Delhi: 4 Arabs held on charge of molestation; released due to diplomatic immunity

In her statement to the police, the victim said the men tried to molest her and harassed her.

Four Arabs were arrested on charge of trying to molest an employee of a five-star hotel from the national capital 's Connaught Place area on Monday night.

The four men - two from the Libyan embassy and one each from Yemeni and Algerian embassies - were apprehended by the police following a woman 's complaint. However, when the police later found that some of the accused enjoyed diplomatic immunity, they were released from the police station.

According to police sources, the Algerian and the Yemeni nationals had diplomatic immunity, while the two Libyans were released on bail even as they were not diplomats.

As per the complainant, the men were travelling in a Yemeni embassy car when they passed lewd comments on her at the bustling Janpath market and made obscene gestures . The incident took place around 8 pm.

In her statement to the police, the victim said the men tried to molest her and harassed her. The police have registered a case under Sections 506 (criminal intimidation), 509 (outraging the modesty of a woman) and 34 (common intention) of the Indian Penal Code (IPC).

4 reasons to hang juvenile
1. Old enough to rape
2. Old enough to help others rape
3. Old enough to use an iron rod
4. Old enough to torture a girl for 2.5 hours

The links claim that
(1) at least three of the accused are going to claim not guilty [now there are several angles by which they will try to do this, but in all of them the blame will have to be put on the "male friend" - which in turn means that prosecution will have to find at least one "states witness" from among the remaining two, but because of his potential complicity the case would go weaker. ]
(2) and the 6th one probably is going to the juvenile court and could be out in months

Overall, an excellent strategy to save the faces of all concerned - perpetrators, police, state, except the two targets, of course.

Congress has to deliver justice real fast , as 2014 (election) is around corner and this case may turn urban vote against them.
India judiciary is under pressure for first time as the whole world is watching and this is being reported even now on daily basis in leading newspapers (top news on BBC)

http://www.bbc.co.uk/news/world-asia-india-20949038
here is video of victim's father lashing against so called Bapu
http://indiatoday.intoday.in/video/delh ... 41347.html

victim's friend slams 'Bapu'
http://www.indiatimes.com/india/delhi-g ... 53887.html

Apparently 'Bapu' has said hathi jab chalte hai to kutte bhonkte hi hai, this doesn't change opinion of big people. [Don't know who is kutta in this context]

They might plead not guilty and try pin all the blame on the juvenile. The juvenile will get away in a few years either way whether he is fully or partly blamed. So why not these 5 or 3 of them plead not guilty and try lessen the sentences by putting it all on the juvenile.

If he is a child, then the owner of the bus services should be also booked under Section 12 of India's Child Labour... or at least till such time, all the rapists are considered as adults. If the child labor law says it is 14 years, then how the hell for a rape he is minor? WTF!!
The Factories Act of 1948: The Act prohibits the employment of children below the age of 14 years in any factory. The law also placed rules on who, when and how long can pre-adults aged 15–18 years be employed in any factory..
So, they can be dealt with as pre-adults, with equal footing as for adults, perhaps with only lenience for less crimes. This delhi case far above any crime one can do. He is in with all types of violence., and he is dangerous to live in a free society.

http://en.wikipedia.org/wiki/Sub_judice

The gist is basically, everybody is innocent until proven guilty, i.e. the accused rights are invoilable. Once the rights of accused are violated, the judges consider that as a serious offence and anything to be proven, the bar will be set beyond and above the violations. Media circuses influences the witnesses, the judge and creates an atmosphere against the accused, thus violating their rights. It creates an atmosphere of prejudice against accused. It can result in lower punishments and higher levels of validations of proof.

In short, if you want those rapists to be severely punished, media circus regarding that case should have stopped yesterday. As it stands today, defence can claim an atmosphere of prejudice. The identification parades are severely liable to be compromised.

and yes, media black outs of some sort are very very normal. In high profile cases in US where the jury exists, the jury is made to stay in hotels without any connection to outside world.

had posted earlier at least 3 times. sheila aunty and politicos know this. No one wants to stop this nexus.
It keeps the criminlas-police and politicos in firm control of their rule against potential adversaries.
The brutal rape was an unexpected side effect to their enterprise.

sheila aunty is not bothered about it. So do the higher ups. court Cases have been filed but nothing has happened.

Media is banned from the court but the judge has said she would have a daily report for the media. Media in the court room is not a good idea as DDM is very capable of twisting the facts and create an anti -India atmosphere.

why commissioner police was not suspended? asks Delhi high court

http://indiatoday.intoday.in/story/delh ... 41491.html
It pointed out that in previous submissions the police had stated that three police control room (PCR) vans were there, while in the latest report they said only one PCR van was on patrolling duty at the time of incident.

Cautioning against attempt "to save officers", the court asked why no action was taken against any DCP or the commissioner and why action was taken against only ACP. The court expressed its displeasure on the police status report
here and there it is being said that Sandeep Dixit controls transport mafia of Delhi, but no article in reputed newspaper regarding this

Private transport operators, mostly shady characters, are allowed to ply buses on public roads.

There is an enormous amount of black money in the 'auto-mafia' and 'transport mafia'. There is a sensational lack of governance here. All kinds of anti-social elements are allowed to invest in autorickshaws to earn quick and easy money, to exploit poor drivers and passengers in New Delhi.

Almost 90 percent of auto ownership in New Delhi is benami, says Nyaybhoomi, an NGO

The scene is worse in the case of buses, which are not only in the hands of dubious individuals who are difficult to nab, but also enjoy protection from the police and politicians in New Delhi

Ram Singh, one of the alleged rapists and the bus driver in the horrific December 16 gang-rape case, was arrested without much delay because the police know well who plies which bus at what time and where. It is a well-oiled nexus at work.

But the bigger problem lies in Sonia Gandhi's selection of a politically correct and compliant 'Dalit Congressman' as home minister.

Sushilkumar Shinde had no qualification to be appointed India's home minister after failing miserably as power minister. Still, he was made Union home minister. He has no clue about what his job means

Alarming Police Shortage

With 70% of existing Delhi police dedicated to VIP security, just getting staffing to the levels found in other cities would need increasing the size of the force by 300%.

I have always thought the real administrative incompetence is by Sonia Gandhi. She has never had a clue what she is doing administratively. Even Dr JJ called her a kitchen level talent once IIRC. She is smart politically however, esp. in divide and rule, must be that Italian blood. I have always thought the BJP committed a political blunder but not letting her become PM. It has allowed her to take on the martyr mantle and avoid taking responsibility for her incompetence.

This entire fly her to Singapore episode smacks of SG 'brilliance'. This is after all the woman who flew to USA to hide the nature of her own illness.

And which Delhi voter gave her that direct authority? We need to better define what babooze can do and what they can't. If we don't write that up, and stick it up on their heads, it would be way too much time lost and the reversal of India rising will never take shape. This is India going down.

^ Completely agree. The plan could not have been without approval of SG. Do not see logic behind reports that Shiela Dixit was behind her transfer, as emergency supply of passport, visa is not possible without diplomatic help sought from Singapore, all this needed approval from the highest level. Victim's family being a simpleton rural one doesn't understand all this politics , questions raised behind air transfer. Even yesterday her father told AAjtak, it was apparently doctor's decision to fly her abroad

Victims in Delhi rape case are to blame, defendants' lawyer says

The lawyer representing three of the men charged with the gang rape and murder of a medical student aboard a moving bus in New Delhi has blamed the victims for the assault, saying he has never heard of a "respected lady" being raped in India.
Manohar Lal Sharma said his clients will plead not guilty to all charges tomorrow when they make their next court appearance. His comments come as Indians have reacted with outrage to the opinions of politicians and a religious preacher who have accused westernized women of inviting sexual assaults. Sharma said the male companion of the murdered 23-year-old was "wholly responsible" for the incident as the unmarried couple should not have been on the streets at night.
"Until today I have not seen a single incident or example of rape with a respected lady," Sharma said in an interview at a cafe outside the Supreme Court in India's capital. "Even an underworld don would not like to touch a girl with respect."

Well in a way it is good.
1. Accused have found lawyer who will defend them seriously
2. That Accused would plead not guilty.
3. That he has blamed the lone witness for the incident. he has not denied his presence at the scene of the crime.
4. That he has not denied presence of the accused ( at least not in media) at the scene of the crime. I think that he would deny later in proceedings.
5. Dying declaration of the girl is more damning.
6. Forensic evidence neatly tie the accused to the scene of the crime
7. Doctors , treating the girl, would be able to describe the nature of crime in graphic detail
8.Postmortem report would certainly indicate the cause of death was injuries inflicted by them
9.DNA reports would also indicate that samples recovered from accused and the scene of the crime and that on the Girl matches
10.Injuries and bite marks would indicate that victim resisted and tried to save herself.

Chargesheet must be containing many other details. The accused will be heard and will be given due justice. Sadly Juvenile might get scot free unless age is confirmed by other means and test is ordered by the Board.

If he really said he has never heard of a 'respectful' lady being raped, something is seriously wrong with this man. Any one who rapes his daughter or wife then can take a similar line. Possibility is that he is some rank amateur as not many are willing to fight for the accused.

This is a step the defense must take. He is playing to the prejudices of the judges and courts. Our judges (and I use the term loosely) have demanded proof of virginity as required for 'good character' in women in the past.
