Another victory for India as China declares Pakistan Occupied Kashmir (PoK) is a part of India

https://postcard.news/another-victory-f ... -of-india/

Finally the best friend of Pakistan “China” has even accepted that Pakistan Occupied Kashmir (PoK) is a part of India. In a significant move China’s state run television China Global Television Network group (CGTN) part of the China Central Television, based in Beijing has portrayed Pakistan Occupied Kashmir (PoK) as part of original map of Jammu and Kashmir which has been a long standing demand by India for decades.

The picture of the entire state of Jammu and Kashmir by China’s state run television was displayed while reporting the terror attack on Chinese consulate last Friday. This move of Chinese Television has come as a surprise for the whole world. Being a good friend of Pakistan and always standing like a roadblock in the way of India, China has turned tables this time by favouring India. But it is suspected that it could be a deliberate attempt by the Chinese Government.

Although there is no confirmation on it yet, whether it was pre-planned move or not as China very well knows it can affect its relation with Pakistan. It may draw reaction from Islamabad and the Pakistan Army. It will also have implications for China-Pakistan-Economic-Corridor (CPEC). India has strong reservations on CPEC as it violates its sovereignty. CPEC is considered as the most important connectivity link under BRI.

Apart from that it is also not good news for Pakistan which is facing the worst crisis ever. It is begging door to door for the financial aid. It has approached International Monetary Fund (IMF) for a bailout second time in five years.

America has too snubbed Pakistan and has stopped all the financial aid it was earlier providing Pakistan.A week ago only The United States of America scrapped off USD 1.66 billion security assistance to Pakistan. “The US has suspended USD 1.66 billion in security assistance to Pakistan after President Donald Trump’s directive”, said the Pentagon. This move came soon after Donald Trump had issued a statement saying, “Pakistan doesn’t do a damn thing for the US”. Earlier, President Trump has also alleged that the Pakistani government had helped Al-Qaeda chief Osama Bin Laden and provided him a hideout at Abbottabad.

Prime Minister Imran Khan who has visited China earlier this month looked hopeful after his return. While addressing the Pakistani Media he said Pakistan has received a ‘big’ package from China.Although Prime Minister Imran Khan is quite hopeful for getting the financial assistance from its so called friend China but current scenario depicts a different story.A week after Imran Khan made statement regarding big package from China the Chinese consulate was attacked in Pakistan and now China run CGTN television has shown PoK as part of Jammu & Kashmir. It clearly signals China is not happy with its so-called ‘friend’ Pakistan.

Cleaning of river Ganga got a major boost when the engineers in Kanpur finally got rid of waste from Sissamau Nalla, diverting it to Jajamau sewage treatment plant. The drain was reputed to be Asia’s largest and is about 128 years old.

‘Namami Gange’ Lifts 128-Year Old ‘Curse’ On Holy River: Discharge From Asia’s Largest Sisamau Drain Comes To A Stop
The River Ganga. (pic via Facebook)
In what is being hailed as the biggest victory yet for the ‘Namami Gange’ project to clean up the Ganga, 14 crore litres of sewage which used to be released into the river from the Sisamau drain every day is now being successfully diverted to the Jajmau treatment plant, reports Live Hindustan.

Sewage from the drain, which is reportedly 128 years old, used to be dumped into the river through the Bhairo Ghat. While 8 crore litres of the sewage had been successfully routed earlier, routing the remaining 6 crore litres proved to be an arduous task. However, this has now been achieved by Uttar Pradesh’s Jal Nigam and Namami Gange engineers.

The report states that engineers and their pumping machines were stretched to their limits in trying to control the flow of the sewage due to the velocity of the drain. The entire effort had been made more difficult due to an existing pipeline and a British-era drain obstructing the way.

Cleaning up the Ganga has been among Narendra Modi government’s top-most priorities with the ‘Namami Gange’ project having been launched for this specific purpose. Union Minister Nitin Gadkari had earlier announced that the project will be finished by December 2019.

A record leap: LPG cylinder now used by 89% households in India

NEW DELHI: Nine out of 10 Indian homes now use cleaner cooking gas, a record improvement over just about five in 10 homes four years ago, as a result of the Modi government’s relentless effort at popularising cleaner fuel and subsidising subscription to poor families.

State oil companies, pushed by the oil ministry, have added record 10 crore consumers since April 2015, expanding the active consumer base by two-thirds. This has increased access to cooking gas, or liquefied petroleum gas ..

Rural electrification in full swing, connecting 7 lakh homes a week.

Rural electrification is galloping ahead with power lines connecting about 7 lakh homes every week as authorities are working overtime to ensure that every household that wants electricity should be linked to the grid by December 31.

The rapid growth is generating demand for electricity, which is good news for power plants because many are running below optimum capacity. It is also expected to significantly improve the quality of life in underdeveloped regions, apart from stimulating demand for bulbs and appliances.
Of the 3.56 crore households that were not connected, 2.1 crore have been electrified.

Experts said, within a year, the newly connected households will contribute significantly to power consumption because of pent-up demand in many regions and fresh rural demand.

“Electricity consumption growth has been robust in the last few months, also aided by growth in household electrification and reduction in power cuts,” Feedback Infra founder chairman Vinayak Chatterjee said. This would require fresh investment in power generation to meet future demand.

The International Energy Agency (IEA) recently said India’s move to energise every village in the country with electricity was one of the greatest success stories in the world this year. IEA, the global energy watchdog for the developed world, said such initiatives improve productivity that enhances economic well-being. It can also spur innovation which can boost micro-businesses, agricultural yields and help people get access to schools, banks and medical services, experts in the IEA said.

Power minister RK Singh said 15 states have completed electrification while another eight are close to achieving complete household electrification. States like Maharashtra, Uttarakhand, Himachal Pradesh, Arunachal Pradesh and Chhattisgarh are left with small number of un-electrified households and expected to achieve saturation any time, he had said last Thursday, exuding confidence that the government will achieve the complete household electrification targets by December 31.

Peak power demand of the country crossed 180 GW in October for the first time.

Data available on the power ministry’s Saubhagya dashboard showed that Uttar Pradesh has the maximum 56 lakh of the total 84 lakh un-electrified households. Rajasthan, Karnataka, Jharkhand, Assam and Meghalaya are some of the states that have un-electrified households.

Association of Power Producers director general Ashok Khurana said the country needs to commercialise coal production to help deliver the required electricity in the next three to four years.

The extradition of Christian Michel James, the main accused in the Rs 3,600 crore AgustaWestland helicopter bribery scandal, has brought into focus the improvement in India-UAE relations, especially with regard to Abu Dhabi handing over wanted criminals sought by New Delhi. But it isn’t just the UAE alone. Over the past four years, New Delhi has managed to persuade many other countries to hand over or quietly deport several wanted criminals, radicalised youth, militant leaders and even half a dozen Dawood Ibrahim gang (D-gang) members absconding from as far back as the mid-1990s.
According to multiple sources, over 100 Indian nationals of different hues have been brought back to the country since 2014, thanks to the excellent intelligence and law enforcement cooperation between New Delhi and other world capitals. These countries include Thailand, Nepal, UAE, Saudi Arabia, Singapore, Myanmar, Bangladesh, Turkey, Oman, Qatar, Afghanistan and France, among others. Since 2014, the UAE alone is reported to have traced at least 30-35 radicalised youth who wanted to or had joined ISIS. Most of them were either born or raised in Gulf countries where they had gone in search of employment.

Breaking News: UK court orders extradition of Vijay Mallya

Vijay Mallya should be extradited to India, London court rules
Mr Mallya attended Westminster Magistrates Court for the hearing.

Mr Mallya, whose business empire once included Kingfisher beer, left India in March 2016 after defaulting on debts of more than $1bn (£785m).

He denies "fleeing" from India, and says he made an "unconditional" offer to pay back the sum in full in July.

The businessman's fall from grace is being avidly tracked in India, where he was once listed as one of India's wealthiest people.
  • -Vijay Mallya: India's most controversial businessman?
-India's 'King of Good Times' to learn fate
Mr Mallya built his fortune from Kingfisher beer, before branching out into Indian cricket and Formula 1 racing. He set up the now defunct Kingfisher Airlines in 2005.

He faces a raft of charges relating to financial irregularities at Kingfisher Airlines. His monetary affairs are being investigated by India's Central Bureau of Investigation and the Enforcement Directorate, which handles financial crimes.

In 2012, he sold a majority stake in his United Spirits group to UK drinks giant Diageo. The deal was supposed to help Mr Mallya reduce United Spirits' debts and free up funds for Kingfisher Airlines.

But the airline, which was grounded in 2012, lost its flying permit the following year. It made annual losses for five years in a row and finally collapsed after lenders refused to give it fresh loans.

Mr Mallya's total debts, including unpaid wages and operating costs, are estimated to exceed $1bn.

He is a high-profile figure who has in the past been called "India's Richard Branson" and the "King of Good Times" for his lavish lifestyle.

PSBs’ recovery against NPAs doubles this year
NEW DELHI: Public sector banks reported recovery of Rs 60,713 crore against non-performing assets (NPAs) in the first half of the current year, which is double of the amount recovered in the corresponding period last year and more significant returns on high-value accounts are expected, the government has said.

In response to a parliamentary question, the finance ministry said following amendments to the Banking Regulation Act, the Reserve Bank of India directed banks to initiate insolvency proceedings before the National Company Law Tribunal in 41 cases, 12 of which had cumulative outstanding of Rs 1,97,769 crore as on March 31, 2017. The remaining 29 had an outstanding of Rs 1,35,846 crore as on June 30, 2017.

“As per RBI data on global operations (with provisional data for September 2018), during the last three and a half financial years, NPAs of scheduled commercial banks reduced by Rs 2,83,770 crore due to recoveries,” the government told BJP MPs Kirti Azad and Bharatiben Shiyal.

The government said measures such an asset quality review (AQR) initiated in 2015 for clean and fully provisioned balance sheets revealed a high incidence of NPAs that were piling up since 2008 — a period when UPA was in office. “As per RBI inputs, primary reasons for spurt in stressed assets is aggressive lending practices, wilful default, loan frauds, corruption in some cases and an economic slowdown,” it added.

The AQR enforced by the Modi government led to stressed accounts being reclassified as NPAs and expected losses were provided for. The transparent recognition of stressed assets led to gross NPAs of scheduled commercial banks increasing from Rs 2,51,054 crore as on March 31, 2014 to Rs 3,09,399 crore on March 31, 2015; Rs 5,66,247 crore on March 31, 2016; Rs 7,28,740 crore on March 31, 2017 and Rs 9,62,621 crore on March 31, 2018. This provisionally declined to Rs 9,46,062 on September 30, 2018.

The government said rise in NPAs was in good part due to banks being made to recognise stressed assets as NPAs and the withdrawal of restructuring schemes in 2017-18. This led to an honest appraisal of the state of bank finances and the role played by indiscreet and risky lending in the past.

With the adoption of a ‘creditor-in-saddle’ approach under the Insolvency and Bankruptcy Code, and interim resolution professionals taking over management of a corporate debtor at the outset, the incentive to abuse the legal system has been taken away, the finance ministry said.

The Securitisation and Reconstruction of Financial Assets and Enforcement of Security Interest Act, 2002, has been amended to make it more effective with a three-month jail term for a borrower who does not provide asset details and for the lender to get possession of mortgaged property in 30 days.

Public sector banks have created stressed asset verticals for stringent recovery, set our protocols for pre and post sanction and close monitoring of large value accounts.

Railways one short of removing all unmanned crossings
TNN | Dec 30, 2018, 01.01 AM IST
NEW DELHI: Railways is just ‘one’ short of eliminating all unmanned levels crossings on broad gauge lines across country and the 3,479th crossing will be eliminated before March end. It also said safety initiatives taken has helped bring down fatalities due to collisions and derailment by 75% during this year.
The major focus on this aspect of safety has resulted in sharpest decline in number of accidents at unmanned crossings from 20 in 2016-17 to only three during the current financial year. The elimination of unmanned level crossings include building of over bridges or underpasses across the rail track and by manning them. The railway ministry, on Saturday, shared a list of this year’s achievements and initiatives. It said the number of rail accidents has decreased by more half from 104 in 2016 to only 44 till November this year.
An official said, “The fatality figures in collision and derailment categories of accidents taken together have come down from 28 to seven (75% reduction) between April to December 15 as compared to the previous corresponding period of 2017. Similarly, number of collision and derailment cases have come down from 45 to 36 (20% reduction).”
The ministry said it has undertaken maximum ever rail renewal of 4,405 km in 2017-18 and 5,000 km has been planned during the current year with outlay of 11,450 crore. Already 2,812 km has been completed.

33.5 crore Jan Dhan accounts, 25.6 crore operative: Govt
TNN | Dec 30, 2018, 02.19 AM IST
NEW DELHI: After an initial target of six crore rural and 1.5 crore urban households, the Jan Dhan scheme for the unbanked has touched 33.5 crore accounts of which 25.6 crore are “operative” while the deposits in the accounts add up to a substantial 85,494 crore.
With the government’s focus shifting from “every household” to “every unbanked adult”, the PM Jan Dhan Yojana is offering an enhanced overdraft facility.........
The statistics show impressive progress in financial inclusion of “unbanked” less well off households as apart from a steady increase in account holders, some 26 crore RuPay cards have also been issued.
Going by the norm that accounts must show at least one “customer-induced” transaction in two years to be counted as “active”, around 76% of Jan Dhan accounts are in use. Many of these are used for direct benefit transfers for welfare schemes and overdraft facility is provided to accounts that show regular credit. The limit has been increased from Rs 5,000 to Rs 10,000
The details provided by the ministry show that UP, with its large population, expectedly has the highest number of 5.2 crore accounts and deposits of Rs 14,882 crore, West Bengal has deposits of Rs 11,470 crore. Bihar is next with deposits of Rs 8,417 crore, Rajasthan with Rs 6,360 crore and Maharashtra and Madhya Pradesh with Rs 5,035 crore and Rs 4,325 crore.
Among larger states that seem to be lagging, Jammu and Kashmir has only 20,40,248 beneficiaries and Tamil Nadu has 93,17,460 account holders. Andhra Pradesh has 92 lakh accounts but only Rs 1,628 crore in deposits. Odisha has deposits of Rs 3,759 crore and Gujarat of Rs 3,676 crore, while Assam has Rs 2,969 crore. Chhattisgarh has deposits of Rs 2,619 crore, Haryana of Rs 2,695 crore, Jharkhand Rs 2,668 crore, Karnataka Rs 2,862 crore and Punjab Rs 2,361 crore.

Leh and Kargil finally connected to the National Power Grid
NEW DELHI: More than 70 years after Independence, an engineering feat by state-run transmission utility PowerGrid has made it possible for India’s northernmost areas in Jammu & Kashmir to plug into the national electricity network to bring ‘one-nation-one-grid’ closer to reality.

On Saturday, PowerGrid and Jammu and Kashmir power department switched on the Alusteng-Alunday stretch of the 350-kilometre Srinagar-Kargil-Leh transmission line tracing some of the world’s highest mountain ranges and inhospitable terrains separating the Kashmir Valley from the frontier districts of Ladakh and Kargil. Sources told TOI power flowed for four hours through the 220-Kv (kilo-volt) line and its four sub-stations connecting Leh with the northern grid at Alusteng near Srinagar.

"This is a milestone for our country. We have now connected our northernmost areas to the national grid. It is a milestone for the people of Ladakh and Kargil. Prime Minister Narendra Modi laid the foundation stone on August 12, 2014 and it was commissioned during this government’s tenure. This is commitment to people’s welfare," power minister RK Singh told TOI.

The project is expected to dramatically improve the quality of life with 24X7 power supply in the strategically important region, which sees long and harsh winters with temperatures dipping to 50 degrees below freezing. Assured power supply is expected to energise economic activity and employment through winter tourism. Environment will get respite from millions of litres of diesel that is burnt by the defence and civil establishments to run generators.

Leh and Kargil towns have been getting power since 2013 from two NHPC hydel projects, built at a combined cost of nearly Rs 2,000 crore at Nimmoo-Bazgo and Chutak, respectively. Built as part of India’s strategy to exploit the potential of Indus before it enters Pakistan, the hydel stations were running at sub-optimal levels in the absence of grid connectivity. The Srinagar line will allow the stations to run at full capacity, feeding surplus power into the northern grid during summer and draw draw 100-150 MW in winter when reduced flow impedes generation.

In the long term, the line will help Ladakh-Kargil region emerge as India’s power house by allowing evacuation of power from proposed solar projects with aggregate capacity of 7.5 GW (giga watt).

Due to their isolated locations, Ladakh and Kargil have remained 95% power deficit regions. Habitations, including district headquarters Leh and Kargil, till recently received five hours of power supply in the evening from diesel generators and a few micro hydel projects.

52 coal mines opened in 5 years to fuel power drive
NEW DELHI: The Narendra Modi government has opened 52 new coal mines since coming to power in May 2014 to fuel its flagship village and household electrification programmes without tripping the system, officials told TOI.

These 52 mines represent 86% growth over the number of mines added in the five-year period between 2009 and 2014, when most projects were stuck in red tape, especially pertaining to environment and forest clearances, before the NDA government took over.

The officials said structural reforms in the government's functioning since 2014 made it possible to quickly open such a large number of coal mines, a cumbersome process involving approvals and permissions from various statutory authorities.

Image

The new mines have added 164 MT (million tonne) to India's annual coal production capacity, marking 113% increase over capacity added during the 2009-2014 period. Since 57% of power is generated in India by burning coal, these mines allowed the government to rapidly move towards universal electricity access without creating shortages.

This is borne out by data in the Central Electricity Authority's latest annual report, which shows demand-supply gap narrowing to 0.7% in 2018, down by 90% from 2009-10 level, and energy supply rising 120% over the 2004-2005 period. But for these new mines, this would not have been possible as the electrification drive has been pushing up demand for power by 5-6%.

On December 19, coal and railway minister Piyush Goyal told Parliament in a written reply that all-India coal production stood at 433.9 MT during the April-November period of 2018-19 financial year, indicating a growth rate of 9.8%. During the same period, state-run Coal India Limited's production stood at more than 358 MT, marking a growth rate of 8.8% over the previous corresponding period.

In April, the government completed the task of hooking up all the 18,452 un-electrified inhabited villages to the national power grid under the Deen Dayal Upadhyaya Gram Jyoti Yojana. It is now in the process of bringing power to all households without electricity by giving free connections under the Saubhagya scheme. So far, 91.9% of the 2.48 crore households identified without power have been electrified.

50 cancer, rare disease drugs to get cheaper
NEW DELHI: In a move to curtail profiteering on crucial medicines, the Centre is set to cap trade margins charged by drug retailers and stockists at around 25-30% for over 50 non-schedule medicines for cancer and rare diseases, which are currently exempted from price regulation, official sources said. The decision was taken at a high-level meeting with the Prime Minister’s Office earlier this month. The list of around 50 drugs, drawn by the Directorate General of Health Services (DGHS), includes 39 anti-cancer medicines and orphan drugs used in treatment of rare diseases. “The PMO had asked the health ministry to prepare a list of non-schedule anticancer and orphan drugs which are currently outside price control but require intervention to make them affordable.

The list has been submitted and order in this regard will be issued very soon,” an official told TOI, adding that the government will use Para 19 of the Drugs Price Control Order (DPCO) to fix the trade margin under “extraordinary circumstances” in public interest. The move assumes significance as many new cancer medicines, mostly patented drugs, and orphan drugs are exorbitantly priced but remain outside the purview of price regulation. By capping trade margin of such medicines, the government aims to make them affordable while limiting excessive gains made by wholesalers, distributors and chemists. At present, the government caps the trade margin on schedule or price-controlled medicines at 8% and 16%, respectively, for wholesalers and retailers. However, in case of non-schedule medicines, firms are free to negotiate with traders on margins.

Experts say trade margins form a major portion of MRP of a medicine and firms often pay exorbitant margins to the trade chain to push their drugs through retailers. The proposed move will also override the department of pharma’s previous order exempting orphan and patented drugs from price control. Niti Aayog had earlier suggested trimming trade margins to bring down prices of key medicines which still remain outside price control.

What our chattering classes haven't yet caught the significance of; one of those targets was in KPK, in Pakistan proper, not just PoK.

Piyush Goyal - Railways Sets a New Record: Integral Coach Factory becomes the largest rail coach maker in the world. Till Feb’19 they have manufactured 2,919 coaches, beating top Chinese manufacturers who produce around 2,600 coaches a year - https://twitter.com/PiyushGoyal/status/ ... 0124211202

India beats China! Indian Railways ICF becomes largest rail coaches maker in the world – a big achievement!
So far, the total production this year (April-February) is 2919 against 2085 in the corresponding period last year. This means a 40% increase in production. The ICF is now eyeing ending the financial year with over 3200 coaches.
Indian Railways’ ICF creates history! The Integral Coach Factory (ICF) in Chennai has manufactured as many as 301 coaches in the month of February, taking the total for this fiscal to 2,919. Interestingly, this puts the factory among the largest railcar builders in the world, beating top Chinese manufacturers who produce around 2,600 coaches a year. Financial Express Online learns that this is the second time in the year, the factory has crossed the 300 coaches per month mark. So far, the total production this year (April-February) is 2919 against 2085 in the corresponding period last year. This means a 40% increase in production. The ICF is now eyeing ending the financial year with over 3200 coaches.
The ICF has also churned out the newly launched country’s fastest train Vande Bharat Express between the April-February period. Indian Railways has placed an order for 44 more Vande Bharat Express train sets with ICF. The first rake out of 44 is currently being manufactured. The remaining 43 Vande Bharat Express train sets are likely to be rolled by the ICF during the next three production years in phases.
Meanwhile, Indian Railways-owned Modern Coach Factory (MCF) in Rae Bareli, Uttar Pradesh too has ramped up production and has manufactured as many as 143 coaches in the month of February, this year. According to the official, a cumulative total of 1,283 coaches have been manufactured by MCF this year against 586 coaches in the same period last year. This has led to an increase of 118 per cent in MCB’s coach production. Interestingly, the factory is now gearing up to achieve a production level of 1,422 coaches this year, double that of last year’s 711, the official added.

Article on Ayushman Bharat scheme {poof}
'It's a godsend': the healthcare scheme bringing hope to India's sick
In a country where treatment can cost two years’ wages, a new project could mean free medical care for 500 million people
https://www.theguardian.com/global-deve ... man-bharat
Rajiv Gupta has a distinct spring in his step. He has brought his mother to New Delhi from the northern state of Bihar for a hip replacement, for which he won’t have to pay. His mother qualified for free treatment under Ayushman Bharat, the government’s ambitious new health insurance scheme.

“I can’t quite believe this is happening. When the doctors in Bihar told me it would cost 200,000 rupees [£2,180], I took mum home. That kind of money is impossible for me. I just run a tiny sari shop. And now she’s getting it done here free,” says Gupta. Then he hurries off as though scared he has got it wrong and someone is going to present him with a bill.
“It is early days, but this is a game-changer,” says Dr Randeep Guleria, pulmonologist and director of the All India Institute of Medical Sciences (AIIMS) in the Indian capital. “Hospital treatment is an impossible cost for the poor – even for sections of the middle class. It’s a godsend to those who would have been kept at home by their families and left to die.”
Shah Mohammed, 50, is recuperating at SGT hospital in Gurgaon, a large private institution in the middle of a deserted, dusty plain that caters to the surrounding villages. Mohammed suffered a fractured jaw and haematoma after his scooter crashed into another vehicle.

“I hadn’t heard of this Ayushman,” he says. “But when I was admitted here, the staff checked and found that I qualified. I can’t get over the fact that when I am discharged, I will walk out of a private hospital without paying a rupee.”

Modi sarkar extends Ordinance banning Triple Talaq
Triple Talaq is a widely prevalent custom amongst Indian muslims. Innately exploitative, triple talaq allowed muslim men to use to terrorize their muslim wives with the threat of immediate & irrevocable divorce.
For 70 years the Nehruvian sickular consensus hoodwinked at this practice to empower the relentless torture & enslavement of Muslim women by their Muslim husbands using the threat of Talaq, while the Indian Feminists & left liberals buried their heads in sikular holes.Triple Talaq ensured that Muslim women were dehumanized & reduced to lumps of flesh only to be used by the husbands when & as they pleased.

Finally in 2018 the Hindutva govt of Narendra Modi banned this abhorrent practice of Triple Talaq via the ordinance route bringing succor to the 100 million muslim women.
While the attendant Bill to ban Triple Talaq has been passed in Loksabha with the majority enjoyed by BJP in 2017, it was however prevented passage in RajyaSabha by Congress & parties of Mahagathbandhan, necessitating the repromulgation of the ordinance by NaMo sarkar in 2019.

The Muslim Women (Protection of Rights on Marriage) Ordinance, Jan 2019

The Muslim Women (Protection of Rights on Marriage) Ordinance, 2019 was promulgated on January 12, 2019. It replaces the Muslim Women (Protection of Rights on Marriage) Ordinance, 2018 promulgated on September 19, 2018. Note that the Muslim Women (Protection of Rights on Marriage) Bill, 2018 (to replace the 2018 Ordinance) was passed by Lok Sabha on December 27, 2018 and is currently pending in Rajya Sabha.

The Ordinance makes all declaration of talaq, including in written or electronic form, to be void (i.e. not enforceable in law) and illegal. It defines talaq as talaq-e-biddat or any other similar form of talaq pronounced by a Muslim man resulting in instant and irrevocable divorce. Talaq-e-biddat refers to the practice under Muslim personal laws where pronouncement of the word ‘talaq’ thrice in one sitting by a Muslim man to his wife results in an instant and irrevocable divorce.

Offence and penalty: The Ordinance makes declaration of talaq a cognizable offence, attracting up to three years imprisonment with a fine. (A cognizable offence is one for which a police officer may arrest an accused person without warrant.) The offence will be cognizable only if information relating to the offence is given by: (i) the married woman (against whom talaq has been declared), or (ii) any person related to her by blood or marriage.

The Ordinance provides that the Magistrate may grant bail to the accused. The bail may be granted only after hearing the woman (against whom talaq has been pronounced), and if the Magistrate is satisfied that there are reasonable grounds for granting bail.

The offence may be compounded by the Magistrate upon the request of the woman (against whom talaq has been declared). Compounding refers to the procedure where the two sides agree to stop legal proceedings, and settle the dispute. The terms and conditions of the compounding of the offence will be determined by the Magistrate.

Allowance: A Muslim woman against whom talaq has been declared, is entitled to seek subsistence allowance from her husband for herself and for her dependent children. The amount of the allowance will be determined by the Magistrate.

Custody: A Muslim woman against whom such talaq has been declared, is entitled to seek custody of her minor children. The manner of custody will be determined by the Magistrate.
