After the indefinite adjournment of the case against Hafiz Saeed, yet another way of the Government of Pakistan saying that the Pakistani perpetrators of the Mumbai terrorist attack will not be punished. After all Pakistan can hardly be expected to arrest terrorists that have fled the Islamic Republic  .

Our Prime Minister Dr. Manhohan Singh had it completely wrong when he stated in Parliament that an ant-terrorist consensus had emerged in the Islamic Republic of Pakistan.

Well he knows Indian justice system. And that is not all that he is asking -- check this out:

Will anyone tie me a rakhi, Kasab asks lawyer

MUMBAI: Arrested Pakistani gunman Ajmal Amir Kasab asked his lawyer if anyone would tie him a rakhi on Wednesday — the day of Raksha Bandhan. To which, Abbas Kazmi, his lawyer, said, ‘‘If some one treats you like a brother, she will surely come and tie a rakhi.’’

According to Kazmi, Kasab has seen rakhis tied on the wrists of several people in court and hence asked the question.
He has also seen several of his guards with rakhis. Kasab has two sisters — Rukhaiya and Suraiya who used to live with him in Faridkot in Pakistan. Kazmi said Kasab would have been aware of the festival in Pakistan.

During his confession given before Judge M L Tahaliyani, Kasab had given details of his family. He had talked about his two sisters and said that they were married and had children. When he was first brought to Arthur Road jail in December 2008, Kasab had expressed a desire to speak to his family members in Pakistan.

On Wednesday, special prosecutor Ujjwal Nikam examined Vilas Gangawane, witness and investigating officer in the CST firing incident. Gangawane said he had conducted the test identification parade of Kasab in jail.

He thinks he is on a grand tourist visa in our country. What kind of example are we setting up ? Pukes must be laughing all the way !!

What is the need to die after commiting a terrorist act in India? You will get mutton biriyani if you've kept people hostage, supplied by GoI sourced from a 5 star hotel.
Even if you get arrested, politics such as that played by Con-gress will ensure you get all the veg biriyani-mutton biriyani you want because you are a high value prisoner. There might even be a career for you later on to support a political party if you have not come into the meidia limelight. Ultimately the PM will sell the nation out to the enemy so that your aakas are free.

So no one is inconvienced. Not the captured terrorist, not the terror masters in pakistan, not the Gov of Pakistan or the Pak Army-ISI. Only the people of India who got killed are inconvenienced. After all, the terrorist was out to kill, and pakistan being an enemy of India was only expressing its enemity, why did the citizen of India have to be around when the terrorist was shooting?

Stupid impotent politicians.

Video conferencing for US witnesses opposed by Kasab's lawyer
The defence in the 26/11 case on Monday opposed the deposition of three American witnesses through video conferencing, citing concerns about perjury and contempt of court.

The prosecution wants to examine five witnesses from the United States of America, including two Federal Bureau of Investigation (FBI) agents and three citizens.

Special Public Prosecutor Ujjwal Nikam has not asked for video conferencing. However, advocate Abbas Kazmi’s objection is to the eventuality of the video conferencing method being used to record testimonies of the three witnesses.

Kasab now wants to plead guilty of all charges
About three weeks after his surprise confession, Pakistani terrorist Mohammed Ajmal Amir Kasab, the prime accused in the 26/11 terror attacks, today told the court that he wanted to plead guilty to all the charges framed against him.

The judge, M L Tahaliyani, however, told Kasab to discuss his plea with his lawyer and inform the court.Kasab had pleaded guilty in the court on July 20, but had accepted only some of the charges.

The court had accepted his partial "admission of guilt" and decided to continue with the trial. Kasab told the judge, "Main sab kabool karna chahta hoon (I want to plead guilty to all charges)."

The lone surviving gunman of the November 26 attacks, Kasab made the plea when the court was examining a ballistic expert as witness in the case. The judge then asked, "Achanak kya hua? Aise kyun kar rahe ho? (What happened suddenly? Why are you doing this?). Earlier you had not accepted all, but some of the charges."

Kasab appeared calm while telling the court that he wanted to plead guilty to all charges.

26/11 trial: Kasab changes mind on pleading guilty
"The moment we informed the court that FBI officials will be examined as witnesses, Kasab got up to say he wanted to plead guilty to all charges," he said. This was done by Kasab to save his masters in Pakistan and it showed that the gunman did not want the prosecution to table evidence which FBI has collected in this case, Nikam claimed.

Cops clueless on Nariman House, 5 patrol boats were stuck in Worli

...
The Indian Express has learnt that the Pradhan committee report makes startling revelations: how the top police brass did not know that Nariman House had Jewish residents until the attack; how Mumbai’s 56-member police Quick Reaction Team had done no firing practice since September 2007 for lack of ammunition; how five Cuffe Parade police patrol boats — meant to be in the area where the 10 terrorists landed — were away, tackling a protest in Worli against the Sea Link.

And how intelligence alerts were sifted first by a “desk officer” who hardly ever passed these to his seniors.
...
The committee is said to have praised the timely response of the Mumbai police but has also noted that it was as if the police were responding to a “law order situation” and not a terrorist attack.
...
...
Senior bureaucrats dealing with internal security had not received any of the several alerts that had been marked from the Centre to the DGP, who had sent in ahead for action. Why?

Because the alerts went to a desk officer who “may or may not keep the higher officials informed”.

...
The QRT is the best-equipped and trained unit in the Mumbai police to respond to such attacks. It was trained for three months under the NSG in 2003 when it was raised, but they are said to have told the committee that they received no hostage-rescue training at NSG’s Manesar training facility.

More significantly, they have not had any firing practice since September 2007 because of “shortage of practice ammunition”.

Not just that, they had only 24 bullet-proof helmets for 56 personnel.
...
...
It’s learnt that the committee’s report lays bare numerous loopholes and significantly unmasks the fact that the modernization of the police force, though envisaged on paper, never took off.

As a result, on 26/11, the force reacted in a chaotic manner with several hotel employees confirming to inquiry officials that many policemen just entered with lathis — in some cases, the antiquated .303 rifle.

Archaic guns, no ammo, all tied up with Govt red tape

•Ammunition worth Rs 65 crore is needed if a policeman has to fire at least 40 rounds each year. Mumbai Police got only Rs 3 crore each year for the past five years.

•No ammunition for firing practice — the last lot received: 45,000 AK-47 rounds in 2005.

•The team that first entered the Taj Hotel had all of one SLR and one .303.

•Bhagwat Kacharu Bansode, the first police officer to enter the Trident, had one revolver.

And the list goes on and on as the Ram Pradhan Committee is learnt to have detailed the vulnerability of a police force and how it fought the terrorists with its hands tied.
...
...
• Communication: With communication equipment outdated and out of range very quickly, the Pradhan Committee is said to have found that Mumbai police officials largely depended on private cellular phones for communication which too got jammed in course of time.

For a long time, sources said, the Mumbai police thought that the handlers were in the city and it was only through “fortuitous circumstances” that the phone link with Pakistan-based handlers was ascertained.

India not serious about probe: Pak

I think the GoI deserves such accusations for the way they have released the pressure on Pakistan.
Pakistan on Saturday insisted that the information provided by India on the Mumbai attacks is "not sufficient" for it to take appropriate measures to bring those responsible for the 26/11 carnage to justice and accused New Delhi of adopting a "non-serious" attitude.

The information provided by India so far is "not sufficient," Interior Minister Rehman Malik was quoted as saying by the "Express 24/7" news channel.

He also said that India has not given some of the information sought by Pakistan last month.

Mr. Malik claimed that Pakistan is "serious" about probing the Mumbai attacks but India has a "non-serious" attitude and "always avoided" providing sufficient information to Islamabad to enable it to that appropriate measures to bring suspects to justice.

Pak claims bodies of four 26/11 terrorists
Pakistan on Monday decided to accept the bodies of four out of nine terrorists who carried out the Mumbai terror attacks, Times Now reported.

Earlier Pakistan had refused to accept the bodies stating that the terrorists were not Pakistani nationals.

The bodies had not been buried and had been kept at a Mumbai morgue, awaiting Pakistan’s acceptance.

Japanese company official testifies in Mumbai terror attacks case

The engine had been dispatched by the Yamaha Company in Japan to Business and Engineering Trends Company in Pakistan on Jan. 20 last year. In fact, the machine was dispatched to the Karachi sea port in Pakistan and the payment was made in Japan itself," the official quoted the Yamaha representative as telling the court.

Pakistan arrest holds clue to fate of Mumbai case
New Delhi is watching [Qari Saifullah] Akhtar’s case closely, aware that its course could indicate just how serious Pakistan is about cracking down on terrorist groups.

“If the United States yet again proves unable to ensure Akhtar’s prosecution,” a senior Union Home Ministry official told The Hindu, “we have almost no reason to expect there will be credible action against anti-India groups like the Lashkar-e-Taiba.”

One more arrested in Pakistan
Federal Investigation Agency (FIA) has arrested one more accused identified as Jamil Ahmed during the ongoing investigation into the Mumbai attacks.

FIA has submitted a request at Rawalpindi’s special court of Anti Terrorism number 1, demanding 14-day remand of Jamil Ahmed.

The ATC, rejecting the request, has ordered FIA to present the accused before it.

Sources told Geo News that Jamil Ahmed was apprehended recently from Southern Punjab.

FBI Agent's testimony in court
During cross-examination, the witness, whose name could not be revealed because of a court order, said the agency had interrogated a Pakistani national. However, "it is not proper for me to disclose the name," he said.

The court thwarted the prosecution's attempts to probe the FBI findings on the email account of Kharak Singh - a fictitious name - with Yahoo.Inc. It observed that the testimony from a Yahoo representative would constitute credible evidence, rather than that of a police officer.

The FBI witness said the agency probed the email address kharak_telco@yahoo. com. After he mentioned about the IP (Internet Protocol) address of the account, the judge said: "This IP address cannot go on record. This is hearsay evidence. How can I take this evidence, Mr. Nikam?"

Defence lawyer Abbas Kazmi also objected to some of the prosecution questions "as it may lead to the recording of hearsay evidence."

The proceedings saw a heated argument between Mr. Tahaliyani and Mr. Kazmi. The judge asked Mr. Kazmi to mind his speech in court.

Govt hands over dossier on Saeed to Pakistan
21 Aug 2009

Govt on Friday handed to Pakistan a fresh dossier on Jamaat-ud Dawa (JuD) chief Hafiz Saeed, accused by it of being the mastermind
behind the Mumbai terror attack.
.
.
The new information pertains specifically to Saeed. Pakistan had earlier alleged that it had not got enough information from India to prosecute Saeed.

No solid evidence against Saeed from India: Pak

Pakistan has not received any "solid evidence" against outlawed Jamaat-ud-Dawah chief Hafiz Mohammed Saeed from India so far, Foreign Minister Shah Mahmood Qureshi said on Friday (August 21), as New Delhi presented a fresh dossier on the carnage to Islamabad. The dossiers with information on the Mumbai attacks provided by India do not have any proof regarding the culpability of Saeed, Qureshi said. He urged India to provide any evidence it has against Saeed, also the founder of the banned Lashker-e-Toiba blamed New Delhi for carrying out the Mumbai attacks last year.

We will examine dossier when it reaches us: TSP FM Qureshi
TSP is proceeding against Sufi Mohammed based on the speeches he made. It has already said that those speeches were enough to prosecute them. Everyone knows how weak, dependent and corrupt the legal system is in Pakistan. A Pakistan unwilling to accept Indian evidence as unable to stand legally in its courts, is something laughable therefore. The intention is obvious. The new dossier will also be treated by TSP with the same contempt.
Our legal experts will examine the new information to see whether it was legally tenable, he said when asked to comment on the fresh Indian dossier handed over to Pakistan’s high commissioner in India reportedly containing evidence linking Jamaatud Dawa chief Hafiz Saeed to the 26/11 attacks. The foreign minister said earlier dossiers from India lacked significant evidence, but if there was new evidence in the fresh dossier Islamabad would examine it.

India to keep giving Mumbai attack evidence: report
NEW DELHI — India will keep providing evidence to Pakistan on last year's bloody attacks in Mumbai, a day after handing over fresh information on the siege, a report said Saturday.

"We are in continuous touch with the government of Pakistan," the Press Trust of India quoted Foreign Minister S.M. Krishna as saying.

"As and when we collect more evidence we will keep sending it across to Pakistan."

Indian Foreign Secretary Nirupama Rao on Friday gave Pakistan's High Commissioner (ambassador) Shahid Malik in New Delhi details on the attack including "input on some of the key aspects and accused involved", PTI said.

Krishna called the exchange of information an "ongoing exercise" between the two neighbours.

TSP will keep on killing Indians and GOI will keep on giving evidence. Ongoing exercise between pissful south asian neighbors onlee.

Remember why British hanged the freedom fighter Bhagat Singh and his colleagues without even a fair court trial?

Because he was using the court as a medium to spread his freedom movement messages through masses since the trial was being observed by journalists. He was becoming more popular every day. British realized this and ordered the trial to be conducted in "closed" house, with no journalists allowed anymore. At later stage, they even denied Bhagat Singh tobe appeared in court and asked the Judge to issue death sentence in his absence.

Now, we are not culture less animals like British. Are we?

In fact, since this trial the foreigners inside their hearts are full of admire and amazed about Indian society's tolerance and calm mindedness. Specially because, everyone knows ajmal is a terrorist and India is only stripping the MuNNa in front of his master(USA). So, the MuNNa is getting stripped in public and that too is something that his master(USA) can't avoid even if she wants badly to.

So, actually, USA has no other option other than supporting India in this court case because if USA tries to play this naked evidence(Ajmal Kasab) down then, she will be naked in whole world and USA's long-running bluff will be called off. This will be a PR disaster for USA amongst its brainy and feeble-minded NRI citizens who still believe in innocence of USA and who are kept conditioned to have a biased prejudice against their motherland(India). Also, of course, biggest blow will be that the USA's "fair and friend" image will be broken from Indians' minds.

So, USA has no other option than just jumping in game and playing it as "we helped India find the link to pakistan!!!" and take credits for it. Its like the FOX is in the BOX. :P

With one sword(Ajmal Kasab), India is cutting two friends(MuNNa & USA) against each other. :rotfl: :rotfl:

Ajmal Kasab is worth a 50KT nuke. I fully support the security expenditure done on his security.

American ambassador is embarrassed that why this court case is running so long. Their MuNNa is getting fried in world media. Now, every day some pak minister or PM needs to clarify their position on court case in India running on a pakistani. What a pleasure! :rotfl:

Folks - please don't fret and fight. I have been noticing a curious way in which things seem to pan out wrt to 26/11. Let me give you a possible explanation and to lift an expression from our erudite brfite Raja ram - please take my ramble FWIW.

India politicians need to be seen taking action to get the 26/11 culprits and theerfore they make a huge hue and cry about "dossiers and evidence" being given to Pakistan. These events are given gerat publicity by the media and ar seen and heard in Pakistan.

Pakistanis do not want to be seen as taking orders from India, and least of all Pakistani leaders do not want to be seen as kowtowing to India.

Every time India hands Pakistan some new titbi of evidence the first Pakistani response is denial at having received anything, followed by a study of he material and then an assertion that the evidence is not enough or that there is no evidence.

In public - this is all that happens. But there is definitely something going on in the background. To me the most significant thing that popped up is the nomination of a successor to Hafiz Saeed the boss man of the LeT. I suspect that in Pakistan there is no doubt whatsoever that they will be held responsible for terror in India and that responsibility is being supported by unkil. But Paki "authorities" do not have the authority to take public action against the LeT which has widespread support. Whatever Pakistan says in public - you can expect that exactly the opposite will happen in private.

This is part of Pakistan's seeming dysfunctionality but it is also part of the brilliant strategy that Pakistan has followed. The situation with the LeT for India is akin to the situation the US faced with AQ Khan. The criminal will only be restrained, not handed over.

Pakistan's biggest strength is that the people of Pakistan by and large support both the LeT and AQ Khan and will lynch any leaders seen as touching these icons. From India's viewpoint attacking the LeT will "release Pakistan" from any obligation to control terrorist groups because India would have taken that over. But as far as Pakistan is concerned India is already at war with Pakistan. Any attack on Pakistan only "proves" that this is correct. The effect is similar to Pakistan refusing to cooperate with the US is the US directly attacks Pakistan.

What the US is doing (and India to an extent) is to "use" the Pakistani government to squeeze the terrorist groups and the Taliban. This was not possible in the old "denial" days when the Paki governments would deny that anything was up. In other words the only thing that has moved forward in international relations with Pakistan is the gradual reduction in wiggle room for the Pakistani government.
Pakistani governments had a lot of wiggle room when governments would change at the drop of a hat. Each new government would make promises, not keep them and then move on to make way for a new government and a repeat of the same.

Perhaps the biggest change for India is cooperation with unkil, and a gradual realization on unkils part that Pakistan has been double dealing. Unkil has a Pakistan problem and India has a Pakistan problem. The policy that is being followed is to hold the Pakistani government responsible for all that happens in Pakistan and to force them to apply pressure on various groups.

What's in it for unkil to cooperate with India? If you set aside the theory that unkil needs Pakistan to control India, the unpleasant truth for unkil is that Pakistan uses the India excuse to avoid action on the nuclear and jihadi front, and unkil cannot pressurize India beyond a point - and this has become particularly difficult after 26/11 because the Indian public will maul a government that is not seen to be "doing something". So forcing India to go soft is not a realistic option for the US. So India and the US are falling into each other's arms - perhaps unwillingly, perhaps inadvertently. They are both cooperating to put pressure on the Paki government to act on jihadis. How the Paki govt acts is up to them but the net effect that should become visible is a decrease in Taliban activity as well as a decrease in anti-India terror. It remains to be seen if Pakistani groups and the Paki govt can wiggle out of this.

The best case scenario wrt Hafeez Sayeed can be his meeting his 72 and becoming shaheed hafiz saeed. He is too prominent for the paks to hand him over or even jail him.

Paki politicians and generals must cringe in their hearts of hearts each time they have to say some thing in public and then GUBO, but since they have been at it for like 50 years and longer, I guess it is the way of life over there and there is no shame associated with this aspect, as long as one is in power. the freudian explanation of the above is pakistan's penchant for maintaining echendee, even while it GUBOS quite freely.

WRT the current travails that pakistan faces with the US and Indian interests aligned and against it, is to hurriedly call off the WOT after doing the barest minimum possible. An extension of this could be that if pakistan is pressured beyond a point it will 72-ise the ultimate prize OBL and others so that the GWOT can be said to be officially over.

I guess unkil knows this and does not apply pressure beyond a point, since unkil is here for afghanistan and CAR not GWOT. From the Pakistanis POV, they can see the green grass at the end of the dark tunnel already if they take some basic steps.

So a 'Shaheed' Hafiz Sayeed memorial in muridke might not be too far off.

Interpol set to issue Red Corner Notice against Hafeez Saeed
Government sources said that the CBI, which acts as the nodal agency for all dealings with Interpol, has already written to the world police body, based on the 26/11 chargesheet, to get an RCN issued against Saeed who was let off by the Lahore High Court as Islamabad didn't press charges against him.

Interpol issues an RCN against any accused after it receives all information and evidence against him from the country in which the crime has been committed. "The RCN will be issued on the basis of the non-bailable warrant issued against Saeed by a Mumbai court earlier and also all the evidences gathered against him by the Mumbai police. These have been handed over to the CBI to let the agency take up the case with Interpol,'' said a source.

According to the evidence provided by India to Pakistan, which Islamabad has conveniently ignored till now, Saeed motivated terrorists to attack Mumbai and was also involved in their training.

The Mumbai police have said that Saeed was among the 35 people who provided training to all the terrorists who executed 26/11 between 2007-08 at Muridke, Manshera, Muzzafarabad, Azizabad and other places in PoK. Ajmal Kasab, in fact, had admitted in his confession before the Mumbai police that Saeed personally saw the terrorists off in Karachi a few days before the Mumbai attacks.

Sources said that a Blue Corner Notice, which is meant to collect additional information about a person's identity and activities in relation to a crime, was already in place against Saeed. The RCN, once issued, can prevent Saeed from moving out of Pakistan.

An RCN, however, is not an international arrest warrant and Interpol cannot force Pakistan to arrest Saeed.

Not sure about the Taliban activity but one cannot help but notice the fact that since 26/11 there is no terror strike in India.
Its 9 months at a stretch.

It would be interesting to observe if there were any longer gaps in recent past (say, last 10 years or so)

Ajmal killed Ombale, says ballistic expert
Deposing before the special sessions court, Vasudev Patil of the Kalina Forensic Science Laboratory said the two bullets recovered from the body of Assistant Sub-Inspector Tukaram Ombale were fired from his AK 47.

The ballistic finding invalidates Ajmal’s claim made on July 20 that he was not responsible for Ombale’s death.
