Strange shielding of swindlers

WHAT kind of government is the Congress-dominated United Progressive Alliance trying to provide the country with? Barely a fortnight after the grand declarations — at the Congress party’s 125th anniversary — of “zero tolerance” of corruption, venality and wrong-doing, the powers that be are resisting resolutely the legitimate demand for a disclosure of the names of 26 Indians caught stashing their black money with the LGT Bank in Liechtenstein.

Having received the names from the bank concerned, the Union government decided to conceal them. It might have succeeded in this dubious design were it not for public interest litigation (PIL) filed in the Supreme Court by three concerned citizens — eminent lawyer Ram Jethmalani, former Secretary-General of the Lok Sabha Subhash Kashyap, and former Director-General of Punjab Police KPS Gill. In the apex court, the government tried to brazen its way out by repeating its specious plea that any disclosure would run counter to the “confidentiality clause” in the double-taxation avoidance agreement with the country concerned.

Such ploys have worked in the past. For instance, successive governments have succeeded in hiding the names of fat cats who habitually took huge loans from public sector banks and merrily refrained from paying them. Non-Paying Assets (NPAs) was the official euphemism for these bad loans; at work, in fact, were NPCs (Non-Paying Crooks). Yet, their identities were kept secret on grounds of “customer confidentiality”. This time, however, the trickery may not work, judging by the proceedings in the Supreme Court so far. When Solicitor-General Gopal Subramanium went on pleading “international obligations” and even claiming “immunity” for as many as 16 of the 21 documents the government has filed, Justice B. Sudershan Reddy, presiding over the two-member bench, observed: “Forget about the documents … We are asking you what prevents you from disclosing the names?” At an earlier stage, his lordship had asked the Solicitor-General: “What is the big deal about disclosing the names?” Eventually, the government’s law officer offered to submit the names of the culprits to the apex court “in confidence” but persisted in refusal to make them public. Since then the Central Board of Direct Taxes has submitted the 26 names to the apex court in a sealed cover with the edict that these must not be put in public domain.

What happens next would depend, of course, on further proceedings in the Supreme Court and its final order. But that is now immaterial. For the UPA government seems firm in being totally indifferent to the people’s diminishing faith in its promises and growing suspicions about its motives. Would someone in authority please explain why is the secrecy of the list of the country’s swindlers being guarded more zealously than that of top-secret military files that are sometimes found on the roadside?

No wonder, there is a widespread impression that the government’s secretiveness is fuelled by the fact that in the hidden list are mentioned not only tarnished tycoons, corporate crooks, hawala honchos and so on but also some “high-profile” politicians and bureaucrats. The plea of international obligations is hogwash. There are reports that Germany had initially offered to convey the swindlers’ list unconditionally. What happened to change the situation and why?

It is against this backdrop that the veteran BJP leader, Mr L. K. Advani, at a public rally in Mumbai, raised the question whether the Prime Minister was hesitating to take steps in this matter because “people belonging to the Congress and its allies are involved”. He also drew the Prime Minister’s attention to a news report alleging that the name of a former Prime Minister also figures in the list.”

Another red herring that the government through its Solicitor-General has drawn across the trail is that proceedings to collect tax from and impose penalties on the worthies on the Liechtenstein list had begun. Once again their lordships had to remind all concerned that the matter went “far beyond taxation”. The rogues that stash black and ill-gotten wealth abroad are criminals. They need to be exposed and punished, not coddled in strict privacy.

What has come to light about the Liechtenstein deposits is disgraceful, no doubt. But it is, in relation to the problem of black money, whether stashed abroad in secret bank accounts or hoarded at home, what the proverbial drop is to the bucket. To India’s eternal shame, half its economy is black at any given time. At the same time, all expert estimates — including that of Dev Kumar of Global Financial Integrity, a Washington-based watchdog — agree that the Indian black money stashed abroad with virtual impunity is close to $ 3 trillion.

Successive governments have periodically promised to bring this money home. But so far none has done so. Suppose by some miracle someone some day does bring back the mind-boggling amount home and decides to distribute it among the 1.2 billion Indians equally, each of us can expect to get a reasonable amount. Mr Arun Kumar, a Delhi-based economist who has worked on the problem for years and has published an informative book on the subject, argues that had the Indian black money stacked in the vaults of foreign banks (that earn a decent income from it) not gone out of the country but were invested productively here, the per capita income of Indians would have been $ 5,000 and not $ 1,176 as at present at market exchange rates. All this, however, is wishful thinking, given the rude realities of life in India. The money hasn’t come back in the past, and it is unlikely to be brought back in the foreseeable future. The United States and several other countries have forced Swiss banks to waive their secrecy laws and cough up the illegal deposits of their respective citizens. India hasn’t even tried.

In this context Mr Advani went on the offensive against Prime Minister Manmohan Singh for the latter’s “failure” to deliver on his 2009 promise to “take steps to bring back the black money stashed by Indians in foreign banks within 100 days of coming back to power”. The BJP leader also complained that Dr Singh “hadn’t bothered to reply to a letter written jointly by NDA leaders over a week reminding him of his poll promise”.

Therein, unfortunately, lies the rub. The black-money-stashed-abroad issue looks like turning into a no-holds-barred slugfest between the Congress and the BJP, as the problem of mind-boggling corruption already has.
It was our R. Vaidya that fired the shot across the bows on Swiss banks and Indian illegal money.

"It is apprehended that intemperate and uncalled for public attack on the CAG methodology (by the Telecom minister) before the national press may prejudice the CBI investigations and cause an obstruction to justice," Swamy had said in his application.

Earlier, I wanted to refer to the recommendations given in the site for a revised Lok Pal bill on a separate thread if possible. Had posted a query on Forum Feedback a few days back.

If you go through the site, you will find that the draft is modelled on Independent Commission Against Corruption (ICAC), HongKong.
There was much worse corruption in Hong Kong in 1970s than we have in India today. Collusion between police and mafia increased and crime rate went up. Lakhs of people came on the streets. As a result, the government had to set up an Independent Commission Against Corruption (ICAC), which was given complete powers. In the first instance, ICAC sacked 119 out of 180 police officers. This sent a strong message to the bureaucracy that corruption would not be tolerated. Today, Hong Kong has one of the most honest governance machinery.
India can also turn around if we also had similar anti‐corruption body. Hong Kong government enacted ICAC Bill because lakhs of people came on streets.
Incidentally, there is going to be a People's March on Jan 30 at Ram Lila Ground in Delhi.

The Supreme Court on Friday cautioned Telecom Minister Kapil Sibal against the regularisation of illegal licences given in the 2G spectrum scam. Petitioner Subramanian Swamy informed the bench that the Government had started the process of “compounding illegality” by charging minor penalty from the 2G licence holders. “The whole investigation into the scam will be fait accompli if these licences are regularised,” he said.

Swamy sought permission to move an appropriate application in this regard and got the court’s nod. “If you make that prayer we will consider it,” added the bench.

^^Saar, if EVM manipulation is true, then its all game over only. The ruling party can never ever lose only. Why should they bother anymore with parliamentary niceties, accountability etc anymore? No wonder the takeover of institutions and corruptioneering is getting so brazenly blatant of late. Because, it really doesn't matter anymore.

Even Indira felt constrained to cancel Emergency and go in for an election. There is the concept of moral legitimacy. When an entity has been delegitimized, it cannot sustain itself for long. So the way to go is to delegitimize EVMs in the eyes of the public, which is already happening to some extent.

Pranab issues statement that Swiss bank accounts names cant be released. betwween $450B to $1.4T in Siwssbanks from Indian peolpe.
Bet on two-three things at a minimum:

- More than half would be INC. Hence the respect for law and secrecy.
- Pranab is working overtime to unearth Oppositon names to make a few scape goats and throw some low level INC types under the bus as coallateral. The amount is too big.
- Pranab also would be working overtime to squeeze/blackmail those without connections to fill the 2G coffers. Those who dont pay up will also join the ones above.

I see some problem with the 2nd option Ramanaji.

Let us assume INC comes up with a list of 20 names consisting for mainly opposition leaders and few others here and there for say $100B worth of accounts. Opposition, being the opposition (not in power) can take the hit and demand that the remaining $1.3T accounts are also revealed.

Once the Govt releases a partial list, irrespective of the contents and amounts, all the excuses are off the table and the nation demands the full disclosure.

The brilliance of Option 2 is even if $100 (not billion) is there with Opposition, the media pack dogs, will tear into that and sarkaris misdeeds are glossed over a s= = and focus will be only on them and nothing else.

its not like the 1980s when the media was not in cahoots with the ruling party. Its part of the ruling establishment

Not true Hari garu.

Without going into CTs, Pranav and RM theories of using satellites, CIA etc and purely sticking to what is proven (as demonstrated by Shri Hariprasad and co) it is not that easy with EVMs to win to level what INC wants/needs. But the stakes for the opposition have risen multi-fold. The EVM rigging is possible in places where INC is atleast second in a given constituency. If INC is third/fourth like in Bihar, UP and several other states etc., no chance at all.

Other necessary factors inculde a helpful and colluding state administration.

The opposition has taken the challenge of pushing it to third place using 2G and other grand stuff.

The fear of becoming third position is the real reason behind the Diggy Raja's histrionics. It is this reason why Jagan, KCR are waterloo for INC in AP. It is this reason why Lingayats have to be split between parties as opposed to polarization with BJP because even in KA INC is coming third in several constituencies and the fight is becoming JDS Vs BJP.

The potential for INC to successfully tamper EVMs will be in Rajasthan, Assam, Maha, Delhi, Jammu region and Haryana

Tampering is useless in TN (because of an emerging two way fight), Gujarat (gap is too wide) and proabaly even in AP (if Jagan and KCR solidifies).

Tampering is useful but difficult in Uttarakhand, Punjab, Kerala, MP, Chattisgargh, Jharkhand (only in limited constituencies) and Karnataka (you see the desperation here) as the state administration is not INC.
(They will try their best in Uttarakhand and Chattisgargh)

Chanceless or useless in the rest of the country that includes vast UP and Bihar along with several NE states.

It is a mixed bag and that is the reason for INC to get 180+ seats where it may actually get about 110.

2-G,CWG,Hasan Ali....all multi-billion dollar scams,the list is growing by the day and the amount is also reaching into the stratosphere. His legacy to history is assured and the Guinness Book of World Records should enter his name as "scamster supreme"in golden letters!

U say tampering not useful in Gujarat and UP & difficult in MP. Still, in 2009, they got 21 LS seats in UP even though they are virtually nonexistent there and 11/26 in Gujarat when they should have got only 2-3 in Guj going by assembly election. Thay also got 12/29 in MP where they should have got 3-4 going by aseembly polls. Conservatively, about 15 in UP+ 7 in MP + 7 in Guj. may have been obtained via EVM tampering. In Raj they may have got another 7-8 in AP (YSR was around then) another 10 or so. In TN as well, something like this must have happened in 2009. Conservatively, they got around 70-80 extra seats by EVM tampering. All states seem to be vulnerable to this. Even states like UP where they have no presence.

Not true Hari garu.

Err, please don't misquote me ... what I have been talking since 2009 is the use of Trojans. The software is not verified on Indian soil, and even if the software is verified, it still leaves the door open for hardware Trojans. There are no practical ways to verify absence of hardware Trojans. All this has been discussed in detail in the EVM thread.

Since Hariprasad was constrained to return the EVM without damaging it, he had to use a vector which was less suited for large-scale exploitation.

The lurch of the Lemmings
One of the most enduring of media-created myths is that of mass suicide amongst Lemmings, the little rodents that live mostly in and around the Arctic. A 1958 Disney documentary film staged scenes of large numbers of Lemmings marching mindlessly off a cliff to their doom in the waters below. Actually, Lemmings can swim. The rodents see major migrations when they multiply rapidly and their population grows. And when this dispersal finds big numbers crossing large bodies of water, some of them drown by accident, not by intent. However, the Disney film — where they were actually forced off a cliff — and earlier articles, created a false notion that still holds: that Lemmings commit mass suicide by leaping off cliffs and drowning in the waters below. This is also the origin of the political slang: ‘Lemming-like behaviour,' to describe a suicidal course of action.

Political scientists in India 2011 can now be forgiven a rethink on the whole fraud. You begin to wonder if there was some truth in it, after all. The ruling United Progressive Alliance (UPA) seems determined to prove that this instinct of the little creatures was no myth. The race off the cliff is real, with Congress Lemmings leading the charge of the light-footed brigade. The massive hike in petrol prices at a time of raging food inflation was merely one among such efforts. In just seven months, the price of petrol has gone up by over Rs. 10. The new hike came even as the government announced that it was taking the price rise seriously and has formed yet more panels and Groups of Ministers to study the problem.( Another Group of Ministers was to have met in December 2010 to decide on whether to hike diesel and LPG prices as well. Yet another was to take a call on raising APL foodgrain prices.) Lemmings, after all, mostly act in large groups.

Now that Prime Minister Manmohan Singh has rearranged the deck chairs on the Titanic, the impression of a collective rush to mass drowning only grows. Handing the rural development portfolio to a man just trashed by the Supreme Court for protecting moneylenders in Vidharbha while he was Chief Minister of Maharashtra, has a Kamikaze-like courage about it. Not only did the Court admonish Vilasrao Deshmukh in scathing terms, it also enhanced the fine levied by the Bombay High Court's Nagpur bench on the government of Maharashtra in the same case from Rs.25,000 to Rs.10 lakh. Now in normal and non-Lemming circles, this would have led to his unaccompanied exit off the Cabinet Cliff.

Justice A. K. Ganguly in his judgment on the case involving Mr. Deshmukh says, among other things: “The message conveyed in this case is extremely shocking and it shocks the conscience of this Court about the manner in which the Constitutional functionaries behaved in the State of Maharashtra.” The judgment goes on to say “it is clear that the Chief Minister was aware of various complaints being filed against the said family [the moneylenders: PS]. Even then he passed an order for a special treatment in favour of the said family which is unknown to law.”

The judgment notes the debt-induced plight of farmers in that very region and also says of Mr. Deshmukh's action: “This amounts to bestowing special favour to some chosen few at the cost of the vast number of poor people who as farmers have taken loans and who have come to the authorities of law and order to register their complaints against torture and atrocities by the moneylenders.”

Obviously, in Dr. Singh's view, the perfect candidate to preside over the destiny of rural India and its development. A man during whose eight years as Chief Minister of Maharashtra, well over 30,000 farmers took their own lives in the State — a feat unrivalled anywhere in the country. Mr. Deshmukh's most famous remark on the farmers: “Committing suicide is an offence under the Indian Penal Code. But did we book any farmer for this offence? Have you reported that?” ( The Hindustan Times, October 31, 2007). Just after the terror attacks of 26/11, he went to the Taj hotel, with his actor son and Bollywood filmmaker Ram Gopal Varma in tow. This provoked outrage in a public which saw them as disaster tourists checking out the rich cinematic promise thrown up by the tragic events. Sacked from his post, Mr. Deshmukh spent some months in cold storage before being elevated to the Union Cabinet.

His successor lost his job over the Adarsh episode and also earned notoriety over the ‘paid news' scandal. On the latter, Ashok Chavan faces a case in the Election Commission and might run into yet more trouble. His successor, imported from New Delhi, gives non-entity a bad name. The NCP, once a declining force, gets a new wind with his arrival. And that party gets more aggressive towards the Congress at the Centre as well, sensing the mess it is in. In Andhra Pradesh, two successive Chief Ministers have spent over a year fighting their own party in a State that contributed 33 MPs to the Congress at the Centre. In West Bengal, the Congress has written itself, with almost Lemming-like fatalism, into a distant third place.

If you watch your Animal Planet you'd expect that, like in other social hierarchies, there are alpha male Lemmings. It requires rare qualities of leadership to guide a bunch of sharp front-toothed mammals off a cliff. Heading the charge means there are lots of large gnawing incisors just behind you. This is no role for the faint-hearted, as Kapil Sibal demonstrated in his stinging attack on the CAG. This was also what happened in the Bofors case, a blistering attack on the then CAG (among other things). The results of that strategy included a government drowning. But history is not the Lemming's long suit. Mr. Sibal might yet learn that the CAG is not a cowering witness in a court room, but the drowning will probably have begun by then. Meanwhile, with 2G, Raja, Radia, illicit funds, and a stubborn CVC, the UPA government's scams are multiplying faster than Lemmings.

Pranab Mukherjee, meanwhile, has made it clear — wagging a finger while doing so — that the government is not about to reveal the names of any tax evaders. Mr. Mukherjee, who heads more Groups of Ministers than have ever been Empowered, suggests there might be one more group soon. That is, to work out Amnesty schemes for tax evaders and those who have illegally siphoned funds out of the country to secret offshore accounts. No one can be named till they are prosecuted, says he. In other words, we will never know the names of those the government chooses not to prosecute.

A Global Financial Integrity Report ( The Hindu, Nov. 17, 2010) estimates that India has lost almost half a trillion dollars in illegal capital flight since Independence. As much as $125 billion, or more than a fourth of the total, vanished between just 2000 and 2008. The government plans amnesty for such offenders and arrests for those protesting high prices.

The line has also been laid down on food security: forget about it. There will be neither a universal PDS nor even an enhanced one. Feeding a hungry corporate world takes all the resources we have. Things are about to get much tougher for the whole team. India's premier Lemmings are simply too busy to pay any attention to their day jobs. Even as the onion season winds down, the World Cup Cricket and IPL seasons are about to begin. This means, of course, that we will still see no Agriculture Minister for a further two months. (Unless someone provokes him with a comment on Lavasa.)

Back in 2008, as global food prices soared, Mr. Pawar revealed to the daily, DNA (Page 1, April 2), that the real reason why wheat prices were soaring was that south Indians were eating too many chapathis. In this, he echoed the view of noted nutritionist George W (then also working part-time as President of the United States). Mr. Bush declared that the world food prices were soaring because millions of Indians and Chinese were eating so much more. (Global prices fell sharply just months later. Were millions of Indians and Chinese suddenly starving? Or were big-time speculators giving prices a yo-yo ride?).

Dr. Singh and Montek Ahluwalia have also bought into the Bush Food Doctrine: the huge price rise in food items suggests that the poor are doing better, eating more. The cliff runway is free and the Lemmings have been cleared for takeoff. :lol:

As politicsparty fellow has postulated, someone is after Sonia. First the CBI closure of Quattrochi case was foiled by some by timed & public declaration by 'Income tax appellate authority' & then the Hassan Ali case being dredged up again by media esp when it was proven that he was linked to Ahmed Patel (Sonia's secretary and confidante). No wonder then that she didn't turn up at the Republic day function and the Rashtrapati Bhawan dinner later.

It could be someone who has just found out that he is out of the reckoning for the top post.

I had speculated on this a couple of weeks back. There could be an international angle too ... note the timing of the Wikileaks disclosure about Rahul Baba's take on "Hindu terror". Also, why did Outlook, a traditionally pro-2G outlet, prominently feature the Radia tapes?

While the Congress richly deserves the opprobrium it's getting one needs to be wary that the replacement is not also compromised. For example, Sushma Swaraj being close to Bellary Reddys, who are big-time ore exporters to the PRC. Etc. Not all elements of the BJP are trustworthy.

If she has made up her mind to do away with Mankamohan, then it becomes clear why 'international angle' would be pretty annoyed with her. Manmohan is a facilitator of scamsters & fraudsters. That he personally does not indulge in corruption is immaterial since he learnt a lesson long ago that his foray into politics gained momentum through his quality of 'strategic silence' and as a corporate scam facilitator. As long as he runs along this narrow niche without opening his mouth too wide, he believes he is safe.

Another factor is that he doesn't feel he is accountable to the public of India. A key pointer to this is the number of press conference he has held in his 7 years of holding the job. Maybe 1 or 2 at max. He isn't answerable to the Indian public. Compare this with the monthly press conferences by a Chidambaram or a Pranab. They too are corporate facilitators no doubt, but still feel answerable to the Indian public since they came through the electoral route. Laloo used to hold a media briefing every week. Manmohan is more in the autocratic mould of TSPA jernails. They just need to meet & make themselves accountable to visiting US politicians and generals.
