Nupur's petition was to move all the cases filed against her in various courts across the country to Delhi. Judges should have either granted it or said no and given the reasons. But then the judges are onto sermonising.

This is an even bigger problem when comments made by a judge are treated as defacto law of the land, at par with a bill passed by the Parliament. We need serious reforms.

basically abduls with butcher knives have won this round and more hands down. Comments are also very misogynist in nature (loose tongue) Judge himself got scared it seems after seeing the Udaipur video and took the easy way out. What are the options here?
-BJP rehabs NS into another white country with tough laws against shantidoots (Hungary), Canada, US are being taken over by them .
-BJP top honcho gives bayan against judiciary that this is unacceptable
-BJP uses other means to penalise miya lords . Bunglaws, muft bijli pani ration freehoarding? All of them seem to be corrupt. Get a file on them?!
Patna HC: 90s once Lalu asked Judges to vacate secretary bunglaws as they were not entitled. From next session personal jibes at Lalu stopped.

Mutterings that Suryakant making remarks was promoted to SC from HC by Namo himself inspite of brazen IT cases on him. Is there a chankian strategy behind?

no reason for anyone to loop in gadkari.

The hierarchy in the state politics is already set and was producing results that have alarmed the erstwhile partners of the MVA, both individually and collectively. In fact, one of the driving forces for onion toppling the BJP was their very real fear of being side lined in the very taliban like ecosystem that they had built and nurtured over the decades.

Earlier the entire sugar conglomerates system spawned another govt and that govt was self perpetuating in its hegemony over the rural landscape and the trapped inhabitants. The system of political patronage, financing crop cycles, APMCs, skimming off the top from coop banks using benami loan accounts was considered an impenetrable fortress until DF walked in and upset the apple cart.

The SS was a mere fringe player compared to the onion emperor and his extended dienasty of grubby fingered offspring. Used, as they were to the legacy of benaami accounts with fake pan cards, new regulations for mandatory aadhar linking is giving them huge grief. It was a washing machine for political black money and the center has closed down that route.

The rumoured 99 prominent families who were the defacto rulers of MAH since independence seem to have lost their steam after they were defanged. DF was majorly instrumental in the laying of the ground work and artfully sowing the political minefield. SS and UT was the front that the onions used to bring down the BJP and form the remote controlled MVA.

The SS saw huge value in the rural hinterland for rent seeking and that is how it fell into the onion trap. Reeling the SS in after that was mere child's play for the onions.

But gadkaris interest in MAH politics is understandable but at the same time it can be damaging as well.

for a guy who has spent so many years in politics and is able to read the tea leaves so well, his unwelcome interest in MAH state politics has set many a top BJP leadership's teeth on edge.

I think, even now all is not lost. We should learn to get many blows and still prevail for the eventual win(battle - war tactics change). The tax evasion case needs to opened just to drag and make him realize he himself is not worth to be a judge of other persons actions now.

Govt should moot idea of reforms in judicial system and openly talk about judges who indulge in nagging and bitching around(loose moths).

This judge and the chandrachud types may be under some phobia / mental disturbance. Lakhs of cases running around for several decades and being very unproductive even while working, summer vacations like school children's, club memberships are all needs to be get to public news.

Some psychological tests needs to be set for the judges yearly , for allowing them to continue till their retirement.

Some of posters here made the claim that appearing to be apologetic to the gulf countries is a good idea due to large number of diaspora etc. I had posited at that time, that this diaspora is needed more by them than us, so they can administer their countries. And that these two bit despots be shown the lifted dhoti

But I also pointed out that this is like an event with far-reaching consequences like parakram withdrawal, kandahar, sharm el sheik etc wherein external enemies take a cue on how soft Indian state is, when GoI did not use shield of “Freedom of Speech” and instead fell on the sword of “UN resolution on Islamophobia”

Turns out I was wrong - not just external enemies but internal grandstanders too thought GoI is ok with the UN resolution. A judge and beheaders took that cue.

Sad day. More lives will be lost :(

SC on NupurSharma case.

The clubbing of all cases against Nupur Sharma (which are similar in nature) makes a lot of judicial sense, first and foremost being that it avoids double jeopardy. Second, it helps in efficient dispensation of justice.
Third, it gives Nupur Sharma a fair chance to defend herself at the trial , all in one go.

SC has:

Violated fundamental rights.
Has voiced "opinion" (quote below) and kept that opinion away from the written order - pointing to inherent bias.
The way she has ignited emotions across the country. This lady is single-handedly responsible for what is happening in the country. We saw the debate on how she was incited. But they way she said all this and later says she was a lawyer, it is shameful. She should apologise to the whole country,
Another example of SC random garbage:

"What was the TV debate for? Only to fan a agenda? Why did they choose a sub judice topic," the Court demanded.
Was there any guidance from SC on media censorship for the matter which is sub judice?

Yet another:
"The freedom of a journalist cannot be equated to that of a political spokesperson who is making statements on television and ignites emotions across the country," the bench said.
Wrong, whichever freedom , whatever it is , must be applied, equally, uniformly and without discrimination.

Ad-hoc, demeaning to citizens and worst of all - vindictive - for now the SC has refused to club the cases making Nupur Sharma defend herself in multiple locations in the country for the same charges even when there is precedence from the SC to the contrary.

A total bunch of clowns.

I came across AG Venugopal and his age when reading about him giving permission to prosecute Ajeet Bharti for contempt. I find it astonishing that someone that old is serving as AG and now received an extension. From his letter on the Ajeet Bharti case, he seems quite empty-headed and not having any special qualities that warrant keeping him on at age 90.

Can someone knowledgeable shed light on how this is possible? Who benefits from this man’s presence in office?

A reset of Kesvananda Bharti verdict is well nigh. Claiming custodianship of Fundamental nature of constitution etc took a huge hit today and the justices should be made aware of the lack of confidence by the other arms of power.

Time for kicking off an impeachment process (even if party arithmetic won’t allow its success ) and NJAC implementation has come. Too many things are sliding.

Time 21:30Hrs IST, 01/07/2022. I scanned the new portals for the latest news on Nupur Sharma (including the Deccan Herald site) from which I had shared the news report on SC bench 'observations'. All those news reports have vanished from the main page. I also checked a local vernacular news web site, same is the case there. The news reports have vanished. All this in a matter of 3-4 hours. This coordinated pulling back of the news reports seems to be based on some pressure from some one on the top level hierarchy. But I cannot guess who that would be.

Deccan Herald now only have a small report -Plea filed in SC for withdrawal of remarks by judge against Nupur Sharma

All said and done, the criticism coming from common people on social media - against Judicial Establishment, BJP, Modi - was really high. I could also see a dejection in the common Hindu and at times BJP cadre on the pussyfooting done by Modi & Co. The belief that Modi is trying to become 'secular' to get the 'world citizen' image is slowly gaining traction.

Govt. can't take SC head on.

All they have to do is help BIF file a case on military purchase and these guys keep making disparaging statements to hurt the Govt. They will do this next year or two when elections are near.

Many a times the judges use this 'oral observations' route to play out their whims and fancies and act as a demi-God. There is also a plausible deniability if things go wrong; as none of these statements would be there in the official decree/verdict/order. The main stream media gets a chance to use these 'oral observations' to further their agenda.
Dilbu wrote:This is an even bigger problem when comments made by a judge are treated as defacto law of the land, at par with a bill passed by the Parliament.
Comments & 'oral observations' do not become the law; but what ever is there in a verdict/order becomes the law of the land. And this again is not a good practise as judiciary is usurping the right to frame laws, rather than being an interpreter.
Hari Seldon wrote:Am sure some "chankian master-stroke 56-D chess" explanation will resurface from the usual suspects. Deja Vu.
At least observing what is trending on twitter & social media. Even fence sitters have now started changing their pro-Modi stance. Modi seems to be working on his own agenda (which may be good or bad). Amit Shah seems to be only capable of managing elections and handling of MLAs & MPs. The law minister is Kiran Rijjiju who is trolled for tweeting about dance classes and promoting tourism to his state. To be frank; Ajit Doval also seems to be more of a 'James Bond 007' (i.e hero through manufactured stories).
hnair wrote:Claiming custodianship of Fundamental nature of constitution etc took a huge hit today and the justices should be made aware of the lack of confidence by the other arms of power.
The biggest problem seems to be the selection criteria for the self appointed custodians of the Constitution and its fundamental nature. Perhaps it may be a good idea for GoI to come up with a documentary on the higher judiciary during all these years; which can also highlight a short biography of the judges and how they were elevated. This *may also* bring out cases where few people from the same family/clan appointed as judges in the higher courts.

This is the structural problem that've been discussed to death here. Like other parties BJP needs a shadow government of junior players who can do this kind of dirty work. Gives a chance to younger folks to learn. You can't build Rome in a day.

The BJP Govt at the Centre (read Modi & Co) seems to think that these issues are "nuisances" that distract from their Sabka Saath agenda. While that line of thinking is understandable, its fatally flawed. You cannot build wealth without building the means to protect it. 1300 years of history has shown that we are great at building & rebuilding our nation & wealth. Not so great at protecting it from barbarians.

So, when the average Hindu life is at risk, the Govt should take it very seriously. The majority population is currently feeling betrayed, insecure & angry.

You don't rebuild a civilization by sacrificing a certain % of people as "statistics", which is the implicit approach of BJP (be it killings in Kerala, WB, Rajasthan or elsewhere). What's needed is an "all for one & one for all" attitude. That's what builds teamwork and motivates people to great heights. Wealth with security.

Sadly, as one Swamiji said in a video posted recently, the BJP seems more keen on reaping the political fruits of Hindu deaths than in preventing/avenging them
