SC’s Election Commission judgment upsets a delicate balance
A steadfast commitment to balanced constitutionalism is imperative
The judgment holds that hereafter, and until such time as Parliament enacts a law contemplated under Article 324(2), appointments of the Chief Election Commissioner and election commissioners shall be made by the President on the advice of a committee consisting of the Prime Minister, the Leader of the Opposition of the Lok Sabha and in case no Leader of the Opposition is available, the Leader of the largest Opposition party in the Lok Sabha in terms of numerical strength, and the Chief Justice of India.


The judgment is questionable on several grounds. The Court erroneously locates the constitutional intent behind Article 324(2) in the Constituent Assembly debates, contrary to its plain language and settled principles of statutory interpretation, which posit that a speech made in the course of a legislative debate is at best indicative of the subjective intent of the speaker and cannot prevail over the plain words of a constitutional text.

{Key point. What's in the Constitution is that which matters not some windbag waxing eloquent in the Constituent Assembly. For the SCI to take recourse to speeches to derive intent is erroneous and is stretching the Court's powers.}

The language of the provision is self-explanatory and reads thus:

Article 324: “The Election Commission shall consist of the Chief Election Commissioner and such number of other Election Commissioners, if any, as the President may from time to time fix and the appointment of the Chief Election Commissioner and other election commissioners shall, subject to the provisions of any law made in that behalf by Parliament, be made by the President…”

To read the words “subject to the provision of any law to be made by Parliament” in Article 324(2), not as a parliamentary option but a constitutional command to Parliament to peremptorily enact a different stand-alone law, is a fraught exercise in stretched constitutionalism.


Indeed, the absence of law contemplated in Article 324 (2) for the last seven decades represents a conscious legislative rejection of a special law on a subject covered by the constitutional provision.

In fact, the wokelord went so far as to say that they would declared the Shinde Govt formation as "unconstitutional", if the Thackeray/NCP Govt had agreed to take the Trust Vote (even if they lost). Because he thinks that the Governor acted in an unconstitutional way.

Recall the CEC over-reach. I had said, like many others, that the Govt would do nothing. It has panned out exactly as predicted. By doing nothing, they are emboldening the SC every day and the legislative/executive domain of operation, freedom of thought/action is steadily decreasing.

Hope they realize the danger and fight-back before it gets too ugly

Mean while looks like Karnataka Congress is realising that they would lose out due to BJP's aggressive campaign.
Cong must also get credit for Bengaluru-Mysuru express highway

A delegation of Congress leaders, led by former minister H C Mahadevappa, inspected the Bengaluru-Mysuru Express Highway for eight km from Siddalingapura near Mysuru, on Friday. They said that they found a few lacunae, including sub-standard barricades :roll:.
Notice the tone of the report. It is as if this group of Congress-folks were some auditing agencies who were sent there by the Ghandi-Nehru clan. They can report the 'lacunaes' to Shri. Pappu Ghandi who is now feeling unfortunate that he is an MP in Indian Parliament ;).

Sachin ji, have you seen the video of the below 'activist' person (apparently she was in the news recently for assualting an actress in a park).

She is cribbing while driving on a smooth new Bengaluru Mysore Express Way and keeps saying it is OK-OK & not a good experience but in the end says she doesn't know why.... and yes she says that the road has a couple of blind-spots :lol:

The MVA lawyers don't want a trust vote.
SCI said UT himself had stated he lost the majority and didn't want a trust vote.

MVA lawyers and media are using inflammatory language.

Long back Bommai Judgment said floor test is the only legitimate path forward for settling questions of the majority.
UT himself resigned as he didn't want a floor test.

It is like Humpty Dumpty.
MVA sat on a wall.
MVA had a great fall.
All of Sonia's lawyers could not put together MVA back.

Credit for what? Just starting the project as usual and sitting on it?
The Karnataka poltics modus operanid is like this.

1) The opposition forms a coalition and gets power.
2) They loot for one to two years and fall apart for the crooks don't want the others to get the CM chair((JDS_Kumaraswamy)
3) Then BJP comes to power and cleans up the mess for 3-4 years.
4) The Karnataka voters repeatedly give hung verdicts and the cycle repeats. You have the NOTARDs and city snakes who fall for single-issue grudges.

By circulating these videos and making people aware of the acute danger. Soros and his tentacles are everywhere but not exactly hidden.
  • Remind them of who else he is funding.
  • Remind them of the desecration of the National Flag during Republic Day and the involvement of of groups funded by him.
  • How they insult our PM who has kept India developing fast during a time of Global mayhem.
  • There are Khalistan related groups whose leaders are connected with Open Society.
  • Quote what Khalistanis and leftists say about Hindus and how so many of them can be traced back to these same networks. This is all in the open.
  • Point out the destruction he has caused in other countries.
Make their blood boil. As this should.

I would not be surprised if the Soros network contacts reach into the Supreme Court. The way they move with urgency when organizations involving his network are involved is telling, even as millions of cases languish for decades.

A question to legal experts:
What is the locus standi of the ICC arrest warrant against Prez Putin??
a. Can he be served the warrant in Russia ??
b. Can be arrested when he visits another country?? (even though he has diplomatic immunity)
c. Impact of this on G20 Summit-can India still send an invite to him??

not a legal expert, but................

who is going to arrest him

He always travels with legit and state provided heavily armed guards as is his sovereign right

It is his finger on the nuke button

no black/white/yellow joker can arrest him in India.

He travels with diplomatic immunity given him by the russian state, and in India he is under the sovereign protection of the Indian govt.

A) No
B) No
C) Yes

As head of state Putin enjoys sovereign immunity. Any coercive action against him can only stand if Russia is defeated and occupied by the victor's.

It's meaningless in the absence of a total Russian capitulation.

Yes they can. But India is not a part of the ICC. The Indian judiciary has already given it's verdict on the topic. The ICC award can only be enforced when India is defeated and occupied.
