Supreme Court admits plea challenging Jammu and Kashmir's Article 370 status, issues notice to Centre


The Supreme Court today admitted a plea challenging the legality of Article 370. The plea challenges the special status granted to Jammu and Kashmir under Article 370 of the Constitution.

The plea says that Article 370 has lapsed and urged that the separate constitution of Jammu and Kashmir be declared illegal. The Supreme Court has issued notice to the Centre, seeking response to the plea.

The plea in Supreme Court comes at a time when a debate on Article 35A of the Constitution, which entitles the Jammu and Kashmir Assembly to define Permanent Residents of the state, is brewing in political circles.

National Conference chief Farooq Abdullah said that abrogation of Article 35A will lead to a "revolt". "When it will come to that decision, you will see this mass rising. Don't forget when the Amarnath land row happened in 2008, people rose overnight," he said.

They are just trying to scare the govt from moving ahead with abrogating Art35A. There is unlikely to be any more trouble than what there already is. Those in the business of separation will cry foul. Govt should go ahead firmly and scrap 35A. This will be one more progress on core issues.

Yesterday I saw a KM Paki, Gohar Geelani who is the darling of all of p-secs who asked why not have a debate on plebiscite. He even said Chincoms are stakeholders in Kashmir. One thing I see with these KM Pakis is the cockiness with which they brazenly make their demands. They are of the firm believe that with TSP, Chincoms (and of course US/UK) firmly behind them, India can do didly squat. And notice the guy when he comes on DDM, he will puke the usual crap about plebiscite, then have a triumphant cheeky grin on his face, and then goes back to texting or whatever on his phone, while the Indians on the show fret and fume. Just as we say TSPA and TSP RAPE mus pay a price for their terror, so also, its high time Indian govt raise the costs for these KM elites like Gohar Geelani, another Islamist prof, I guess his name is Wahid Siddique, who comes on DDM and peddles conspiracy theories like Amarnath attack was done by Indian army etc.

These guys are so bold because they don't have anything left to lose. By making outrageous demands, anything - any middle ground, any concessions made is a gain for them.
They then reset and ask for more

This is the same funda as some people demand more and more, appeal to the sense of justice, human rights, mediation, every trick in the book

NIA questions Syed Ali Shah Geelani’s sons in terror funding case

Updated: August 8, 2017
National Investigative Agency (NIA) on Tuesday questioned Hurriyat Conference chairman Syed Ali Shah Geelani’s sons, Naeem and Naseem, in terror funding case. On July 31, Naeem was scheduled to visit New Delhi to appear before NIA for interrogation but according to a PTI report, he was admitted to the SKIMS Hospital after he complained of chest pain. While Naeem is the head of the separatist conglomerate Tehreek-e-Hurriyat, Syed Ali Shah Geelani’s younger son Naseem works at an agricultural university in Srinagar.
On July 30, the NIA conducted raids at two places belonging to a close aide of Geelani in Jammu. Devinder Singh Behal, chairperson of Jammu Kashmir Peace Forum was also detained. The NIA also arrested seven Kashmiri separatists in connection with a case of alleged terror funding from Pakistan. Geelani’s son-in-law Altaf Ahmad Shah alias Funtoosh, Ayaz Akbar Khandey, Raja Mehrajuddin Kalwal, Peer Saifullah, Aftab Hilali Shah alias Shahid-ul-Islam, Naeem Khan and Farooq Ahmad Dar alias Bitta Karate are the seven arrested.
An NIA officer said, “We have ascertained financial trails which are leading to some of these accused. It has also been ascertained that some of the funding has been coming from Pakistan.” The NIA spokesman alleged that these men were raising, receiving funds through illegal means, including hawala, for funding separatist and terrorist activities in Jammu and Kashmir. “They were using funds for causing disruption in Kashmir Valley by way of pelting stones on security forces, burning schools, damaging public property and waging war against India.” The agency said that while conducting raids in Jammu and Kashmir, Delhi and Haryana, it has recovered documents, electronic devices, cash and valuables worth several crores of rupees.

Mehbooba Mufti-Farooq Abdullah meet over Article 35A shows how crucial the issue is for Kashmir

On Tuesday, Jammu and Kashmir chief minister Mehbooba Mufti surprised everyone by dropping at the residence of National Conference president and former Union minister Farooq Abdullah at his Srinagar residence to discuss the prevailing crisis over Article 35A of the Indian Constitution that has been challenged in the Supreme Court.

According to reports, Abdullah has suggested to the chief minister that she should consult other parties with an aim to create a wider consensus among “like-minded parties in the battle to prevent Article 35A being struck down in the Supreme Court.”

The Centre, whenever such an eventuality has arisen in past in the apex court, has always defended the case of the Jammu and Kashmir :evil: . But Mufti seems to have been pushed to the wall in this case by the manner in which the country's attorney general, obviously representing the Centre's point of view, called for a "larger debate" on the issue, casting an ominous shadow on the future of the alliance.

[I think all opportunistic Kashmiri politicians have sensed we are upto something which is prompting them to take prophylactic actions..]

Going through the judiciary is a double-edged sword. It means the political leadership is chickening out from taking a decision. Judiciary is full of progressives. Decisions are not predictable.

They fear that their gravy train is about to crash.

It is this exclusivity given to them by 370 & 35A, that they misuse to be the arbiters of kashmir. They are misusing this to make money, taking a pro-separatist stance, every time the gravy train starts to dry up.

Enough is enough already! India has lost too many lives in this nonsense at the hands of these charlatans. Too many lives have been uprooted.
This special status for J&K needs to end at the earliest!

Going through Judiciary is less prone to politicking therefore less chance of political grandstanding and political party backed chaos. Same with quota politics. Same with RJB.

It is an easier way out for the politicos and can be called chickening out. The Executive and legislative options will always remain on the table if the will is there.

My problem is what if the judge is a Nehruvite and they are aplenty. I think brute legislative power should be used even if there is short-term backlash. The people are with the govt on this. The President can declare Art 35A null and void. Leaving it to the judiciary leaves it to chance. I hope this has been thought through.

Unfortunately, there has been a judicial coup in India too, we were too distracted to notice. The people are no longer sovereign and even constitution amendments can be struck down using the entirely arbitrary 'basic structure of the constitution'. Even if the relevant laws/constitution amendments were passed in the parliament, they would surely be challenged in the courts and the final decision be taken there. The current approach is only going directly to the last step.

extremely doubtful if this guy is appropriately specced to take on MAD.

and certainly not easy to butt heads with guys who have working majorities in both LS and RS.

Unless the guy is squeaky clean there is always a way to meet somewhere in the middle. Politics is the art of possibilities.

These are all pressure tactics. The side that can hold its breadth longer will win. KMs will fight it tooth and nail. But if it must be done it should be done.

When the time for BJP-PDP split comes this will be the excuse to push the alliance apart. BJP will push the change and PDP will break the alliance on the issue. It will not come a second before BJP is ready.

Both will get what each want. BJP fulfills its promise and PDP an issue to go to the people and agitate against the center.

Unless the number of people living in Jammy and Ladakh magically increase, there can be no change in the numbers in the state assembly. Getting control of the legislature will require buying out whichever PDP or NC MLAs they can, in addition to winning O er the rest of the populace. Moreover, if possible, we need to find a way to split NC and PDP vote base.

there is a catch. there was no alliance in the last assembly election. they could gang together in jammu to stop splitting muslim vote. but it is a risk worth taking.

My suggestion:

Create two separate states (Kashmir and Jammu) and one federally administered territory (Ladakh). Remove article 370 from the Jammu and Ladakh constitutions. Remove article 35A from Kashmir constitution. Repopulate J&L.

Yesterday, Seshadri ChraiJi was saying that there is nothing, nada, zilch in the instrument of ascension that is conditional. So 35A is not binding. To which a Congoon fomer supreme court justice Dushyant Dave (or Dubey?) was mocking and laughing ChariJi off. As usual the Paki KM on the show, Junaid Matto was strident referring to the instrument of ascension as "your piece of paper", and of course Omar Abdullah's keep was egging the traitors along with soft ball questions and asking loaded questions to ChariJi and of course accusing BJP which is her customary leitmotif. And there was another traitor later, Sugata Bose of TMC who sleeps with some Paki prof, who, at a Asia society event I attended several years ago was peddling 'joint sovereignty' to the nodding approval of the former US amby honchos (well done beta was their message). Bose puke refers to BJP nationalism as aggressive, militaristic, and arrogant.

Leaving aside all the noise, is ChariJi correct that instrument of ascension was unconditional? And if so, why do people as qualifies as Dave/Dubey make a mockery of such a claim?

I believe it will, if one works out the minor quirks. Trying to wholesale remove article 370 from J&K constitution will be hard. Pakis are only focused on K and not J/L. They don't care about the Hindus or the Buddhists. That is why separate the two into three.

Jammu and Ladakh will be a good start. Kashmir will take longer (KM are a breed apart, and thus, must be separated). If Indian policy continues to combine J with K, J & L will continue to economically suffer. Changing the population mix is the goal (as the chinese have shown it, and so have the pakis in GB and PoK). Trying to politically deal with Jammu & Kashmir as one unit runs the risks of inevitable roadblocks from all sides. People in Jammu and Ladakh will be amenable to removing article 370 and 35A but not the valley kashmiris.

Important milestone is if this motion to scrap article 370/35A is hailed in the Jammu and Ladakh area that many elements in the state would want not to happen. Doing it in parts risks ineffectiveness and doing it in the entire state in one go without building a politically viable force of native Jammu and Laddakh would only backfire.
