with reference to the discussion on the Supreme Court judgements on Art 35A and Art 370 the matter was raised earlier also in the case titled Bachan Lal Kalgotra vs State Of Jammu & Kashmir And Others . The order was issued on 20 February, 1987. citations: 1987 AIR 1169, 1987 SCR (2) 369

In the circumstances, in view of the peculiar Constitu- tional position obtaining in the State of Jammu & Kashmir. We do not see what possible relief we can give to the peti- tioner and those situate like him. All that we can say is that the position of the petitioner and those like him is anomalous
it recognized the considerable disadvantage that people are put to by the relevant articles
Surely they are entitled to expect to be protected by the State of Jammu & Kashmir. In the peculiar context of the State of Jammu & Kashmir, the Union of India also owes an obligation to make some provision for the advancement of the cultural, economic and educational rights of these persons. We do hope that the claims of persons like the petitioner and others to exercise greater rights of citizenship will receive due consideration from the Union of India and the State of Jammu & Kashmir.
and finally declined to provide any relief
We are, however, unable to give any relief to the petitioners.

I think the very foundation of Art 35A is now being questioned claiming it to be unconstitutional. It would be very difficult to prove how 35A is constitutional as it came just by way of a presidential order with no parliamentary approval and even if it is constitutional it can be withdrawn in the same manner.

I think that is going to require gymnastics. How do you enforce or not enforce a law in only part of a state. to divide the state you have to first remove 370. The more logical thing to do is to first remove Art 35A in entire state by court judgement or PO. Next step should be Art 370 which will require legislature and can wait after 2019. I am not in favor of leaving it to the courts given some of the kind of species that make it through as judges.

It seems that the way Article 35A was introduced is illegal and it also violates fundamental principles of the constitution. Now it all depends on who the judge is.

If Article 35A is legal, then the cabinet via Pres Kovind can issue an order to change it. If it isn't, it goes out of window. Either way, no problem.

The forced change in demographics by genocide of Kashmiri Pandits should definitely be taken into consideration when people talk about a constituent assembly vote. Fact is that the concept of permanent resident and thereby the legitimacy of the assembly itself should be called into question.

Whether or not 35a itself is relevant now should be the question. There will be protests which must be circumvented by changing the nature of the state assembly. First, enable a change in the definition and then include all retirees willing to move to a subsidized housing in New townships built in Jammy and in habitable regions in Ladakh. Can't be easy but with a 15-20 year plan, we can achieve two goals: save the region, and resettle folks who would appreciate the subsidized housing.

If Art 35A is declared ultra vires by court or overturned by PO, people can automatically move to J&K. No need for state intervention to relocate people except for KPs.

First people in will be ex-sainiks and family that too clustered in defendable groups. There will be attacks but once sufficient mass is in the balance of power will shift decisively.

But the law needs to change for that.

It seems the case has been referred to a three judge bench. The center is not opposing the article but not supporting it. Should have actively done so.
Lets see if the gamble pays off.

Today, there was a complete shutdown in Kashmir against any attempt to strike down Article 35A of the Constitution which defines Permanent Residents of the state and prevents outsiders from buying and owning property in the state. This is the first time that Kashmir has observed a shutdown to protect a provision of the Constitution of India. On the face of it, this is a huge departure from Kashmir's predominant separatism which doesn't recognise the Indian Constitution. In the last 28 years of the separatist movement, different groups have called for over 2,200 days of shutdown - totaling 6 years- for Azadi and a plebiscite. [How very convenient :roll: :evil: ]

The recent spate of encounters of militant commanders and the crackdown on the separatists in Kashmir are nothing but the Central agencies’ way of manifesting their strong disapproval of the Jammu & Kashmir government’s “secret peace deal”, under which some PDP lawmakers were allegedly opening channels of communication with the separatists and the militants, top sources in the People’s Democratic Party told The Sunday Guardian.

Some ministers allegedly opened “secret channels” with both Hurriyat leaders and militant commanders when the government “durbar” moved from Jammu to summer capital Srinagar in May. Determined to broker peace, a senior minister went to Pulwama to explore the possibility of establishing contact with militant commanders active in South Kashmir.

Reports said that the minister, along with a ruling party MLA from the valley, were able to establish lines of communication with South Kashmir’s militant commanders, but before a deal could fructify, the Central agencies got an inkling of it and decided to go for an “all out” operation to nip the CM’s plan in the bud.

The Army moved more reinforcements to Shopian, Kulgam and Pulwama in order to conduct anti-militancy operations, leading to the killing of those who were allegedly roped in by the PDP for brokering the “deal”.

The first one to get killed was Bashir Ahmad. Ahmad was a resident of Kasabayar Rajpora, and it was at his residence a series of meetings were held, outlining the “deal”.

The security grid, which had received inputs from the Central intelligence agencies, had decided to arrest the PDP MLA, but stopped short of that, arresting his driver instead. The driver is being interrogated to ascertain how deep are the PDP leaders’ connections with the militants.

CM Mehbooba felt dejected by the attitude of the Central agencies. According to PDP insiders, J&K’s DGP S.P. Vaid had even announced the broader contours of the deal when he said that the police would go for the counselling of youths who had joined militancy. Mehbooba Mufti had plans to reach out to the Hurriyat leaders, promising them that the Centre would soon open a dialogue with them. But it fell apart as the Centre made announcements to the contrary, while deciding to book the separatist leaders in different cases and probe all the money channels surrounding them.

CM Mehbooba was further snubbed when the NIA arrested seven separatist leaders, including Syed Ali Shah Geelani’s son-in-law Altaf Funtosh.

According to senior police officers, they were told by CM Mehbooba not to allow the NIA to take the separatist leaders out of J&K. But at the Srinagar airport, the police officers, who were pleading with the NIA to complete the formalities before they flew out with the separatists, were told that they had instructions to arrest them if they obstructed the NIA.

The differences between the PDP and the BJP exhibited itself again when Mehbooba’s request for opening more trade routes with the other side of Kashmir across the LoC drew a curt response from the Centre, which said it was seriously mulling to close the existing Uri-Muzaffarabad and Poonch-Rawalkote trade routes on the recommendations of the NIA. Sources said that deep down the PDP is feeling that its public base in South Kashmir has been eroded by the hard policy of the Centre.

Of course, the liaisons come with serious security risks. The movements of terrorists are compromised due to frequent visits to their lovers, not to talk of bitter ex-girl friends turning informers.

This is a great example of offensive defense. The narrative changes from overthrowing the constitution to maintaining the "safeguards" in it.

The case histories, accessed exclusively by TOI, show as many as 14 terrorists from diverse groups like Lashkar-e-Taiba, Jaish-e-Mohammad and Hizbul Mujahideen to be involved in "womanising". Of these, eight were killed between December 26, 2015, and August 5, 2017, while one was arrested upon surrender.
As many as five are active terrorists. One on the radar is Sayar Wani, a Hizbul Mujahideen militant in Kulgam who allegedly uses the houses of "girlfriends" as hideouts, and forces himself on others at gun-point. He currently has a reportedly steady relationship with a girl from Yaripora. (But that does not prevent him to be "in the market" for other "merchandise" !)
A militant from Tral, Mohammad Ishaq, wanted by the police since December 2015 for threatening sarpanchs and panchs, is believed to be in a same-sex relationship. ( Has he "come out of the closet" yet :mrgreen:

Another 'most wanted' terrorist, Bashir Ahmed Wani of Anantnag, who was killed on July 1, was known to be in a relationship with a person from Dialgam. Danish Dar of Sopore used his love interest's house as a hideout, but ran out of luck on August 5, when he was killed.
Junaid Ahmed Mattoo, a Lashkar terrorist who had gunned down two policemen in June 2016, was involved with a woman from Arwani. He was killed in June.

Three Hizbul Mujahideen terrorists, including self-styled chief operations commander Yasin Itoo alias 'Gaznavi', were killed in an encounter that began on Saturday night and also claimed the lives of two armymen in Shopian district of South Kashmir.
Following a tip-off to the local police, a cordon was laid in Awnira village of Shopian on Saturday night by the Special Operations Group of the Jammu and Kashmir Police, Army and the Central Reserve Police Force.

The explanation of how exactly our casualties occurred are seldom provided in our media (could be operational secrecy but more likely just media apathy). However, I wonder if this is caused by our protocol of offering/allowing surrender first before shooting? The only other way that it could happen is if we were ambushed.

This is what news reports say:
The gun fight started Saturday night when a joint team of police and army launched searches in Avneera village. Militants fired at them in an apparent attempt to break the cordon, injuring five army men. Two of them -- sepoys Gawai Sumedh Waman and Ilayaraja P, both 25, -- died late in the night.
Another:
However, even as the cordon was being put in place, residents of the village started pelting stones at the joint team. Sources said that while the militants and security forces opened fire, another group of militants started firing at the soldiers from outside the perimeter. “This is for the first time in over a decade that militants from outside the site of the gunbattle have come to the help of their besieged associates,” said sources.

“I have never seen militants firing from such close range. The soldier who was killed was just ten metres ahead of me,” said a senior officer.


According to police sources, the firing by militants and the stone-throwing by local residents helped several other militants, including two other Hizb commanders Saddam and Altaf, escape. “The attack from outside was an attempt to help Ghaznavi escape but he could not break the cordon despite moving from one house to another. We have also recovered a Krinkov rifle,” said sources.
Looks like other militants mingled with the stone pelting scum( or it was the stone pelting gang itself) and fired on these armymen

Two other commanders escaped because of these stone pelters

Massive and continuing stone pelting during almost all encounters strongly indicates involvement of local police and even PDP in encouraging these stone pelters.

This Article is legally sound. Both Article 35A and 370 can be removed by a Presidential order. There is no need to even pass a ordinary Resolution or Act in the Parliament. As soon these Articles are removed J&K will revert to being an Ordinary State and normal legislature can be constituted for it. Otherwise, UOI can formally annex J&K and designate it as a Union Territory.

Think of it in a reverse way. Terrorists hide only in places where they are assured of such support.

if there is one thing I would rue is the limited a) night fighting ability, they still wait for the day break to go for the kill.

Anyways one picture in the DFI shows the stone pelters keeping vigil standing on trees using torches during the night more like monkeys ready to shout alarm at the sight of a tiger

they have to fix a) before we can even expect these
b) aerial recon on demand
c) using UAVs and Choppers to engage

The Kk 62 , also known as Kvkk 62 (konekivääri 62 "machine gun 62" or kevyt konekivääri 62 "light machine gun 62") is a Finnish 7.62×39mm light machine gun designed in late 1950s with the first prototype ready for testing in 1960. It was officially adopted as the standard infantry support weapon of the Finnish Defence Forces (FDF) in 1962 as the 7.62 konekivääri 62; the first weapons were delivered in 1966. Four Hurriyat leaders in 14-day judicial remand
A Delhi court today sent four Kashmiri separatist leaders, including the son-in-law of Hurriyat faction chief Syed Ali Shah Geelani, to 14 days’ judicial custody in the terror funding case. Apart from Geelani’s son-in-law Altaf Ahmed Shah, popularly known as Altaf Fantosh, the others to get 14 days’ judicial remand are Peer Saifullah, Mehrajuddin Kalwal and Nayeem Khan.
Three other separatist leaders — Shahid-ul-Islam, Farooq Ahmed Dar and Mohamad Akbar Khanday — were sent to judicial custody till September 1 on August 4. The court’s order came after the NIA submitted that they were not required for further interrogation. All seven accused were arrested on July 24 on charges that they were allegedly receiving funds from Pakistan to sponsor alleged terror activities and stone attacks on forces in the Kashmir Valley.

JKLF chief Yasin Malik arrested in Srinagar
Jammu and Kashmir Liberation Front (JKLF) chief Yasin Malik was arrested by police here on Saturday. A spokesman of the JKLF said Malik was arrested from his residence in Maisuma area. Malik along with Hurriyat leaders Syed Ali Geelani and Mirwaiz Umer Farooq has been spearheading the separatist resistance in the Kashmir Valley for over one year.

Just how we have now realized how Gandhi-Nehru dynasty has conned India throughout the "freedom" struggle, similarly we must understand that ethnic cleansing of KPs by jehadis wouldn't have been possible without tacit government underdealings. If gobarmint wanted to nail the militancy, it could have done so easily in past. Just the way current government is doing it. By giving free hand to police/armed forces. All these years their hands were tied. Now its's appearing as piece of cake for them to kill pigs on daily basis.

Regarding the stone pelters, what we need to do is to have drones take videos. Then round them up later. And while we're at it, post it on Youtube. It will out the libtards and their ilk and will build political space to use steel on the pelters.
