Nicolas Sarkozy DID take $50 million of Muammar Gaddafi's cash, French judge is told

John Lichfield Paris Wednesday 02 January 2013

Documentary proof exists that France’s former President Nicolas Sarkozy took more than €50m from the late Libyan dictator, Muammar Gaddafi, a French judge has been told.

The claim, leaked today, was made just before Christmas by a Lebanese-born businessman, Ziad Takieddine, who has been a fixer for legal - and allegedly illegal - dealings between France and the Middle East for 20 years.

Expanding on claims already made by one of Mr Gaddafi’s sons and a French investigative website, Mr Takieddine told an investigative judge that he could show him written proof that Mr Sarkozy’s first presidential campaign in 2006-7 was “abundantly” financed by Tripoli. The payments, he said, continued after Mr Sarkozy became President.

In total, he said, they exceeded the €50m in illegal payments to Mr Sarkozy claimed by Mr Gaddafi’s son Saif al-Islam just before the demise of the Libyan regime - thanks partly to French and British airstrikes - in 2011.

Mr Takieddine’s claims were rejected today as “outrageous” and “self-interested” by sources close to Mr Sarkozy. Last year President Sarkozy denounced a similar claim by the investigative website Mediapart as “grotesque”.

The Lebanese businessman is himself under formal investigation for allegedly organising and receiving illegal kick-backs on arms deals over two decades. He today admitted that his allegations against Mr Sarkozy were part of a proposed trade-off with the French judicial system.

He told the newspaper Le Parisien that he was ready to show investigators proof of Gaddafi’s alleged financial dealings with Mr Sarkozy if a judicial investigation was launched into Libya’s financing of French politicians. This implied that he was trying to minimise allegations against him, dating back to 1993, by igniting, or re-igniting, allegations which were more recent and more explosive.

“Yes, Libya financed Sarkozy,” Mr Takieddine told Le Parisien.

The claims, however self-interested they may be, are deeply embarrassing for Mr Sarkozy. Mr Takieddine had close business and personal relations for many years with a string of centre-right politicians, including the former President’s childhood friend, Brice Hortefeux, his close ally and former interior minister, Claude Gueant[acute on e] and the current head of Mr Sarkozy’s centre-right party, Jean-Francois Copé. He is also known to have played a significant role in Mr Sarkozy’s dealings with Gaddafi to free Bulgarian nurses falsely imprisoned in Libya in 2007.

Mr Sarkozy already faces separate allegations that his party – possibly without his knowledge – took illegal campaign contributions from France’s richest woman, Liliane Bettencourt, in 2007. Last month, his official accounts for his failed re-election campaign last year were rejected by a campaign watchdog.

Allegations of illicit dealings with Gaddafi are especially sensitive for the former French president. With Prime Minister David Cameron, he organised and led the international support for the Libyan opposition which eventually led to Gaddafi’s downfall and death in October 2011.

Before that, however, Mr Sarkozy puzzled many of his own supporters by granting Gaddafi an obsequious and glittering state visit to France in December 2007. It later emerged that a number of contracts had been signed by France and Libya, including a deal to supply surveillance equipment to the Libyan intelligence services.

Mr Takieddine is under formal investigation for a number of alleged offences including receiving illegal kick-backs on French arms deals to Pakistan and Saudi Arabia in 1993-5. In a meeting on 19 December to discuss these allegations with Judge Renaud van Ruymbeke, Mr Takieddine offered to steer the French judicial system towards written evidence of kick-backs to Mr Sarkozy’s 2007 campaign. He said there had been a series of meetings to organise the payments in 2006-2007 between Mr Gueant, then Mr Sarkozy’s chief of staff, and Mr Gaddafi’s private secretary, Bashir Saleh.

Written accounts of these meetings, Mr Takieddine told the judge, had been handed to the former Libyan Prime Minister, Al Baghdadi al-Mahmoudhi. After the Libyan revolution, Mr Mahmoudhi sought and received unofficial asylum in France. He has recently been returned to Tripoli by Tunisia, having left France after Mr Sarkozy lost the presidential election in June last year.

Italian marines return to Kochi
'We have kept our word and have full faith in the Indian judicial system. I'm sure the people of Kerala and the country will look upon this as an act that shows the good relations the two countries have,' Italy's consular general told reporters soon after the marines arrived here at 8.30 a.m. on a chartered flight from Rome

---
The two Italian Marines who had gone home to celebrate X'Mas has landed back at Kochi by a special flight. They would now report to the Commissioner of Police, Kochi city and also surrender their passports at the court.

Crisis of faith over Vatican cash machines
Italy's central bank has blocked all electronic payments through cash machines and by credit cards in Vatican City following the world's smallest state's failure to fully comply with international anti-money laundering rules.

The incident raises further questions about the transparency of the Vatican's finances. Its efforts to adopt international standards in combating money laundering and terrorist financing were given a mixed assessment last July in a study of its financial system.
The Vatican is not included in the European Commission's "white list" of states that fully comply with international standards against tax fraud and money laundering.

with economy going down the drain, there tooth combing every operation to mop up resources.

Kerala govt has no jurisdiction to prosecute Italian marines: SC (Mathrubhumi: English)
The Supreme Court Friday ruled that the Kerala government has no independent jurisdiction to try two Italian marines for shooting down two Indian fishermen off the Kerala coast last year.

The apex court bench of Chief Justice Altamas Kabir and Justice J. Chelameswar held that it was only the union of India that had the jurisdiction to hold the trial of the two marines Massimilano Latorre and Salvatore Girone.

However, the court said the central government, in consultation with the chief justice, will set up a special court to hold the trial.

The Italian government will be free to raise the question that it had the jurisdiction to conduct the trial of these two Italian marines in their country.

Upon raising this issue of jurisdiction, the special court will decide the question whether the government of India or the Italian government has the jurisdiction to conduct the trial of the two marines under the Marine time Law.

Two Italian marines, Chief Master Sergeant Massimilano Latorre and Sergeant Salvatore Girone, on board the Italian cargo vessel Enrica Lexie had shot dead two Indian fishermen Feb 15 last year suspecting them to be pirates.
---
The main question which remains is that when all this happens where would the Italines Marines be? In India, or in their home country? Does the stringent bail conditions set by Kerala HC now hold good? As I read it looks like Kerala Govt. have been clearly asked to keep away from the case and now it is played out at the Indian Union level. The verdict also now clearly takes the onus away from the current UDF government in Kerala state.

The apex court directed to shift the two accused Italian naval guards to Delhi and to keep them under the control of the Italian Embasy. They will report once a week to Chanakyapuri Police Station
The Italian wheels are moving slowly as the memory of the murdered fishermen slowly fades. Is there a country in this planet where Indian murder suspects are hosted in the Indian embassy? Hate to say this we are a disgrace.

Pulse. What's on their minds.
Standing ovation for Irish President Higgins after UNESCO speech
PRESIDENT Michael D Higgins received a rapturous reception for his speech at the UNESCO headquarters in Paris earlier today.
...
Towards the end of his address, he spoke about the urgent need for dialogue between different belief systems.

"A dialogue between what is called the Western world and moderate Islam. If we are threatened by the extremes of any distorted faith system, it is often because we have not had the conversation we need with those who see the truth, the beauty, the belief that is at the heart of some of these beliefs. The western world has neglected its conversation with modern Islam," he said.

After the speech, the president was approached by the Saudi Arabian ambassador who was so taken with his words that he wanted to put up the cost of having the entire address translated into the remaining five languages not covered by the UNESCO translations - but in fact the whole speech would have to be translated into all the relevant languages anyway, as true to form, Michael D strayed far from the official script.

And UNESCO Director, Dr Jennifer Pearson was little short of starry-eyed. "I have never seen a reaction like the reaction. Normally when a president comes to speak, we listen with attention, but today people listened with passion, and almost as one they all got up and gave him a standing ovation," she explained.

It is a very disturbing development. It simply reinforces bigoted European view that lives of dark complexioned people are worth nothing. When I see stories like this, I can understand why people refer to Man Mohan Singh as constable Singh. I hope the politicians will let the judiciary do its job without any hindrance; after all the constitution clearly defines the role of judiciary in Indian governance; even the PMO has no legal rights to interfere.

Supreme Court permits Italian naval guards to go to Italy to cast vote
The Supreme Court today permitted two Italian naval guards, accused of shooting dead two Indian fishermen off the coast of Kerala, to travel to their country to cast vote in the upcoming elections there.
...
The bench also comprising Justices A R Dave and Vikramajit Sen allowed the plea of the two marines and the Italian government to allow them to travel for four weeks to Italy.
Travel to Italy to vote? and that too 4 weeks? What is going on? Has such latitude been shown to any murderers in any part of the world, post colonial days? Even in Italy, I suspect if they will be treated so well. They are being treated as if they are ambassadors from Italy. Everything Italian has been bad news for India in the last 3 decades...

A beautiful plot by the GoI to fool the aam aadmi. As soon as the italian citizens land in own their country, the Indian authorities who will join them have no authority or jurisdiction to touch them, let along make them keep their promise of coming back. GoI knows this, VERY WELL. 4 weeks after their departure a news will popoup, suggesting Indian authorities did everything possible to bring them back but Italians did not co-operate so nothing can be done. Pranab Mokaji will say that we have lodged this ISSUE with Italians. British were long gone, but slavery continued.....All I can do is blame myself for letting the country in the hands of thugs and not taking charge on my own...it hurts

Four weeks time is for calisthenics in the bedroom onlee. Their biological rights cannot be violated. Even in a tinpot country like eyetalie, voting cannot take four weeks.

They will be convicted in India but be shipped off to eyetalie to serve the time and there they will be handed over to the military who will manage them. Arrangements have already been made with the maharani. That's how the two blood thirsty buggers are safely ensconced in the eyetalian embassy in Delhi. They must have been fed up with aapam and stew in kerala.

Best would be to give them death sentence and hang them secretly now that we have perfected the art of secret hangings.

Do it quickly as pranabda seems to still be in a good mood.

Former far-right Dutch politician converts to Islam
A former member of the anti-Islamist Dutch politician Geert Wilders’ party and personal friend of his, has declared his conversion to Islam.

Arnoud van Doorn was a member of Wilders’ right-wing Freedom Party until the end of 2011.

He said that he had made a fresh start by announcing his decision to the world and taking his Shahadah [Testimony of Faith] on his Twitter account.

PratikDas ji, I take it you're being sarcastic. :) Lunacy eventually meets its opposite lunacy, left or right.

The Euros just don't have a solid purva paksha to Islamism, when all they have to fall back upon is a primitive mutation of Christianity crossed with racism and liberal democracy.

Any deracinated philosophy, however sophisticated, cannot combat entrenched fanaticism. It will eventually get sucked into its vortex. Because it does not have any pragmatic that can substitute for that part of the psyche that Islamism appeals to.

India has to develop a purva paksha that has roots not just in a higher philosophy but also an actual sadhana and service of some kind.

IMHO, right now Europe and even India are putting two "left" feet forward in dialogue with Islamism - either pseudo-liberal lefty types, or cranky extreme right-wingers.

Blogged this today:
"Louder" dialogue: Right foot forward
"Citizen diplomacy" is fruitful only if the agents of dialogue are reasonably in sync with their nation's purpose and philosophy. Such individuals from both sides can use the informality and good intentions to create a genuine dialogue and enhance mutual understanding. If India had genuine representatives, I would be all in favour of track II diplomacy and cultural exchange. But an octogenarian Wagah Candle Holder pining for his ancestral aangan in Lahore and trying to keep alive his dhimmi-schooled father's Urdu may not be India's best foot forward.

Nor, in my view, is a "secularist" who is unwilling to acknowledge the depth and real context of India's civilization as a valid (and valuable) starting point in modern times, much less take pride in it. What is he willing to fight and die for? - That question undergirds his qualification to dialogue on behalf of the nation, rather than merely his "pacifist" unwillingness to fight. Or worse. (See this interesting speech by M.J. Akbar on the Idea of India.)

This is all the more important because this generation of warfare has stepped out of the conventional framework of Westphalian states, and its driving force goes beyond a primitive nationalism and even political-economic ideology. In this scenario, there are "countries" today that are not really nation-states in the proper sense of the term, they are sly foxes in the garb of law abiding nation-states. Their behaviour confuses naive observers, who call them "failed states" that are not quite failing. But the fact is that they were never meant to be successful as nation-states. their success lies in something else, something much larger. Taking advantage of the protocols of being called a nation-state and especially a failing one that cannot control "non state actors" is part of that larger war, specifically its diplomatic aspect.

When this is the big picture, a nation that is in a make-believe delusion that it is about nation-states is decidedly out-of-place and a naive oddity, setting itself up for others to play games with it. Therefore, those Indian commentators that try to distract the nation by calling a strangely idiotic "pride" to the fact that India is not considered a "failed state" are deluding the people. They are a direct threat to the future development of India's national purpose, much less ideal representatives for dialogue with others.

As long as India cannot put its "right" foot forward, its probably better to keep transactions limited to covert ops where required, as punishment for specific actions or to cultivate certain trends. At the same time, the need of the hour is for a vigorous discussion (not wrangling, not cavil) within India to clarify and then solidify the idea of India going forward. As actions speak louder than words, this combination of internal dialogue and hard external ops will make for a "louder" dialogue, decency be damned.

Carl ji,

I think what the Euros lack is an integral unity concept like Dharma, and secondly one cannot do a good Purva-Paksha of Islam from a Christian PoV, taking history and theology into consideration.

Both these deficiencies make Europe susceptible to Islam.

Carl ji, it would be best if you refer to me by my name as I know a miniscule amount of what you do.

Thank you for taking the time to write back. Having lived in several "Western" countries, I can only imagine the Christian, closet Christian, and Science-loving atheist being shocked by the headline, so I wasn't being sarcastic, only curious to know your thoughts.

Amongst Europeans I work with, many of them being very friendly and well-meaning, I sense that any gravitas that Hinduism might have earned is undone by the perception of what [little] Hindus typically achieve after all the corruption, superstition, ityadi. So, I'm afraid it would take a few miracles for Hinduism, not more Christianity and not 'all peaceful' Buddhism, to appear as the logically meaningful relief to Islam. In other words, most Europeans I know respect hard work, smart work, and achievements and they don't see much of that in India -they just see people slogging it out in an inefficient system we're too lazy to change, i.e. not admirable.

Purulia arms case: Denmark asks India to give fresh proposal for Davy extradition
New Delhi: Talks between India and Denmark on expediting the extradition of prime accused in Purulia arms drop case Kim Davy to face trial here failed to make any headway on Thursday as the European country asked for a fresh proposal which will be examined by their justice department. "The talks were held in a cordial manner and there was a discussion on extradition of Kim Davy," Union Home Secretary RK Singh told reporters.

However, sources in the delegation said the Indian side expressed their disappointment over sending a fresh proposal and conveyed that this would delay in bringing the accused to justice. It was conveyed that it took nine years for Denmark to decide on the earlier extradition request and the fresh proposal appeared to be a delaying tactics yet again.

The visiting Danish delegation headed by Deputy Permanent Secretary in the Justice Ministry Jens Christian Bulow assured India that any fresh proposal might be expeditiously processed. CBI reiterated its earlier offer asking them to handover Davy to India so that he could stand a trial here and, if sentenced, can serve the prison term in Denmark, the sources said.

The Home Secretary also said there was a provision in the law whereby prisoners can be transferred to their country for serving the prison term.
The Indian delegation comprising officials from Home, Law and External Affairs Ministries and CBI was led by Special Secretary (Internal Secretary) in the Home Ministry S Jayaraman.

India has also made an option to try Davy in a special court within the Indian Embassy in Copenhagen.
After a Denmark court had turned down the extradition plea and the authorities in Copenhagen refused to go in for appeal, India, in a bid to put pressure, scaled down its diplomatic relations with that country last year.

The case relates to an incident on the night of December 17, 1995, when an AN-26 aircraft dropped arms and ammunition in West Bengal's Purulia district. The consignment had hundreds of AK-47 rifles, pistols, anti-tank grenades, rocket launchers and thousands of rounds of ammunition.

Five Latvians and British national Peter Bleach were arrested in connection with the incident. However, Davy, a Danish citizen, and the prime accused in the case, had managed to escape. Since then, the Indian government has been pressing for his extradition to India with the Danish government.

The extradition order was passed by Danish government on April 9, 2010. However, Davy had approached a local court challenging the order of the Danish government. The court set aside the order.

Thereafter, an appeal of Danish government was also set aside by the High Court in Denmark on the ground that if Davy is extradited to India for prosecution, there would be a real risk that he would be subjected to treatment in violation of article 3 of the European Human Rights Convention.

The arrested Latvian crew members were released from a prison in Kolkata in 2000 after requests from Russian authorities while Bleach was given a presidential pardon in 2004 following requests by British government.

PratikDas ji I agree, we can't expect to expand Dharma abroad when it is tottering at home. Hence a focus on Dharmaarthic development on the Bharatiya thread. I've seen discussions in Western circles over emerging societies such as Chinese Confucian culture, and of course Islamic culture. They are discussed as "alternative" models for growth or stability, etc....and whether there is anything the West could learn and take from them in these times. But India is not seen that way -- rather, India is seen as a reasonably successful though "messy" recipient of Western democracy, with nothing new to offer in modern times. That's because our polity and practical social life is not shaped by intellectual ideas stemming from original Bharatiya culture. Our intellectuals, including those that sell the "idea of India" to Westerners (like Shashi Tharoor and MJ Akbar) do NOT seem to have any pride in original Sanskriti culture, much less think of it as relevant to modern times and the future of India or the world. At best its a museum piece. And when they sell the "idea of India" abroad, their boast is limited to how much less embarrassing India is than Pakistan! With intellectuals like these, we cannot expect to be exporters of culture and ideas. They cannot think originally because their worldview is not Indocentric. They can only think about further implementing Western (or Islamist or Chinese) cultural exports in India, perhaps with "Indianized characteristics". Other cultural ambassadors such as classical musicians or some guru-based organizations do a better job of representing the 'idea of India'. We need a more Indic, Brahminical intellectual movement of ideologues.

Added: No harm in borrowing and learning and implementing good things from other cultures into India right now - I have nothing against that. But in "Indianizing them, we need to make sure that they are aligned and made extensions or revivifications of corresponding memes within India's own past. This is what our current crop of intellectuals are not doing at all - in fact, they do the reverse...they try to show that modern concepts and diversity and "secularism" are endangered by native Indic culture! I wrote about this before: Identity and Learning: Worlds within worlds

For example, democracy and multicultural "secularism" is successful in India because of Hinduism and certain ideas of Dharma within it -- this has to be understood and made known to others, as well as the fact that since ancient times India had republics side by side with monarchies. Republican cities and states were not unique to Greece. Unless these native memes are revivified in the process of adopting and learning things from others (West, China, Japan, Communism, Islamic world, whoever else), they will sit uncomfortably in our incomparably complex society, and end up creating new problems, not least of which is a devolving civilizational life reflected in criminal and corrupt trends.

The Italian Government has reneged on its commitment to send back the trigger happy Italian Marines who murdered India fishermen.

It will be interesting to see what spin the Italian born Party Boss of Congress Party , namely Mrs. Sonia Gandhi will have to put on this matter. As party leader of the ruling Congress Party led UPA coalition administration of Dr. Manmohan Singh it is not going to be easy to shift the blame for this error in judgement.:

Please Note; Congress led UPA Govt did not oppose the bail plea of Italian Marines in SC. Its Union Govt's duty to oppose the bail plea.

In the name of Jesus, the family of victims had pardoned the marines in return for blood money

The empress won't say anything. This had the full blessing of CONGoons. Weall saw this coming, but sucks when it happens anyway. Reinforces the colonial racist white mentality that Brown people are worthless and Brown laws are below a white person.

We are a polished banana republic. Again nothing new.

Italy Won't Send Accused Marines Back to India
:rotfl: :rotfl: :rotfl:

There was absolutely no need to send the marines for voting. That could have been done from India itself.

Those marines should have been sitting in an Indian Jail with chains around their feet and hands, watching the cockroaches in their cells. Instead they are being feted in Italy as heroes!

I think NaMo MUST make this an election issue! How Italian in high places facilitated the escape of the Italian Murderers! He should go for the Jugular of the Congress - the Dynasty! In fact for this, there should be an inquiry whose verdict should be that SG intervened personally. SG in fact should now face the punishment that should have been meted to those Italian Murderers. And she should not be allowed to escape to Italy! Her punishment should come in India! The first thing NaMo should do when in power is to confiscate her passport(s)! No Mercy should be shown!

RajeshA and chanakyaa, you two were spot on! What a shameless venal Govt. Still 14 months to go for election. :-?

I'm outraged but not surprised. If we take a deeper look into the timeline of events, we can decipher this GoI sham.

Dec 21: GoI gives rare exemption to Marines after which court allows them to go to Italy for Christmas.

Dec 21: Salman Khurshid says "If the court in its wisdom has relaxed some conditions then it is entirely a matter between the court and the petition?? We must respect the court judgment". No mention of GoI exemption that allowed the Court to release the marines.

Jan 18: The Supreme Court orders that the marines be shifted from Kerala to Delhi, and be under the 'custody' of the Supreme Court till the Central Govt constitutes the special court. The Supreme Court in its judgement, ordered that a special court be setup after consultations with the Chief Justice of India, to try the two marines in accordance with Indian maritime laws and UNCLOS 1982.

Feb 12: AugustaWestland CEO arrested. Details of bribery in Indian deal start coming out.

Feb 16-18: No cooperation from Italian investigators to MoD investigation team in Italy.

Feb 23: No progress on setting up a special court. A bench of Chief Justice Altamas Kabir expressed displeasure over the failure of the government to set up a special court in pursuance of its Jan 18 directions to try two marines. Taking exception that nothing had been done in last one month since the apex court passed its direction to set up the special court, Chief Justice said that had the court been set up, the trial in the case would have been over.

Mar 11: Italy refuses to send Marines back.

Now, doesn't this smell of a deal where Italy prevents the AugustaWestland probe from throwing up names and INC promising to drag feet on the Marines case in India? Who wants a defense scandal a year before General Elections?
