Do lawyers get punished when they are caught lying in the court? Or when it is apparent they tried to misguide the course of justice or evidence submitted was false?

Anand said he has been a defence lawyer in both criminal and civil cases for nearly three decades, and together with his son also ran a charity that offers free 24-hour legal advice
Sharma has had a history of taking on the higher judiciary. Among the cases he has argued is a public interest litigation inquiring into the assets of a former Supreme Court chief justice and another against a sitting chief justice of the top court, both of which were thrown out.

Not only was his case against the chief justice S.H.J. Kapadia arguing that there was a conflict of interest in a high-profile tax dispute involving Britain-based Vodaphone Group rejected, he was fined 50,000 rupees ($909) for wasting the time of the court.

A Supreme Court lawyer working on behalf of the government said Sharma was "notorious" for being an excessive litigant. Under Indian law any citizen can file a public interest litigation and the latest Sharma is fighting is one against a government decision to allow foreign direct investment in retail.

"My fight is against corruption whether in government or judiciary," said Sharma. "I can see the same thing happening in this case. There is public pressure, the politicians are pressing the police. The evidence will not be evaluated, innocent people will be fixed."

Lawyer A.P. Singh, who will argue the case for Vinay Sharma, a gym assistant, and Akshay Thakur, a bus cleaner, recalled that when he went to prison to meet his client, the accused begged him to save him

I wouldn't get worked up over the school shooting response in USA vs India. It is all just for show and political theater. Nothing will come of it because 55% of American support unlimited gun rights, upto and including RPG's & SAM's if possible. There are folks who have fully operation tanks and howitzers and atleast a few with 88mm self propelled guns with ammunition in their arsenals. Too much money and too much enjoyment in blowing up stuff.

Ramana, this human trafficking is not limited to buyers/sellers at Delhi, it is an India wide problem. Several of the kidnappings take place in long distance trains. A child kidnapped in a city/town has a better chance of getting tracked back compared to a kidnapping in a train. A kidnapping conducted in the night- before the parents realize kid might be gone 100's of miles, before the police swings into action (if at all they act). Jurisdiction problem comes into play, just like the responsibility of a floating dead body in the river was passed down to different police stations (really happened in Kolkata). Very difficult times for Indians.
Also we ignore the VIP culture in Big cities like Mumbai and Delhi. With VIP's/politicians floating in crores, women are routinely bought/ sold for short periods of time. For eg the police commisioner of Mumbai in 2006 is in record, having said that about 40% of TV actresses were in flesh business. I know from my sources in Bollywood, of a 90's actress being a "one year keep" for different businessmen. It may be on consent in this case, but we should not underestimate a huge underground market for buying and selling women (and men).

Delhi gangrape: Brutal juvenile gets tagged as 'minor' by school principal, may evade harsh punishment
The school principal of the juvenile accused in the December 16 gangrape case today submitted before a Juvenile Justice Board that as per the school records he is 17 years and six months old.

The present and the former headmasters of the school in Bhawanipur at Badaun in Uttar Pradesh, where the juvenile had studied till Class III, appeared before the Board presided over by Principal Magistrate Geetanjali Goel and told her that they cannot identify the boy but know that he took admission in the school in 2002.

The former principal said during the time of admission, the boy's father had come to admit him and mentioned his date of birth as June 4, 1995.

He further told the court that they never ask the parents to give the child's birth certificate as age proof during the time of admission in the school.


"We take this as the official record and later on follow the same throughout the academic session, so it could not be doubted," the Principal said.

Taking note of the submissions made by both the school Principals, the court has now fixed January 28 as the next date of hearing in the case.

The legal aid counsel for the juvenile advocate Rajesh Tiwari, however, told media persons outside the court that on the next date of hearing in the case the Board will hear arguments to decide the age of the juvenile and will thereafter give its verdict whether he is a major or minor.

Some time back didn't a politician from congress talked about naming and shaming rapists on internet database, then what is the problem in publishing photos of these 5+1 criminals?

The incident was reported to Ghazipur police station in east Delhi January 9 when the victim managed to flee from the clutches of the accused, identified as Zakir, who bought her from a man with whom she had come to Delhi from Karnataka Jan 6 after being promised to provide a job here.

A police officer said that Zakir raped the woman many times.

"Zakir had also beaten her up. He along with his woman associate, Geeta, was contacting some clients in Mumbai and Pune to sell the victim. Meanwhile, the victim managed to give them a slip and reported the matter to police," said the officer.
"After the deal got fixed, one of the trafficking gang members took the victim to Delhi via train and the victim was handed over to Zakir at Hazrat Nizamuddin railway station where he was already present with Geeta," the officer added.

During questioning, the accused revealed that a few days ago they had sold a 23-year-old woman at Delhi's GB Road brothel No 57.

"This woman was also rescued Monday and the brothel owner, Mumtaz, was arrested," the officer added.

Uttar Pradesh chief minister Akhilesh Yadav on Sunday gave a cheque for Rs. 20 lakh to the victim’s family.

He also promised to bear the education expenses of the victim’s brothers.

The Delhi govt has announced financial help of Rs.15 lakh. It also plans to provide a free flat to the family in Delhi.

Delhi BJP president Vijender Gupta has given a cheque for Rs.5 lakh to the victim’s family.

The institute in Dehradun, where the victim studied, has promised refund her course fee — Rs. 1.80 lakh.

The institute has also offered free education to her two brothers

He said that photos and other details of CONVICTED RAPISTS would be published. As of now, none of them are convicted.

Moreover, it was probably just a campaigning tactic and no photos/details of any rapist will ever be published. Obviously, most voters would have forgotten he didn't deliver on his promise, but would continue to support him because they liked his idea at the time and raised his "value" within their minds at that time. The only way for that "value" to be countered would be if they realized he didn't fulfill what he said he'd do..

Rapist-killer gets death in 10-day trial


NEW DELHI: Ten days after being set up to try cases of sexual offences against women, a fast-track court in Dwarka, west Delhi, on Tuesday gave the death sentence to a 56-year-old farmhouse guard for raping and killing a three-year-old girl in 2011.

This was the first sentence handed out by any of the fast-track courts set up in the capital after the Nirbhaya gang-rape.

Terming the crime as "most diabolic and gruesome", additional sessions judge Virender Bhat sent the accused, Bharat Singh, to the gallows, saying the case fell in the "rarest of rare" category. The victim had died while she was being raped and her internal organs had come out, the court said.

"There is a steep rise in crimes against women, particularly minor girls. Time has come when the courts have to take a stern view of such crimes and inflict harsher punishment possible upon the perpetrators... so that a stern message is sent to society," the court said.


On April 10, 2011, the girl was returning to her house in Kapashera in southwest Delhi when she strayed towards the farmhouse. The girl was called inside by Singh, who was alone on duty, and was raped by him, the prosecution had said.

But he’s quickly gaining notoriety for the controversial statements he’s made about the case, in which a 23-year-old woman and a male companion were attacked on a moving bus by six men. She later died from injuries from a gang rape.

“This all happened because of the lust of the boy. This is the boy who should be hanged,” Mr. Sharma said during a telephone interview on Thursday. “He’s responsible for everything. He should be punished.”

^did the gods ever saved the country earlier? had so done, we would not have been in this current mess up. our gods and their gods, and all gods have left for good. what is left out is only an evil setup. if we need those gods to come back, we need serious revamp and sanitize the whole country.

These criminals and rapists needs surgical castration rather chemical, before even they are put on trial. First eye-for-an-eye, then the democracysuppression regime games can kick in. Girls and women must be encouraged to carry pocket knives, and perhaps given situation may take on one-one direct when these monsters pull out their whangs and whack it! gone in one chopper!, ..and continue to hold the knife and dare the subsequent mauler. NGOs and self defense organization must start these trainings for girls right from middle school /home schools.

Now I agree that Shive sena plan to distribute 20000 Rampuri knives on birthday of Thackrey senior may be right, girls must learn self defence, be on maximum alert and carry weapons. Regarding physical castration I am sure govt is worried about genitals of Rahul Gandhi who is involved in one such case.

14:24 Delhi gang rape prime accused to move Supreme Court: Just in: Prime accused Ram Singh in the rape and murder of the Delhi physiotherapist will move the Supreme Court seeking for the trial to be moved to any state out of Uttar Pradesh. His lawyer says Ram Singh fears he will not get justice if the case is tried in UP. The court will now hear the case on January 21.

^^ The accused is moving supreme court so that case is heard in courts out of Delhi and UP (as he will not get justice) , wow..! Surely they are hardened criminals and why that lawyer is not being lynched?? Why SC doesn't take case under its fold and deliver justice within 30 days also marathon of HC etc will be saved?? Is Altamas Kabir there to speak in favour of criminals only??

You don't need new laws. You just need them to be implemented in order them to work. Post 16/12. People have little patience for BS in these cases. I hope that the people in this country remember what has happened and why it has happened. Only then will things improve.

One of the defence team, A.P. Singh told reporters that his client Vinay Sharma, a gym instructor, had been badly beaten up in jail by fellow prisoners and was in agony when he appeared before the district court on Thursday.

"Vinay Sharma was badly tortured in jail by other inmates who pounced on him. He was not in a position to stand up in court because he was in great pain," Mr Singh said.
Am so happy to read this. I hope they are being sodomized and tortured to the point, in Tihar , that they beg for hanging.

In cases like these where state failed to protect a potential bread winner for family, where victim's education was sponsored by selling land and working 2 shifts in a day, compensation is justified (IMHO). That picture tore my heart. I am almost in tears now. That home looks so similar to some of my close out of state relatives. I was involved in marrying off one such girl who worked her way up in the education (and economic) chain.

It really really makes me depressed to think it could have been her that we were reading about :x :x :x

Where is the hangman's lever? I volunteer to pull it for these mother*$(I$#$# rapist pond scums!

this is my concern.. we have taken a reactive route to democracy rather proactive... in the sense, we are not complete yet, meaning half democracy state. we are still suppressed by the ruling class. the majority is still corrupt, and like corruption to sustain.

As the days and weeks are passing and the father of Delhi gangrape victim is gradually emerging out of the grief, he is transforming into a champion for people's cause.

He has said that his daughter's last wish to bring development in his village would now be his own last wish.

"I had no control over what happened with my daughter. But since she often used to say that she wants to open a hospital in the village, I will try to meet UPA Chairperson Sonia Gandhi and Prime Minister Manmohan Singh to say thanks to them for all the support that they extended to me during this crisis hour and demand a medical college in the village", he said.


He will board Shramjeevi Express from Buxar Railway station on Friday for New Delhi.

"The girls of my village travel for 20 to 40 kms to reach a college. This was one of the reasons behind my decision to shift to Delhi 25 years ago. My daughter would have been alive if there were good schools and colleges in the proximity of the village. Since UP government repaired the roads in the village and ensured development during my stay in the village, the villagers have fixed great hope in me. So I will do anything to bring a medical college in the village. I also want to demand from the Central and the State Governments to open a university in Ballia for those who were interested in higher education", he said.

He also wants his younger son to become a doctor and work in the village for at least five years.

"Chief Minister Akhilesh Yadav has announced opening of a Primary Health Centre in the village. RPN Singh, founder chairman and managing trustee of The Indian Ocean Medical Institute Trust of Mauritius was in the village on Wednesday to express his condolence. He praised the sacrifice of my daughter and offered a free medical seat to my younger son in Sir Seewoosagur Ramgoolam Medical College, Mauritius. The pre-condition is that my son clears his class 12th examination with 60 percent marks and gets a no-objection certificate from the Medical Council of India. The medical college will not charge any fee from him. I have promised him that my son will serve in the PHC of the village for first five years", he said.

Singh's ancestors had migrated to Mauritius a century ago from village Sonadih in Bilthara Road area of Gorakhpur district in the neighbourhood of Ballia.

"Anil Kumar Bachoo, Vice Prime Minister of Mauritius also talked to me on phone when Singh was in my village. He assured me every support in future", the father said.

He said although he is an unfortunate father, whose daughter was brutalized and thrown out of a bus to die, he was also a proud father.

"My daughter has been adopted by entire world after her death. The Delhi government has promised admission in engineering college to my elder son and now Mauritius governments is ready to give admission to my younger son in medical college. Although I cannot leave my job, now I am also thinking to join the protest against the incidents of rape in the Country. My elder son also wants to join the protest in Delhi. We don't want this flame to die so easily. We all need a law which deals with such cases very harshly", he said

Not really the statement should be "SC accepts the plea to consider the juvenile as an adult"

US system interests me. Looks like a sense of ownership is introduced to each town, city, county and the state. If cities want better security, pay up the taxes and plan to have a city police. If they want a fire brigade, same is the approach. At the state level state collects taxes and have state wide police forces and fire brigades. Counties have an elected official as the Chief of Police (Sheriff). Bad performance, the Sheriff can look for another job next time. A kind of one central government being the father, and the state government being the mother (like we have in India) I feel requires a change. These are two huge bodies, and shirking responsibilities become much easier.

A similar anomaly exists in pretty much every job in civil service. A Village officer, can at the maximum reach the level of an RDO (who is junior to the District Collector). All these follow the British pattern of governance, and the separation exists. I guess this is applicable for pretty much in every job profile which has an "Indian xxxxx Service" cadre associated with it. The Army also has a similar concept where a jawan can become a Subedar Major at the most. Then they have the Hon. Commission system, which is equivalent to the "Conferred IxS" status which is used in the civil service.

Two states in the south have a "State Service Cadre" these days. Karnataka has her own "Karnataka xxxx Service" cadre. Recuritment is based on a style similar to UPSC exams. Postings generally happen as RDOs (in Admin) or a Dy.SPs (in Police). These are all sub-divisional postings. The flip side of this arrangement is that local level politics etc. would start influencing these jobs as well. A myth perpetrated around the "IxS cadre" is that they may not be so easily influenced by local politics (and thus become more efficient and impartial). Kerala does not have this scheme, and it is more promotion based. A Sub Inspector would pretty much become a Dy.SP with around 18 years service, and then can even be promoted as Supt.of Police but will not hold L&O charge of a district.

At this point I feel that many of the British introduced systems now needs a total revamp. The system worked fine when British ran the show, but now we need Desi versions of the same. A bottom-up approach may be better.
