Is there a concept of class action suit in India? Can people who were banned/attacked on twitter for their beliefs/targeted get together and file a class action suit based on discrimination grounds for damages?

As predicted, nothing has happened to Twitter. There have been no fines and there was never a threat of blocking them anyway. Twitter has made no changes, committed to nothing and provided no assurances. The cases filed are symbolic and the whole IT regulations are challenged in court.

In short, this government appears full of show and bombast and won’t confront anyone, even if it’s a lightweight as Twitter.

No one expected a ban/block but one did expect fines, curtailment of revenue using financial means or more usage of other platforms.

This is getting to be a habit lately. The old BJP habit of being non combative that was present when it had 2 seats and 116 seats is back.

Closest match would be Public Interest Litigations (PILs). But the petitioner should be able to convince that the action of twitter is targetting a set of people. Also every individual who find their beliefs targetted can approach the courts in his/her area. In fact this route is more popular and easier to achieve. When Mo.Fo Hussein drew up insulting pictures of Hindu godesses, there were many cases filed in multiple courts in India. Hussein then had requested Supreme Court to club all these petitions and hear it at one place. Finally he did not wait for that and ran away to UK. If there are multiple petitions in multiple courts the accused/defendant will have fun running around all these courts.

With a 300+ seat majority the current government may be the most impotent one. I do understand that main ministries (Home, Revenue, Defence etc.) have their hands full due to COVID situation, but are having some grip over things. But that does not mean other departments have no time. Ministry of I&B, MeitY have been consistetly performing in a poor manner and no course correction done yet. MeiTY is under SS Dhotre and I&B under the 'ever popular' :roll: Prakash Javdekar. After all talks and gung-ho posture the BJP has not been even make to make a minor impact on main stream media or social media outlets.

And lo and behold, the Twitter India MD has been granted a reprieve by the courts as well. So all in all Twitter has cocked a middle finger to BJP.

You are 100% right. It is sad that failed actors like Sonu Sood and Swara Bhasker have more PR and impact than this government.

There's always that pride about not changing any textbook while during the COVID-19 times they could have easily created slew of educational videos for students to take on various topics. Topics could have included analysis of various ways that social media is anti Hindu.

NYT has a real problem with India. Big article about covid cases surging in Africa. India is mentioned as main cause of Africa 's problem (via delta version). No mention of China or who gave vaccine to Africa.

RSP facing some serious flak on SM for his schoolboy whining when he is the actual Minister meant to be taking action. No fan of SuSa but there is probably room to keep him happy by giving him this role and a chance to take on the likes of twitter et al

What is even more frustrating to the point of making one angry is that a company that is not even a heavy weight is making a government that has a historical majority in Parliament appear powerless.

One cardinal rule is that one should never make “last chance” type of threats if one is not prepared to follow through. RSP has made a fool of himself, the BJP and the GoI

He should immediately order all Govt. departments to stop using Twitter and switch to Koo. Then ban it after a week and setup an investigation

I wonder now how much of the Twitter brouhaha in India is due to ego problems of ministers in government. Best to work through the courts as the new regulations come into force.

I have started enjoying the humiliation of Ministry of I&B and MeitY etc. If these people don't have the guts to challenge some one, then they should not come up with the joke called 'strict rules'. It is now proven that these two ministries are more like glorified eunuchs who have no governing skills, and not even the basic skill to earn some one's respect. If these people had some spine, they could have at least moved all government department Twitter handles to some other Indian made platform. "Power gets respect"; if these 'Gandhians' don't get it, then it is only them to be blamed.

This takes the cake. and it is also indicative of how closely jack on crack is watching the BJP leaders.

This is clearly malicious intent and has been instigated by jack on crack poking sony to make the complaint now for a post that bumbling prasad made in 2017.

this very same music has been posted millions of times by countless twitter accounts, youtubers, Instagrammers, facebook thookers and bumbling prasad gets singled out now for a post that he made in 2017.

so, how will bumbling prasad react, in the gandhi way or the sardar patel way

time to take the gloves off. India's parliament does not have to answer to anyone including other bleeding heart "pillars" of "our" institutions and guardians of "our" democracy.
As it turns out, RS Prasad’s Twitter account was blocked for a post from his account in 2017.

On 16th December 2017 when India celebrates Vijay Diwas, RS Prasad had posted a video which was a tribute collage for those who laid their lives down during 1971 where India defeated Pakistan and Bangladesh was born as an independent country.

The background music of that video had ‘Maa Tujhe Salaam’, sung by AR Rahman, produced by Sony Music.

It is pointless blaming Jack. If one expects to be taken seriously one needs to have self respect first. If one does not respect oneself or the organisation one represents, it is useless to expect that others would respect you. Both ministries currently have no self respect left.

To be fair, both MeitY and RSP are active on Koo. Next step probably should be to reduce posting on Twitter. Hold back posts randomly or only post every other post to Twitter.

Twitter interim grievance officer for India Dharmendra Chatur quits
Don't know if there are more stories happening at the background. This official's resignation should not stop GoI process of making Twitter understand the law in India. But don't have much hopes on R.S Prasad & Co.

HC refuses to stay new IT rules regulating digital news media

Some of the applicants to the suit are listed below.
Foundation for Independent Journalism, The Wire, Quint Digital Media Ltd and Pravda Media Foundation, parent company of Alt News, sought a stay on the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021, on the ground that a fresh notice has been issued to them to comply with the rules or else coercive action will be taken.
It is a rogue's gallery.

Pravada Media Foundation is the parent of Alt News. Given the propensity of this agency to lie outright I will be surprised if this agency is not related to the former USSR agency.

The rest of them are similar agencies.

It seems that the plan is not to ban twitter. It is to get them to run away by creating so many obstacles that either they will comply or will have to run away.

I hope that this Jeremy twit is not accepted as a compliance officer if he chooses to remain in the communist republic of California.

Does that solve anything? Does anyone know whether it is mandatory to have Indian offices for a company to operate in India?

Apart from not making ad revenue what prevents Twitter from shutting shop in India and continue as normal?

twitter took away the Indian Vice President's blue tick and gave it to the PFI in Karnataka.

So we now have a jehadi organisation in India that is blue ticked, but a request for the blue tick by the Art of Living, kolkata chapter, has been denied by twitter which says that AOL does not meet the criteria set by twitter but somehow and very strangely, PFI Karnataka does.

Time to show these bigots the door.

Hamburg's data protection authority has banned Facebook from processing personal data from German WhatsApp users

This collection of data was discovered earlier after German authorities did an audit. European Union (EU) Data Protection Authorities (DPAs) have been actively and consistently enforcing regional and national privacy laws against these same companies.

This is one way they will hit back against ameriki companies which can insidiously cross international borders without affected countries being able to do much about these transgressions

The net result is that: All German Authorities and Government Agencies are to leave Facebook by the end of the year: Federal Data Protection Commissioner

This will undoubtedly have EU wide repercussions, likely leading to other countries outside the EU clamping down too.

So, just wait patiently for them to screw up in India as well.

Looks like they are on their way out, anyway

Yes and yes. After the law two things can happen.

Lose intermediary status. I.e Can be prosecuted for garbage posted
Neck to choke. I.e someone within the purview of Indian law will be held accountable


Please note that previously "shoot and scoot" was easy. I.e anyone can post anything libelous/scandalous and the intermediary will be in communist republic of California( to borrow from pratyushjis words) and be answerable to no one. Please note that data retention for 180 days after the "user disappears" or remove questionable material within 72 hrs etc.
