The so-called constitution of Jammu & Kashmir which the KM and the constituent assembly are swearing by and vowing to protect has this as a preamble (I have highlighted the key parts):
THE CONSTITUTION OF JAMMU AND KASHMIR
WE, THE PEOPLE OF THE STATE OF JAMMU AND KASHMIR, having solemnly resolved, in pursuance of the accession of this State to India which took place on the twenty sixth day of October, 1947, to further define the existing relationship of the State with the Union of India as an integral part thereof, and to secure to ourselves
JUSTICE, social, economic and political;
LIBERTY of thought, expression, belief, faith and' worship;
EQUALITY of status and of opportunity; and to promote among us all ;
FRATERNITY assuring the dignity of the individual and the unity of the Nation;
IN OUR CONSTITUENT ASSEMBLY this seventeenth day of November, 1956, do HEREBY ADOPT, ENACT AND GIVE TO OURSELVES THIS CONSTITUTION.
I am not a constitutional expert but I know a broken agreement when I see one. Each one of the highlighted parts above have been violated.
If the state of J&K and its majority (the first party) have willfully and negligently violated the terms of the agreement and have directly or indirectly caused provable harm and verifiable risk to the integrity of the Nation to which it had "assured to preserve", then the second party, viz., the Union of India, is clearly the aggrieved party and, therefore, has a right to ask the first party to meet the terms of the accession agreement or, in case the first party has not complied, has a right to revisit the terms of the original accession. This means that articles 370 and 37-A are subject to review and renegotiation, or even abrogation.
I suggest that the INDIAN SC ask the J&K High Court to verify that the state and its people have not violated the above. If anyone is found guilty of that violation of the constitution law, should be arrested for breaking the laws of the state.
