ISLAMABAD (Staff Report) – Bangladesh war crimes trials violate various provisions of international human rights treaties, according to a Pakistan’s leading legal think-tank.
n a legal workshop organised at Serena hotel by the Research Society of International Law (RSIL), president Ahmer Bilal Soofi gave a slide presentation introducing the audience to the legislation enacted in Bangladesh over a period of time, under which the present trials are being conducted.
These included the Collaborators (Special Tribunals) Order 1972, International Crimes (Tribunal) Act, 1973 (as amended in 2009) and various provisions of the Bangladesh Constitution.
Mr Soofi highlighted that the Tripartite Agreement 1974 was an agreement of non-prosecution and that pursuant to same, all prisoners of war were repatriated to Pakistan, including the 195 suspects. “Therefore, in the spirit of reconciliation embodied in the Tripartite Agreement, Bangladesh, as a state, gave up its right to try war crimes in 1971. As a follow-up, Bangladesh also repealed the 1972 Collaborators Order,” said Mr Soofi.
...he said tribunals were granted a separate procedural charter in which there were glaring flaws, from a human rights perspective,” he added.
He further pointed out that the Bangladesh law created space for introducing hearsay evidence, something unheard of in criminal trials anywhere in the world.
“The trial procedure and practice is in direct violation of Articles 9, 6 and 14 of the International Covenant on Civil and Political Rights (ICCPR), a convention to which Bangladesh is also a State Party. Therefore, there is an obligation on Bangladesh to comply with the same,” he highlighted.
The workshop was attended by a large number of academics, diplomats, law students and eminent members of civil society. Ashtar Ausaf Ali, Special Assistant to Prime Minister, was the special guest at the occasion.
During the discussion, Dr Shireen Mazari raised the concern as to why this issue has not been raised by the Foreign Ministry so far. She further stated that, given the inherent strength of the issue, it must be brought to the notice of international community by Pakistan(Does the Paki society "feel confident" of bringing this "ugly matter " to the attention of the world ).
Abdullah Gul stated that people in Bangladesh and in Pakistan are both followers of Quaid-e-Azam due to which they should find a way to improve their relations.
So what Pakis are saying is the 1974 agreement for repatriating POWs nullifies the war crimes prosecution.
The tripartite agreement was to repatriate the POWs not the stop prosecuting war crimes.
Bangaldesh could not have given up the right in 1971 as the state was formed only in Dec 1971.
So right there are lies.
Hearsay has to be used as lot of time has passed by since 1971 when the war crimes were committed.
Hearsay is secondary evidence.
So instead of hanging they will get life imprisonment.
besides Pakistan should be ashamed of the war crimes its soldiers committed on their own citizens.
Bangladesh was East Pakistan in those days.
All the suffering they are seeing is a result of harboring war criminals and murderers amongst themselves.
State minister says Bangladeshis can face trial for their involvement in ‘war crimes’ during separation
DHAKA – Bangladesh’s State Minister for Foreign Affairs Shahriar Alam on Sunday urged the government of Pakistan to not ‘interfere’ in the ‘internal affairs’ of the South Asian nation, The Daily Star newspaper reported.
He made the statement after Pakistan expressed concern over the dismissal of Jamaat-e-Islami chief Moti ur Rahman Nizami’s review plea against the death sentence in ‘war crimes.’ He also requested Pakistan to “stop misinterpreting” the tripartite agreement signed by Bangladesh, India and Pakistan in 1974.
“We are disappointed with Pakistan’s reaction. We never welcome anyone interfering in our internal issues,” Alam said.“Despite repeated reminders, they are still doing it. They keep saying they are saddened by the verdict. But those being tried are Bangladeshi citizens after all,” he said.
The state minister pointed out that the 1974 tripartite agreement stated that the 195 Pakistanis who were repatriated to Pakistan would be given immunity but it did not mention anywhere that Bangladesh nationals involved in ‘war crimes’ would not be tried.
“I find this a serious issue, as these ‘war criminals’ are trying to assure their future generation with the notion that Pakistan as a state will be by their sides. Otherwise, why is Pakistan so saddened by Nizami’s death penalty,” he questioned.
A statement released by Ministry of Foreign Affairs in Islamabad called Nizami’s trial controversial. “We are concerned over Supreme Court of Bangladesh’s verdict that rejected Jamaat-e-Islami leader’s petition to review his death penalty,” it said.
The statement also read that they were following the reactions of world communities and human rights organisations over the ‘war crimes’ trial. On May 5, the Supreme Court dismissed Nizami’s petition to review his death penalty handed down to him for Jamaat’s opposition to the separation movement in 1971.
