The crisis in India today is one of capacities, and this cannot be addressed by the reinvention of institutional forms. It doesn’t matter if our responses are centralised or decentralised, as long as the executive agencies remain infirm, under-manned, under-trained and under-equipped.

...Our principal problems lie, not in architecture, but in manpower, materials and execution. We have eviscerated our institutions over decades, and now believe that the solution lies in creating layer upon layer of meta-institutions to ‘monitor’, ‘coordinate’ and ‘oversee’ this largely dysfunctional apparatus.
Counter-terrorism: The Architecture of Failure, November 24, 2011

The National Counter-terrorism Centre (NCTC) is an ill-conceived, redundant and derivative, vanity project, which aspires to imitate its namesake in the US, without the strength, the sinews, the resources or the constitutional context that would make such aspirations attainable. And if the idea itself was bad, its execution has been infinitely worse, tainted by deception and sleight of hand, as the Union Ministry of Home Affairs’ (UMHA) seeks to arrogate powers specifically excluded from its jurisdiction by the Constitution.

UMHA’s National Counter Terrorism Centre (Organisation, Functions, Powers and Duties) Order, 2012, has, unsurprisingly, run into trouble, with no less than 14 State Chief Ministers opposing the Centre’s move to create the NCTC, effective March 1, 2012. The Chief Ministers have rightly objected to the absence of any consultative process, as well as to specific clauses of the Order, principally including the power of arrest and seizure conferred upon the proposed NCTC’s Operations Division, purportedly under Section 43A of the Unlawful Activities (Prevention) Act (UAPA), 1967.

In his letter of February 24, 2012, in response to the objections voiced by some of the Chief Ministers, Union Home Minister (UHM) P. Chidambaram has artfully argued that the powers conferred on the NCTC derive from the UAPA Amendments of December 2008, and that, when these were brought to Parliament, “There was no demur or opposition to either section 43A or the other amendments”. UMHA officials have argued, further, that when similar powers of arrest and seizure were given to the National Investigation Agency (NIA), through its empowering Act of December 30, 2008, there were no objections regarding any perceived infringement of the Constitutional distribution of powers between the Union and the States. In other words, the States were now presented with a fait accompli and were being told, facetiously, that, having failed to object to the Centre’s jurisdictional enlargement in the past, they had lost their right to do so in the present and the future.

This, however, is evidently not the position UHM Chidambaram projects to his closer confidants. Indeed, if evidence of bad faith on the part of the Centre was required, it is provided by the Wikileaks disclosures regarding Chidambaram’s alleged conversation with FBI Director Robert Mueller at a meeting in New Delhi on March 3, 2009. According to the record cabled by US Chargé d’Affaires Steven White, “[Mr. Chidambaram] conceded that he was coming ‘perilously close to crossing constitutional limits’ in empowering the NIA. He explained the concept of a ‘federal' crime does not exist in India, with law and order the responsibility of the State Governments.” Further, Chidambaram “opined that the NIA law would be challenged in court because it ascribes certain investigative powers to the NIA which may be seen to conflict with responsibility that is exclusively with the States.”

It was his maiden visit to a mortuary, and that too to identify the body of a man, who held him at gunpoint barely a month ago.

D. Anandan, teller of the Bank of Baroda's Perungudi branch where the robbers struck first on January 23 and robbed over Rs. 19 lakh, was among 17 bank officials who identified the bodies of the five suspects gunned down in a police encounter in the early hours on Thursday.

Terming the robbery and the identification as the most ‘unforgettable moments' of his life, Mr. Anandan said an overpowering stench that hit him when he entered the mortuary after a four-hour-long wait. “I was shown the body of a clean shaven man. I am 100 per cent sure he was the one who came into our branch brandishing a gun along with two others,” he told The Hindu.

Mr. Anandan recalled the man — who was later identified as the gang's kingpin, Vinod Kumar from Patna — as the one who orchestrated the robbery for full 10 minutes with his left hand hidden in his trouser pocket and the right hand, with the unbuttoned shirt sleeve hanging loose over it, holding a pistol.

“He had disfigured fingers but I hadn't noticed them during the tense moments of the robbery. But I remember his face — he had a stubble then — very clearly as he pointed his gun at me from outside my cabin and shouted at me in Hindi to open the door,” Mr. Anandan said.

Struck by fear, Mr. Anandan had opened the door for Vinod Kumar, who entered the cabin with his accomplice, a short and dark youth whose body the teller identified as well. As Vinod Kumar put the gun on Mr. Anandan's shoulder, the other bundled Rs. 19.73 lakh into a bag after tucking his pistol into his trousers. “The gang leader then hit me on my back with his gun when I said I don't have the keys for safe room. Finally, I gave up after seeing the anger in his eyes. They led me to the safe-room and took Rs. 1.70 lakh while the third robber brought the manager and customers to the room at gunpoint. All three left after warning us not to leave for the next 10 minutes and then yesterday I saw them dead in the mortuary,” he said.

The fourth suspect was a gang member, who was waiting at the main door of the branch as the robbery unfolded.

While the body of the third robber with a gun was identified by the manager of the branch, the fourth was spotted by a clerk in the bank, police sources said.

The city police on Wednesday ascertained the identities of two more bank robbery suspects, who were killed in a recent encounter at a Velachery apartment.

One of them was wanted by the Bihar police in connection with the murder of the head of a math, the police said.

Police said one of the voter identity cards seized bearing the name, Harish Kumar, belonged to one of the men gunned down by the police in the early hours of Thursday. Teams sent to Bihar for a probe after the encounter established the real identity of Harish as Rajiv Kumar of Milkipur village in Nalanda district. Another body identified was that of Vinay Prasad, who also hailed from Bihar.

Italians back down after exhausting all their leverage looks like which included threatening UPA over kickbacks. India responded with opening its own investigation into the allegation. Good move - Italians can pipe down now. India has agreed to Italian forensic team to join Kerala Police in investigations.

While sticking to their stated positions, Italy and India have decided not to let the killing of two fishermen cast a shadow on their bilateral ties. The Italians are also working on the proposal of cash compensation to the victims. After the meeting, Italian foreign minister Guilio Terzi and his Indian counterpart SM Krishna held their respective positions. But Italians seem to be reconciling to the Indian position on not treating the incident as a diplomatic or political issue but a law and order one.
“We met in the backdrop of an unfortunate incident... There is a very strong public opinion on both sides. Minister Terzi and I agreed that we need to clear the air so people in both countries are reassured” Krishna said after the meeting.

In the afternoon, Terzi travelled to Kochi to meet the two Italian Mariners detained for the killing.

Asserting that there were “differences of opinion” between India and Italy over the incident, Terzi said, “I have explained frankly the position of our government on the legal aspect... There is a difference of opinion and it has not been resolved.

We hope to pursue the matter in a friendly spirit, understanding and cooperation.”

India wants the law of the land to take its course, while Italians want the marines to be tried under their law, citing article 97 of the United Nations Convention on Law of the sea.

"I went to the senior district officers with a copy of the medical certificate but nobody paid attention."

I put a comment on the TOI page, it was really popular but completly exposed the INC, it had a lot of responses, but caused a lot of pain even though it had no inflammatory language that it has now been deleted. Heh heh.

Only when truth hurts are such actions taken. :lol: :lol:

Intel reveals ISI-Naxal link
Indian intelligence agencies now have concrete evidence to prove that Pakistan’s Inter-Services Intelligence (ISI) has established direct contact with Naxal outfits in India. The sole purpose of this strategic move by the ISI is to use the formidable Naxal network to step up violence in the hinterland.

A recent classified intelligence report accessed by this newspaper states that ‘the ISI in particular wants Naxals to cause largescale damage to infrastructure projects and industrial units operating in the interior parts of the country where ISI’s own terror network is non-existent’.
The report reveals that the ISI is using its Bangladesh-based operatives to establish contact with the top leadership of the CPI (Maoist). The task has been assigned to a key ISI operative, Mohammed Aslam, who normally operates from Dhaka and Chittagong. Top Ulfa commander Paresh Barua, the report states, has played a key role in bringing the ISI and the Naxals in ‘direct contact’. Ulfa, in fact, wields a lot of clout among the Naxal leadership since it has been helping them with supply of weapons through the terror outfit Kamptapur Liberation Organisation.

The Naxals categorically told the ISI that they did not need any financial support but required more sophisticated arms and ammunition, particularly RDX, to make IEDs. Naxal outfits are so far not known to use RDX so the move is being seen as a tactical shift in their fight against paramilitary forces.

“There is no denying that Naxals are cash rich as their collections from various means, like extortion and protection money, run into hundreds of crores. What they need are weapons for which they can even afford to pay,” a top intelligence official remarked.

Investigators said that Ahtesham Malik, one of the two arrested in Delhi, travelled to Pakistan last summer using his valid passport and trained for 40 days in “bomb-making and explosives”. His is the third case where a young man from the Valley was chosen and sent to Pakistan using legal travel documents to receive training from Lashkar.

I am simply stunned by the media report that jailbird Suresh Kalmadi was allowed to leave his prison cell to attend,not a court hearing but a meeting of the parliamentary committee on ...Defence! This is simply incomprehensible.A man accused of stealing thousands of crores in the CWG scam is thought of as still a fit person to sit in on the defence of the country? This sounds like the Mad Hatter's tea party in Alice! The man whom two sports ministers of this govt. warned the PM about,were sacked for the same,and SK was given a blank cheque by the PM to loot the nation using the CWG.His name should've been removed at least temporarily until he was cleared of all charges by the courts.Kalmadi's presence at Defence Committee meetings will now lead to intense speculation and allegations about his role in defence kickbacks too!

The massive investigations against NGOs,after the KKM expose,is most welcome,but the manner in which it has been done has allowed it to appear as if the NGOs are victims of a police state.The anti-N-power NGOs like PMANE ,are like ticks on the tail trying to "wag the dog".However,in going after the crooked NGOs and their foreign masters and patrons,those which are doing yeoman service to the people of the nation must not suffer in a general "cull" of those guilty.Special fast-track courts must be set up to investigate and prosecute the guilty whoever they are.

Hit-and-run on high seas; 2 Kerala fishermen killed
In a hit-and run incident on high seas, two fishermen were killed and three others reported missing after an unidentified ship collided with their boat, off Kerala coast during early hours on Thursday.

Two men were rescued by another boat. The incident comes close on the heels of the killing of two fishermen by naval guards from an Italian ship, mistaking them for pirates, off the Kerala coast earlier this month.
The accident took place 15 nautical miles off the Alappuzha coast.

The fishing boat had left from the Neendakara Fishing Harbour on Sunday with seven fishermen on board for deep-sea fishing.

what is going on off the coast of Kerala.

Murder case in Italy against marines who shot Kerala fishermen
The Italian government says that two of its marines, currently in a Kerala jail for shooting two fishermen from Kochi, will be tried for murder in Italy. This is part of Italy's attempts to persuade India to release the marines who were arrested a few weeks ago. A court in Kerala today extended their custody till March 5.
India says because the incident took place within its waters, the marines must face a trial here according to Indian law. Italy has disputed that, describing the arrests of the guards as coercive and unilateral. A series of Italian delegates including the country's foreign minister have met with SM Krishna, Minister for External Affairs. They have stressed that as members of the Navy, the marines are entitled to immunity abroad, and should be tried in their home country.
The Kerala High Court is also hearing a case filed by the family of one of the men who was killed. His relatives have asked for a crore as compensation. The lawyers representing the Italians have told the High Court that the Italian government has initiated criminal proceedings against the marines. The murder charges against them mean they could face upto 21 years in prison, according to Italian law.

Meanwhile, the police custody of the marines has been extended by four days till March 5. This comes after a Kerala court had given a week's extension of the period for police interrogation on February 23.
Italians will be let off in italian system surely. better they are tried in India which is the correct thing considering the crime.

Some of the boats serve as our intel eyes and ears. The ships on the other hand double as drop-offs for arms and weapons. These drop off would be convenient if done in the desi-fishing range so that the entrypoints in the socialist republic are close by. So the ships would need to scare away those that are not the couriers.

Track who supplied and transported stuff for SL insurgency, and how. The entire southern tip ranging from Maldives to Lakshadweep with Kerala as base is the southern gateway.

Antony's office 'bugged', defence ministry orders probe
NEW DELHI: Defence minister A K Antony's office is 'bugged' and the defence ministry ordered probe with Intelligence Bureau, according to sources.

The bugging came into notice on February 16 following which defence secretary Shashikant Sharma took up the matter with IB for a probe.

Last year, finance minister Pranab Mukherjee had confirmed that he suspected his finance ministry offices were bugged and had sought an inquiry into the alleged incidents.

They think MI is the one who did it. Army confirms that they did deploy tech surveillance in sensitive areas in Delhi.

MI team who do daily checks are the ones that found the device before an IB team was called in.

I hope this is not a false case to blame VKS.

New Delhi: The Defence Ministry has denied that Defence Minister AK Antony's office was being bugged, saying an investigation into "inconsistencies" found during a routine sweep has turned up no proof of any bugging device. In a terse press release issued this afternoon, the government said, "Reports of 'bugging' in South Block in a section of the media is hereby denied. Routine checks are conducted in the offices of Raksha Mantri and other officers in South Block. Nothing has been found in these checks."

Even the Defence Minister denied reports of his office being bugged. "This was a routine check and it keeps happening. There was no bugging... it is baseless" Mr Antony said this evening.

The Defence Minister's office and five other rooms in the ministry are randomly swept by intelligence wings of the three services - Army, Navy and the Airforce, twice a day. It was during one of these sweeps, called counter-measures, that the "inconsistency" had been found.

Sources tell NDTV that it all started when a routine Military Intelligence sweep detected traces of abnormal radio frequencies, in three places including the Defence Minister's office, on February 16 during a routine sweep. Military Intelligence used radio frequency detectors that can detect frequencies up to about six Giga Hertz. Subsequent checks showed no abnormal frequencies at one of the places but continued in the other two places, sources added.

A loose pin-like object is also believed to have been found in Mr Antony's office but checks didn't reveal anything wrong.

It is also understood, since number of important defence deals were being processed, Defence Secretary Shashikant Sharma was immediately informed by the Military Intelligence who then had asked the Intelligence Bureau (IB) to conduct a routine check. However, IB sources say the check revealed nothing.

NGO’s- conversion, demonstration and terrorism
The Government of India has finally woken up and has put around 77 Non Governmental Organisations under the watch list for fueling anti India activities. The topic regarding the mis doings of some NGOs in the country have been doing the round for quite sometime and recently the Ministry for Home had also pointed out that there are some organisations in and also outside the country which are aimed at causing unrest.

The problem is three fold according to the Economic Wing of the Intelligence Bureau. Preliminary investigations which have dealt with the funds of these NGOs show that their activities have ranged from causing unrest, terrorism and also conversions.

The country has 68000 registered NGOs. But the problem is not with these NGOs as their records and financial transactions have always been an open chapter. The problem is with the 77 NGO’s which have now been identified by the Government of India. The Home Secretary, R K Singh says that these NGOs are not being probed. He however adds that some NGOs have diverted funds and these are the ones which will be probed.

However the IB has decided to put all these 77 NGOs under the watch list as there has been some suspicion regarding their dealings. Most of these NGOs get their funding’s from the Gulf, the United States of America and also some Scandinavian countries.

The NGO’s from both the US and also these Scandanavian countries have been notorious for pumping in funds in a bid to cause and unrest and even conversions. For the sake of conversions, these NGOs which have their bases in the above mentioned two places have pumped in nearly Rs 10000 crore and these funds are currently under the scanner of the Home Ministry. There have also been instances to show that funds are being pumped in, in large numbers for the sake of causing anti development protests. The recent one being the protest against the Kundakulam nuclear plant in Tamil Nadu. The Home Ministry feels that the protests were funded by NGOs in the United States of America. These kind of NGOs have been set up in various parts of the world and the job is to create protests against projects which would help in the development of a nation. In addition to this some of these NGOs have also been parking money and supplying them for the naxalite movement as well.

There have also been a large number of complaints regarding the funds that are being pumped in for the sake of conversions. The funds are pumped in and then distributed to smaller groups who use the same for forcible conversions.

The biggest headache is however the NGOs which are being fed from countries such as Saudi Arabia. These are the funds which are pumped in and parked in NGOs which are used for terrorist activities.

The Home Ministry says that these NGOs which have their bases abroad will be put under the scanner and that country too would be informed regarding the same. All the money that would be coming in would be monitored very closely and the spending would be scrutinized as well. All three types of activities as mentioned above are grave offenses and the punishment that would follow too would be severe, an official informed.

The government of India which has often been soft on NGOs as it was believed that they were harmless has now decided to up the ante. There have in the past been very few cases where such activities have resulted in prosecution, but this time around the Government says that the punishment would be stringent. The Financial Task Action Force too would be on its heels and would pick up any small diversion of funds and initiate criminal proceedings. In addition to this the government would also place under the scanner the registered NGOs too and watch all fund movements initiated by them.

Israel embassy car attack: Man held in Delhi

A headway was made into the three-week-old Israeli car bombing case with the Delhi Police arresting a 50-year-old man, claiming to be a journalist, for allegedly being part of the conspiracy.

The accused, Syed Mohammed Kazmi, who claims to have been writing for an Iranian publication, was picked up after a probe showed that he had been in touch with the suspect who is believed to have stuck the magnetic bomb on Israeli diplomat Tal Yehoshua's car on February 13, official sources said on Wednesday.

When asked whether any person has been detained in connection with the February 13 attack, Delhi Police Commissioner BK Gupta told PTI, "We will let you know".

Kazmi is alleged to have helped the suspect in conducting the recee of the Israeli Embassy to keep a tab on arrival and departures of the diplomats, the sources said.

Police conducted searches at his native place near Delhi, they said. Israeli diplomat Tal Yehoshua and an Indian driver of the embassy vehicle, was among four people injured in the blast after a magnetic bomb stuck to the vehicle went off.

Mining mafia: IPS officer crushed to death in Madhya Pradesh

A young Indian Police Service officer was crushed to death in the Morena district of Madhya Pradesh, police said on Thursday.

Narendra Kumar, sub-divisional police officer of Bamor in Morena district, was trying to stop a tractor loaded with illegally-quarried stones on Thursday afternoon."But instead of stopping, the driver ran over him. Kumar was rushed to hospital but died on the way," DIG (Chambal), D P Gupta told IANS.

Kumar was a 2009 batch IPS officer and was on probation. His wife Madhurani Tewatia, an Indian Administrative Service (IAS) officer, is also posted in Madhya Pradesh but is presently on maternity leave in Delhi.

The tractor driver identified as Manoj Gurjar has been arrested and a case has been registered under section 302 of the IPC against them.
Kumar was posted at Banmore since last one month and during his brief tenure he had taken on the mining mafia head-on by seizing number of trucks and tractors engaged in illegal mining in the area, the sources said. Madhya Pradesh home minister Uma Shankar Gupta and the state's DGP Nandan Dube have rushed to Gwalior following the incident.
