Pakistan loses sovereign immunity over Hyderabad Funds

NEW DELHI: The riveting, 67-year-old India-Pak Hyderabad Funds saga has taken another turn with High Court of Justice in London ruling that Pakistan no longer has sovereign immunity over the State of Hyderabad's wealth. All these years, India has been forced to deal with Pakistan bilaterally to recover the funds because in 1957 Pakistan invoked its right to sovereign immunity from any court proceedings in Britain on this issue, thereby blocking any possibility of recovering these funds through the legal route.

Hyderabad Funds refers to the 1,007,940 Pound Sterling and 9 Shillings transferred from the erstwhile State of Hyderabad's bank account in National Westminster Bank in London to an account in the same bank, of the then Pakistan high commissioner to UK on September 20 1948, just 2 days after the Nizam decided to accede to India. The money is currently valued around 35 million Pound Sterling and has 3 claimants - Pakistan, India and Nizam's family.

As the successor state to the Nizam's State of Hyderabad, India has all along maintained its claim over the money. Faced with no prospect of recovering the money through the Courts, ever since the 1960s the Indian cabinet has been approving efforts aimed at pursuing an out-of-court settlement with Pakistan and Nizam's heirs to recover what in the past has often been referred to as the sacred inheritance of the people of India.

With Pakistan no longer longer enjoying its state immunity over the funds, India has once again got the chance to seek a recovery of this inheritance through the legal route. According to the Indian government officials, the Funds were not private monies of the Nizam but monies that are referred to as State monies. The transfer to the account of the Pakistan High Commissioner took place on the instructions of the Nizam's finance minister who may have been an authorized signatory to the account, but he did it without the consent of the Nizam's Government as the Nizam himself later confirmed. ``These instructions were irregular in as much as the Finance Minister of the Nizam's Government had no power to withdraw this money without the express sanction of the Nizam or the State Government. The Nizam's subsequent instructions to retransfer the funds were not complied with,'' the government had said in a statement earlier.

The recent ruling of the British High Court of Justice in the case of the High Commissioner of Pakistan in UK vs National Westminister Bank & others means that the dispute over the ownership of funds can now once again be decided through the legal route, without Islamabad being able to block such proceedings. The matter had reached British courts in 1954 after the Nizam and the State of Hyderabad (then part of the Indian Union) challenged the transfer saying it had been effected by the Nizam's agent in London without the Nizam's or the Nizam Government's consent. At the time the matter went right up to the House of Lords who in 1957 recognized Pakistan's right to invoke sovereign immunity but also noted that its ruling meant that any legal proceedings to determine the true ownership of the Funds would now be blocked forever.

According to the recent High Court of Justice ruling Pakistan lost its sovereign immunity when it voluntarily decided to file a legal claim in 2013, against the National Westminster Bank seeking full recovery of all monies exclusively for itself. Midway through the proceedings Pakistan's seems to have realized that its claim could not possibly succeed without a loss of its state immunity over the funds. In fact it learnt that initiating proceedings itself amounted to voluntarily giving up its right to immunity and submitting to the Court's jurisdiction. And so in November 2013, just days before the first hearing on its case, Pakistan decided to discontinue the proceedings it had itself initiated.

Faced with Pakistan's attempt to recover the Hyderabad Funds through a suo motu legal effort, India had no choice but to ask to be 'impleaded' or joined in the proceedings. One of the pleas made by Pakistan while seeking to abruptly discontinue the proceedings was that it was under diplomatic pressure from India and that it was negotiating with other parties. In its ruling on January this year, the Court set aside Pakistan's plea to discontinue the proceedings, and formally joined all the interested parties which included India, the grandsons of the Nizam. The Court also asked Pakistan to pay the legal costs incurred by the Bank, India and the two grandsons who had opposed the Pakistani plea to abruptly discontinue the proceedings.

A leading UK legal firm BrownRudnick interpreted the decision as emphasizing that sovereign states must take great care not to take steps which can constitute a waiver of their sovereign immunity from jurisdiction.

So fauj is going after MQM with a vengence.
First they raided Altaf Hussein's house in Karachi, arrested the few MQM boys guarding that place.

Now they've made this video of a man Saulat Mirza who is on death row, and is about to be executed. This is a video recording that they are releasing in which he blames Altaf Hussain and another MQM big boss, Babar Ghauri, for ordering the murder of KEC MD (Karachi Electric supply Corporation) Shahid Hamid, his driver Ashraf Brohi and guard Khan Akbar in July 1997.
The establishment will push for this video to be appended as a dying declaration by this guy, implicating Altaf.



Altaf has been unusually vitriolic in his recent speeches, but this clearly is a kinda existential threat for him.
Hmm wonder what altaf's reaction might be hain :twisted:

Guess many IED Mubaraks in Karachi and Sindh, more talk about sindhudesh etc etc

This ij just like pakistan announcing that it will take action against Taliban in North Waziristan several months in advance.
It gives a lead time for the bad pakistanis to relocate (or be forcibly relocated).

IF, (and this is a big if), they do decide to hold it, they will hold it on separate dates in different provinces, so that Pakjabis come out with flying colours.

After 46:00 in the CUnFair video is clear example of why a western person not rooted in India can never ever understand what Hinduism is. Calling RSS dangerous is like calling YMCA terrorists.

Oddly enough, she can figure out Baki machinations with data and statistics, but cannot use the same accumen to justify that claim that RSS is "dangerous". Rather UnFair of her, and she does live up to her name.

Drone strike near Pak-Afghan border takes out Hakimullah's aide
A close aide of former Tehreek-i-Taliban Pakistan (TTP) Chief Hakimullah Mehsud, Khawrey Mehsud, was killed in a drone strike near the Pak-Afghan border yesterday.

According to TTP spokesman Muhammad Khorasani, Khawrey Mehsud was killed in a drone attack in Kurram Agency near the Pak-Afghan border on March 18. Two other militants were also killed in the drone attack.

What do I want to see? I want to see this thread drop off the bottom of this page and get into page 2. That will happen when Pakistan is no longer able to organize terror attacks on India. Shitistan will simply drop out of the consciousness of Indians and that is what i want to see.

Pakistan's actions have been directed solely at remaining relevant to India. in the absence of terror Pakistan is as relevant to India as the last turd you deposited in your last visit to Pakistan.

Trampling people’s basic needs
Every child born in Pakistan carries the burden of government debt of close to Rs100, 000. He/she faces a high rate of child mortality and those among them who survive are mostly underfed and undernourished and are unable to get good education and gainful employment when they grow up. Most of them have no access to clean water, sanitation and medical facilities and some of them work in the palatial houses of the rich more or less like slave labour.

The defence and debt-serving expenditure accounts for almost all the tax revenue. The rest of the government’s expenditure is being financed by internal and external borrowing. There is a huge amount of floating debt that the government is unable to clear. Public sector enterprises are incurring a large quasi-fiscal deficit that is being financed by borrowing.

This country was created for the ordinary people of the Subcontinent. It has been taken over by a tiny minority of the rich elite and is being managed by it for the rich.

The only way to get rid of the indigenous colonists is through an awakening of the proletariat at a large scale.

As of now bakistan has less than 2.1% of total area as forest, with most of the forest area in NWFP and POK especially GB.

Pakistan has very low forest cover. Natural forests represent just over 3 percent of the total land area, but their community and species diversity reflects the country's great physiographic and climatic contrasts. Pakistan's forest and woodland types include: littoral and swamp forests; tropical dry deciduous forests; tropical thorn forests; sub-tropical broad-leaved evergreen forests; sub-tropical pine forests; Himalayan moist temperate forests; Himalayan dry temperate forests; sub-alpine forests; and alpine scrub. Coniferous forests predominate. The North West Frontier Province contains approximately 40 percent of the forests in Pakistan.

Woodfuels are very important in Pakistan. Around 90 percent of Pakistan's wood production is used as fuel, and almost 80 percent of households use wood for cooking.

The rate has been ~40 K hectares deforestation/year, which means by now only ~1,500 K hectares would be left. In 25 years they have lost 40% or more of their forest cover and in 35-40 years they would have lost almost entire forest cover.

It is this kind of deforestation which is causing the floods happening in bakistan, it may also be responsible for the drought in Tharparkar. I am fairly certain that the floods in J&K were also due to such terrible deforestation rates. With economic mismanagement and lack of fuel and electricity for heating leading from it, the deforestation and floods would keep increasing. This would lead to further damage to economy and would lead to a cascade.

This is very similar to North Korea where similar deforestation and erosion of land have occurred. This fact should be highlighted everytime there is a debate on Indians causing the floods and rivers running dry.

PAEC chairman Ansar Pervaiz said Karachi Nuclear Power Plant, Chashma Nuclear Power Unit-1 and Unit-2 have been producing a total of 755 MW of nuclear power. The rate has been ~40 K hectares deforestation/year, which means by now only ~1,500 K hectares would be left. In 25 years they have lost 40% or more of their forest cover and in 35-40 years they would have lost almost entire forest cover.

AoA! Bakistan always looked up to KSA and Bakis always claimed they were araps. Now Bakistan will become like Arabistan with no forest cover.
