi is still pending for adjudication before a division bench of the IHC.

An Anti-Terrorism Court (ATC) of Islamabad on December 18 granted bail to Lakhvi. The federal government however detained Lakhvi under the MPO.

The IHC suspended the detention order on December 26, but the Islamabad police registered a kidnapping case against Lakhvi.

The Supreme Court on January 7 restored the detention order and asked the IHC to decide the matter after hearing the federal government.

Hearing on Lakhvi’s detention IHC Justice Noorul Haq N. Qureshi, on Wednesday held an in-camera hearing of the petition filed by Lakhvi against his detention under the MPO.

The court resumed hearing in the open court.

However, additional attorney general Afnan Karim Kundi sought an in-camera hearing as he wanted to submit some ‘sensitive documents’ before the court.

Raja Rizwan Abbasi, Lakhvi’s counsel, on the other hand insisted on a hearing in the open court.

Justice Qureshi, however, accepted the request of Mr Kundi and went to his chamber where Mr Kundi and advocate general Islamabad Mian Abdul Rauf briefed him about the detention.


Further hearing in this matter has been adjourned till Thursday.

After the hearing, advocate Abbasi told mediapersons that further hearings in Lakhvi’s detention case will be held in the open court.

The detention of 26/11 mastermind Zakiur Rehman Lakhvi has been extended by a month.

Lashkar-e-Taiba (LeT) terrorist and Mumbai terror attack plotter Lakhvi was put under detention by Pakistan after an anti-terrorism court granted him bail in the Mumbai attacks case on December 18.

His first detention order was suspended by court.

After this, the government arrested him again in a kidnapping case.

Two countries have asked Pak to hand over Lakhvi to India: FIA tells Court - DT
The Islamabad High Court (IHC) on Monday directed issuance of notices to the all concerned on the appeal petition of Federal Investigation Agency (FIA) against Zakiur Rehman Lakhvi, the alleged mastermind of Mumbai attacks.

A two member bench of the IHC while hearing the federal agency petition remarked “the detention order of Lakhvi was issued after the court directed the release of the accused” adding the handing over to foreign country is a diplomatic issue and court had no concern with it”. During the hearing FIA prosecutor Chaudhary Azher told the IHC bench comprising of Justice Shaukat Aziz Siddique and Justice Noor ul Haq Qureshi that the government was facing international pressure and informed the court that two countries had suggested Pakistan handover Lakhvi to India.

On this point Justice Shaukat Aziz Siddiqui remarked “court had no concern this totally diplomatic issue and falls in the domain of the federal government” adding a question the bench asked why the Lakhvi case was not sent to the military court. The counsel for Lakhvi was not present in the court due to lawyers’ community strike. The IHC issuing the notices adjourned the hearing of the case till January 26th. Meanwhile, the district administration of the capital extended the detention of Lakhvi for 30 days. The Deputy Commissioner Islamabad Mujahid Sherdil issued the Lakhvi’s detention extension order under Maintenance Public Order (MPO).

Earlier, the FIA challenged Zakiur Rehman Lakhvi’s bail in the IHC.The petition filed by the federal agency stated that the anti-terrorism court (ATC), hearing the Lakhvi case, ignored the testimony and granted bail to the alleged mastermind behind Mumbai attacks. The alleged mastermind behind the Mumbai attacks, Lakhvi, was granted bail by the ATC and then he was detained under MPO, a day after his bail was granted by the court.

Lakhvi was arrested in February 2009 and was indicted along with six others, including Abdul Wajid, Mazher Iqbal, Hamad Amin, Sadiq, Shahid Jameel, Riaz, Jameel Ahmed and Younis Anjum, on November 25, 2009. Lakhvi is also believed to be the operational head of the Lashkar-e-Taiba.

Currently, Lakhvi is detained in Adiala Jail for a six-year-old kidnapping case. The case was registered by the Golra Police on December 29, 2014, on the complaint of Muhammad Dawood, a resident in the federal capital’s outskirts. The government’s prosecutor pleaded to the court that the Supreme Court had nullified the IHC’s decision and submitted that there were certain things which were not for public consumption and could be shared with the counsel of the petitioner. Earlier, the Supreme Court had ordered the suspension of Zakiur Rehman Lakhvi‘s release order and referred the case back to the IHC for early hearing. The federal government pleaded to the apex court to set aside the IHC’s decision related to the suspension of Lakhvi’s detention.

Through an appeal petition submitted in the apex court, the government said that the suspension order of Lakhvi’s detention issued by the IHC was passed in violation of the Article 199 of the constitution and was unreasoned.

It pleaded to the top court to set this order aside. The petition was filed on the behalf of the interior secretary and SSP Islamabad and said that the IHC had passed the order without duly considering the relevant facts and circumstances. “It seems the court passed the order in haste,” Justice Jawad S Khawaja remarked, adding that the federal government was not given the opportunity to plead its concerns over the detention of Lakhvi under Maintenance Public Order (MPO).

‘Pakistan court ignored evidence given by India’ - Mumbai Police - The Hindu
The Mumbai Police have conveyed to the Ministry of External Affairs that the Pakistani court which granted bail to Zaki-ur-Rehman Lakhvi — the alleged 26/11 mastermind and top Lashkar-e-Taiba commander — in the ongoing Mumbai attacks trial in Pakistan, has apparently not taken into consideration the evidence they submitted, The Hindu has learnt.

Responding to a letter from the MEA on the Pakistan court’s bail order, the police have said they can make only a prima facie determination on the merits of the court’s action as they are not privy to the Indian court report on the cross examination of four Indian witnesses by the Pakistani Judicial Commission which visited Mumbai twice.

“The Indian court had submitted its report in a sealed envelope and we therefore are not privy to what the court had opined. However, we have studied the order by the Pakistani court at length and it nowhere makes a mention of the evidence sent by the Indian court,” a senior police officer told The Hindu .

In March 2012, the eight-member Pakistani Commission visited India and examined four Indian witnesses to collect evidence in connection with Lakhvi and others facing trial in Pakistan. However, the report submitted by the panel was rejected by their court as the Commission members were not allowed to cross-examine the witnesses.

Eventually, the two countries arrived on a consensus to allow the Indian witnesses to be cross-examined by the Judicial Commission. In September 2013, the Indian witnesses deposed before the Pakistani Commission during its second visit. The hearing took place at the Mumbai’s Esplanade court and the evidence was recorded by Additional Chief Metropolitan Magistrate P.Y. Ladekar who later sent the same in a sealed envelope to the Pakistani court.

The MEA in its letter had asked the Mumbai police to study the bail order of Lakhvi issued by an anti-terrorism court of Pakistan. Lakhvi and seven others, including Abdul Wajid, Mazhar Iqbal, Sadiq, Shahid Jameel Riaz, Jamil Ahmed and Younas Anjum, were arrested in 2009 for planning, financing and executing the Mumbai attack. In December 2014, Lakhvi was released on bail.

Lakhvi's bail plea in kidnapping case rejected - Dawn
A judicial magistrate on Friday rejected the bail request of Zakiur Rehman Lakhvi — the alleged mastermind of the 2008 Mumbai attacks — in a case pertaining to the abduction of a man named Anwar six and a half years ago.

Lakhvi's counsel submitted the application during the hearing today and contended that the kidnapping case registered against his client is false.

Arguing against the bail request, public prosecutor Nabeel Tabish said that investigation in this case is still underway. He added that until and unless investigation is complete, the First Information Report (FIR) against Lakhvi cannot be dismissed.

Judical Magistrate Naveed Khan subsequently rejected Lakhvi’s bail plea.

Following registration of the kidnapping case in December last year, Lakhvi was arrested by police and taken into protective custody at the Shalimar police station as there was no suitable place to accommodate him at the Golra police station.

Lakhvi is also facing trial for being the alleged mastermind in the 2008 Mumbai attacks. India has relentlessly sought him since the attacks killed over 160 persons, including several foreigners, causing international uproar and a diplomatic storm.

Mumbai attack mastermind Lakhvi challenges detention - Indian Express
Zakiur Rehman Lakhvi, the 2008 Mumbai attack mastermind, Monday challenged his detention under a public security act in the Islamabad High Court (IHC), saying the government has detained him on “illegal grounds”.

“We have challenged the detention of Mr Lakhvi in the IHC. The government has detained him on illegal grounds. After bail from the trial court, the government had no legal justification to detain Lakhvi under Public Maintenance Order,” Lakhvi’s counsel Raja Rizwan Abbasi told PTI.

He said IHC judge Noorul Haq Qureshi has fixed Tuesday for the hearing of Lakhvi’s plea.

The government transferred the 26/11 case from Anti-Terrorism Court (ATC) (I) to the recently-established ATC (II) here on January 14 without giving any reason.

On December 18, 2014, the trial court granted bail to 54-year-old Lakhvi but was detained the next day under the Maintenance of Public Order (MPO).

However, the IHC suspended Lakhvi’s detention on “weak legal ground”. Just before he was to be released from Adiala Jail, Rawalpindi, Lakhvi was arrested on charges of kidnapping an Afghan national in 2009.

Pakistan faced strong reaction from India following the bail order.

He has been kept in the high-security Adiala Jail, Rawalpindi till second week of the March under the same order after the Pakistan government extended his detention by 30 days.

Earlier in January, Lakhvi had challenged his detention in the High Court which suspended the detention order. However, the Supreme Court set aside the High Court’s order on the government’s plea.

Lakhvi and six others – Abdul Wajid, Mazhar Iqbal, Hamad Amin Sadiq, Shahid Jameel Riaz, Jamil Ahmed and Younis Anjum – have been charged with planning and executing the Mumbai attack in November, 2008 that left 166 people dead.

All of them are kept at the Adiala Jail.

Lakhvi enjoying luxury jail time: report - DT
One of Pakistan’s most notorious prisoners is living in relative luxury despite the government’s protestations that it is cracking down on militants, BBC News reported.

Zakiur Rehman Lakhvi is one of the main suspects behind the 2008 Mumbai attacks. Yet right next to the jailer’s office in Rawalpindi’s sprawling Adyala Jail, Lakhvi and six of his comrades have several rooms at their disposal. “They have the jailer’s permission to have a television, mobile phones and access to Internet, as well as dozens of visitors a day,” the report states. “He [Lakhvi] can receive any number of guests, any time of day or night, seven days a week,” says one jail official. No special permission is required, and his visitors are not even required to identify themselves to jail authorities.

Pakistan arrested Lakhvi on December 7, 2008, four days after he was named by Indian officials as one of the major suspects behind the November 2008 Mumbai attacks. He was reportedly arrested from a training camp of the militant group Lashkar-e-Tayyaba (LeT), which is said to have been fighting the security forces in Indian-occupied Kashmir. Exactly six years later, he hit the headlines again when an anti-terrorism court trying him for the Mumbai killings ordered his release on bail.

The ruling came barely a day after the horrendous 16 December school massacre in Peshawar, and at a time when the civil and military leadership were making a rare joint call for action against “all shades of terrorism”. Lakhvi’s bail seemed to call that resolve into question. Lakhvi, 55, was born in the Okara district of Punjab – which is also the native district of Ajmal Kasab, the only gunman in the Mumbai attacks who was taken alive by the Indian security forces.

In 1990, he joined Jamiat Ahl-e-Hadith (JAH), a Salafist movement funded by sources in the Middle East. Later he became a member of LeT, JAH’s armed militant offshoot. He is said to be a close relative of Hafiz Mohammad Saeed, LeT’s founder and current chief of Jamatud Dawa (JuD), an Islamic charity Saeed founded when the government banned LeT after the 2001 attack on Indian parliament. Throughout the 1990s, Lakhvi worked at the LeT’s head office near Muridke, Punjab, where JuD is also headquartered.

During this period, he was actively involved in fighting, and later planning combat missions, inside Indian-occupied Kashmir, according to security sources. He became the operations head of LeT in late 1990s. Lakhvi and six others were indicted for the Mumbai attacks in Pakistan on the basis of evidence provided by the Indian government. The evidence included a confession by Ajmal Kasab and some satellite phone data the Indians recovered from a boat that the attackers had hijacked en route from Karachi to Mumbai.

Indian officials at the time said Lakhvi had spoken to the attackers during their journey, and may have been in touch during the attacks. They said Kasab identified Lakhvi and said he helped “indoctrinate all the attackers”. But then two developments provided the grounds on which Lakhvi was granted bail. In 2012, the Indian officials denied a Pakistani judicial commission comprising Lakhvi’s defence lawyers, prosecutors and a court official from cross-examining Kasab in Mumbai.

Later, a prosecution witness - a primary school teacher who had taught Ajmal Kasab as a child - turned hostile and testified that Kasab was alive and in Pakistan, and that he had seen him. Lakhvi’s lawyers used the teacher’s evidence to try to get him freed, and argued that the charges were concocted as a result of international pressure. The court accepted the teacher’s account. Many believe Pakistan initially arrested Lakhvi only because Kasab’s evidence was so damning. But once the storm had blown over, analysts say, the Pakistani authorities reverted to their original policy of treating LeT as an ally. Either way, Lakhvi’s bail provoked a strong reaction from India, where Home Minister Rajnath Singh urged Pakistan to take steps to reverse the decision.

Hand over Lakhvi to India or international court: US to Pakistan - PTI, Economic Times
Criticising Pakistan for failure to contain extremist groups, an influential US Senator today asked it to either hand over Mumbai attack mastermind Zaki-ur-Rehman Lakhvi to India or present him to the International Criminal Court in the Hague for crimes against humanity.

Chairman of the powerful US House Foreign Relations Committee Ed Royce also said "certain families in Gulf states" are funding 600 Deobandi schools in Pakistan which was a major cause of concern.

Identifying terrorism as a major threat facing the region, Royce slammed ISI, saying there was a need to strengthen the civilian government while trying to dissuade the Pakistani spy agency from types of conduct it had been engaged in.

Without naming Lakhvi, Royce, who is leading a bipartisan congressional delegation, said Pakistan must bring to justice Lashkar-e-Taiba terrorists involved in the 26/11 Mumbai attack case and wondered how Lakhvi is taking visitors instead of facing action.

"The same individual (Lakhvi) today is taking visitors and is not being brought to court of justice. What I called for is for Pakistan to turn that individual over to India or if Pakistan won't do that which thay should do, then turn him to International Criminal Court in the Hague where he will be tried for crimes against humanity," he told reporters here.

Royce met Prime Minister Narendra Modi and Home Minister Rajnath Singh yesterday and discussed various issues, including threat of terrorism in the region.

26/11 Mumbai attack mastermind Lakhvi's release ordered by Pak court, India protests
A Pakistani court on Friday declared as “illegal” the detention of Lashkar-e-Taiba commander Zakiur Rehman Lakhvi, the mastermind of the 2008 Mumbai attacks, and ordered his release.

Justice Noor-ul-Haq Qureshi of the Islamabad High Court described as “null and void” the notifications that were issued by Islamabad’s district administration for Lakhvi’s detention.

Immediately after the order, India reacted saying it is the responsibility of the Pakistan government to take all legal measures to ensure that Lakhvi does not come out of jail

"The overwhelming evidence against 2008 Mumbai attack mastermind Zakiur Rehman Lakhvi has not been presented properly before court by Pakistani agencies. Pakistan should realise there are no good terrorists or bad terrorists," the home ministry said in a statement

This is the second time that the same judge of the Islamabad High Court has ordered Lakhvi’s release. An earlier order of the High Court was overturned by the Supreme Court in January, which said the high court’s decision was rushed.

On December 18 last year, the anti-terrorism court conducting the Mumbai attacks trial granted bail to Lakhvi but authorities subsequently detained him under the Maintenance of Public Order (MPO) law after the development sparked angry reactions from India and the US.

However, judge Noor-ul-Haq Qureshi had suspended Lakhvi's detention under the MPO. Just before he was to be released from jail, Lakhvi was arrested on the charge of kidnapping an Afghan national several years ago.

Lakhvi, currently being held at Rawalpindi’s Adiala Jail, and six other men have been charged with planning, financing and executing the assault on India’s financial hub in November 2008 that killed 166 and injured hundreds

Zakiur Rehman Lakhvi's detention illegal: Islamabad high court
ISLAMABAD/NEW DELHI: The Islamabad high court on Friday termed Mumbai attacks mastermind Zakiur Rehman Lakhvi's detention illegal.

High court judge Noorul Haq ordered the immediate release of Zakiur Rehman Lakhvi.

The Pakistani government had on March 5 filed details of charges Lakhvi, 54, is facing in the Mumbai attack case, his alleged involvement in the abduction of an Afghan national, and the judgment of the Supreme Court in his detention case.

Lakhvi's counsel Raja Rizwan Abbasi had said in court that the government was planning to register another case against his client like it did when he was granted bail in the Mumbai attack case.

He argued that the government had earlier filed a false case of abduction of an Afghan national, Anwer Khan, against Lakhvi but it could not prove anything against him in court.

Lakhvi last month had challenged his 'fresh' detention under the Maintenance of Public Order (MPO) act.

In December, 2014, the anti-terrorism trial court here granted bail to Lakhvi but he was detained the next day under the MPO. However, the Islamabad high court suspended Lakhvi's detention on "weak legal ground".

Pakistan had faced an angry reaction from India following Lakhvi's bail.

Just before he was to be released from Adiala Jail in Rawalpindi, Lakhvi was again arrested on charges of kidnapping Khan in 2009.




The Supreme Court also set aside the high court's order on the government's plea. Subsequently, the government extended his detention for another 30 days till the second week of April.

Meanwhile, GoP arrests Lakhvi on an old 'abduction' case
The IHC grants him bail in that case too.
The defence counsel tells the court that GoP is filing frivolous cases against Lakhvi.
IHC accepts that argument and tells GoP that it couldn't file any new case against Lakhvi without IHC's consent.

'Credible information' on LeT commander Zaki ur Rehman Lakhvi shared with Pakistan: US - PTI, ET
The US has said it shared "credible evidence" with Pakistan on LeT operations commander Zaki ur Rehman Lakhvi's involvement in the 2008 Mumbai terror attack, days after it reminded the country its commitment to bring the perpetrators of the horrific attack to justice.

"The US has provided credible evidence (on Lakhvi) to Pakistan," a senior US official told PTI.

The official refused to give any further details and said this was an ongoing legal matter.

But, the information provided by the US to Pakistan on Lakhvi and others related to the Mumbai terrorist attack is credible, the official said.

The detailed information shared by US on individuals related to the Mumbai terrorist attack is based on the interrogation of David Headley, who is currently serving jail sentence for his involvement in the attack, and the information gained from him.

Various security agencies and intelligence wings of the US have done their own investigation with regard to the Mumbai terrorist attack.


Earlier, the US had said there was a strong counter- terrorism cooperation with Pakistan and it hoped that Pakistan would follow through its commitment on bringing to justice the perpetrators of the attacks.

"The government of Pakistan has pledged its cooperation in bringing the perpetrators - financiers, and sponsors of the Mumbai terrorist attacks to justice and we urge Pakistan to follow through on that commitment," State Department Spokesperson Jen Psaki had said, adding that Pakistan is a critical partner in fight against terrorism.

Pak court reserves judgment on Lakhvi's plea - PTI, ToI
A Pakistani court on Friday reserved its judgement on the plea of LeT operations commander and 2008 Mumbai attack mastermind Zaki-ur-Rehman Lakhvi against his detention under a security act.

"Lahore high court judge Mahmood Maqbool Bajwa heard the arguments of Lakhvi's counsel advocate Raja Rizwan Abbasi and a law officer and reserved its decision," a court official said after the hearing.

He said the verdict is likely to be announced anytime. Lakhvi yesterday challenged his detention in the LHC and prayed to it to set aside the Punjab home department's order for being "illegal and a violation of Islamabad high court order".


The Punjab government on March 14 detained Lakhvi for another 30 days under the maintenance of public order before his release from Adiala Jail Rawalpindi on the IHC order.

IHC Judge Noorul Haq Qureshi on March 13 suspended the federal government's order to detain 55-year-old Lakhvi and ordered his immediate release.

"Since the government could not produce any solid evidence against the detention of Lakhvi under Maintenance of Public Order, there has been no legal ground to detain him any more under that law. Lakhvi should be released immediately if he is not required in any other criminal case," the IHC court order had said.

India had strongly reacted to the IHC's ruling, saying the overwhelming evidence against Lakhvi has not been presented properly before court by Pakistani agencies.

On December 18, 2014, the trial court (Anti-Terrorism Cout-I, Islamabad) granted bail to Lakhvi but he was detained next day under the MPO. However, the IHC suspended Lakhvi's detention on "weak legal ground".

Just before he was to be released from Adiala Jail, Rawalpindi, Lakhvi was arrested on charges of kidnapping an Afghan national in 2009.

Later, the government challenged the HC's order in the Supreme Court which suspended the government's order to end his detention. The SC suspended the HC's order.

Today the HC again suspended the government's order which was issued on February 13 to detain Lakhvi.

A Pakistani court on Thursday set free Zaki-ur-Rehman Lakhvi, the 2008 Mumbai attacks mastermind and LeT operations commander, suspending the Punjab government’s detention order against him under a public security act, drawing India’s ire.

Justice Muhammad Anwarul Haq of Lahore High Court suspended the detention of Lakhvi (55) under Maintenance of Public Order after the government failed to present sensitive records against him in the court.


The judge ordered Lakhvi to submit two surety bonds worth Rs.1 million each for his release.

“The law officer had submitted important information about Lakhvi, but the court did not accept this and declared the evidence unsatisfactory,” an official of LHC told PTI {But, the previous pargaraph claims that the government did not present the sensitive evidence to the judge. Which one is correct?}.

Justice Muhammad Anwarul Haq on the last hearing on April 7 had directed the government’s counsel to submit record of secret documents about activities of Lakhvi on Thursday. Lakhvi had challenged the March 14 order of Punjab government’s District Coordination Officer, Okara to detain him for 30 days.

Lakhvi’s counsel Raja Rizwan Abbasi argued that after the LHC’s earlier direction he had filed a representation before the Punjab home secretary against his “illegal” detention but the home secretary dismissed it and upheld the 30-day detention order issued by District Coordination Officer, Okara.

Mr. Abbasi pleaded that a person could not be detained beyond 90 days without obtaining an order from review board and the detention period of his client had gone beyond 90 days. A provincial review board comprises judges of the High Court. He pointed out that though the trial court had released Lakhvi on bail in December 2014, District Magistrate of Islamabad issued detention order against him.

Later, the Islamabad High Court set aside Lakhvi’s detention and ordered the government to release him.

However, another detention order was issued by the DCO, Okara and he was not released, the counsel argued.

He had pleaded the court to strike down the impugned order and order the government to release Lakhvi.

Responding to Lahore High Court order on Zakir-ur-Rehman Lakhvi’s detention, India said it reiterates its concerns on the issue which have been made known to the Government of Pakistan in the past.

“The fact is that known terrorists not being effectively prosecuted constitutes a real security threat for India and the world. This also erodes the value of assurances repeatedly conveyed to us with regard to cross border terrorism,” said Syed Akbaruddin, External Affairs Ministry spokesperson.

26/11: Pak. High Court sets deadline - PTI, The Hindu
The Islamabad High Court on Monday set a two-month deadline for the trial court to conclude the 2008 Mumbai attack case, warning that it would accede to Pakistan government’s plea to cancel the bail granted to LeT operations commander Zaki-ur-Rehman if it failed to do so.

A two-member Bench of the IHC headed by Justice Noorul Haq Qureshi gave the “two-month deadline” to the Islamabad Anti-Terrorism Court to conclude the case against Mumbai attack mastermind Lakhvi and six others going on since 2009.

The Bench was hearing the government’s plea for cancellation of 55-year-old Lakhvi’s bail.

After the arguments from the prosecution and defence lawyers, the Bench said: “This court gives two months to the trial court to conclude the Mumbai case and adjourns this case [a plea to cancellation of bail to Lakhvi] till then.”

Prosecution chief Chaudhry Azhar told PTI after the hearing here that the judge also said in his order that the court would cancel Lakhvi’s bail if there was a delay on the part of his lawyers.

The Snowden documents show that, months before Mumbai, British intelligence began spying on the online communications of Zarrar Shah, a key plotter who was the technology chief for the Pakistani terror group Lashkar-e-Taiba.

Britain’s General Communications Headquarters, or GCHQ, had the ability to monitor many of Shah’s digital activities, including Web searches and emails, during weeks in which he did research on targets, handled reconnaissance data, and set up an internet phone system for the attack.

But based on documents and interviews, it appears that the British spy agency did not use its access to closely analyze data from Shah until a Lashkar attack squad invaded Mumbai on Nov. 26, 2008. Nor did the British tell the Americans they were watching Shah beforehand, despite the close alliance between GCHQ and the N.S.A.

The British data could have complemented separate chatter that the N.S.A. and C.I.A. were collecting about a potential attack on Mumbai, none of it related to Headley.

Senior U.S. intelligence officials gave us their first account of their warnings to India about a Lashkar threat to sites in Mumbai frequented by Westerners, including the Taj Mahal Palace Hotel, the eventual ground zero.

Meanwhile, Indian intelligence had separately tracked Shah’s communications before the attack, another layer of a complex international scenario.

Once the shooting started, the spy agencies went into high gear. The British realized that prior targeting of Shah gave them real-time access to the Karachi control room from which Lashkar chiefs directed the three-day siege using phones and computers.

GCHQ and N.S.A. pulled a haul of intelligence from the monitoring of Shah and others that enabled analysts to assemble a “complete operations plan” of the plot, according to an N.S.A. document. The evidence helped the Western and Indian governments push Pakistan to crack down on Lashkar.

U.S. officials emphasized that they had warned the Indians. British officials disputed the idea that they had information that could have prevented an attack; they said they would have shared such intelligence with India.

The Indian government did not respond to requests for official comment, though an official in the Intelligence Bureau, India’s counterterror service, told me his agency was not involved in monitoring Shah.

As with past failures to prevent terrorist attacks, more aggressive analysis and better intelligence-sharing could have made a difference. But high-tech spying has its limits.

The Propublica expose is a bokwas report on NPR last night. Basically it puts the onus on British and US go scot free.

And what TSP crackdown on LET?


And who did the British and Americans really pass on the info to?
Its a sad joke on the victims of the 26/11 attack to release the video just when TSP has let Lakhvi go free.

Was DCH on DEA pay rolls while he was doing all this LET business?

Lakhvi’s release: India seeks U.N. help - PTI, The Hindu
India has sought U.N.’s intervention in the release of Mumbai terror attack mastermind and LeT commander Zaki-ur Rehman Lakhvi, saying it was in violation of the norms of the global body and it should raise the matter with Pakistan.

In a letter to the current Chair of the UN Sanctions Committee Jim McLay, India’s Permanent Representative to the UN Asoke Mukherjee said Lakhvi’s release by a Pakistani court was in violation of the 1267 UN resolution dealing with designated entities and individuals. — PTI

everyone well remembers the last time that India hauled the pakis to the UN and we are still paying for that blunder. Hopefully now, better brains have been at play during this reference to the UN. This whole enterprise seems to be ill advised.

Man, this is pathetic, begging UN for deliverance? TSP and US will welcome this with open arms to discuss all "issues" including Lakhvi. You get the drift. If there is nothing much India can do to force TSP on this issues, better to STFU than have more humiliation poured on India by this UN piece of crap.

Lakhvi’s case in UN - Editorial in DT
India has taken up the release of Lashkar-e-Taiba (LeT) commander Zakiur Rehman Lakhvi with the al Qaeda Sanctions Committee of the United Nations Security Council. The latter has assured India of taking up the issue at its upcoming meeting. India has expressed its concern that Lakhvi’s release was in violation of UN resolution 1267 dealing with designated entities and individuals associated with terror groups, including al Qaeda and LeT. Lakhvi is among the seven persons charged with planning and executing the Mumbai attacks in November 2008 that left 166 people dead. The trial of Lakhvi has been underway since 2009. The Islamabad High Court freed him on April 9, a move which India said eroded the value of assurances repeatedly conveyed to it by Pakistan on cross-border terrorism. The development could spell serious repercussions for Pakistan. The release of Lakhvi had also raised concerns in the US, UK, Russia, France and Germany, with Washington calling for him to be rearrested.

Despite reaching a consensus on indiscriminate action against all militant groups and their members, the government procrastinated and delayed the trial of this particular case, apparently at the behest of some hidden hand. Both the Indian and Pakistani governments remained engaged in a series of allegations and counter-allegations over the release of Lakhvi. Our foreign office blamed India for Lakhvi’s release on the grounds that Pakistan was not given access to main accused Ajmal Kasab and not provided with substantial evidence. However, this does not absolve the government of its responsibility for bringing the Mumbai attacks culprits to justice. The government’s plea that Lakhvi was released under the court's orders and it cannot intervene in the judicial process lacks persuasiveness. The question arises why the government has not prepared a proper prosecution as per the demands of justice. Instead, Islamabad demanded of New Delhi to first punish the perpetrators of the Samjhauta Express tragedy, as though this resort to the usual Pakistan-India tit-for-tat exchange would get it off the hook. Pakistan believes that by protecting figures like Lakhvi, it is safeguarding its strategic interests, which is a false assumption.

The government needs to adopt a sensible approach in this case. It can no more afford backing those persons who are counted among terrorists by many states of the world. It should abstain from protecting such figures and giving them the status of strategic assets. An even larger question is: if the UN takes up the issue and imposes sanctions, what will be its effects on Pakistan’s diplomatic relations with other countries? The government needs to review its policies regarding its treatment of those who are accused of committing terrorist activities in the country and abroad. In case Lakhvi’s luxurious jail confinement and subsequent release are the outcomes of the blessings of some high powered entity, the government should reconsider its obedience and revisit such polices in the national interest.*

Rest in peace, Parag Sawant. Has any non-Indian news agency reported this story? They report all kinds of silly things from India, this is very serious. The July/2006 terrorist attack on the Mumbai trains, was as bad, perhaps worse, than the Madrid train bombing two years earlier.

Has anyone been charged or convicted, what is the status of the investigation etc.

My heart goes out to the departed Parag Sawant. May he rest at the feet of the Lord. May the Lord give strength to his wife, daughter and parents to bear the loss. A couple of years back when I read that he was making some progress, I was hopeful he would pull through. But, alas, it was not to be. Very sad. We should never forget and never forgive those who caused so much pain. They shall be caught and eliminated.
