Pakistan seeks extradition of Kasab to stand trial at Adiala and also wants Indian magistrates to testify
Pakistan on Sunday formally sought the custody of Ajmal Amir Kasab — the lone surviving terrorist from the 2008 Mumbai attacks — and requested Indian magistrates to testify in the Rawalpindi trial of seven Lashkar-e-Taiba men charged with involvement in that crime.

Besides, the Interior Ministry wants India to allow the metropolitan magistrates and police officials who recorded Kasab's statement to appear before the Pakistan courts

Indian officials on Sunday reacted cautiously to the Pakistani request for the Mumbai magistrates and investigating officer to testify before the Rawalpindi court. Asked by The Hindu if this was a step forward, a senior official said “Maybe.” “There are too many moving parts [right now] to take a call.” He said it was a potential step forward but one could not conclude that with certainty yet.

Senior lawyers said India could consider Pakistan's request if the magistrates concerned were prepared to be examined as witnesses voluntarily.

Shanti Bhushan said if Kasab's confessional statement implicating some other accused facing trial in Pakistan required corroboration as per Pakistani law, India could consider such a request. P.P. Rao said the law allowed for such evidence to be provided in writing as well.

The Pakistani dossier and request comes on the eve of the SAARC summit in Bhutan, where Prime Minister Manmohan Singh is likely to meet his Pakistani counterpart, Yusuf Raza Gilani, on the sidelines.

More Indian reaction to Pakistani request
Senior advocate P.P. Rao said: “Neither the Government of India nor any other government in India can compel a magistrate who has recorded the confessional statement of an accused to appear in a court. What no Indian government can do, the government of a foreign country cannot do. Therefore, the Government of Pakistan has no jurisdiction whatever to compel magistrates in India who recorded the statements made by Kasab to appear in a Pakistan court as prosecution witnesses.”

However, if the magistrates were prepared to give evidence voluntarily, the Rawalpindi anti-terrorism court could send a list of questions to them and get their answers.

Mr. Rao said that if the Pakistan prosecution wanted to cross-examine the witnesses, even that could be obtained in the form of question and answers, and such an exercise would be permissible under the law.

Senior advocate Rajeev Dhavan, however, said: “The question of a Pakistan court examining our judicial magistrates does not arise. Ajmal Kasab has given a confession before a judicial magistrate in judicial proceedings. When this is the position, how can you interrogate a judicial officer as a witness?”

Dismissing the Pakistani request as “diplomatic posturing,” Mr. Dhavan said that under Indian law, no judicial officer can be subjected to cross examination in a court. What could not be done under Indian law could not be permitted under Pakistani law, he added.

Former Union Law Minister and senior advocate Shanti Bhushan said Pakistan's request could be considered if the magistrates volunteered to give evidence.

He said that if Kasab's confessional statement implicating some other accused persons facing trial in a Pakistan court required corroboration as per Pakistani law, then India could consider such a request.

“Failing to do so might result in acquittal of the accused implicated by Kasab, and there is the possibility of Pakistan blaming India for letting off the accused,” Mr. Bhushan said.

Advocate Prashant Bhushan also said that though there could not be any compulsion, if the magistrates concerned were prepared to be examined voluntarily as witnesses, then India could consider the request.
Indians have to learn. Pakistan has absolutely no intention of pursuing the 26/11 case with any seriousness. It is simply putting the ball back on our court by making untenable demands. Rehman Malik says that Pakistan has 'replied to every dossier that India has sent'. India does not want replies, it wants action which is not forthcoming.

Just before SeS, Prof. Hafeez Saeed was claimed to be under house arrest. Later, we knew he was under protective custody for his own safety. He was claimed to have been arrested for his jihad speech and collecting funds. He claimed that jihad was part of Islam, as we predicted he would say here in BR, which effectively shut everyone's mouth. Nothing was known about collecting funds for jihad, which is prohibited in Pakistan. In any case, no case was filed against him anywhere in Pakistan for these two offences. It was all a drama and our India team fell for it for the umpteenth time. Now, another drama is being enacted and our eminent lawyers, except Rajeev Dhavan, are pulling their hair out. However, if India wants to wilt under US pressure and start the dialogue, these six dossiers offer a perfect alibi. That's a different matter.

Kasab's crime is in India and he is on trial in India. What is his offense in TSP that he needs to be extradiated?
As for subpoenaing Indian magistrates TSP has no locus standi and is doing drama bazi.

I think it was Jihadi Sethi or Jihadi Haider who speculated way back that sooner or later US force India to resume dialouge with TSP, and India will keep bringing up Mumbai, and TSP must "manage" India's protests deftly. And this is exactly what TSP is doing to perfection. Their predictions have been right on.

With some minor pressure from US, TSP is going through some motions, but it has absolutely no intention of doing anything that India is demanding or whatever is needed. One can never prove these things (unless a nation has an over-reaching media like US which serves its interests through propaganda), but does anybody have an iota of a doubt, that TSPians, to the Abdul on the street feel triumphant over pulling off Mumbai? Under the circumstances, how can any govt in TSP, US pressure or no, make any move against an LET that is so popular with the public? Only a military defeat, like what US inflicted on Nazi Germany or Japan, or India on TSP in 1971, will force TSP to do the needful.

Bereft of US pressure, TSP wouldn't even be going through these gimmicks; they would have said Kesab is not a TSPian, Mumbai was executed by Col ProHit or some other insulting characterization. And US pressure won't mount beyond current level for all the reasons we have discussed. And to rub salt to India's wound, US wants India to give something to TSP as well. So thats where we are. MMS wants some political cover to acquiesce to orders from Washington and to execute his own vision of "South Asia", and TSP is doing what it can without giving or even appearing to give an inch. Truly disgusting state of affairs.

Since the crime was committed in India, why don't the Pakis simply give access to Hafiz Sayed or Zaki ul Rehman. simple No? the Truth is neither Pakis intrested and neither are US, UK, EU, CHina and Saudi Arabia, the stakeholders in Pakistan willing to Armtwist them to cooperate with 26/11. for these folks some dirty brown infidels died - Yes for these foreigners- ALL Indians of all religions are SDRE Hindu scums only.

Pleading for justice in international arena is nothing but sign of pathetic weakness,both mental and physical. We cant blame or expect other to do our dirty job beside Why do we keep forgetting that Pakis are master's dog and dont act without permission or dont crosses line without nod from above. Onlee solution is to kill the dog instead of pleading pretty please to Paki Patrons and keep killing till dog not left any more. I am not angry with Paki at all , they are acting normally under the rules of mortal enemity, dissapointment is onlee with our own leaders, politicians and DIE elites whose smuggness,stupidity and inaction keep sucking Indian vitality every second.

Heard Ms. Nirupama Rao on the TV after the Thimpu meet. She said that PM Manmohan Singh did bring up the issue of Prof. Hafeez Saeed. Gilani replied that they have some difficulties in the judicial process. That is the end of the story. Now that India has decided to look forwards and not backwards, per Ms. Rao, isn't it time to close the thread ?

I second that.

On a different note, I can't help but wonder about the plight of poor Judge in Mumbai, who anyways is running the risk on his life by actually conducting the hearing on Kasab, now he must be having sleepless nights contemplating the possibility for him to travel to Pakistan to appear in front of a Pakistani Judge...

400 % agree.

As predicted on 27/11/2008 itself on BR, the Mumbai terror plot will end with a pappi-jhappi and no punishment to pak and we will continue the farce till the next more spectacular attack.

Pakistani PM Gilani apparently told our PM at Thimpu, when the question of Prof. Hafeez Saeed raoming about freely in Pakistan was raised, that there is 'some judicial difficulty' in Pakistan in charging Professor Hafeez Saeed. This is one of the biggest lies that Pakistan has peddled. The Islamic Republic of Pakistan, the Pakistani judiciary, and the Pakistani Army are complicit in this. If one looks at the history of arrests and releases of Prof. Saeed since circa 2002, the utterances of various Pakistani Ministers, the revelations made by arrested terrorists and the UN declaration of Prof. Saeed as a terrorist, one can clearly see the perfidy played by Pakistan.

The only reason we may keep this thread for a little longer would be because of two reasons: one, the Mumbai court verdict is still not out and two, we have been meticulously following the developments in Pakistan on their part of the trial and their fraud. The Pakistani fraud is still on-going and this thread is a good repository of that.

Mumbai: Mohammed Ajmal Amir Kasab, the lone Pakistani gunman arrested during the 26/11 terror attacks, may seek treatment for a stomach ailment after the special court gives its verdict.

Kasab is said to be suffering from hiatus hernia (the protrusion of the upper part of the stomach into the thorax through a tear or weakness in the diaphragm). He also complains frequently about stomach ulcers.

Although it isn’t confirmed whether he will have to undergo surgery, a special, high-security room at JJ Hospital, Byculla, has been kept ready since December 2009. “A vacant ward on the third floor of the ophthalmology department building has been prepared,” a senior doctor said.

Dr TP Lahane, dean of JJ Hospital, however, denied that Kasab required surgical intervention. Three doctors from JJ Hospital have been monitoring Kasab’s health. “We have not been advised on any surgical procedure for Kasab so far,” he said.

Kasab was earlier admitted to St George Hospital for a week after he complained of chest pain. “He eats small portions at regular intervals. If he overeats, he vomits,” said a senior police officer on condition of anonymity.

If the verdict goes as it should, namely Kesab is guilty, I won't be suprised if US and its mouthpiece media followed by western alackeys do equal equal: "India and Paaaakistaaan bring perprtrator of Mumbai carnage to justice". Ultimate kick on India's gut if any is needed.

Two Indians are also standing trial along with Kasab. They are charged as accomplices.

Kasab Guilty.. Sabauddin and Ansari acquitted. No punishment till tomorrow.. WTF.. Why can't they pronounce the verdict and punishment together? Why extend this ordeal by one more day?

If he gets the noose,then it should be a public spectacle,held in Bombay,to show the world that whoever wages war against India ,especially its innocent people,will get their just rewards.His remains then should be disposed of beyond the 12nm territorial limit of the country so that it does not contaminate the motherland.If we throw it into the Paki High Commission,they might erect a monument to him back in the pigsty,so returning him "home" shopuld be avoided like the plague.

1.Residents of Faridkot, home to the alleged surviving gunman of the Mumbai massacre, deny any connection with their wayward son but believe India should release him in the interests of peace. {Where is the peace brigade. Let's have peace.}

2.The day before the sentencing, a hawker distributed a weekly newspaper published by Jamaat-ud-Dawa, which Indian and US officials believe is a front for the Lashkar-e-Toiba militant group blamed for the Mumbai attacks. {Only India and U.S believe. This reporter don't believe such stupidity}

3.With Faridkot's wheat harvest in full swing,{PROSPEROUS WORKERS} workers loading grain into vehicles to a din of folk music {Something infidel in here. Remnants of Infidel India. :eek: Need to stop this to reach completeness of a peliever} said they were sympathetic to Kasab's "good intentions" against an "enemy" country.

4.Residents said they would denounce any sentence India hands down to Kasab.

Kasab should be kept alive for atleast 5 years. I have an uncomfortable feeling that we dont have the complete story from him. Future developments, like capture of people due to Headley's singing might mean that we have to interrogate him further. A solitary confinement would do nicely.

TSP is too smart for us, and especially with its 3.5 doing equal equal, keeping Kesab won't serve the intended purpose. Plus, with MMS ever so keep to make love to TSP, and elites like Raja Mohan urging him to set a scorching pace in delivering Kashmir so scared that TSP will beat the pulp out of us through more Mumbais, 26/11 is already a footnote. I think it be best to hang the MOFO and offer his body to the TSP high-commission and humiliate them. Itg may be a miniscule victory, but thats about all we can hope for the moment.

After the Headley arrest and plea bargain charade its clear that the 26/11 attack was based on his and Rana's scouting. These two locals could have doen the same but their inotus were secondary to the attack. The judge is a modern day Vikrama. He has avoided the Afzal Guru situation.

My Macaulay trained mind would have called him a modern "Daniel"!

The charge against Ansari and Sabauddin was that of helping with the Mumbai attacks by providing maps of the targeted areas. Ansari was accused of creating the maps and handing them to Sabauddin, who was based in Nepal. The latter was accused of passing these maps on to his LeT contacts.

The case against them rested on two primary pieces of evidence.
a. A witness called Nooruddin testified that he was present when Ansari handed over the map to Sabauddin in Nepal.
b. The map was found on the body of Abu Ismael, the terrorist who was in the Skoda with Kasab and was shot dead at Girgaum Chowpatty. This map was found to be similar to the one found on the person of Ansari when he was arrested.

The judge acquitted Ansari and Sabauddin on these charges since he found the evidence to be not conclusive. Essentially, the prosecution could not prove that the witness, Nooruddin, went to Nepal. Second, the map found on Abu Ismael's body was not soiled and did not have any blood stains on it, despite the fact that the clothes of Abu Ismael were blood soaked. Thus, the defence's contention was that there was reasonable doubt about the map being found on Abu Ismael's person. And the judge accepted this argument.

There is a case pending against Ansari and Sabauddin in Uttar Pradesh related to the attack on the CRPF camp in Rampur in 2007. Hence, they are not going to be released any time soon. They will be transferred from Mumbai to UP. Further, the prosecution has announced that they will be appealing the acquittal.

No offence to Ujjwal Nikam and others who worked hard to bring Kasab to justice. However, it looks to me the whole investigation or prosecution seems to be like a big joke. I just cannot believe that these Kasabs and other TSPites can just come to Mumbai and achieve such a huge thing with no local sleeper cell support.

We simply did not convict any one Indian which is a new achievement on its own. The breastbeating of "greatest achievement" continues in both print and TV. The prosecution did a good job of 1993 blasts though it took them 25 years. I may differ from many here but to me this is a new low.

Another new track of investigations are going on - Link all masjid blasts as done by some kind of Abhinav Bharat. it started off from malegaon. Now Ajmer. The latest is Ajmer and Hyd's Jamia masjid are linked. Wait for few more months, all the Khalids and Abduls arested for Hyd, Ajmer blasts will be released and replaced by some good Mil.Intel folks, sadhus and sadhvis.

Basically, the rule of thumb - no arrests/convictions of IMs whatsoever. Period.

Time is given for the defence counsel to go through the verdict and prepare any leniancy pleas. This is a normal court procedure. In many cases the judges do ask the accused whether he/she has any thing to say about the verdict, or want to claim leniency on any grounds (the usual stuff being, aged parents, commited crime at young age etc.).

The quality of DDM journalists is so pathetic to describe in words. I was listening to NPR on my drive back home where the host interviewed one dorkette from Mumbai mirror or some such rag. She apparently survived the assualt on the Taj. Now apart from her poor English, which is OK, but when asked if Kesab's conviction brings closure, she was rambling about how Mumbai has no chocie but to move on. Nothing about the real perpetrators in TSP, nothing about TSP cocking a snook, nothing. Just rambling BS.

Kasab will be kabab.No Q about that.The problem as many friends in the legal world tell me is that the FRIs are so poor sometimes,with huge loopholes either be design or incompetence,that there is genuine doubt in the minds of the judge whether the evidence is accurate.Our system is such that if there is reasonable doubt then the accused is judged to be innocent.Let's leave it at that.Sometimes a few guilty get away,but it also means that the innocent too get relief.We have had reports of umpteen occassions when police evidence is fabricated just so that they can declare a case closed.

While the "kebab" must be "cooked",a point to ponder is that he is the only living soul who can pin the masterminds of the diabolic plot,because he knows their faces and is a mine of info on the entire conspiracy.Kasab the kebab merely pulled the trigger ,killing dozens thoug he did and must pay for it,but the masterminds must also be brought to justice in similar way that the murderers of the Israeli athletes at Munich were so despatched.There can be no compromise on this.The swine in Pak who were the chief perpetrators of the Mumbai massacres must be eliminated with extreme prejudice.Pak must be taught a lesson and therefore while Kebab Kasab must similarly be despatched,let us let the sword hang over his head untilw e have extracted every last drop of info about him and use him in PR events to tell the world who in Pak were responsible.He must name them and the international community must act upon his info.If Gen.Noriega can be so esily exrtradited by the US to France on mere drug dealing charges,then why can't the US extradite Gilani/Headley and likewise Pak dawood and Co.,plus the heads of the LET,etc. waging "war" (without any Geneva Convention rules)against India?
