NEW DELHI: The outrage over the December 16 gang rape appears to have had no effect on offenders as three rapes and five molestations were daily reported during the fortnight after the incident in the capital.

The city witnessed 45 rapes (three in a day on an average) and 75 cases of molestation (five in a day on an average) in the last 15 days of 2012.

Idiots like M L Sharma should be demoralized by imposing fine for wasting time of the court, but with Kabir as SC CJI who on record has said that atmosphere shouldn't influence the outcome, accused should get fair trial etc etc..encourage lawyers like these.

Without a jury system I'm baffled why the Judge thinks there will be 'influence' on the case. Does he think a judge is liable to be influenced by the public?

That Sharma lawyer does sound increasingly like a loon. But that is good as it damages the defendants case.

I still fear that the DNA may get thrown out on a technicality. At which point it becomes a he said she said case, which is what the defense wants.

Plea to transfer Delhi rape case to Coimbatore
COIMBATORE: The defence counsel of an accused in the Delhi gang rape case has chosen Coimbatore in Tamil Nadu and Mathura in Uttar Pradesh as possible alternative venues for the trial which is scheduled to resume on Monday.

When TOI contacted Delhi-based Supreme Court lawyer M L Sharma defending Mukesh Singh, the man who was driving the bus on December 16 in which he along with five others reportedly raped a 23-year-old woman, he said Coimbatore would be his first choice for shifting the trial. Asked why he preferred Coimbatore over Chennai or Bangalore in the south, Sharma said that the trial could not be conducted in metropolitan cities.

"Chennai is a metropolitan city and we do not want the trial to be held in such a place. The people in these places are already biased against my client and they will indulge in protests and try to mount pressure which will go against a free and fair trial for the accused. In places like Coimbatore, people mind their own business and do not interfere aggressively in such protests," said Sharma.

Sharma also said that the reason to include Coimbatore as an option was that the city has a reputation to be a silent and peaceful one unlike Delhi which according to him was already prejudiced against his client. He claimed that his client would feel more secure in a place like Coimbatore. He believed that they had a stronger chance of escaping capital punishment in Coimbatore unlike in Delhi where everyone, according to Sharma, was bent upon hanging all the accused. Ironically its been just over two months since the Mahila Court here in the city awarded double death sentence to R Manoharan (26) involved in the sensational Jain siblings murder and rape case.

"There is no scope of a fair trial for our clients in Delhi because they have already been branded as culprits due to media focus on the incident and overdose of protests from the general public. Everyone wants all of them to be hanged under any circumstances," said the defence counsel.

" There are lot of temples, people are god fearing here and they mind their own business. We also believe that there will not be political pressure from any quarters and the case will not be utilized for gaining mileage by any of the political parties," Sharma added.

Sharma admitted that neither has he visited Coimbatore nor has he researched the previous rape case trials held in the city. He said that his client has already given him the permission to opt for any place where he believed there were chances of conducting a trial away from media's eyes. Sharma had earlier courted controversy when he said that "respectable woman do not get raped".

Sharma had also filed the PILs in supreme court demanding the cancellation of 194 coal block allocations and also another one challenging the union government's decision to allow FDI in retail sector.

However, Coimbatore does not have a reputation to deal lightly with people accused of rape as in the recent cases of N Manoharan who was awarded double death sentence in November 2012 for the rape and murder of Muskan Jain and her brother Hritik. Even the district bar association decided to boycott Manoharan and the lawyers refused to appear before court on his behalf until A Sharmila, a city based lawyer, became his advocate through the legal aid cell.

" Coimbatore is not a place where serious crimes like rape are taken lightly. People are of the opinion that maximum punishment should be awarded in such cases," said Sharmila.

In another case A Arumugam (30) was awarded triple life sentence in addition to more than 30 years' imprisonment for the rape and murder of a 17-year-old and her mother at their village in Pollachi. The city has also witnessed numerous candle light vigils and protests condemning the Delhi rape case and even women from Coimbatore Bar Association conducted a public protest in connection with the case. Various members of civil society have also organized candle light vigils and condolence meetings for Nirbhaya in the city both after the incident and her death later during treatment in Singapore.

" Not only the rapists involved in the Delhi gang rape but every rapist should be given capital punishment," said Anisha G, a college graduate.

Well, it would be surprising id case is transfered elsewhere. Defense lawyers always resort to all such tricks and tactics in criminal cases and this is nothing new, Sharmaji or no Sharmaji. The case is neatly tied up. The dying declaration is enough and there are hundreds of corroborating evidence. Fellows might get Pardon from some high above but Courts would sentence them to death. That is why all this desperate attempts by Lawyers.

The CJI is stating that movement was hijacked by hooligans, so far this line was maintaned by NDTV, congress etc. I see this man with suspicion. On one hand he justifies the public anger on the other he says public sentiment should not influence out come, his bench has accepted application for transferring the case out of Delhi. He should clear the mental clouding he suffers from.

This rape is the tip of the iceberg.***** business propels the increasing incidence of rape.Many cases in Punjab are seeing the surface suddenly, and the Police seems to be hushing up things.Just as there is IAC(India Against Corruption), there should be IAR(India Against Rape).

^^ Rather than indulging in political emotional speech like 'I also wanted to be there' he should have balls to vow that I will make sure all cases regarding violence against women are given justice before I retire. 'I wanted to be there' reminds of line adopted by Shiela Dixit, Rahul and others who try to project law and order is not their responsibilty.

This non sense gag order on media is only to make sure people do not start protesting or wake up once again, what sort of gag order is this where there is no update trickling from judiciary side and regarding day to day hearing, but the lawyers of accused are roaming like free bull, farting what ever they want ?

I think CJI has a misplaced sense of justice. Don't forget his bench sat on a rape case appeal from Tamil Nadu for over 13 years.

Union home secretary RK Singh and Delhi Police Commissioner Neeraj Kumar faced the ire of retired Justice JS Verma and his two committee members who said that the gang-rape of 23-year-old paramedical student brought out the failures in maintaining law and order in Delhi and dealing with sexual assault crimes against women.

The committee members have recommended punishment up to 20 years for rape and life imprisonment for cases of gang rape but the panel stopped short of recommending death sentence to the convicts which was one of the major demands of protesters and almost all political parties.

While speaking to reporters after submitting the report, Verma said that he was shocked to see home secretary RK Singh praising Delhi Police commissioner Neeraj Kumar after incident because an apology was expected from the Delhi Police for not being able to protect the victim. Verma also said that there is a lack of sensitivity on the part of the police officers who implement laws.

We have submitted the report in 29 days. When I offered to do the work within 30 days, I did not realise the magnitude of the work. The home minister has said that budget session will start on February 21. There were two months. So I decided to do it in 30 days. If we are able to do it in half the time available, then the government with its might and resources should also act fast,” said JS Verma, while talking to reporters.

Committee members were also of the view that the police action against students and protesters after the gang rape incident scarred Indian democracy. The use of force by policemen against school and college students had come under severe criticism by political parties and Delhi chief minister Sheila Dikshit wanted police commissioner Neeraj Kumar to be removed from the top post.

“Youth has taught us what we, the older generation, were not aware of. I was struck by the peaceful manner in which the protests were carried out. The youth rose to the occasion,” Verma added.

The three-member committee has also recommended that the union government should end the ambiguity over the control of Delhi Police. Delhi chief minister Sheila Dikshit had raised the issue during the protests by students which followed after the gang rape incident. The union government had formed the three member committee to suggest necessary changes in law to stop rape and other crimes against women. The committee was given a period of one month to suggest the changes.

The committee had asked for suggestions from public, political parties, non-government organisations (NGOs) and it received over 80,000 suggestions from India and abroad. The two national parties, Congress and Bharatiya Janata Party (BJP), had suggested death sentence for rape.

Committee members have also asked the government to amend Armed Forces Special Powers Act (AFSPA) and suggested that all rape cases involving men in uniform in areas of conflict should be brought under ordinary criminal law. The members have also asked the government to appoint special commissioners with adequate powers to redress complaints of sexual violence against women in conflict areas.

^^ Who were these people who provided suggestion, was an advert floated online / in news papers?? What is the evidence regarding this?

Why Verma babu doesn't comment on 100 000 rape cases pending in court where a fat judge is sitting over the case?

Does he think judiciary is not to be blamed??

What about justice kaju & Co (Pratibha Patil) granting pardon on several cases like these?

Verma can speak only on matters referred to him. Otherwise he will be like that idiot Katju.
Glad he spoke about RK Singh praising Neeraj Kumar who should be dismissed for gorss dirlection of duty and being the fountainhead of the corrupt Delhi Bullice. Note the repeated failures after the rape was committed:bus allowed to ply with curtains drawna nd lights out, the arguement as to where to take the victim , and on which thana should be the lead and water cannoning the peaceful protesters.

J.S. Verma panel report is a tight slap to MHA which runs the IPS and the Delhi Bullice starting from the Secy MHA RK Singh downwards.
If he has any honor he should seek early retirement.

Shocked by system’s apathy: Verma panel

The three-member Justice JS Verma Committee has rejected the demand for the death penalty for rape convicts and recommended stricter implementation of existing laws and police reforms as part of a slew of measures to prevent crime against women, particularly rape. Justice Verma said the failure of governance was the root cause of crime against women.

The panel has called for gender sensitisation of security agencies and judiciary along with sweeping changes in the Indian Penal Code (IPC). In a radical suggestion, the panel has proposed that if a woman kills a rapist or a would-be rapist, she could claim the right to self-defence under Section 100 of the IPC.

The commission suggested disallowing anyone from contesting Assembly or Lok Sabha elections if a court has taken cognisance of a case against him. The commission also recommended that all heinous crimes should be included for disqualification under Representation of People’s Act.

“We also suggest that if cognisance has been taken by a magistrate of an offence mentioned in Section 8(1) of the Representation of People Act, 1951, the candidate ought to be disqualified from participating in the electoral process,” said the Verma committee.

It also recommended engaging CAG in the audit of statements and affidavits filed by candidates.

Not entertaining the clamour for the death penalty in rape cases, the committee proposed life sentence as the maximum punishment. The committee also recommended against lowering the age criteria for juveniles accused of heinous crimes like rape.

The committee, consisting of former Chief Justice of India JS Verma, former Chief Justice of Himachal Pradesh High Court Leila Seth and former Solicitor General of India Gopal Subramanian, submitted its report to the Government on Wednesday and then held a three-hour marathon briefing, which was telecast live by a majority of the TV channels.

Stressing on complete gender equality in all spheres of life, the panel suggested right to education, speedy justice, qualitative recruitment of more personnel in judiciary, engaging eminent retired judges in the vacancies, and police reforms.

Verma also suggested the Centre to find a solution for ambiguity on the control of Delhi Police and long pending demands and arguments of the State Government and the Home Ministry over the issue.



Coming down heavily on khap panchayats, the Justice Verma Committee said ‘means adopted by them have assumed unreasonable proportions’ and asked the government to ‘ensure such bodies do not interfere with the choices made by people regarding marriage’.

Verma said that they had received more than 80,000 suggestions and his team had gone through all. On how he decided on a time frame for finalising the report, Verma said when a senior Cabinet Minister approached him on behalf of Prime Minister, he asked him when is the next session of Parliament.

“The Minister told me that the (Budget) session will start on February 21. There were two months. So I decided let’s do it in 30 days. If we are able to do it in half the time available, then the Government with its might and resources should also act fast,” he said.

Justice Verma expressed shock over the conduct the Home Secretary for patting the back of Delhi Police Commissioner Neeraj Kumar.

“The Commissioner of Police was given a pat on his back by no less than a person holding the post of Home Secretary. I was shocked to see that. If I were in his position, I would have first sought apology for the failure of the duty to protect citizens,”
said Verma in the beginning of his press conference, which lasted for around three hours.

“Equally shocking was the apathy of people and our society. None offered help to the victim and her companion, who were made to wait for a long time. It was shocking to learn that the police personnel reached the spot were arguing about the jurisdiction for long time. There was total apathy of everyone who had a duty to perform. We are not commenting more on this issue, as the case is pending before the trial court,” he said.

Justice Verma was critical of the apathy of the State police as well and pointed out few DGPs came forward with any suggestion or response to his panel. “One senior police officer of Delhi few days ago approached of our members and sought to know details of our queries already sent. We told him that everything was in the website. And his next question was to know the address of our website. Hardly any DGP responded to us,” said Verma, without naming the “senior” cop of Delhi.

He also criticised the Government for misusing the CBI and called for review of AFSPA and Representation of People’s Act in connection with crime against women.
Review of AFSPA might be a slippery slope. Instead now that women officers are in the armed forces (legal branches also) ensure that military courts are empowered to prosecute such cases.

The Verma commission sought out inputs online. It was widely spread out on twitter atleast. I personally know tons of people who put in their suggestions.

Does Justice Verma commission have powers to give recommendations with regards to AFSPA in kashmir?

Pakis in cohorts with RNIs,WKKs will be able to torment our armed forces by foisting false "rape" cases. Especially some from abroad have given their opinion too, chances are there some pakis in disguise might have given their opinion. Their aim is to dilute or repeal AFSPA in kashmir to weaken our forces.

J.S. Verma panel report is a tight slap to MHA which runs the IPS and the Delhi Bullice starting from the Secy MHA RK Singh downwards.
If he has any honor he should seek early retirement.
In fact it explains a lot of things, doesn't it?

Balaatkaar Shinde :

1) Despite being ultimately in charge of the security of private citizens in Delhi, is so incompetent that horrifically violent rapes, murders and other crimes against those citizens take place with appalling regularity.

2) Despite the public outrage in Delhi following the rape, followed his first instinct as a Mainovadi, and commanded his police to terrorize protesting citizens with excessive force.

3) Is now seeking to alleviate the blowback using the ultimate card in the Mainovadi's deck... the "Hindu Terrorist" card. Remember, Pigvijay Singh did this over Hemant Karkare and 26/11 to divert attention from emerging evidence that UPA misgovernance had reached epic proportions. Successive UPA mouthpieces have sought to distract the Indian public from scam after scam using the same card... over Malegaon, Samjhauta, Ajmer Sharif etc.

Now it is Balaatkaar Shinde's turn. Of course, since he is officially the HM of the GOI, his words in this regard carry more weight than Rahul Gandhi's (in a private conversation) or Pigvijay Singh's (as a party administrator.) But none of that matters. Balaatkaar Shinde, like all Mainovadis, is happy to throw the national interest under a bus as long as people can be induced to forget about the Balaatkaar that happened under his watch.

They did give advert in news papers with email addresses, FAX number, etc

so a 5 yr girl is raped but she doesn't die, the rapist will go free after 10 or 20yrs. What will he do after coming after jail. I am sure his appetite for sex will not change after being jail. in fact he will be even more dangerous after spending so many yrs in jail. These judges should be made to face the same in their own families, then they will understand what it means to be raped.

Hahahahaha.....What a joke....nothing new...what would have happened if Mr Verma's daughter or grand daughter was raped???? I am sure he would have recommended death penalty and also reduced the age of Juvenille to even 13. His photo looks like a rapist. Bloody shame on this society where people like Verma lives.

These judges are the biggest criminal, by pardoning rapi sts justice katju went into good books of congress, they sit over 90 000 cases of ra pe, they are slaves in hand of ruling congress. I hope one of these days daughter of a chief justice gets the same treatment on road...theek hai??

Verma Committee report on ‘Amendments to Criminal Law’ has noted that “the Juvenile Justice Act has failed miserably to protect the children in the country. We cannot hold the child responsible for a crime before first providing to him/her the basic rights given to him by the Indian Constitution.’’
Mango people should ensure that Juvenile Md Firoz is released soon and gets employed in the house of justice verma and daughters...
