regarding the case filed in the Delhi High Court on Article 370
Even as the state Law Department has announced that it will fight the petition filed in the Delhi High Court challenging Article 370, the BJP, which is part of the coalition regime, has expressed ignorance about any such decision taken by the government.
“I am not aware of any such decision by the government to fight the petition in the Delhi High Court,” said Minister of State for Law Ajay Nanda, who belongs to the BJP. “There is no question of the Law Department taking such an important decision without consulting the BJP.”
Quoting Law Secretary Abdul Majid, local media yesterday reported that the government had sought a copy of the petition from the Delhi High Court to fight the case with clarity. “We have to thoroughly examine the petition filed in the Delhi High Court so that we will be in a better position to counter the claim,” the Law Secretary was quoted as saying in local reports.
The Delhi High Court on Monday had agreed to hear a public interest litigation (PIL) challenging the constitutional validity of Article 370 that gives special status to Jammu and Kashmir.
The PIL, which challenges the Constitution Order, 1954, that adds a proviso to Article 368 of the Constitution, was listed for hearing before a bench comprising Chief Justice G. Rohini and Justice Sangita Dhingra Sehgal. The bench said it would take up the matter for further hearing on January 2 after the winter vacation.
Not showing much enthusiasm for contesting the petition, the Minister of State for Law said both coalition partners would sit together and discuss every aspect of the PIL before taking a final decision on fighting it. “Without thoroughly going through the PIL, how can we say that the J&K Government can become a party to fight it,” said Nanda, who himself is an advocate.
After the Supreme Court’s historic verdict on the Securitisation and Reconstruction of Financial Assets and Enforcement of Security Interest (SARFAESI) Act, Kashmir-centric parties and other separatist groups have already stepped up attack on the PDP for allegedly diluting the state’s special status. And now the Delhi High Court has admitted a PIL challenging Article 370.
The Supreme Court in its verdict had observed, “It is clear that the state of Jammu and Kashmir has no vestige of sovereignty outside the Constitution of India and its own Constitution, which is subordinate to the Constitution of India… they (residents of state) are governed first by the Constitution of India and also by the Constitution of Jammu and Kashmir.”
The BJP has hailed the Supreme Court’s verdict as historic.
The statement of BJP spokesperson Virendra Gupta provides an indication of the party’s stand on Article 370. “Because of Article 370, growth and development of the state has been hampered and it has only benefited the ruling elite of the Kashmir valley. The masses, particular of the Jammu region, have become victim of the secessionist and parochial designs of the ruling elite,” Gupta said.
Highly placed sources in the BJP said Gupta’s statement was part of the party’s strategy to send out a message to its coalition partner that it was against fighting the PIL in the Delhi High Court.
The BJP has decided to mount pressure on its coalition partner not to become a party in the PIL. The abrogation of Article 370 is at the core of the BJP’s ideology, though the party had shelved this demand to share power with the PDP.
Despite repeated attempts, Law Minister Abdul Haq Khan, who belongs to the PDP, was not available for comments.

The best and only option IMO is to carve a area out of Kashmir (a la a city town like Chandigarh) and make it exclusive homeland for KP's and let them with their hard work make it a prosperous city with no fear of Jehadis running it over but that would need long term planning and cojones of steel.
Going back to Kashmir and living like Pre-90 is not a option for KP's.

Effectively they have been cleansed out of their own state by muslim terrorists and a govt that did not defend them.

IMO Govt needs to bifurcate J&K into 4 entities of which 3 will be trouble free while 4th one needs to be handled on district to district basis. Also would keep lots of leaders busy in fighting for loaves. 'Divide and Rule' is just not a slogan created for history books, it was used successfully by Brits in all their territories.
Current administrative structure of J&K is untenable and will always have KM terrorists calling the shots and scamming both Pakis and Delhi Sarkaar.

Repealing requires state assembly to ratify. As long as NC/PDP hold the numbers, that will never happen.

In principle, if the national parties BJP+Cong get together, together they have enough numbers to pass the repeal motion in the assembly.

Does Art 370 anywhere suggest that the state can not be bifurcated ?
Anyways security and well being of the nation is way beyond any article. GoI can let courts decide the legality of the action for next 40 years while the state is divided.

There appears to be no end to controversies in Kashmir that vitiate the peace and tranquility of once called “Paradise on Earth” more often than not. The enemies of peace in almost every situation are no other than the separatists who claim to represent the sentiments of a particular segment of population that sells the unachievable idea of “azadi” and in the process ruin Kashmir’s peace and economy.Mainstream opposition parties too don’t miss opportunities to exploit such public protests to run down the Govt of the day.
After a prolonged turmoil following Burhan Wani’s killing in an encounter that spread over the entire tourist season and working period, Kashmir is again on the threshold of a new phase of disturbances. This time, the issue raised by separatists is the grant of Domicile Certificates to the West Pakistan refugees living in Jammu for the last seven decades without any tangible rights akin to “State Subjects” due the State’s old peculiar law that confers special privileges to them to the exclusion of other Indian citizens. Surprisingly, the 3-time CM and the president of State’s premier and secular party, Dr. Farooq Abdullah too has lent his weight to the separatists on this issue claiming it as “dilution of State Subject law and identity”.
Indeed,the special PRC law is discriminatory in nature but has constitutional protection. Consequently, these refugees have been deprived of basic rights but however,are entitled to rights available to other Indian citizens like jobs that are not under the State Govt and participation in Lok Sabha election.
In the deplorable phase of communal frenzy and bloodbath that marked the birth of two nations in 1947, non-Muslims migrated from Pakistan to different parts of India. Out of about 47 lakhs Hindus and Sikhs who migrated to safer locations in India as refugees, 5764 families mainly from Sialkot, one of the richest cities of West Pakistan, and Shakargarh had entered Jammu. It was Sheikh Abdullah who was then heading the State administration, allowed the refugees to stay in the border villages. Today, their number is 19760 families including 20 Muslims. Barring these families, all other refugees who migrated to other parts of the country have since assimilated into their new homes without carrying any taboo of being ‘refugees’. But this was not so in Jammu where they are ‘alien in their own country’.
Political leaders continued to roll out promises to these unfortunate refugees for their permanent solution but the State laws and Kashmir leadership always came in the way. No political leader in India or J&K had courage to brush aside all these obstructions; legal or political, and do justice to them. Modi during his election campaigns in Jammu in 2014 and 2015 too parroted similar promise to them as also other categories of refugees in the Jammu. The PDP-BJP Agenda for Governance also included this issue for action. It records under heading “Social & Humanitarian Initiatives” that “For the deprived groups, the coalition Government will work out a one-time settlement for refugees from Pakistan Occupied Kashmir of 1947, 1965 & 1971; take measures for sustenance and livelihood of the West Pakistan refugees…”
A pleasant announcement came in early December 2016 that the State Government would issue Domicile Certificates to all these refugees who could not be given Permanent Resident certificates under State laws. Naib Tehsildars were authorized by the State Govt to issue certificates whose format too has been communicated.Even as citizens of India they were facing problems in getting Central Government jobs for want of domicile certificate. The certificate records their original place of residence in Pakistan before migration and the present place of residence. It verifies two facts, one is that the certificate holder is a Displaced Person (DP)from West Pakistan and the second is the present domicile. It is not Permanent Resident Certificate which has its own history and legal requirements.
It was in 1927 when the local people agitated to the Maharaja Hari Singh that Punjabi were coming to J&K to grab major share of jobs and acquire land that deprived the natives of these limited opportunities. Kashmiri Pandits who constituted the major educated class amongst the locals were the worst affected by this trend. To protect the interests of the locals, a State notification bearing No. I-L/84 dated 20th April, 1927 was issued followed by another State Notification No 13/L dated 27th June, 1932 that categorized the residents in Class I, Class II and Class III. This law was allowed to continue even after Independence to protect the interest of the ‘State Subjects’ under Delhi Agreement of 1950 and subsequently by the State and Union Constitutions.
Section 6 of State Constitution defines the Permanent Residents as “(1) Every person who is, or is deemed to be , a citizen of India under the provisions of the Constitution of India shall be a permanent residents of the State, if on the 14th day of May, 1954- (a) he was a State Subject of Class I or of Class II: or (b) having lawfully acquired immovable property in the State, he has been ordinarily resident in the State for not less than ten years prior to that date…”
Section 8 of the Constitution empowers the State Legislature to “make any law defining the classes of persons who are, or shall be, permanent residents of the State,” while Section 9 gives power to legislature to (a) ” defining or altering the definition of the classes of the persons who are, or shall be, permanent residents of the State: (b) conferring on permanent residents any special rights or privileges” (c) regulating or modifying any special rights or privileges enjoyed by the permanent residents”
The State Constitution did not define ‘Permanent Residents’ but referred to the Maharaja’s notifications of 1927 & 1932. These privileges and rights are in gross violation of the fundamental rights of Indian citizens being discriminatory on grounds of place of birth (Art. 15 (1), equality of opportunities for employment (Art. 16 (1), right to acquire, hold and dispose of property ( Art. 19 (1) ( f), and right to reside and settle in any part of India ( Art. 19 (1) ( e).The Govt of India had agreed to protect these special rights of the’State Subject’ but to avoid misunderstanding the words ‘State Subject’ were agreed to be substituted by words ‘Permanent Residents’ even in the State Constitution. With the Constituent Assembly ratifying the Accession on 5th February, 1954, and issuance of Presidential Order on May14, 1954 under Article 370, Part-II of Indian Constitution was extended from May 14, 1954 recognising ‘State Subjects’ as Indian citizens from Jan.26, 1950, but Part-III ( Fundamental rights) extended from the date of issuance of the Order i.e May14, 1954. Consequently, the Constituent Assembly made related provisions for ‘ Permanent Residents’ by inserting Sections 5A to 5F first in the Kashmir Constitution Act of 1939 under which the State was run till the new Constitution of the State was adopted and enforced on Jan 26, 1957.
It is noteworthy that special rights and privileges to ‘Permanent Residents’ under State Constitution are not static and can be ” defined and amended” by the State legislature in terms of the power conferred on it by Sections 8 & 9. So, the Legislature can define ‘Permanent Residents’ to include or exclude any group of people on any exigency. The State had used this power once for granting ‘Permanent Resident’ status to Tibetan Muslims in Kashmir. They were not only settled in a separate Tibetan Colony in Srinagar but also allowed jobs under the Govt. No issue, it was compassionate consideration. But why West Pakistan refugees were deprived of this facility? Is their religion a real problem?
Separatists are fueling the issue of Domicile Certificate to West Pakistan refugees in Jammu by misleading people of Kashmir that it would change the demography of J&K. As per 2011 Census Report, the Muslim population the State was about 68% (85.67 lakh out of total population of 1.25 cr with decadal addition of 17.74 lakh against 5.61 lakh of Hindus),and how can less than 20,000 Hindus and Sikh families living here since 1948 would change the demography? They are motivated by more of communal consideration and not as much of claimed change of demography or any other rationale. Moreover, Domicile Certificate is neither PRC nor the State PRC law changed to bring these DPs in the fold of the State. This is sheer disinformation.
Why the separatists and other mainstream Kashmir centric parties are silent on the increasing presence of Rohingya and Bangladeshi refugees in Jammu? Is their silence because of their being co-religionists?
According to Govt. figures given in the last session of the Assembly, about 13,400 Rohingyas and Bangladeshi refugees are living in Jammu. Bathindi, a Muslim colony in Jammu city, alone housed 686 Rohingyas. This ethnic group, along with thousands of their Muslims was forced to leave their homes after a crackdown on them by the Myanmar junta about five years ago. Despite illegal settlers in Jammu they talk about”Jammu being hundred times better than their native Myanmar as all religious groups live here in harmony”. However, security agencies view them as a security risk in view of Pakistan’s exploitation of vulnerable groups for subversion.
NC is gearing up for bigger ruckus in the budget session of the State Legislature, making it an issue of “dilution of State’s special identity”. But how? It is never explained. While this unlawful settlement of foreigners is going on for last four to five years but both BJP Govt in the Centre and now in the State is maintaining intriguing silence of fast changing demography of the Winter Capital.
Many of the womenfolk amongst them have married the local Muslims and thus legally became ‘State Subjects’ while their relations have bribed their way to get this status through manipulation. Obviously, the separatists and Kashmir based parties don’t view this trend as threat to demographic structure of J&K.Even if the people of Kashmir may not fall in the trap of separatists for another spell of upheaval, the stand taken by them have exposed their communal politics.

I think the NC Abdullahs thought Hillary will win seeing Robin Raphael rehabilated and started crowing about Azadi and supporting Hurrirats.

I think a good case to haul them up for all the loot in name of Cashmere.

On the face of it, trifurcating J&K seems like a no-brainer, yet no government has gone ahead with that step. So there must be a good reason this has not happened despite the passage of time and multiple governments. In my opinion that is because we do not wish to change the status quo of the state given its "disputed" status and our claim over entirety of the state. The moment we mess with the boundaries, our claim on the occupied areas gets weakened. Keep in mind that Pak has also not formally incorporated "Azad" Kashmir, Gilgit & Baltistan into Pakistan as province or provinces, again because in their claim it is the entirety of J&K (excluding areas in Chinese possession).

Since this is also related to TSP, cross posting from J&K thread. SSJi, look forward to your insight on whats cooking.

Very disappointed that Yashwant Sinha seems to have turned a WKK. Of late, he is advocating that India bend down on its knees before the Harried rats, and he even advocates kissing up to TSP. This from the same guy who just recently in his many speeches and articles was steadfast in maintaining that TSP is a perpetually hostile country, its a terrorist abomination, and no point talking to it. He even praised ModiJi for the surgical strikes. So what gives?

It befuddles me that everyone advocates this BS about "talking to our own people in the valley". My bloody foot. They must answer the following questions:

1. What is the purpose of the talks? Not just some nonsense about "bringing p!ss". Those who recommend dialogue, do they unequivocally believe J&K is an integral part of India, and any alteration of this sacred principle will be a non starter in any dialogue?

2. If so called "our own people" demand secession in any talks, what will Indian govt's position be? After all, if dialogue is the only option, then in the dialogue, Kashmiri Muslims will re-iterate what they have always demanded: secession. So whats the purpose of the dialogue?

3. Anybody who thinks they can neatly separate out "our own people" in the valley from TSPA/ISI/RAPE needs to have their heads examined. "Our own people" cannot utter a single word without approval and remote control signal from TSP. Do they understand this or not?

4. Finally, do they understand or not that terror and violence in the valley is controlled and calibrated by TSP?

So every Johnny come lately pontificates on the "need for dialogue" with "our own people", but don't realize the futility of any such "dialogue". What saddens me in this whole thing is that for ages we have been saying that Harried rats have no credibility, they are irrelevant yada yada, and yet we have the likes of a BJP stalwart like Yashwant Sinha advocate that we suck up to those Paki pipsqueaks.

Mehboob Mufti says in a speech in J&K Assy that only emotional integration with India is left as technically the state is integrated with India.
This is a quantum jump from the Abdullah and the Hurrirats point of view.

I think after a big IAS guy from Kashmir wrote article about giving honorable way out of conflict for Hurrirats etc , stage is being set emotional putch putch with Valley Urchins.

A beautiful sculpture of Lord Vishnu Ji dating 2005 BC was excavated in Simthan area of Bijbehara tehsil in South Kashmir district of Anantnag and it is in possession of State Archeology, Archives and Museums Department.
The sculpture was discovered by the people while digging the earth in the area five days back. They handed over it to Bijbehara Police which later informed the State Archeology Department and handed over it to them in presence of Tehsildar Bijbehara, Sajad Ahmed today. The sculpture is with one broken arm.
According to Director State Archives, Archeology and Museums Department, Mohammed Shafi Zahid, the sculpture is akin to the figures of Verinag sculpture which are rich in iconographical details and speaks about richness of art of Kashmir. The sculpture is having rosary, long ear lobes and decorated crown on its head, he added.Zahid said he is proceeding to Srinagar tomorrow for further information and details. He said Simthan in Bijbehara is richest archeological site, where in ancient period, a university under the name of Vijeshwar also existed.
He said besides the sculpture of Lord Vishnu Ji, earlier eight to 10 sculptures of various Hindu Gods including Kartikya and Ganesha were excavated from this site. In addition to it, pottery and stone implements of stone period were also unearthed from during the excavation in forties and they are lying with Archeological Survey of India (ASDI).

Muslims in JK leaving religion becase of ISIS.
ISIS have left deep scars in the "promises" of Islamic state. People are questioning the whole idea. Totaliterian society is just not working.

He said terror activities by groups like the so-called Islamic State are responsible for people shunning their faith in Kashmir. "Youth in Kashmir are very sensitive. Everything is on the internet these days. They have seen how innocent people are slaughtered and killed by Islamic State in Syria and Iraq."

In a major setback to the ruling BJP, which had often been supporting two month yatra to Shri Amarnath Ji shrine in South Kashmir Himalayas, located at the height of 12,756 feet from sea level, Shri Amarnath Ji Shrine Board (SASB) today drastically reduced the yatra period to just 40 days this year.
An official announcement made by the SASB after its 32nd meeting in New Delhi said annual pilgrimage to Shri Amarnath Ji cave shrine would commence on June 29 on the occasion of Skandshasthi and conclude on August 7 coinciding with Shravan Purnima and Raksha Bandhan.
“The yatra would last 40 days,” it said.
Governor NN Vohra, who is also chairman of the SASB, presided over the meeting.
The yatra has lasted 59 days (July 2 to August 29) in 2015, which was reduced to 48 days in 2016 (July 2- August 18). It has further been reduced to just 40 days in 2017 (June 29- August 7). In 2013 also, the yatra duration was 55 days (June 28-August 21).
The SASB announced that 7500 pilgrims would be allowed to proceed to the holy cave shrine everyday from each route (Baltal and Nunwan) totaling 15,000 per day. This means that a total of 6 lakh pilgrims will be entitled to undertake yatra during 40-day period this year.
Advance registration for the pilgrims will start on March 1, 2017 through 433 designated branches of Punjab National Bank, Jammu and Kashmir Bank and YES Bank, spread over 32 States and Union Territories.
The Board further directed CEO SASB PK Tripathi to advise the intending pilgrims to secure the Compulsory Health Certificate issued by the doctors /hospitals nominated by the State or UT in which he resides and only thereafter processed to seek Advance Registration from the nearest located designated Bank which would issue the pilgrim a Yatra Permit which is valid for his journey on the specified date and the specified route.
The Board called for timely steps for ensuring uninterrupted telecom connectivity during Yatra 2017. Appreciating the services rendered by the Langar Organizations during Yatra 2016, the Board expected continued cooperation from them during Yatra 2017.
The Board said the pilgrims should take into account the harsh climate and terrain in the high altitude region of the Yatra area and prepare themselves fully before embarking on the pilgrimage.
“As in the past the awareness campaign would be launched with the cooperation and support of the Ministry of Information and Broadcasting and CEO shall also place all information relating to Yatra on the Board’s Website (http://www.shriamarnathjishrine.com),” the SASB said.
Noting the Chairman’s direction to take sustained efforts to further improve the facilities to be provided to the pilgrims the Board reviewed the Action Plan, which has been drawn up for the conduct of Yatra 2017, particularly the arrangements being made for providing medical care, sanitation facilities, and installation of the railings at all vulnerable places along each of the two routes and the measures being taken to preserve the environment of the Yatra area by ensuring solid waste management and removal of garbage in a scientific and environment friendly manner. The Chairman directed the CEO to ensure that all the arrangements are timely in place well before the commencement of the Yatra.
The meeting was attended by Sri Sri Ravi Shankar, Dr. Kapila Vatsyayan, Dr. (Prof.) Ved Kumari Ghai, Pt Bhajan Sopori, Vijay Dhar, Dr Devi Prasad Shetty, D C Raina, all Members of the Board. Besides, P.K Tripathi, Chief Executive Officer and Jitendra Kumar Singh, Additional Chief Executive Officer of the Shrine Board, also attended the meeting

Both the Houses of J&K Legislative Assembly have adopted a one sentence “unanimous” resolution saying. “all the political parties should put in all out efforts at their disposal for creating a conducive atmosphere for the safe return of all the migrants especially Kashmiri Pandits, who had to migrate from Kashmir valley to other parts of the country under difficult circumstances”.
Nothing is more uncharitable and ridiculous than responding to the twenty-seven years old issue of ethnic cleansing of Kashmir and extirpation of its millennia old indigenous group from their homes and hearths with just one gratuitous sentence.
The tone and tenor of a lone sentence wrapped in carefully chosen high-sounding parliamentary terminology, and given the name of “Resolution,” is unmistakable indication that that its proponents have other motives than the antics of humanism. They are playing crude politics with those who do not at all count in their political chemistry. It is another joke with them.
We are told that it is the first ever resolution adopted by J&K Assembly on a sensitive issue, which Kashmir political class and its diehard champions in New Delhi —- in or out of government—, have always treated with disdain. For more than a quarter of a century when this community is in exile, the Assembly never felt the need of making even a customary show of humanistic gesture leave aside passing a resolution and that too unanimous. Pandits will not succumb to political gimmicks.
The person who mooted the idea, almost out of the blue, in the Lower House of the Assembly, himself held the reins of government for two consecutive terms. Prior to him, his father also rode the tide of power for a long time. Neither of the two ever felt the need of bringing in such a resolution during their tenure. Now that Omar is swearing by humanism, a word that did not exist in his political lexicon all this quarter of a century has suddenly become a champion of the cause of humanism and a benefactor of the exiled community.
This explains that there is something more than what meets the eye. Firstly, why did the humanitarian sensitivity fail to prick the conscience of the leader of the opposition who himself enjoyed power for two consecutive terms during which he was at the helm of affairs?
Secondly, the text of the one-sentence resolution is denuded of all historicity and contextual background. It is randomly incoherent with neither a prologue nor en epilogue.
Is the option of creating conducive atmosphere in the hands of the legislators or the separatists and secessionists? If it is in the hands of legislator then they have been deliberately and purposefully vitiating the atmosphere all these nearly three decades. The resolution is not going to change their hearts.
But if it is not in their hands, then the resolution is futile and irrelevant. It makes an appeal to the legislators but not to the people of the State, the people who fiercely opposed the return and rehabilitation of the internally displaced Pandits jointly proposed by late Mufti Saeed and PM Modi in New Delhi. It has to be recollected that most of the legislators in the Lower House of the Assembly who “unanimously” voted for the resolution are the very persons who had created huge ruckus in this very house against the return of the Pandits when announcement by the then chief minister and the Prime Minister. Even some MLAs from the ruling group were accomplices in that ruckus. How come this change of heart happened overnight?
After passing the Resolution in the Assembly, what stops them from reverting to the old antics of hunting with the hound and running with the hare?
The Resolution proposes “safe return” of Kashmiri Pandits. Who will ensure their safety? When armed insurgency surfaced in 1989-90 in Kashmir, the NC-Congress coalition government of the day abandoned power and their stalwarts hid either in a foreign country or in the Government quarters in Jammu to escape the wrath of the insurgents leaving the Pandit religious minority to the mercy of the jihadis with drawn swords. Will such governments provide safety to the returning IDPs? Pandits don’t live in a world of illusion.
Will the State police provide them security, the same police that deserted their posts and stations and joined the armed insurgents providing them logistical support? Most of the killings of Pandit Government functionaries in central and state intelligence services took place on the identification by the local police.
And lastly, remains the role of army and Para-military forces. But the State government, mainstream political parties, Hurriyatis and diehard extremists all demand that army be withdrawn, paramilitary forces be withdrawn and only local police should be seen on the streets of the towns and villages of Kashmir. What security can the army or Para-military forces provide to the Pandits when these forces themselves are on slippery wicket? It is not humanly possible to deploy paramilitary and military force to protect each and every Pandit household.
The best security for a religious minority is the good will of the majority community. But in a situation of surcharged religious frenzy, which is a handy instrument with all extremists segments of mainstream or non-mainstream political parties in Kashmir, security of the religious minority becomes a casualty. The Resolution has not said a word in elucidation of ‘security’ it is pontificating.
The Resolution deliberately avoids mentioning the real cause of extirpation of the religious minority from Kashmir in the aftermath of armed insurgency in 1990. It attributes their exodus to “under difficult circumstances”. Any historian, researcher or student reading this Resolution fifty years from now, will never be able to imagine what the “difficult circumstances” were.
In Kashmir, there was armed insurgency sponsored from outside, welcomed by the locals and deftly handled by experienced and battle hardened intelligence sleuths who had accumulated vast experience of conducting identical operations in Af-Pak region for many years. It was a meticulously planned and most efficiently as well as secretly conducted proxy war against India in which the Hindus of Kashmir were made primary target of armed jihadis.
By using the term “difficult conditions” the Resolution absolves the murderers, terrorist, looters, vandals and all who played major role in killing and extirpation of the religious minority of the Pandits followed by loot and arson of their homes and properties. These are not “difficult conditions” but a situation of gravest threat, premeditated, planned and executed with deadly thrust.
By passing a resolution that carefully and cleverly sidetracks the facts of history and the ramifications of ethnic cleansing of a minuscule religious community in the only Muslim majority State of the Indian Union, a big question mark is put on the concept of secularism propounded by the State of Jammu and Kashmir.
In final analysis, the sensible way for doing justice to the extirpated community is to order instituting a Commission of Inquiry headed by three judges of the Supreme Court of India to establish the causes of rise of religious extremism in Kashmir and fix the onus for the extirpation of the Pandit minority community. The findings of such an inquiry will clear huge overgrowth of falsehood and canard under which the stunning truth remains concealed. That will also pave the way for the format of interaction between them and the majority community in Kashmir.

20 years is quite a long time. Older generation might have passed away. Younger generation have already moved on with jobs and other livelihoods. So how much it is feasible for them to pack all their bags and headback to hellhole named Kashmir, I don't know. However they should retain property rights and ideally if each of them can open a hotel or conduct some business in K-state as a right, that would be a good idea.

PoK locals take to streets against Pakistan's atrocities

ISLAMABAD: Anti Pakistan protests have been taking place across Pakistan occupied Kashmir (PoK) for weeks now, even as Islamabad on Sunday observes the annual Kashmir Solidarity Day in support of the Kashmiri people.

Enraged at Pakistan's high handedness and denial of basic human rights in the held region, the PoK residents took to the streets to express their ire at the corridors of power in Islamabad.

PoK residents claimed that the Pakistani government, via its intelligence agency Inter-Services Intelligence (ISI) and administration, is committing atrocities on innocent citizens.

The demonstrators further alleged that there is no existence of civil liberty and fundamental rights in PoK, as the ISI is calling all the shots in the administration.

Those who don't agree with Pakistan's occupation are being persecuted and tortured and authorities are muzzling the voice of people and curbing basic right of freedom of expression, asserted the protesters.

Journalists, bloggers, civil rights activists all are targeted for speaking and exposing Pakistan's real face to the world.

An equally dismal situation prevails in Gilgit Baltistan, where recently there was a massive crackdown on journalists.

Such avoidable loss of life is really sad.
Whenever there is a possibility of an avalanche risking lives of troops and/or villagers, the area should be first evacuated and then an avalanche should be triggered by dropping some explosive charge from helis. Just a simple precaution like this can save precious lives.

Putting all speculation to rest, the government on Tuesday informed Parliament there was no proposal for setting up separate colonies for Kashmiri Pandits in Jammu and Kashmir. Minister of State for Home Hansraj Gangaram Ahir said this while replying to a written question from Ashwini Kumar of Congress in Lok Sabha.

4 Terrorists Killed In Kashmir's Kulgam, 2 Soldiers Die In 10-Hour Encounter
SRINAGAR: Four terrorists have been killed in a 10-hour encounter in Jammu and Kashmir's Kulgam that started last night. The encounter - at Frisal village, around 60 km from Srinagar -- has also claimed the lives of two soldiers and a man in whose house the terrorists had holed in. Three other soldiers have been injured.

The encounter was followed by massive clashes between the protestors and police, in which at least two dozen people were injured. Most of them sustained bullet injuries and four of them were shifted to Srinagar for treatment. One of the injured men, 25-year-old Mushtaq Ibraheem, died in the district hospital.

In one way this new tactics employed by terrorists shows a tightened escape routes on the other hand it shows more Palestinization of Kashmiri terrorism. I am sure authorities will undertake a major cleansing operation after such incidents but this dramebazi has to be stopped and the cost be increased so high such elements think thrice before repeating it.

^^ I don't think a democratic govt in presence of a 'secular' press/media can perform this dirty job, I repeat we need to put j&k through presidential rule and repeal art 370 at the earliest to clean this terror factory, the more we let this drama continue it will increase the costs at a future date; terrorism in Punjab was not eliminated by words of peace and love,
as they say never engage the same enemy for too long in the same fashion.
Militancy all said and done is on back foot and we are much better placed diplomatically to trash any OIC or UNSC resolutions, the more we delay the more China/CPEC dynamics will play a role, once CPEC is complete and Pakistan is 35th province of china, the arc of evil(Communalism and Communism) will increase its influence and assertiveness in our matters including J&K article 370
PS: Militarily i never think it was a challenge to contain it or reduce it to manageable levels apart from the time factor
