High court bans sale of beef in Jammu and Kashmir

ammu and Kashmir high court has banned the sale of the beef in the state after hearing a Public Interest Litigation (PIL) against cow slaughter.

The division bench justice Dhiraj Singh Thakur and justice Janak Raj Kotwal issued the order on Wednesday over the PIL filed by advocate Parimoksh Seth.

The PIL said that slaughtering and sale of bovine animals is rampant in some parts of the state which severely affected religious sentiments of a section of the society. It further stated that the practice continues despite the fact that provisions of Ranbir Penal Code make killing of bovine animals an offence punishable under Section 298-A and possession of such slaughtered animal an act punishable under Section 298-B.

The court also observed the divisional commissioner of Kashmir had not filed an appropriate response about smuggling, slaughtering of bovine animals and their subsequent sale in the Kashmir valley.

It directed the director general police to ensure that appropriate directions are issued to all police official, especially district heads and station head officers (SHOs), to strictly enforce the ban.

"Strict action shall be taken in accordance with law against those who indulge in this activity," the HC observed.

The HC's order comes as the Rajasthan government ordered a three-day ban on sale of meat during Jain festivals this month, two days after a similar measure in Mumbai raised a huge controversy.

In Maharashtra, the BJP-led government passed the Maharashtra Animal Preservation (Amendment) Act in March, banning the slaughter, sale and import of beef, a move which has been challenged in court. According to the law, slaughter and sale of beef as well as the possession and consumption of beef is a criminal offence

Over 1,600 overground workers active in J-K: Police

The Jammu and Kashmir Police have prepared a list of active overground workers of various militant outfits in the state, facilitating militants in one or the other way.

A police report said more than 1,600 overground workers were active in the state and some of them have been booked in criminal cases.

A majority of them have got scot-free but the Police Department and other intelligence agencies are keeping a close eye on their activities.

Though the number of militants has come down in the state, the higher number of overground workers is a cause for concern for the security agencies and the police.

The number of active militants in the state varies from time to time and there is a difference of opinion between intelligence agencies on it. At present, security agencies put the number of active militants in the state between 200 and 300.

The police have laid down rules for identification of the overground workers.

“People who facilitate militants in carrying out attacks and other terror-related activities is considered an overground worker. Those who provide resources to militants or propagate their propaganda also fall in this category,” said SJM Gillani, Inspector General of Police (IGP), Kashmir.

Overground workers are active in 18 of the 22 districts of the state. Besides, two districts of the Ladakh region, Jammu and Samba districts are free from overground workers.

As per the police report, the highest number of overground workers are active in Reasi district of the Jammu region, where 210 people have been identified. Reasi is followed by Doda district, where 141 overground workers are active. Kishtwar district stands at number three in the list.

As per the report, not a single militant is active in Reasi and Doda districts while only three militants were active in Kishtwar district in 2014.

In the summer capital Srinagar, there are 104 overground workers while in the Sopore area of Baramulla district, still considered as hotbed of militancy, there are 17 overground workers.

As the police have shortlisted these overground workers from various different districts of the state, action has been taken only against a few.

“Action might not have been taken against every overground worker but whosoever has been found involved in criminal activity has been booked,” the IGP said.

Instead of IPC it was this Penal Code which is actually in use in J&K area. Due to all the special grants which J&K gets, they also were allowed to get away with having a separate penal code. But Ranbir Penal Code which was introduced by the Dogra Kings, are very closely modeled after the IPC (drafted under supervision of Lord Macaulay). Here is a web site which talks about the differences between RPC and IPC.

I don't think there are very drastic changes between the two laws. And I don't know the legalities, but most of the other laws (including AFSPA) seems to be valid all across India - including J&K. Only the penal code seems to be different.

In the state of J&K Indian Penal Code is non-applicable owing to article 370/special status of the state. Named after Maharaja Ranbir Singh this penal code is in force since 1932.

Militants outsmart Indian agencies with new tech tool

A technological breakthrough prompted by the devastation of Hurricane Sandy in 2012 in New York area is the latest militant tool baffling the Indian security establishment.

The technology, of sending mobile communications without using mobile networks, has given another twist to the ongoing cat-and-mouse game between militants and security agencies in recent months. For sometime now, Indian agencies have noticed infiltrating militants from Pakistan carrying smart phones without SIM cards. And they presumed the militants would procure local SIMs in Kashmir for using them.

However, latest inputs, including interrogation of Sajjad Ahmed, who was captured by the Army in August last week, show that the militants are adopting the breakthrough technological solution, primarily meant to ensure basic mobile communication even when mobile networks are down, to overcome eavesdropping by Indian agencies.

Indian agencies can today listen in on VHF conversations, mobile phones and satellite phones.

With accurate interception and monitoring of these devices, intelligence agencies, the Army and the BSF have been very effective in neutralising several militants, especially when they infiltrate into India.

These technical capabilities have dealt deadly blows to attempts to breathe life into a dying Kashmir militancy.

With the breakthrough capability to send bare mobile communications through VHF (very high frequency), the militants seem to have been successful in avoiding Indian agencies, especially during the crucial hours when they cross the Line of Control.

The technology is to pair a smart phone with a radio set, and send out short SMSs, an SOS appeal or the exact location to other paired devices using line-of-sight very high frequency. The first public discussion on the solution, and the most high profile product for it, emerged in the U.S. after the October 2012 Hurricane Sandy. The ineffectiveness of cell phones after mobile towers were destroyed by the hurricane was the reason for dreaming up the technological breakthrough.

The capability ensures that the infiltrating militants have continuous, but bare, communication link with their handlers and other militants who are in the group, while avoiding tracking by Indian agencies. This capability is secure even in high peaks and ravines, especially near the Line of Control where conventional mobile and satellite phones can give away their exact location.

Ahmed, who was captured from Rafiabad area, told his interrogators about what they call YSMS communication application. He said they were advised against using mobile phones, and to rely on YSMS for contact.

When Abu Suhaib, one of the militants in the infiltrating group and technology expert among them, was sure to be killed by the Indian Army on August 27 he tried to break up the system, However, Ahmed stopped Suhaib from fully destroying it. The Army later recovered the Samsung mobile phone and the wireless set paired to it for YSMS.

Sources said the recovered radio set is a traditional one, and not the slim gadget that U.S. start-up GoTenna has developed. “Which means this is either a Pakistani or a Chinese solution,” an official in a technical intelligence agency said.

“We have been recovering smart phones without SIM cards for sometime. Now we know the reason,” he said.

J&K beef ban: Clashes in Srinagar, separatists detained, ISIS flags raised

Srinagar: Clashes broke out here on Friday between police and people protesting against the Jammu & Kashmir high court directive to ban beef in the state with some youth displaying Pakistani and ISIS flags.

After Friday prayers, a group of masked youth set ablaze the tricolor and displayed several controversial flags including that of ISIS, al-Jehad terror outfits and banners resembling Pakistani flag near the historic Jamia Masjid in Nowhatta area of downtown Srinagar.

They also carried posters of Lashkar-e-Taiba founder Hafiz Saeed and Hizbul Mujahideen commander Burhan Muzaffar.

Some protesters also pelted stones at police personnel posted on law and order duty in the area. Police fired tear smoke shells to disperse them, a police official said.

The were no reports of any injuries.

The clashes were going on till reports last come in, the official said.

Meanwhile, several bovine animals were reportedly slaughtered in south Kashmir's Anantnag district as a mark of protest against the high court order.

Court martial sentence in Machil fake encounter confirmed

Jammu: The army`s northern command GOC on Monday confirmed the life sentence awarded to six army personnel, including a colonel-rank officer, by a general court martial in the 2012 Machil fake encounter case, an army official said.

"General Officer Commanding in Chief (GOC-in-C), Northern Command, Lieutenant General D.S. Hooda has confirmed the sentence of a Summary General Court Martial in the Machil encounter case," Colonel S.D. Goswami, spokesman of the army`s Udhampur-based Northern Command, told IANS here.

"Colonel Dinesh Pathania, Captain Upendra, Havildar Devendra Kumar, Lance Naik Lakhmi, Lance Naik Arun Kumar and Rifleman Abbas Hussain have been awarded life imprisonment," he said.

In April 2012, the army had claimed killing three guerrillas in Machil sector on the Line of Control in Kupwara district during an infiltration bid.

There was a public outcry after photographs of those killed in the alleged encounter were released, as relatives and neighbours of the slain persons claimed that the three civilians were framed and killed in a stage managed gunfight and they were not connected with militancy in any way.

Police investigations later proved the three civilians were lured with promises of jobs and taken to the border where they were killed in a fake encounter for money and rewards.

The army later ordered a general court martial that found the six army personnel guilty.

The intra-Kashmir journalists workshop, held in the last week of August, was jointly sponsored by the Kashmir Initiative Group, the Kashmir Institute of International Relations and the Centre for Peace, Development and Reforms.This was the first such meeting in the nearly seven decades after Kashmir was divided arbitrarily by a line based on the results of a bloody conflict.Prime Minister Chaudhury Abdul Majid said: “We welcome any measure aimed at connecting the divided parts of Jammu and Kashmir.” Reportedly, a memorandum of understanding will be signed “to build a permanent bridge” to have “a news pool for joint use of content”.Initially, only apolitical content will be shared. Given the state of things, this is a very realistic and sensible limitation. Will the PDP-BJP coalition headed by Mufti Mohammed Sayeed do anything to ease their pain?The PDP’s election manifesto of 2014, entitled An inspirational agenda solemnly promised to “mark borders irrelevant” and to “complete connectivity”. The ‘agenda of the alliance’ with the BJP promises to “support and strengthen the approach and initiatives” taken by the BJP regime at the centre “to normalise the relationship with Pakistan”.Even in March 2015, when this was written, there was no sign of such steps. However, the agenda explicitly bound “the coalition government” to take CBMs “such as enhancing people-to-people contact on both sides of the LoC, encouraging civil society exchanges, taking travel, commerce, trade and business across the LoC to the next level and opening new routes across all the three regions to enhancing connectivity”.
It remains to be seen what steps Mufti takes to fulfil these promises. He has done nothing to remove the existing crippling hurdles on LoC trade.His finance minister Dr Haseeb Drabu, who wrote those two documents, reportedly and fixed the deal, pointed out in the past the need for proper banking systems, agreement on currency, functioning telecommunications facilities and a mechanism for the resolution of disputes.None of this can be established now; for, his chief Mufti follows New Delhi’s diktat. The PDP president Mehbooba Mufti, once sensibly proposed a dual currency in Kashmir. The trio has lived up to those famous lines. The Plight of Jammu

Some 2000 years ago, the wise politician Kautilya said that both the territory and its people made up the state. In case of Jammu and Kashmir, we have failed miserably to secure both the people and the territory of the state.

Speaking of territory, the state is skewed in the favour of Jammu which is nearly 1.75 times the size of Kashmir but still its people are discriminated against the Kashmiris and the Kashmiriyat.

Jammu and Kashmir has got reduced to Kashmir in the political narrative since the times of Jawaharlal Nehru agreeing to the conferring of special status on to the state so as to preserve the ” kashmiriyat” of its masses. Unfortunately there was no similar connotation for the culture of Laddakh or Jammu that needed preservation not only from the ‘Hinduana’ culture of the rest of the India but from Kashmiriyat itself. Slowly and surely, the Jammu and Laddakh regions have suffered for being a part of the state that also has the Kashmir valley in it. The figures speak volumes for themselves.
Jammu returns 2 MPs and 37 MLAs roughly representing some 1 MP per 15.6 lakh people and an MLA per 85000 people. While Kashmir valley returns 3 MPs with one MP per 9.6 lakhs people and 43 MLAs with one MLA per 62000 people. Both the regions have an equal number of districts while Jammu is nearly 1.75 times the size of Kashmir. The state is yet to see a CM from Jammu and this is after when the Congress had fought the 2002 elections promising the Jammu electorate that the CM would be from Jammu along with a regional development board to look into the complaints of neglect by the governments. The Congress pandered to the leaders from the valley once again and formed the government with NC with rotation of the chair of CM for 3 years each between them. This was when the Jammu electorate had given them 15 seats and BJP just 9.

Historically too, the region of Jammu and Laddakh have been treated unfairly. When asked for the status of a union territory for themselves, the Sheikh Abdullah government carved out a Shia muslim majority district Kargil in 1974 out of the Leh district. In 1949 too, Sheikh Abdullah had divided a Hindu majority Udhampur district to create a separate district of Muslim majority Doda. Rajouri-Poonch subdivisions have been carved out of Jammu division to keep Muslims in majority in the subdivisions.

This is very much in line for the Greater Kashmir that the UN observer to the region Owen Dixon had proposed as a solution for the region. The muslim majority regions to the north of Chenab were to be kept under Pakistan while India gets the Hindu-Buddhist majority regions. The plan could not see the daylight because it was impossible for Nehru to sell this idea to a nation that has been sensitive over the Kashmir issue.

The current CM too hails from the valley and despite both of the parties have 29 legislators each in the house but still Jammu got just 5 seats in the 17 member ministerial council. This is when the BJP threw in all its weight behind strengthening the voice of Jammu in the executive.

The CM unilaterally decided to shift the AIIMS type institution proposed in Jammu to Srinagar and the calling off of the proposed lake over Tawi river in Jammu. The best bet will be to delineate the state into separate states of Jammu and Kashmir and make Laddakh a union territory keeping a common state high court and Governor. The population of the Jammu is reeling under a regressive article 370 and article 35 A of the constitution. The article 35 A does not let the Gorkhas settled in the state since 1846 get the status of a permanent resident of the state. The SC and ST residents of Jammu cannot avail any benefits guaranteed to them by constitution. It has effectively created two categories of citizenship in the state. Even women who get married to men outside of the state loose their citizenship.

It is high time that a state of Jammu is carved out of Jammu and Kashmir so that normal and justified rules and Acts like the Prevention of Corruption Act 1988, the mandate of CVC, the basic fundamental rights guaranteed to normal Indians can be extended to them. The service tax can be levied and so that the revenues out of service tax can be apportioned to the state.

The people of the area are paying the price for the separatism of the few hailing from the valley as for saving an imaginary ‘Kashmiriyat’ the trade and investment in the Jammu and Laddakh regions has been brought to a standstill. As far as Article 370 goes, it lost its very validity the moment Sheikh Abdullah ousted the Dogra ruler Hari Singh in 1953 via a resolution of the state constituent assembly. There is absolutely no point in bearing a Nehruvian legacy that is no more than a burden.

The plan may have some flips too with chances of the Jammu population might not agreeing to the partition. The partition would leave the revered shrines of Kheer-Bhawani, Amarnath at the very mercy of the Jehadi elements of the Kashmir valley. It might also make the restoration of Kashmir Pandit all the more difficult but looking at the state of the affairs, any restoration of KPs looks like a dream even if there is no partition of the state.

Certainly the odds in favour of partition are many and a call for partition should be taken after taking into account the years of neglect of the region.

Counter-insurgency cop killed in shootout with Udhampur suspect

Mohammad Altaf Dar, a sub-inspector in J-K Police, was running an independent Special Investigation Team (SIT) and was the man behind cracking most of the high profile militancy cases and killing of top militant commanders in the valley.

“It is a big loss for us,” the Inspector General of Police (IGP) Kashmir Javed Mujtaba Gilani told The Indian Express. “He was one of the best counter insurgency officers we had”.

On Tuesday evening, the 37-year-old Altaf had left for Bandipore to “pursue” a group of militants led by Lashkar commander Abu Qasim, the mastermind of Udhampur attack. “He had inputs that Qasim and his associates are going to receive a group of militants in Bandipore,” said a police officer. “He and a few police officials were in a private car pursuing another vehicle in which they believed militants were traveling. At one place, when they tried to intercept the car, the militants fired at them. He was hit by bullets in neck and abdomen”.

As top police officers in Srinagar were informed about injury to Altaf, they arranged a chopper and airlifted him to Srinagar for specialized treatment. However, he was declared brought dead.

An Assistant Munshi – who received four out of turn promotions in his 15-year career – a tech-savvy Altaf was the man behind the J-K Police’s technical surveillance that earned him a name of ‘Altaf laptop’. It were his inputs that led to the killing and arrest of top militant commanders in the valley and cracking of the high profile militancy cases.

MHA seeks report from J&K on HC order on Article 370

NEW DELHI: The home ministry on Monday sought a report from the Jammu and Kashmir government on the state high court's order that Article 370, which grants special status to the state, is beyond amendment, repeal or abrogation.

The ministry sought a copy of the Jammu and Kashmir High Court order from the state government as early as possible, explaining the grounds on which the order was issued, official sources said.

The state law department is expected to forward the copy of the high court ruling to the central government.

Jammu and Kashmir HC has ruled that Article 370 has assumed a place of permanence in the Constitution and the feature is beyond amendment, repeal or abrogation.

The court also said Article 35A gives 'protection' to existing laws in force in the state. "Article 370 though titled as 'temporary provision' and included in Para XXI titled 'temporary, transitional and special provisions' has assumed place of permanence in the Constitution," a division bench of Justices Hasnain Masoodi and Janak Raj Kotwal ruled in a 60-page judgment.

"It is beyond amendment, repeal or abrogation, in as much as constituent assembly of the state before its dissolution did not recommend its amendment or repeal," the bench ruled.

With the flood victims still waiting for proper rehabilitation, the Minister for Relief and Rehabilitation Syed Basharat Bukhari today said the proposed Rs 44,000-crore flood relief-package was under the active consideration of the Central Government.

It has been over 13 months when the floods hit Kashmir, but the state is still awaiting the Centre’s approval for the proposed special package.

The state government, however, in a written reply today stated that the proposed package had two components — special financial package and National Disaster Relief Fund — and would be released under the two heads.

The official documents revealed that the restoration of the damaged infrastructure in Kashmir was going on under the medium and long term projects.

The overflowing Jhelum had left a trail of destruction in the summer capital last September, causing an estimated loss of Rs 1 lakh crore and affecting lives of 14 lakh people in the city. The floods also resulted in death of 85 people in the Valley.

The initial assessment report prepared by the state government, which provided break-up of the colossal destruction, had mentioned that 83,044 concrete houses were fully damaged while 96,089 were damaged partially in the disaster.

The state government had sought a special financial package of Rs 44,000 crore from the Centre for rehabilitation of the flood-affected people and restoration of the damaged infrastructure. However, the Union Government has so far announced only Rs 16-crore package.

Officials said once the state gets approval from the Government of India, the relief will be distributed under different categories.

The BJP today scripted a new chapter in J&K politics as it wrested control of the Ladakh Autonomous Hill Development Council (LAHDC) at Leh for the first time ever, winning 18 of the 26 seats that went to the polls on October 17.

The saffron party’s graph at the civic body has witnessed a significant surge from four seats in 2010 to 18 in the 30-member council--four members are nominated by the government.

The Congress, which had been ruling the council with 22 members, could only manage five seats. The party’s senior leader and Chief Executive Councillor Rigzin Spalbar lost to National Conference's P Wangdan by over 800 votes. Internal bickering and anti-incumbency are learnt to have cost the Congress dear. The National Conference managed to win two seats while an Independent emerged victorious from Diskit.

The PDP, which had refused to ally with the BJP, failed to open its account.

The BJP and the Congress had contested 25 seats each while the PDP and the National Conference had fielded candidates from eight segments. A new outfit, New Ladakh Movement, had fielded 17 candidates. In all, 90 contestants were in the fray.

Constituted in 1995, the council saw its fifth elections this time. It has been ruled by the Congress thrice while the Leh Union Territory Front formed the council once.

During the 2014 Assembly poll, the BJP had won 25 of the 37 seats in the Jammu region, which enabled it to form its first-ever government in the state in alliance with the PDP. It, however, had lost both the Assembly seats in Leh district to the Congress. The BJP opened its account in the parliamentary elections when it won the only Ladakh seat last year.

SRINAGAR (Web Desk) – Rebutting the Indian claim of Occupied Kashmir being part of India, the Jammu and Kashmir High Court has ruled that the State has never been part of India.

“Article 370 of Indian constitution that deals with the status of Jammu and Kashmir is beyond abrogation, repeal or even amendment,” the high court said in its ruling last week.

“Article 35A gives ‘protection’ to existing laws in force in the State. Article 370 though titled as ‘Temporary Provision’ and included in Para XXI titled ‘Temporary, Transitional and Special Provisions’ has assumed place of permanence in the Constitution,” a division bench of justice Hasnain Masoodi and Janak Raj Kotwal ruled in a 60-page judgement.

“It is beyond amendment, repeal or abrogation, in as much as Constituent Assembly of the State before its dissolution did not recommend its Amendment or repeal,” the bench ruled.

lol srinagar court means jack$hit in determining it's statehood. The statehood is determined by Indian constitution and the general consensus. The only thing that's wrong with j&k is article 370, it goes against the fundamental right of an Indian citizen to go and live anywhere in the country without any barrier.

The poll results for the Ladakh Autonomous Hill Development Council (LAHDC) reflects the faith of the Ladakhis in national unity over separatism.

People of Leh district of the strategic trans-Himalayan Ladakh region went to the polls on 17 October to elect the fifth Ladakh Autonomous Hill Development Council (LAHDC), which consists of twenty-six elected members and four nominated members. Over 65 per cent of the electorate exercised their franchise. The elections authorities announced the results on 23 October. The verdict was on expected lines.

The Bharatiya Janata Party (BJP), which had created a history of sorts in the 2014 general elections by winning for the first time the lone Ladakh Lok Sabha seat, created another history by winning handsomely eighteen out of the twenty-five council seats it contested. The BJP dislodged the Congress, which controlled the powerful LAHDC, Leh, for fifteen long years without a break. In 2010, the BJP had won only four seats, which was not surprising since BJP was a marginal political player in Ladakh before May 2014.

The victory of the BJP in the council elections was noteworthy since it had suffered a massive defeat in the region at the hands of the Congress in the December 2014 J&K Assembly elections. The Congress broke all previous records by winning three of the four seats it contested, the fourth seat won by an independent candidate. The BJP defeat had baffled most of the political pundits.

The Congress, which, like the BJP, also contested in twenty five council segments, managed to secure only five seats. In 2010, it had won a whopping twenty-one seats, notwithstanding the fact that it had been in power in Leh district since 2000 [the first LAHDC, Leh, was controlled by the Ladakh Union Territory Front (LUTF), which enjoyed the support of Ladakhi Buddhist Association (LBA) and Ladakhi Muslim Association (LMA)].

Political observers say that it was anti-incumbency that resulted in the humiliating defeat of the Congress. They are partly right and partly wrong. Although the anti-incumbency factor was important the causes of the Congress’ defeat were deeper. One such cause was that the leader of the Congress Legislature Party and former Cabinet Minister Nawang Rigzin Jora, a Ladakh Buddhist himself, had become the mouthpiece for the separatist-friendly Kashmiri leadership. His stands both inside and outside the Assembly after the PDP-BJP formed coalition government in J&K last March alienated the Ladakhis from the Congress.

The stand that the Congress took on the political status of J&K vis-à-vis India or the unstinted support it gave to the 1974 Indira Gandhi-Sheikh Abdullah accord was a negation of what the people of Ladakh stood for, fought for and rendered supreme sacrifices for. The 1974 accord provides for a review of the central laws applicable to the state since August 1953 and withdrawal of such central laws as are considered harmful to the state’s special status.

The people of Ladakh in general and those of Leh district in particular have consistently fought against the Kashmiri leadership’s divisive ideology and hegemony over the state’s polity. They all through demanded, and continue to demand, their complete merger with India. They vouch for a separate dispensation invested with Union Territory status under the Indian Constitution, sans Article 370 that holds J&K aloof from India, creates doubts in the minds of the international community about the political status of the state and empowers the Kashmiri leadership to exercise veto powers in domains of legislature and executive.

The fact of the matter is that they are ardent believers in the concept of national unity and have full faith in the Indian political and constitutional organisation. The comprehensive defeat of the Congress in the council elections needs to be viewed in that context.

This verdict is politically very significant in another respect as well. The people of Ladakh rejected outright the pro-greater autonomy National Conference (NC) and the pro-self-rule Peoples Democratic Party. Both the Kashmir-based parties stand for a limited accession of the state with India and also want New Delhi to take on board Kashmiri separatists to resolve the Kashmir issue. The PDP and the NC had fielded eight candidates each to test the political waters in this region. While the PDP failed to open its account, the NC won only two seats. The PDP and the NC had fielded candidates mostly in the segments where the Muslims were somewhat more numerous hoping their divisive politics would help them make some inroads in the region, but the Ladakhis, including the majority Buddhists and minority Shiite Muslims, reposed full faith in the BJP and five Congress candidates.

The defeat of the Congress, the PDP and the NC was a clear and loud message from Ladakh that it has no place for divisive politics or hate and break-India politics. But more than that, the people of Ladakh, like the people of Jammu province, who had decimated the Congress, the NC and the PDP in the 2014 Lok Sabha and Assembly elections, told the Kashmiri separatists that they will never succeed. The Ladakhi verdict would go a long way in convincing the international community that the majority of J&K is against the ongoing secessionist and violent movement in certain parts of the Kashmir Valley.

It is hoped that the authorities in New Delhi will call the Pakistani bluff and isolate those in Kashmir who masquerade as “true representatives” of the people of Jammu, Kashmir and Ladakh and strengthen the very vast nationalist constituency in the sensitive border state.

Srinagar: Lashkar-e-Taiba (LeT) militant Abu Qasim, the alleged mastermind of the Udhampur attack on a BSF bus on 5 August, has been killed in a gunfight in Jammu and Kashmir, police said on Thursday."Abu Qasim, the operational commander of the LeT, was killed during the night in an ambush by the security forces in Khandaypora village of Kulgam district," a police officer said.
The Hindu reports that the search operation had been going since Tuesday, but Qasim managed to escape. On Wednesday afternoon, security forces and Qasim and other militants engaged in an encounter in the Bhutoo forest. One soldier of the army’s 14 Rashtriya Rifles lost his life in the encounter. Qasim escaped again before the security forces caught up to him on Wednesday night.
Qasim is not only suspected to be behind the Udhampur attack but also of killing Altaf Ahmad, the top counter-insurgency officer in Kashmir. The Hindu reports that he is also allegedly behind other attacks in the Valley, such as the Hyderpora attack in 2013 and the Silver Star hotel attack in 2012.

We may feel surprised/angry/disheartened by seeing such images from valley. But there was a bigger crowd in Mumbai for Memon. This crowd is as much a representation of the whole state as was the crowd in Mumbai graveyard. I am neither trying to reduce the significance of such a crowd in valley nor am I trying to exaggerate the significance of the crowd in Mumbai. My only point is that such crowds are not the barometer of legitimacy (as some intellectuals would like us to believe) while discussing JK status in the Indian union.

all muslim dead terrorist's remains are handed over to the civilians who have undertaken to arrange the funereal of such people. This has been a very long standing practice. Even absolutely unknown dead terrorists attract an audience at their funereals

How on earth do you deal with a state which has so many Jihadi supporting fifth columnists who hate their fellow countrymen just because the latter share a different faith to theirs? No amount of development will please these parasites.

Other than flooding the valley with tens of millions of Indians from other states in order to dilute the separatist voice I cannot see another solution to this problem - but there seems to be no political will to go down this route.
