Disqualify Smruthi Irani after she gets elected or before that and find Pappu lost the election? Either way it will be extremely embarrassing situation reducing the nation to a level of a Banana Republic. I wonder (YSR)Sampath has that many guts. He is no doubt will be advised by mafia to do so.

But with NM becoming PM soon, decision to disqualify someone he discribed as younger sister? ECI people need B*Ls of Titanium.

There is no way someone can survive if the spending is counted. But disqualification cannot happen anytime soon as it is all after accounting. They have a month's time I believe to give how much they spent.

The Congress will also officially complain about the Modi rally and press for Irani's disqualification this week. "The party is in no mood to forgive given the nature of campaign mounted by Irani and the BJP," says a top Congress leader.

Irani could not be reached for comment but a BJP leader close to her told ET this was "vintage tit for tat politics by the EC. We haven't received any complaint or notice," said the leader.

Section 77 of the RPA talks of the requirement to maintain true and correct accounts of spending and section 78 requires that these accounts to the filed with the electoral authorities.

Candidates can be barred from contesting elections for a variety of offences including filing of improper accounts under Section 10(A) of the RPA. The maximum period of disqualification is six years.

An official in the Election Commission dismissed the allegation that the poll watchdog was being vindictive, stating that team Modi's problems with the Commission have only started post April 30, after the Commission ordered an FIR be registered against the BJP Prime Ministerial candidate for flouting rules. The official also pointed out that in the case of Irani, since she had taken "advantage" of the rally ----as well as the fact she was mentioned by Modi in his speech and was present on the ..

Explaining the process by which the Commission calculated election expenditure, the person cited earlier said the intention was to ensure a level playing field. "The Election Commission comes out with a price list of equipment, furniture and other election related expenses in every constituency to ensure level playing field. In these elections, the Commission is also carrying out extensive video surveillance of every rally to capture details like evidence of vehicles, furniture, rostrum, chairs, ..

"There are also expenditure observers appointed in each constituency and the lavishness of the Modi rally was brought up by the local observers. We have asked them to conduct a detailed probe and they would be getting in touch with the candidate also," said the official.

There are many in South who would just cringe at the name of Islam. They don't care about Sufism, Shia, Sunni ityadi. All this Ganga-jamuna tehzeeb is not part of the narrative in South. Islam like Christianity was viewed as a monolithic entity. Their nuances were not discussed. People just hated those religions or just did not care.
My grandfather got Alzheimers when he was 85 and lost his memory but would get flashbacks of the 1940s and would talk about Muslims in unfavorable terms. He was very mild mannered in general, these were old experiences bubbling up.

Khujli baba is live on TV now. He is a staunch Hindu today has three finger Bhasma and Kumkum on his forehead. Looks like Muslim votes were not available, a quick aarti this morning at Ganga to fool yindoos.

Ajai Rai 's deliberate violation looks either stupid or sinister. Stupid because it looks like an act of a bad loser who knows the outcome. Sinister because he could be made a sacrificial lamb by stooge EC before acting on BJP . Smithi Irani could be taken down after this.

According to a trusted 'distant' relative (maternal grandfather's son-in-law's mother's daughter's bhabhi) who is about a decade senior to Sampath and Brahma in AP cadre IAS, these guys are well known in babudom for being sticklers to the rule-book but may have different interpretations....and they have never been known to have taken/given any special favors from/to any party. FWIW.

Just replace the word CM with Modi and Congress with BJP and this news would have been all over headlines even in Antartica.

Sampath was appointed by mafia queen so that he will be EC upto 2015 at the advise of YSR gang. He may be "honest" but just like MMS "honesty" he will be loyal to mafia.

Is it not worth noting that 2 or the 3 ECs are from AP cadre, wherein huge loot was taking place under YSR? Mafia plan well for this kind of things. Only thing misjudged is the NM and peoples hatred towards mafia.

NEW DELHI: Interpreting a 75-year-old law, Delhi high court has held that a non-Muslim woman who embraces Islam after marriage but reconverts to her original faith can dissolve the union due to apostasy.

Granting divorce under the Dissolution of Muslim Marriages Act 1939 to Sultana (name changed), a division bench of Justice S Ravindra Bhat and ​Justice Najmi Waziri also clarified there is no requirement in such circumstances for a woman who leaves the pale of Islam to prove her act in a trial. The mere act of apostasy dissolves the marriage if she so desires.

"Were a woman married under Muslim personal law to apostatize, the marriage stands dissolved. In such circumstances, the woman is entitled to seek a decree of declaration that the marriage stands dissolved from the date of her apostatizing," Justice Waziri explained.

The bench went into the circumstances under which the pre-Independence act was passed in 1939 to emphasize, if people come or are brought into Islam from a different religion, they should be permitted to go back for which there should be no bar.

The HC was hearing an appeal filed by the husband Asif (name changed) challenging the grant of divorce by a Saket family court to Sultana on her petition. Asif contested Sultana's reconversion back to Hinduism and alleged she did it under pressure from her parents. Asif also cited Section 4 of the Dissolution of Muslim Marriages Act to contend that it prohibits dissolution of marriage only on the ground of apostasy.

On her part, the estranged wife argued that for her reconversion to Hinduism no evidence is required to be led, as her mere statement 'ipso facto' amounts to abjuration of Islam and its tenets. She also filed an affidavit admitting to her apostasy along with two fatwas from two mufti. The wife also informed the court she had withdrawn complaint filed under Domestic Violence Act and another petition seeking maintenance. Now that she had apostatized, neither the marriage nor any right to claim maintenance subsisted.

The HC agreed with the trial court verdict and ruled that Section 4 has not altered the rule of Muslim personal law that apostasy dissolves a marriage. "In the opinion of this court, all that Section 4 has done is to introduce an intervening mechanism, but to reach the same conclusion, i.e., that apostasy would not by itself dissolve the marriage and some further substantive act would be required to be done in this regard; the substantive act being the filing of a suit seeking declaration as to dissolution," it observed. However, it rejected Asif's argument that Sultana would have to prove her apostasy..

Per 5forty3, early trends point to NaMo comfortably ahead in Varanasi though lead is not gigantic....More importantly, Ajay Rai seems to be second and not Kejriwal.

Congress' Ajay Rai in a soup after using party symbol; EC orders inquiry

In a deliberate act , after NaMo showing symbol outside 100 Mts, Ajai Rai shows symbol inside the Polling station . TV reports indicate that EC ordered FIR. Mr Rai has defended his action saying he is showing symbol before casting his vote while NaMo was showing after casting his vote. Presumably, Mr Rai could have voted for symbol other than Panja.

Dressed in a cream colour kurta and pyjama, Rai walked into the polling station early in the day accompanied by his wife to cast his vote.

He also spoke to reporters within 10 metres of the polling station, which again is a breach of law.

"We have called for the CCTV footage of the polling booth and action will be taken after examining the same," special election observer Praveen Kumar told PTI in Varanasi.

Kumar also said that flashing of election symbol at the booth is violation of Section 130 of the Representation of Peoples Act and a report will be sent to the chief election commissioner after an inquiry into this matter.

A report has also been sought from the local administration.

The Congress defended Rai saying the BJP is using double standards.

"The BJP earlier said there was nothing wrong with Narendra Modi wearing the lotus symbol and now it is saying take action against Ajay Rai," said Congress spokesperson Meem Afzal.

Rai too defended his action saying that he has the right to wear the symbol as a candidate.

Rai also claimed that his action cannot be compared with the case against Narendra Modi as the BJP's prime ministerial candidate had shown his party's lotus symbol after casting vote.

An FIR was lodged against the Gujarat chief minister after he addressed a presser on April 30 outside a polling station in Ahmedabad''s Gandhinagar constituency and had clicked a selfie with his party's symbol in his hand.

The district administration had then clarified that Modi was well outside the 100 metre banned distance when the press conference took place.

Modi is also fighting Lok Sabha elections from Varanasi.

AAP's Arvind Kejriwal raised objections about Rai wearing the 'hand' badge in the polling booth and told reporters that Rai had clearly violated the law.

The BJP leaders also raised objections and sought an action against Rai by the Election Commission

Many are talking about comeback of Lathbandhan by Jail ke Panchi. Biharis would give them very unpleasant surprise to all such Lathbandhan and Gathabandhan. NiKuddin is gone with the wind and Jail ke Panchi would return to their Basera. Never again those dark days, Bihar still remembers even though anal-Yeats conveniently forgets the bitter truth about Jail ke Panchi.

NEW DELHI: A new army chief looks set to be chosen days before poll results are announced as the Election Commission of India has allowed the UPA government to go ahead with the process, defence ministry officials told ET.

The poll panel's green signal was communicated over the weekend, according to the officials, who did not authorised to speak to the media.

The government is expected to take a final decision on the appointment this week, but an official announcement will only be made on June 1. After Monday's final phase of polling, votes are to be counted on May 16. ET was the first to report on May 2 that the Centre had sought the poll panel's nod on the issue.

The Election Commission's approval has come almost two weeks after the government first sought its nod for picking the next army chief. The EC, however, is tightlipped on the issue.
