The objective is to take the matter out of both political and judicial preview. Once it's done, regardless of what is done, the mosque will come down.

Even stranger, peacefuls are justifying theft and nobody in MSM is calling them up on this. Black lives matter, statues need to torn down, names need to be changed, histories to be rewritten and in the US former presidents need to be cancelled but in India Hindus need to endure!

SuSwamy is going hammer & tongs on this GyanVaapi case and was seen recommending central government to repeal The Places of Worship Act, 1991. This recover temples scheme can also go against NaMo and BJP. There are many such demands now with an expectation that NaMo and BJP would sort these out. They would be seen weak, "secular" :roll: and not strong enough to give what the Hindu community demands. SuSwamy etc can spin these incidents to hit back at BJP and NaMo as well.

I also feel that the info about Baba Vishwanath being found and the survey video being released (leaked) was to set a narrative among the people before any gag order could be passed by any Court. Very Chanakian indeed. Any gag order will be basically infructuous after every WhatsApp bearing phone already has this information. Now the issue is in the people's court.

Gyanvapi Mosque hearing: SC orders sealing 'Shivling' area, allows access for prayers
The 'leak' of survey findings seems to have been a deliberate move and also done at the right time. The advocate commissioner may have stepped beyond his mandate, but by this move the judicial establishments will not be able to keep away the survey findings and the court deliberations away from the public eye. The "Classic Case of Shivling" will now have to be settled very clearly and in a way that the general public are convinced. And this seems to be a starter doze as the survey reports would bring out more artefacts related to the old temple (including the Nandi statue).

Chandrachud might try to set a "new precedent" by allowing this to become a syncretic place of worship. A protected area for Shivling + continued namaz by the peaceful --> this may become the steady-state solution. It will be heralded as a "watershed" moment by the leftist gang.

He will not let a Babri happen under his watch, either by the people or by the administration. Even a judgement that asks the State Admin to rebuild a mosque at taxpayer expense, will not go down well with the Muslim community

He will also, in whatever judgement he comes up with, uphold the POW act.

BJP, if they really care for Hindu interests, must repeal the POW act and allow excavations everywhere. But knowing them (from Modi downwards), they will try to extract political mileage from Gyanvapi & Mathura - and pretty much stop at that.

Before we start cursing the government, may I please bring to your notice that the PoW Act has been declared by The Supreme Court as a part of the "basic structure of the constitution" in the RJB judgement and hence no party can change/ repeal it (Clause 82, page 122 of the judgment)

But if some commentators are to be believed, that does not stop any ancient monument (i.e. more that 100 years old) to be restored to its original character

Basic Structure is a self-referential joke that makes the Constitution look like some sort of Holy Book with commandments that cannot be questioned or altered. It goes against the very nature of society and laws. It’s like the “contempt of court”, blasphemy style monstrosity

Literally anything can and should be changed. And this Govt has the people’s mandate to do so

The reason I don’t have hope from BJP on this is because they have not shown spine in taking on the SC so far. Plus they tacitly allowed the PoW to be passed by staging a walkout.

if it is a clear cut case under the POW act, then how and why did Supreme Court refuse to stop Gyanvapi mosque survey......

Places of Worship Act, 1991 not applicable on monuments older than 100 years.



What are its main characteristics?

The Act states that a site of worship's religious trait must remain the same as it was on August 15, 1947. It asserts that nobody ever shall translate any religious denomination's holy site into one of a distinct denomination or section. It asserts that each and every lawsuit, appeals, or other proceedings pertaining to transforming the character of the area of worship that are pending before any court or authority on August 15, 1947, will be terminated as soon as the legislation becomes effective. There can’t be any further legal proceedings.


However, there is an exception to the prohibition on implementing new deliberations in cases involving conversions of status that occurred after August 15, 1947. This saves judicial proceedings, lawsuits, and appeals concerning the possibility of status that occurred after the cut-off date.

These clauses do not pertain to ancient and historic landmarks, archaeological locations, and is still protected by the Ancient Monuments and Archaeological Sites and Remains Act, 1958; a lawsuit which has been eventually settled or discarded of; or any disagreement which has been settled by the stakeholders or conversion of any place that occurred by acquiescence prior to the Act's commencement.

The Law was not applied to the Ayodhya place of worship known as Ram Janmabhoomi-Babri Masjid. It stated that this legislation will take precedence over all other laws currently in force.

There is something called economic crisis, BJP is walking on coals right now. Its stupid to do a final charge at this point of time. Build Rama temple, let's celebrate that. Then make sure Gyanvapi mosque Shivling is made a proper place of worship. Meanwhile develop economic and military capabilities.

POW act is some arbitrary cr@p pushed by peaceful lobby under PVNR, I wouldn't put it past him to sneak in a 100 years back door while pouting inscrutably.

Places of Worship Act, 1991 is not applicable on monuments older than 100 years.

So the owasis, ranas, & arfas are wilfully misleading the people, especially their own people.

In fact Section 4(3) of the Act actually exempts everything which is over 100 years.

And the 1st petition on Gyanvapi was filed in 1928 and at that time the act did not exist. Read it's subsection 3(4) as well.

The congi govt made one mistake and left one loophole in that act.

and that loophole was that if the site falls under the Ancient Monuments and Archaeological Sites and Remains Act, 1958 then Place of worship act won't be applicable.

That means if someone can prove that the place comes under ancient monument then it wont come under place of worship act.

Now what is ancient monument ? Any monument or place of worship that is more than 100 years old could be deemed as an ancient monument.

So suppose an idol is found in any mosque that is more than 100 year old then ASI has powers to declare that site as ancient monument n then place of worship act wont be applicable.

So if the Shiva Linga found in Gyan vapi mosque is more than 100 year old (As it is definitely)

Then ASI can declare that site as ancient monument and then POW act wont be applicable in that case court can give that place to the Hindus.

I am that sure minds behind this Gyanvapi activity must be aware of this loophole and they will definitely use it.

So by this they can reclaim all temples without repealing place of worship act coz all mosques have some idols, and many are built on sites that are more than 100 years old.


but, in the long term, we need that the act to be completely repealed, as it's a deliberate, wilful and evilly calculated mockery of an ancient civilization, a bleeding premeditated wound left festering by the colonial powers and their collaborating successors and bootlicking lackeys

2/3 majority in both houses.upper house can reject 3 time and drag it to 18 months. President can send it back for considration. SC protests etc. Democracy has safty valves counter prssure groups. So majority govt can not behave like dictator. .

let us hope that the loopholes pointed out above are valid. Otherwise, I am not very sure of the outlook for any change in the PoW act- this is a government which has always treated the judiciary with kid gloves e.g., NJAC. In that instance the judiciary acted in a highly arbitrary fashion and against the valid law of the land, but the government for perhaps good reasons but best know to itself backed down and put the law in abeyance.. where it remains

^^^^ it is not a loophole, but redundant to apply Places of Worship when ASI act is applicable. According to ASI act, (which has same provisions as PoW act) if its more than 100 years old, and declared as Ancient monument, then that place would come under the protection of ASI (Archaeological Survey of India) and can be used as a place of Exhibition/picnic spot but not a place of pilgrimage. They will not allow Pooja to the moorthy.

Actually, sometime back ASI tried to map Tirumala on the request of TTD, so that even if some things are getting eroded, ASI has the capacity to restore. It was done with good intentions after "Veyyikaalla Mandapam" was destroyed but couldn't be transferred to some other place as state govt. Of Chandrababu Naidu didn't have technical expertise to map the stones, dismantle the struture and build it again the same way as used to exist at a different place. So in 2018 ASI accepted the request and sent a letter to that effect. Then TTD realized that, if ASI steps in, ASI would stop the poojas and make Tirumala as picnic place, not a pilgrimage anymore.

So, those who think bringing ASI into picture are in delusion. Archeological Survey of India was basically established in 1950 through an act, by Nehru, to protect Islamic Monuments in India post independence and also to prevent Hindus to start pooja in ancient temples, once taken over.

See the Brihadeeswaralayam in Tanjore, its a picnic place not a place of worship.

There are no Hindu places of worship in India, except those which have been under continuous pooja for the last 100 years.

When there's no worship of Shiva for the last 100 years at Gyanwapi, its a picnic spot, not a devine place.

Also mind you, it was Gouri pooja which was discontinued at that place, not the Siva aradhana... so technically Hindus dont have any claim on the Shivlinga which was discovered. Its just a piece of rock.


If at all anything has to be done, it has to be done a'la Babri Masjid and the places of worship act has to be amended

If you needlessly elevate the "status" of "minorities" without defining such in the constitution, not only will they become radically entitled by osmosis, but also climb on your head and deliberately micturate on you

These are not defined as minorities anywhere else in the world and neither are the Hindus accorded such "minority" status anywhere

so very easy to exploit and socially, as well as, culturally subjugate the Hindus by guilting them ad nauseam

and did one ever think that a day would come when gandhi would be on the walls and Godse would be in hearts of the people.

+1. I remember reading that PVNR was associated with RSS in his younger days, even though as a politician he opted for the secular Congress party.

Then they did a poor job on two counts 1)they still wished to pray in their old place of worship 2) they also did not do a good job in destroying the old building and building some thing new afresh. Also in case of temples like Gyanvaapi there could be evidences of the secular Moghul despots ordering the destruction of those specific temples.

India is being bribed by the greedy gora marketing guys because of the sheer size of it's affording middle class market. Their own markets have plateaued out a long time ago. This is an attempt to hard sell their products to a woke market that they hope to create and choreograph

They all do the conventional analysis of marketing data, and that, in India, is often deceptive. these guys all forget that even the allegedly free spending upper middle classes are notoriously price sensitive.

India is being celebrated as the first-ever country of honour at the Marche du Film at the Cannes Film Festival that is currently in progress. The goras will not do this without a moneyed and business reason tied to their collective bottom lines

The Miss world title also came India's way even though there were better qualified contestants at the beauty pageant and for the very same reason too.

Recent global events have also brought India an undeniably prominent brand recall and whether that is a good or bad thing, remains to be seen.

These goras tend to see India in terms of indolent bulls sitting placidly in the center of many a busy street, contentedly chewing the cud, while the traffic flows around them.

The goras are slowly beginning to realize that many of those often tranquil bulls have b@!!$

Macron and Lenain are eager to please India right now as France realises both countries have some long ladders within the next throw of dice to move up the global power game, while other players are risking getting swallowed by long snakes. In a non-offensive way, both of us are good Tier 2 players who can combine strengths to close-in on Tier 1s and zoom past many others. India needs to get a lot more going with French in the indo-pacific, who keep repeating we have 2 Million + people in this region hoping India will take serious note.

This may not be acceptable under the rules of Islam. How can a mosque share space in a building where another deity is worshipped?

Do you think that these people are in any way following the rules of Islam? Their only interest is to spite non-Muslims and sustain communal disharmony so that they (ashraf) can retain control over the (pasmanda) masses/mob.
