BJP ready for debate on Article 35A; call for two-day shutdown in J&K
"The BJP is open to a debate with anyone or any political party on whether or not Article 35A is in the interest of the people of the state. We are extending an open invitation," J&K BJP chief spokesperson Sunil Sethi told reporters.

Sethi said over the last few days, the political climate in the state has heated up over Article 35A and some political parties, especially those active in Kashmir, have taken an "anti-national and anti-people" stand on the issue.

The J&K BJP chief also targeted the National Conference (NC) and the Congress for misleading the people in the Kashmir Valley over Article 35A that it is for their betterment and in the interest of the state.

"The continuation of Article 35A will not have any benefit for the state. The central government has pumped crores of rupees into the state over the last 70 years but the development has not been as it should have been," he said.

Sethgi said that the special constitutional provision has acted as an obstacle in the state's development because it did not allow outside investment.

"Investors do not come here to set up Infrastructure. The youth are not getting the jobs," he added.

The BJP spokesperson alleged some politicians want to maintain the position for vote bank politics.

the islamo - fascist nature of the State Govt is biased to such an extent that the rights of women are denied blatantly in contempt of the J&K High Court . Attempts are made by the Govt to pass amendments in the Legislature to deny rights to women.

Preamble of J&K constitution provides for equality.
Section 19 of J&K Constitution provides for equal opportunities for both men and women.
Article 14 of Constitution of India states as under: “The State shall not deny to any person equality before the law and equal protection of laws within the territory of India.”
Articles 15 and 16 in the Constitution of India prohibit discrimination on the grounds of sex. Article 21 provides right to life. But they are insignificant before PRC law of J&K.

Though the State Government initially filed Special Leave Petition (SLP) in the Supreme Court against the verdict of Full Bench of J&K High Court but later withdrew the same after making an opinion that it will carry out necessary amendments in the Act governing issuance of PRCs.
In March 2004, an attempt was made by the PDP-led coalition government to bypass the High Court’s landmark judgment. It moved an official Bill after the tough stand of Hon’ble Supreme Court which was passed in a record 6 minutes.
But the Bill was declared “defeated” in the Legislative Council. The main reason was that the bill had created a storm in Jammu and at the national level as anti-women, reactionary and out-dated.
But the defeat of the Bill did not deter the coalition government. Instead of implementing the High Court verdict, officials in the Revenue Department continued to endorse “valid till marriage” on the State Subject Certificates issued to unmarried daughters of State Subjects.
In Hari Om vs. State of J&K & others (PIL No. 1002/2004 & CMP No. 1089/2004), the Double Bench comprising Justices V.K. Jhanji and Y.P. Nargotra, in its interim judgment on Sept. 24, 2004, ruled: “In the meantime, respondents (State of J&K & others) are directed not to make any endorsement of ‘valid till marriage’ on the State Subject Certificate issued to unmarried daughters of State Subjects”.
The State Government did not implement the interim order, and dismissed the judgment with contempt. On Jan. 27, 2005, Commissioner/Secretary to the Government, Revenue Department, issued circular No Rev (LB) 87/74 asking the State Subject Certificate issuing authorities to make endorsement: “The certificate may be reissued after marriage to indicate if the lady has married a State Subject or non-State Subject”.
The petitioner again knocked at the doors of the High Court and sought contempt proceedings against the J&K Government, via PIL (COA (PIL) No. 2/2005). The matter went to the Double Bench comprising Justices V.K. Jhanji and Parmod Kohli. On July 11, 2005, the Bench stayed implementation of the impugned anti-women circular and issued notice to the J&K Government. This had its impact on the J&K Government and on Aug. 2, 2005, it withdrew the circular vide No. Rev/PRC/04-WP. Thus the J&K High Court on four occasions delivered judgments aimed at ensuring gender equality. The judgments were unambiguous and were hailed by one and all.

Assam NRC row: Shiv Sena backs Centre, seeks 'ghar wapsi' of Kashmiri pandits
The Shiv Sena on Friday came out in support of the Narendra Modi government over the draft National Register of Citizens (NRC), but asked whether the Centre also had the courage to ensure the "ghar wapsi" of displaced Kashmiri pandits.

The BJP ally said those who posed a threat to the country's security must be thrown out and the infiltrators in Kashmir must be eliminated.

The party said abolition of Article 370 of the Constitution, which gives special status to Jammu and Kashmir, was as much a nationalistic work as implementing the NRC list.

"The issue of national security is not only restricted to the 40 lakh infiltrators in Assam. The situation in Kashmir is worsening day by day. There is more threat from Pakistan, where military rule is imminent under the leadership of Imran Khan.

"Forty lakh illegal foreign residents in Assam have changed the geography, history and culture of that state. The same is happening in Kashmir. Will the government show the courage of ensuring the 'ghar wapsi' (return) of 1.5 lakh displaced Kashmiri pandits the same way it is throwing out the illegal citizens in Assam?" the Sena asked.

The so-called constitution of Jammu & Kashmir which the KM and the constituent assembly are swearing by and vowing to protect has this as a preamble (I have highlighted the key parts):
THE CONSTITUTION OF JAMMU AND KASHMIR

Preamble:-

WE, THE PEOPLE OF THE STATE OF JAMMU AND KASHMIR, having solemnly resolved, in pursuance of the accession of this State to India which took place on the twenty sixth day of October, 1947, to further define the existing relationship of the State with the Union of India as an integral part thereof, and to secure to ourselves

JUSTICE, social, economic and political;
LIBERTY of thought, expression, belief, faith and' worship;
EQUALITY of status and of opportunity; and to promote among us all ;
FRATERNITY assuring the dignity of the individual and the unity of the Nation;

IN OUR CONSTITUENT ASSEMBLY this seventeenth day of November, 1956, do HEREBY ADOPT, ENACT AND GIVE TO OURSELVES THIS CONSTITUTION.


I am not a constitutional expert but I know a broken agreement when I see one. Each one of the highlighted parts above have been violated.

If the state of J&K and its majority (the first party) have willfully and negligently violated the terms of the agreement and have directly or indirectly caused provable harm and verifiable risk to the integrity of the Nation to which it had "assured to preserve", then the second party, viz., the Union of India, is clearly the aggrieved party and, therefore, has a right to ask the first party to meet the terms of the accession agreement or, in case the first party has not complied, has a right to revisit the terms of the original accession. This means that articles 370 and 37-A are subject to review and renegotiation, or even abrogation.

I suggest that the INDIAN SC ask the J&K High Court to verify that the state and its people have not violated the above. If anyone is found guilty of that violation of the constitution law, should be arrested for breaking the laws of the state.

I hope the SC does not back out when the case opens for hearing and provides a deferment a backhanded win to the separatists. This talk of civil war, revolt should not scare us. We already have a war on our hands, let us face it together and let the government do its job and impose the will of the Indian people. Let the court simply answer the legal question at hand. 35A has not gone through the due process of law and hence invalid and not part of the Indian constitution.

Both the J&K constitution and Article 370 (and 37-A) have been violated by the people of J&K (read the valley kashmiri muslims). Let the high court judges in J&K first enforce their own state's constitution and the laws that go with it. Hurr-rats are in serious violation of the laws of the land. Declare them illegal aliens, take away their passports and kick them out.

Otherwise to discuss 37-A with the state is moot. The right place for it is in the dustbin of history.

Expect it to be long drawn. If the SC strikes down Art35A which it should there will be a law and order problem in Kashmir which the govt will not want in an election year.

It is important to break the enthusiasm of NaPaki backers, let them keep calling the strikes for few months. Till then keep giving new dates till they get bored of it. Then strike these unconstitutional articles in one go. These must be thrown out - J&K people enjoy those rights which are denied to others in the country. There should be unified law in the country - no more religion or cast based laws.

Actually, this is the right issue for the election year. Those who oppose the removal of article 35 and 370 aren't going to vote for the govt anyway, so what is the point in deferring?

And as for law and order, there has always been something every couple of years. We'll be OK

Militant recruits in Kashmir have adopted a new strategy to get arms training in Pakistan. They travel on valid visas and infiltrate back into the Valley through the treacherous Line of Control after receiving training.
Of the five Kashmiri militants killed along the LoC in Kupwara this year, at least four had visited Pakistan through the Wagah border on valid documents, a top police official said. The five were buried in Kupwara as they were believed to be from Pakistan. However, the bodies had to be exhumed after their families here identified them.
J&K DGP Shesh Paul Vaid termed it a “new phenomenon”. “While many such militants have been detained, it seems they are now finding it hard to return via Wagah and are taking the LoC route.”
Another officer said a “well-knit militant network” was managing visas and documents. The police say the individuals first acquire a passport and get a recommendation letter from their contact to obtain a visa from the Pakistan High Commission. The purpose of visit mentioned is usually meeting a relative or studies.

SC defers hearing on plea challenging Art 370 to Sept -- Apex court to hear on Aug 30 the petitions challenging validity of Article 35-A

I do not think, this challenge to article 370 will stand. The "period" for temporary is not defined and the J&K assembly as the inheritor of the J&K constituent assembly is a fact validated by courts in the past. I am waiting to see of the 35A challenge will be given its due on Monday.

Lets see what happens. Our judiciary is not very reliable when it comes to national interest as it has been politically subverted for a long time by a particular political dispensation. By no logic of law can Art 35A be called constitutional as it did not go through parliament. Should have been scrapped long back but for support of a particular political dispensation.

Independent India and I are both septuagenarians, but since I am a trifle older, I take the liberty of indulging in some reminiscences, on behalf of us both, on the nation’s 71st birthday. My early recollections are focused on Kashmir, because that is where I was born; in a town called Anantnag, near Srinagar.

Etched in my memory, is the traumatic night of 30 October 1947, when India was a mere 10 weeks old and I had just crossed three years. Clutched in my mother’s arms I, along with two elder siblings, hid under bushes in our garden, as bullets ricocheted off the tin roof of our cottage. We lived in a village named Badgam, about 30 km south-west of Srinagar airport, where my father was a revenue officer in-charge of the district. The fusillade was coming from surrounding hills, occupied by Pakistani kabailis (tribals), en route from Uri and Baramulla hoping to capture Srinagar airport.

At the break of dawn, we piled into the family horse-drawn tonga, with just the clothes on our back and fled to the airport, where RIAF DC-3 Dakotas were disembarking Indian troops. My father watched, as we clambered into a departing aircraft, which flew us to Delhi, and refuge with relatives. We rejoined father in mid-1948, to start life again from scratch.

Growing up, in lovely little towns of the Valley in post-independence decades was idyllic. My playmates were all Kashmiris; of Muslim, Hindu and Sikh faith. Our parents were friends; we ate in each others’ homes, and celebrated festivals together. But even as children, we clearly understood that Kashmir was not (yet) India, and that the average Kashmiri’s attitude towards India was ambivalent.

India provided huge financial assistance to J&K; food, education, clothing and medicine were either free or heavily subsidised. Kashmiris would accept the largesse, but tune in every evening to Radio Pakistan which invariably played on their religious heart-strings, spouting propaganda about "occupation" of Kashmir and "atrocities" by the Bharatiya fauj (Indian Army).

Kashmir’s first ‘Prime Minister’ Sheikh Abdullah was the state’s tallest figure then; a friend of Nehru’s and a staunch secularist, he was the self-styled Sher-e-Kashmir (Lion of Kashmir). In 1953 he fell from grace and was alleged to have conspired with the Americans to become "King Abdullah" of an independent Kashmir. He was arrested, and the Valley burst into flames.

In 1953 as a nine-year old, I recall seeing my father, then magistrate of Baramulla, coming home, bleeding from the head; there had been ‘patharao’ (stone-pelting) in the old town, as agitators waved Pakistani flags and shouted pro-Pakistan slogans. The para-military forces opened fire, and many were killed, before the Valley relapsed into sullen silence.

In 1959 when I left J&K, to join college and the navy, my parents were in Leh (Ladakh), which seemed like ‘Shangri La’. The Valley, too, was peaceful, with few signs of hostility or bitterness amongst Kashmiris. However, an utterly unimaginative New Delhi seemed to have little to offer them, apart from money. The state, being a nest of corruption and nepotism, 95% of the millions that India poured into it, never reached the impoverished Kashmiri. In the absence of a politico-economic strategy for creating jobs, industry or infrastructure, Indian money merely enriched some Kashmiri politicians and aggravated the people’s resentment and alienation; which Pakistan exploited.

India’s maladroitness did not end here. A succession of Pakistani-orchestrated incidents, between 1963 and 1999, demonstrated the ineptness of our intelligence agencies, lack of civil-military coordination and the complete strategic bankruptcy of New Delhi. This depressing sequence included the theft of Prophet Mohammad’s sacred relic, kidnapping of Rubayia Sayeed, sister of ex-Chief Minister Mehbooba Mufti, seizure of Hazaratbal shrine, capture and burning down of the Charar-e-Sharif shrine, persecution and expulsion of Kashmiri Pandits from the Valley, the Kargil War and hijacking of IC-814. Add to this, the self-inflicted wound of the rigged 1987 elections which triggered armed militancy.

This reminiscence is not a history of Kashmir’s travails, but merely a reminder to those who profess shock at the recent developments in the Valley, that the Indian state has, since 1947, learnt nothing from history. It repeated its mistakes and failed to convince the Kashmiri that he/she is an Indian.

We can, smugly, point out, to our Kashmiri brethren, the political and economic mess in Pakistan, and that its PM-elect is, a Taliban supporter, upholder of blasphemy laws, oppressor of Ahmedias and holds regressive views on women. But they see, at home, the political chicanery and government lassitude, which has resulted in repeated crises. The army restores near normalcy, at a big cost in soldiers’ lives and peoples’ goodwill and, on each occasion, politicians in Delhi and Srinagar belie the peoples’ hope that they will step in with a panacea for Kashmir. In this context, serious reflection is required, whether our milieu of growing intolerance and an agenda of revoking Article 370 in a tearing hurry, will really win Kashmiri hearts and minds?

In closing, let me recall three men, forgotten today, who were legends in my Kashmiri boyhood. The gallant Major Somnath Sharma of 4th Kumaon, whose patrol made its last stand in Badgam, to successfully defend Srinagar airport against Pakistani tribals, and who earned India’s first Param Vir Chakra posthumously. Brigadier Mohammad Usman, having spurned Jinnah’s offer to become Pak army Chief, was Commander 50 Indian Para Brigade, which re-captured Jhangar and defended Naushera. Usman was killed by a Pakistani shell and posthumously earned the Maha Vir Chakra.

Last, but not the least was 19-year old Maqbool Sherwani, who realized that the marauding kabailihordes had to be delayed in his native Baramulla till the Indian Army’s arrival in Srinagar. Using guile and deception, he succeeded; but when the enraged Pakistanis discovered his subterfuge, Sherwani was nailed to a wooden cross and shot repeatedly. A grateful Indian Army has erected a memorial to this local hero.

The French have a cynical aphorism: “the more things change, the more they remain the same”. This Independence Day, let us introspect if this is also true of India’s management of Kashmir?

The Supreme Court today adjourned its hearing on a fresh plea challenging the Constitutional validity of Article 35-A, which empowers the Jammu and Kashmir Assembly to define “permanent residents” for bestowing special rights and privileges to them.
A bench of Chief Justice Dipak Misra and Justices A M Khanwilkar and D Y Chandrachud did not take up the matter as the petitioner had circulated a letter in the Apex Court registry seeking adjournment of hearing on the plea.

The Jammu and Kashmir Government today approached the Supreme Court seeking adjournment of the August 31 hearing on petitions challenging the validity of Article 35-A of the Constitution in view of upcoming local body elections in the State.
In a letter to the Registrar of the Supreme Court and circulated, M Shoeb Alam, the standing counsel for the State in the Apex Court, sought adjournment of hearing on five petitions scheduled for Friday, by a three-judge bench headed by Chief Justice of India Dipak Misra.

Article 35-A, which was incorporated in the Constitution by a 1954 Presidential Order, accords special rights and privileges to the citizens of Jammu and Kashmir and denies property rights to women who marry those from outside the State.
The provision, which leads to such women from the State forfeiting their right over property, also applies to their heirs.

Political parties including the National Conference and the CPI (M), have moved the Supreme Court in support of Article 35-A, that also empowers the state assembly to define “permanent residents” for bestowing special rights and privileges to them.

These preliminary objections, filed on December 2, 2015, were settled by FS Nariman and the then Advocate General even as PDP-led government paid Rs 1 crore to constitutional experts for seeking counsel on the subject.

In fact, a letter dated August 1, 2017, addressed to the J&K Law Secretary by then Advocate General, had also noted that a “detailed supplementary affidavit was required to be filed so as to place on record the factual background which necessitated in adding Article 35A to the Constitution.”

No Supratik, all these are excuses. The current one is local elections, next will be LS and after that will be state government and then someone will die, yada, yada. No political will. Disappointing.

Be patient is all i can say. Many vested interests both within and outside India want India to loose in Kashmir. They can flare up things before elections. Without MAD it is going to be back to square one. So be patient.

if anything, chicken out is not what this govt is. Surgical strikes and DeMo were two high stake things. We over here cribbed and complained about this govt on other forums endlessly. Good bad that aside the govt took decisions. I would concur with what suprateek said. This govt and RSS has kashmir always on top of their mind. It seems a thing of past but remember PM spent multiple Diwali's in Kashmir, formed govt with ideological antithesis and walked away from the govt. At least I didnt even know about article 35A before this govt. Revenge is a dish best served cold and relentlessly.
Based on all this I find it hard to believe that Art 35 A will stay. They know pakis are keeping the pot boiling but not keen on boiling the pot. If this govt comes back again with full majority, I would find hard to believe that pakis do not get their narrative of 7 decades burnt in pyre.

The will of the majority of the nation cannot be held hostage to some group demanding special status indefinitely.

Especially not when it has harmed the security of the nation.

Jammu and Kashmir policemen disguise as stone pelters to catch real culprits

The Jammu and Kashmir Police Friday adopted a fresh strategy of nabbing stone pelters by planting its men among them at historic Jama Masjid downtown to arrest the real culprits in action.
As the crowd swelled to over 100 people and two chronic stone pelters started leading the agitation, the first tear gas shell was lobbed at the mob dispersing them. However, to the surprise of the two stone pelters, who were leading the mob, they were grabbed by policemen, covertly placed in the crowd, and whisked away in waiting vehicles.
The policemen, who disguised as stone pelters, brandished toy guns to scare others while the duo were taken to the police station.

I still insist that the cops should use paint guns with indelible paint. If the stone throwers walk around with semi scrubbed faces after that, arrest them.

Terrorists' 'shelf life' reduced, over 360 killed in 2 yrs in J & K ; CRFP DG

NEW DELHI: Back-to-back operations by security forces in the Kashmir valley has reduced the "shelf life" of terrorists and over 360 were killed in less than two years, CRPF director general (DG) Rajiv Rai Bhatnagar has said.

In an interview to PTI, he said as figures show an increase in the number of local youths joining terror groups in the valley, security forces are reaching out to young men through all possible ways to stop them from taking up arms.

Bhatnagar said keeping in mind the security challenges, the CRPF has "increased the protection level" of its troops operating in Jammu and Kashmir by inducting full-body protectors, bullet proof vehicles and special armoured 'interception vehicles' to enable personnel to operate in life threatening situations.

"The terrorists in Jammu and Kashmir... Some of them are from outside and there are also the misguided youth (locals) who join terror groups. It is quite a mix. The numbers go up and down but if you were to look at the length, the time for which terrorists survive in J&K, then the signal is very clear that it (terrorist recruitment) is having no impact.

"The shelf life of terrorists, the time frame to survive, is very short. So, even if the numbers (of joining terror ranks) may be large, they may be more, but the consequence is limited," he said when asked if recruitment of local Kashmiri youths by terror groups is rising and a cause of concern.

The chief of the country's largest paramilitary force said the youth was being drawn into it (terror ranks) as "there was a little bit of glamourisation", but they have to understand that it will not get them any result.

"It is only a matter of time. We have made a lot of efforts (to wean them away) and have also asked them to surrender, and a lot of them have come back. They have to understand that taking up the gun serves no purpose," he said.

The CRPF chief, on youths taking up arms, also said, "Obviously this is something that we have to prevent and take appropriate steps so that the youth does not take to militancy and those who have done so, come back."

"The official numbers show an increase in recruitment. However, with the increase in the number of neutralisations the overall picture is better," he said.

Bhatnagar acknowledged that the forces were taking it as a challenge to ensure that a lot of effort is taken to see that recruitment of youths for terror acts goes down.

Good governance, transparency in official dealings and an all-round exercise is on to gain confidence of the public and the youth in Jammu and Kashmir and the valley, he said.

The chief of the Central Reserve Police Force (CRPF), which has over 60 battalions deployed in the Kashmir valley (over 60,000 personnel), said his force, the state police and the Army are operating in "very good synergy".

The forces now have an edge or to say the upper hand in the terrorism scenario in the valley, Bhatnagar said.

"We have worked as one unit. That has given us a lot of success. This year 142 terrorists have been neutralised. If you look at last year's figures, it was more than 220 terrorists who were killed. There is excellent coordination between security forces and they have the upper hand.

"Their (terrorists') notable commanders have been neutralised. Fidayeen attacks on camps have been effectively rebuffed. We have denied them any success in terms of camp attacks also," the DG said.

He said the law and order situation in the valley is not like any other theatre in the country as there is a "guerrilla hit-and-run like tactic" used here.

"We are, hence, working very closely with the Jammu and Kashmir Police," Bhatnagar said.

"Our drills, our equipment as well as our schemes are working well and we are able to counter efforts to disrupt the operations through stone pelting.

"It is in only on very rare occasions that the stone pelters have managed to disrupt the operations that too when it has been sudden exchange and the preparation has not been there. That has been the only time that the terrorists have managed to get away," the DG said.

He also spoke about better equipping his personnel to combat the security challenge in the state, specifically in the valley.

"We have gone in for better protection, full body protectors for our people, use of less lethal weaponry so that there is less collateral damage and the number of casualties and serious injuries on our side and the public is less.

"The collateral damage has been fairly minimised," the DG underlined.

When asked about the use of much-debated pellet guns and the damage rendered by them on locals, Bhatnagar said while these ammunition are not being discarded, its use is part of a well laid out standard operating procedure.

"The sequence in which we use force is well laid out. We fire and disperse them (protestors) by using tear smoke and other allied irritant kind of non-lethal gases.

"So our first effort is to disperse them by making a proper bandobast. Also, we have a large number of plastic bullets that are used," he said.

Pellet guns, the CRPF chief said, is used where we find that it is required to disperse the mob.

"We are taking precautions by using deflectors (on pellet guns) so that injuries are on lower art of the body. There is a graded use of force. Even when crowd tries to come very close, our boys have shown restraint. We have done our best to meet the objectives for which we have been deployed in J&K," he said.

The pure intent is always to have less and less collateral damage, he said.
