Tejpal seeks recusal of judge, alleges trial was under pressure from State govt.




Following a formal application from the accused, Additional Sessions Judge Pramod Kamat on Thursday recused himself from the case involving Tehelka co-founder Tarun Tejpal where a woman journalist had alleged sexual abuse. The case was transferred to Principal District Sessions Judge P. B. Deshpande.

Mr. Tejpal’s application seeking recusal, inter alia, alleged that the history of the present trial and the investigation had been rife with pressure imposed by the State Government. The matter pertaining to application moved by the accused, seeking the Court’s directions on copies of documents forming part of chargesheets, has now been posted for hearing to October 1 before Judge Deshpande.

On September 16, Judge Kamat had suo motu disclosed in the court that prior to his joining the Office as the Presiding Judge of the District Sessions Court, Panaji, he was on deputation as Law Secretary for the State Government. He said that in that capacity he was instrumental in the appointment of Special Public Prosecutors/lawyers for prosecution in the instant matter.

Earlier on Thursday, responding to the judge's offer of recusal, Mr. Tejpal's lawyer moved a formal application before the judge praying that he recuse himself from continuation as the Presiding Officer in the matter forthwith and sought an appropriate direction.

Mr. Tejpal’s application alleged that the history of the present trial and investigation has been rife with pressure imposed by the State Government from its very inception by an FIR filed not by the prosecutrix but at the instance of the Goa police. So the applicant/accused has reasonable belief that the State Government by misusing the process of law has falsely been implicated in this false case.

Therefore, it further said that the continuation of the Presiding officer of this case in this matter will cause grave prejudice to the applicant as former was part of the executive of the Government at the relevant time.

“The previous position held by the Judge, making him formerly part of the State machinery is similarly a cause for reasonable apprehension on the part of the accused as it once again threatens the imposition of State pressure on the trial,” it reiterated and insisted that recusal of the Presiding Officer in the matter becomes imperative for the quest of fair trail.

'The application appreciated that in this instance the Judge himself, recognizing that the right of the accused to a fair trial is of paramount concern and acknowledging that the position formerly held by him has posed a cause for reasonable apprehension in the mind of the accused, had offered to recuse himself should either party request the same.

People, note how no one in the media is now reporting about the churn that must be underway in the Congress party. Where is "madam"? What kind of inner jihad is Rahulg up to? What about Priyanka? Does she not want any political role? Really? What about Robert Zardari? Where are Kapil Sibal? Renuka whatever, Jayanti Natrajan? All those shrill shrews and grating bag holders...what's happen in the second biggest political party in the country? Media not interested or are they just soft pedalling to permit them the time to recover, something they would not allow the BJP

At the sight of the boy, the angry priest bashed the little boy’s head repeatedly against a pillar in the temple, causing him to bleed. The priest suspected that the boy was a thief.

Bhaskar Prasad, a Dalit Sangharsh Samiti (DSS) leader however says that the boy was targeted because his parents were cobblers by profession and belonged to the scheduled caste. “Why would an 8-year-old boy go to a temple on a Sunday morning if it was not for prasadam.

He was a poor boy and hungry,” Bhaskar told Deccan Chronicle. Not surprisingly, police at Nelamangala town police station on Monday morning refused to register a complaint. Santosh’s father Sakabettaiah’s thumb impression was taken on a blank piece of paper! Police denied they had even entertained such a complaint.

Now goes without saying that act is deplorable even if the boy was a thief. But what is astounding is the reporting.

1. It has been made out into a Caste conflict. There is no iota of proof that it is one. But this insinuation is enough fodder for multiple excluvist hate based cults to copy paste onto various fora and media and malign Dharma. This is a typical reinforcement of the islamic and Xtian viewpoint on Brahminism.

2. It is deplorable that hitting children is common in India and i acknowledge a Priest who cannot control his anger shouldn't be at the helm of a Dharmic institution. Yet from the reporters point of view there was no investigation whether there was a nuisance issue of petty theft involved. A Dalit Sangarsh Samiti that looks like a political kind of groupings word seems to be of more sanctity than any basic enquiry.

Hundreds of such articles that really have no bearing to casteism have such headers. Thousands of busy people who just read headlines imagine enough research is done to justify the headlines. The reinforcement of the Islamist and Xtian propaganda on Brahminism is reinforced and weakens Dharmic forces no end.

This kind of article i classify as a Hit and Run attack on Dharma.

Majority of Hindus and even a section of the Muslim community have started believing that indeed Madrasas, known for their great contribution to Indian society in pre and post-independent India, have become safe haven for terrorists. But then, little did the unsuspecting citizens realize that this methodical dissemination of selected information about alleged terror links with Islamic educational institutions is part of a larger game plan of India’s strategic intelligence community, seeking a meaningful role in what is known to the general public as Operation Hornet’s Nest — a joint Israel-West classified strategic intelligence mission whose primary aim is to tinker with the political landscape in the Middle East as per exigencies of the prevailing circumstances. Besides, this systematic effort to push the Muslim community to the wall perfectly fits into BJP’s ultimate political objective of making the minorities electorally irrelevant.
How can one forget BJP’s prominent parliamentarian Sakshi Maharaj’s ridiculous allegation that Madrasas in the country produces anti-India militants? If we minutely scrutinize India’s post-terror attack response force, NSG, chief J.N. Choudhury’s assertion of global militant outfits receiving active assistance from like-minded domestic groups and individuals for launching devastating terror attacks, the secret design to defame the minority community gets exposed further. How else can such a senior functionary, who does not even receive any classified intelligence input officially, come out with such revealing conclusion? Are we to presume that he was tipped-off by some source privately?
Above all, will Choudhury or the Indian government have the guts to explain why such alleged unlawful activities always takes place under the very nose of India’s myriad intelligence agencies?
What intrigues many is the sudden spurt in deceptive anti-Muslim propaganda activities in the country in recent days. Is there a link between what is going on presently and National Security Adviser (NSA) Ajit Doval’s quiet meeting with US security officials? What was the urgency that made Doval stay back even as Prime Minister Modi returned from his official trip to the United Nations? Knowledgeable sources believe that it was all about negotiating New Delhi’s possible engagement in secret strategic operations that are planned and executed outside public glare. That the cacophony over possible IS-Al Qaeda threat to India is more propaganda than real can be proved by three simple facts. Firstly, Al-Qaeda’s new Indian franchisee Qaedat Al-Jihad, led by Asim Umar, is actually a toothless organization comprising of incompetent foot soldiers, incapable of causing harm to India’s core strategic interests. Their very first mission in Karachi had ended in dismal failure. Secondly, there is something fishy about the highly publicized story of three masked men waving IS flag in Indian-administered Kashmir after Friday prayers. A province, whose people are yet to recover fully from the flood havoc, surely has no time to encourage such activities. Thirdly, the Syrian government has explicitly denied the report of any stray groups of Indian youths fighting for the IS either on their soil or Iraq contrary to Indian intelligence claim.
The big question is why would a shrewd Modi want to create an aura of mistrust inside the country when he is apparently so desperate to improve India’s global standing? Surely, Modi knows that a volatile domestic environment can derail his ambition of making India a global manufacturing hub. A nation at war within cannot expect the international business lobby to invest lavishly. And yet Modi is strolling down that suicidal path of involving India into hegemonic power play and introducing minority-apartheism. Experts believe the calibrated propaganda to control peoples’ mind is just a small part of a larger plan to create provocative agents that provide Indian State the justification to heckle Muslims. And Modi and his NSA Doval, it seems, has a grand plan to make India the principal pawn in the strategic armory of those who have exploited the unfortunate divide in the Muslim world effectively. In a foolish attempt to reframe India’s strategic goal, the top political leadership has in fact exacerbated the xenophobic trait existing within the nation’s multi-cultural societal structure. Seema Sengupta’s article suggests couple of things.
1. Article looks ghost written, the journo is only frontnaming it.
2. A person/set of persons is/are afraid of Doval
3. The writer believes that Doval has the capacity and will plant deep assets; and will share them with the westerners.
3.a I think the article writer has analyzed Doval’s feb speech and seems to have concluded that Doval may be recruiting and abetting nationalist muslims to penetrate or weaken Wahabbis in India. Therefore she is demanding a thorough background check before giving new accesses (last para).

In 2002, in around the months surrounding Parakram standoff, a cretin of an editor along with Suzy Roy had made a trip to Packistan. In one of the conferences, that editor had said something on the following line to the packies :- “you take them from the outside, we will handle them from the inside”.

Does anybody have newsreport/snippet or related literature that gives source about that quote.

Hard to find it sir. But AD may be the most dangerous person for siculars now. He threaten peaceful in Bdesh, Pakiland and also in India. Almost 30% of world peaceful population. It appears that a lot of behavior we see from Indian p-secs is straight out of the book of cultural Marxism. The following documentary is a good summary of how cultural marxism came to be. It discusses the use of Freud to psychoanalyze society as fundamentally ill (something the Donigers have applied religiously to Hindoos) in order to bring about revolution from the top.

MurthyB ji, these two videos are very insightful. They are about Marxism and West. I agree with you in many ways we are encountering the same phenomenon here. The videos talk of a period of ~1914 to ~1990 in Europe and in the second part mostly the US. I would advise those who want to understand our 'Journalists' to watch this video. Also draw comparisons to the Marxist institutions like Frankfurt School - JNU or IIMC co-located with JNU. While we generally understand this, the actual relationship between what is happening and the ideology which drives it is established here.

Briefly, as I watched, these are a few points I noted:

Political correctness is an idea of the Marxists to actually promote Cultural Marxism. That they could not get the working class to revolt and hence decided to attack the culture that stops the working class from revolting. This was done through the idea of Political Correctness.

The theory is to criticize. Destructive Criticism of every institution of Western civilization to promote cultural Marxism (at around 10:10 in the first part was an important take away). We have seen this with almost all actions of Modi Govt and institutions of India as well as Hinduism coming under major attack in the press.

In part 2 the link between the Frankfurt School (the German institute) and Columbia University and California University becomes clear.

The ideologues constantly tried to identify Victim groups. Students, blacks, women etc. They also used ideas like Sexual liberation, Gay Rights, etc to further attack strong points of the Western Civilisation.

Total intolerance to any ideology other than Political Correctness is a hall mark of this approach of the Marxists.

ALERT!! Pakistan Times Tries to Get Kohli Banned

This is a set-up. At minimum, the Hindustan Times should have waited until after the World Cup - or if their 'journalists' can't stand the heat, they need get the **** out of the dressing rooms.

We need an online campaign to make the Pakistan Times pay for this.

However, the Hindustan Times, whose reporter was abused by Kohli, has filed complaints with the ICC and the BCCI.

Once he was done with his training and was returning to the dressing room, India's premier batsman saw a scribe of a national daily in front of him.

To the horror of that journalist, Kohli started using filthiest of language and it went on for some time before he stormed off and some of the Indian team members looked amazed as to what exactly had happened.

The particular journalist also seemed clueless but once Kohli cooled down, he told someone about an article that had appeared about him and his girlfriend Anushka Sharma in a national daily and he thought that it was that particular journalist, who had written the story.

When he was told that he had mistaken this particular reporter as someone else, Kohli called one of the journalists and through him apologised for the incident.
Read the whole thing and think about it for a microsecond. A SPORTS JOURNALIST couldn't handle a few choice words thrown at him by mistake? FIRE the oiseule, and any of his bosses who didn't fire him when he first :(( :(( .

Seriously, folks, look up "Jasvinder Siddu" the famed Hundistan Crimes 'Journalist' whose H&D was so violated by Kohli.

I am not able to find a single article written by this guy. There is something much worse going on here - the HT has hastened to withdraw its "complaint to the ICC" etc.

Needs a serious Anmol-type investigation and some public questions about HT.

So Kohli didn't know who Jasvinder Sidhu was, even though he was interviewed by him for this pointless article, and suspected that he wrote something about the actress (which he didn't).

TBH, I don't believe this as both have bright future ahead of them & I dont trust Indian Media.

Anmolji, all that actress stuff is cover. The guy is 399% bookiestani-inspired onlee. Look carefully at his sequence of articles, and try reading them: they are ALL fluff - he doesn't know diddly about krikit AND his writing is cr*p. Tell me the HT could not find a Mumbaikar who knows about krikit to send on an all-expenses-paid junket to cover the World Cup in AUS/NZ for 3 months with a Press card to get access to India practices and parties? And one who can write better than this Shakespeare Sid-hu?

Goes back to 2012. He covers bookie court cases. Pakistani bookie-banned ones, Azharuddin case (he just copied IANS and PTI feed there), BCCI fixing cases, IPL fixing cases, then out to AUS to attend meetings on match-fixing, ... but if you read those 300-word middle-school 'articles', you will see that he NEVER reports an interview with a bookie. Hmmmm!! Strange or what?

Based on the above record, UBCN has to wonder whether the 'interview' with Kohli about Combating Fatigue included wondering whether his endurance/ alertness were being affected by his social life. THAT would explain his presumption that Kohli would be rather excited to see him again. The article that HT actually posted may have (wisely) deleted that part.
