@ManjaM

I am talking specifically about WB. Worse things have happened in Bdesh continuously over the last four decades yet no one stood up in WB. Those who did were put down as "communal". That is the extent of brainwashing. It will take a lot of time and effort to correct this mentality. What is happening in WB is peanuts as compared to what happened in Bdesh.

http://www.newindianexpress.com/states/tamil_nadu/Cops-Recall-Horror-During-Ambur-Clash/2015/07/02/article2897905.ece
As the dust settles after the violence that erupted in the streets of Ambur town following the death of Shameel Ahmed allegedly after being tortured while in police custody (whose case has been transferred to the CB-CID) stories are surfacing of how some police constables put their lives at risk to save fellow constables from the unruly mob during the clash and how others were injured on Saturday.

Two constables with the Vellore unit of the Armed Reserve (AR) police saved a woman constable from an unruly group of protestors who were assaulting her while dragging her to an isolated spot. In the process of saving her from being gravely injured, they themselves sustained serious injuries.
Constables M Vijayakumar and P Kumar fought off a mob that was wielding sharp knives, including ones used to skin goats and sustained multiple deep injuries while doing so and had to flee from the attackers after rescuing the woman constable for almost a kilometre before seeking help to get to a hospital.
Kumar sought the help of a motorist to go to the Primary Health Centre at Madhanur. Vijayakumar requested a car driver to drop him off at a medical facility and underwent a surgery at the Christian Medical College. Both have since been referred to the Government Vellore Medical College Hospital. Considering the extent of injuries to the two constables, it is a wonder they managed to reach the hospital on their own.

Constable Vijayakumar (34), a native of Kalavai, was stabbed several times. He is now undergoing treatment for a deep cut that stretches from his buttock to his calf with cuts on his back, left abdomen and head.

His brother Velmurugan said, “he has received 98 stitches for the cut on his leg. We have not informed our parents as they cannot bear the sight of him suffering in pain. He cannot sit on the bed and is in a lot of pain.”

Kumar sustained injuries with stab wounds in his abdomen. Several police personnel have sustained injuries that required stitches.

Rajalakshmi of AR Police of Kancheepuram district and a head constable of Ambur Station sustained serious injuries on their heads with the woman cop underwent surgery at the Christian Medical College Hospital.

Even though there were about 350 policemen deployed when over 2,000 youth (some of them as young as 15 years of age) gathered at 9 pm near OAR Theatre on the National Highway-46 at Ambur to protest the death of Shameel Ahmed, they were caught unawares and unprepared when the protestors turned violent for four hours leaving 38 police personnel, including 10 women constables, injured.

“We were wearing protective gear but many protestors were armed with knives. We were shaken when they launched the attack. They were huge in number,” said an injured policeman.

Pelting of stones and deadly weapons were used to inflict injuries with the protestors also resorting to arson with several vehicles being burned and property being damaged. Some police personnel consider themselves fortunate to have survived the attack. The situation was finally brought under control after Inspector General of Police (north zone) M N Manjunatha arrived close to midnight with a contingent of policemen and boosted the security.

Pictures of the injured police personnel are doing the rounds through WhatsApp with messages asking “Where is the NHRC?(National Human Rights Commission) Are we not human?”

Crime Branch of the Criminal Investigations Department (CB-CID) has started an inquiry in alleged custodial death of Shameel Ahmed, who was allegedly beaten up by the Pallikonda police and said to have sustained injuries during illegal police detention. He died at the Rajiv Gandhi Government General Hospital in Chennai without responding to treatment on June 26.

On Thursday, CB-CID officials headed by Nagajothi, superintendent of police started their inquiry with six members, including police personnel of Palikonda station at Otteri office and Ahmed’s father-in-law N K Mohammed Ghouse, according to a source in the department.

Followed by death of Shameel Ahmed, hundreds of youth indulged in anti-social activities and a clash erupted between the mob and police, which left 38 police personnel injured.

A case was registered against Pallikonda station C Martin Premraj and six other policemen — special inspector of police Sabarathinam and constables Nagaraj, Ayyappan, Murali, Suresh and Muniyan — following a complaint by the victim’s family and the case was transferred to CB-CID. Inspector Premraj was placed under suspension by orders from DGP Ashok Kumar.

Ahmed’s relatives claimed he was detained in the quarters allocated to Premraj between June 15 and 19.

http://www.newindianexpress.com/states/tamil_nadu/Probe-into-MLAs-Role-in-Ambur-Violence/2015/06/29/article2892065.ece
The police have launched an investigation into the alleged role of Aslam Basha, Member of Legislative Assembly of Ambur, into violence against police personnel on Saturday night.

Many locals claimed that it was a “planned” attack on the policemen and Aslam Basha instigated angry Muslim youth, who were involved in the attack. They had gathered for a protest to condemn the death of 26-year-old Shameel Ahmed who was allegedly kept in illegal detention and beaten up by the Pallikonda police. Shameel Ahmed later died.

“We suspect that the MLA had a role in the clash. During preliminary inquiry, some persons informed us that he indeed instigated the violence. We will look into this allegation,” said a senior police officer camping at Ambur.

Scattered bricks and stones near the OAR Theatre in Ambur on National Highway 46 were proof that the nearly 2,000-strong mob had come to participate in the protest armed with bricks and stones, blades, knives and petrol that was used to set vehicles on fire. The protest left 38 policemen, including women personnel, battling injuries. Four of them sustained grievous injuries.

The protesters reportedly turned violent minutes after the MLA left the spot after speaking to the gathering. At least 350 policemen on security duty at Ambur faced stone pelting at 9.30 pm. The mob later set fire to the DSP’s vehicle stationed in a nearby school. The protestors pushed the vehicle outside the school before setting it ablaze. Another police vehicle also face similar damage.

The windshields of several government buses were damaged in the incident, while four two-wheelers were also damaged. A TASMAC outlet was gutted in the fire, with liquor worth `20 lakh being destroyed.

“We were asked to close shops hours before the protest. It was a clear indication that something undesirable was going to happen,” said a fruit shop owner at the Ambur bus stand. He closed his shop at 7.30 pm, compared to his regular 10 pm.

http://www.newindianexpress.com/states/tamil_nadu/Hindu-Outfit-Wants-Ambur-MLA-Aslam-Basha-Disqualified/2015/06/30/article2893696.ece
The petition said that a large number of police personnel were beaten up and government vehicles burnt during violence that broke out in Ambur following the death of Sameel Basha, a worker in a leather factory in the town.
Besides, the hospital where he was declared dead was ransacked and public vehicles passing along the national highway damaged, it said.

It said the incident occurred in the presence of Ambur MLA Aslam Basha, who should therefore be arrested under the National Security Act. His membership of the Legislative Assembly should be revoked.

“The protesters should give `5 lakh as compensation to the policemen who were affected during the violence. They should also pay `20 crore as compensation to the government for causing loss of public property,” the outfit demanded in the petition.

“Such protests are increasing and the police should stop these. The State government should also equip police forces in Ambur, Mannadi, and Muthupettai with modern weapons to control such protesters,” it added.

The petition said that Sameel Basha died in the hospital 10 days after the Pallikonda police registered a case against him. “Without knowing fully about the incident, the protesters caused extensive damage to public property,” it said.

http://www.newindianexpress.com/states/tamil_nadu/Cops-Kept-Youth-in-illegal-Custody-for-4-Days/2015/06/28/article2890411.ece
Chief Judicial Magistrate of Vellore, S Sivakadatcham has ordered a judicial inquest into the death of Sameel Basha, who was reportedly illegally detained by the Pallikonda police and beaten up. He died in the Rajiv Gandhi Government General Hospital (RGGGH) in Chennai on Friday.

Basha was allegedly involved in an illicit relationship with Pavithra, a married woman, who reportedly went ‘missing’ on June 13. Following this, Basha was picked up for inquiry by the police.

Talking to Express, N K Mohammed Ghouse, Basha’s father-in-law, said, “We handed over Basha to the Pallikonda police at 11 am on June 15 after the family of the woman (Pavithra) created a ruckus in our area. But the police tied him and beat him up badly.” Basha’s father, K Shah Jahan, said, “The Pallikonda police station inspector took my son to a guesthouse in Ambur on June 15.”

Sources in the police department confirmed that inspector Martin Premraj kept Basha in illegal custody for four days near Pallikonda police station. However, no report was filed stating that he was in police custody.

Ghouse claimed he visited the police station several times between June 15 and 18, but Basha was not to be seen there. The policemen in the station apparently told him that Premraj had taken Basha for inquiry in connection with Pavithra’s case. On June 18, Ghouse called sub-inspector of police Ravi from his mobile phone. “The SI told me that they were taking Basha to Salem for inquiry and disconnected the call,” he claimed. Ghouse also alleged that Premraj finally handed over Basha to him at 12.40 pm on June 19 after obtaining a written assurance from him that they would produce Basha for inquiry, if necessary.

Ghouse added, “(Inspector) Premraj asked me to give hot compression treatment to Basha as he had injuries, but claimed there was nothing to worry about. He said they are not registering a case either. But Basha was in a bad shape and could not move his right hand.”

Basha was taken to the Ambur GH and admitted for treatment at 3 pm on June 19. He was shifted to the Government Vellore Medical College Hospital, Adukkamparai on June 23. He was moved to the RGGGH on June 26 and around 5.40 pm the same day, he passed away, Shah Jahan claimed.

Doctors at the RGGGH said, “Though there were no visible injuries, he suffered polytrauma (multiple traumatic injuries).” The brachial plexus, a nerve which is under the shoulder joint and carries signals from the brain to the muscles that move the arms, was injured. He suffered ‘cardiac arrest’ and died, the doctors said.

http://www.newindianexpress.com/states/tamil_nadu/Shameel-Ahmeds-Lover-Untraceable/2015/06/29/article2892446.ece
he woman, with whom the late Shameel Ahmed (not Sameel Basha as identified earlier) was having an illicit relationship with, has yet to be traced with her mobile phone remaining switched off.

Twenty-three year old Pavithra, wife of Palani and mother of a four-and-a-half-year old daughter, went missing on June 13. Pavithra and Ahmed were working in the same leather factory in Pallikonda till six months ago and were allegedly carying on an extramarital relationship. They were sacked from work after the management learned about their affair.

Ahmed took up a job in a jewellery showroom in Erode and continued his relationship with Pavithra.
On June 13, Pavithra left her home and apparently called Ahmed over the phone to meet him. Ahmed told her that he was at work in Erode and asked her to come to Erode where they met in a house for a day after which Ahmed called and told her family members that he had sent Pavithra back home. However, Pavithra did not return home, police said.
Following this, Palani and his family members picked up a quarrel with Ahmed’s family residing in Ambur. Ahmed’s uncle Khaleel handed Ahmed over to the Pallikonda police on June 15 to look into the issue.

Detained by the Inspector of Pallikonda, Martin Premraj, at his police quarters for four days, Ahmed was allegedly beaten up and handed back to his family on June 19. Ahmed later died on June 26 at the Rajiv Gandhi Government General Hospital, Chennai.

Meanwhile, Pavithra remains untraceable, with Pallikonda police registering a missing woman case, which will be investigated after normalcy is restored in Ambur, according to a senior police officer.

On the Kerala episode. Without much fanfare K.P and the Coast Guard picked up the boat with the crew. One thing I noticed was that even the Malayalam News channels have not given a undue publicity in this case. They are all focusing on a case of film piracy :P. As per latest reports the stories of the people in the beat does not add up, and K.P wants NIA to probe the incident. This looks like not a case of an innocent boat losing its way.

Security alert: Drone hovers near TISS, BARC - ToI
MUMBAI: An unidentified drone hovering around 20m above the Tata Institute of Social Sciences in Trombay on Monday afternoon triggered a security alert as the Bhabha Atomic Research Centre, which is on the terror hit-list, is located nearby.

The incident comes more than a month after a pilot alerted the Air Traffic Centre on sighting parachute-like objects over the airport.

On May 26, Dharmanandan Diamond Pvt Ltd, a Surat-based diamond firm, released helium balloons for promotional merchandise to mark a cricket tournament at the Air India ground, which is adjacent to the runway near the old Kalina airport. Police arrested two men, including the event organizer, in the case.

Sources said that around 12.30pm, unidentified persons flew the drone at a height of 20m for few minutes in the area and then fled in a waiting private car.

A professor from TISS, who was passing by, noticed the drone and immediately alerted the police control room. The professor, who is now the prime witness in the case, has recorded the incident. He has handed over the video footage to police.

"We are examining the video clips. Prima facie, it appears that it may be some event management firm practising a videoshoot as nowadays more and more people are engaging event organizers with drone cameras," said deputy commissioner of police (zone 6) Sangramsingh Nishandar.

Joint commissioner of police (law and order) Deven Bharti said, "Despite a ban, some event organizers use drones for shoots without prior permission. We have been regularly informing event organizers that they should take permission from the civil aviation and the police. We will definitely catch the culprits in this case and take strict action."

"PM Modi asks Ministry Of Home Affairs to submit NSCN(K) action strategy"
http://www.asianage.com/india/pm-modi-a ... rategy-323
Prime Minister Narendra Modi has directly intervened and asked the Union home ministry to submit a detailed action plan on cracking down on the NSCN(K) — the breakaway fraction of the Nationalist Socialist Council of Nagaland — which recently carried out the worst attack on the Indian Army in three decades in Manipur on June 4. As soon as Mr Modi returns from his Russia visit, the MHA will submit a detailed note and presentation on the outfit’s nefarious and anti-national activities seeking a ban on the outfit.

There have been running differences on the issue within the government wherein a section felt the ceasefire issue was not handled properly by the MHA. While the MHA maintains the outfit had unilaterally abrogated the ceasefire pact with the Centre at the behest of ‘’foreign powers’’, the ministry’s Cabinet note seeking an urgent ban on the outfit has been pending for atleast two weeks before the Cabinet secretariat.

However, Mr Modi’s direct intervention is expected to settle the matter and pave way for the Union Cabinet to finally take up the banning of the insurgent outfit under the Unlawful Prevention Activities Act (UAPA) possibly as early as next week.

Poll | Does the Delhi gangrape minor deserve a second chance?
Welfare officers and counselors at a correctional facility that holds the juvenile accused in the December 16 Delhi gangrape case say the now 20-year-old is a changed person and the home’s most disciplined inmate.

Authorities say he has turned religious, is growing a beard and offering namaz five times a day. He is observing the Ramzan fast too.

Set to walk-free in six months, the boy convicted of raping and killing a 23-year-old woman in Delhi, doesn’t want to leave the “safety” of the reform home he has spent the last two-and-a-half-years in, afraid he will be “lynched” the moment he steps outside.
90%+ people in the poll voted for NO to the question "Does he deserve a second chance in life?"

Sen_K ji, that news is really depressing. It shows how deep the rot is. Is also shows how powerless the legislative (as PM) is ineffective in front of executive (babudom). Modi is against a very formidable C-System that is definitely anti-BJP but also very self preserving, even if that means being anti-Indian.

The unanswered question is: What was Tomar, then posted as First Secretary in the Indian embassy in Kathmandu, doing in the hijacked plane? The most charitable explanation that I have heard so far at the highest level of government is that it was a “bad coincidence” that Tomar boarded a flight that got hijacked.
Many believe that commandos were not given the go-ahead to storm the plane in Amritsar simply because Tomar was inside it. A proposal to send commandos in was apparently sabotaged by none other than N K Singh, Secretary to then Prime Minister Atal Bihari Vajpayee. Tomar is married to Singh’s youngest sister. Many swear that Singh pulled out all stops to ensure his brother-in-law’s safety!
As is well known, from Amritsar the plane flew to Lahore, Dubai and finally landed in Kandahar. Tomar’s presence in the hijacked plane remained a tightly-guarded secret known only to a select few in the Indian establishment. But it didn’t remain a secret for too long.
On 27 December, while 1C 814 was stranded in Kandahar and negotiations were underway for the release of hostages, Pakistani Foreign Ministry spokesman, Tariq Altaf, gleefully announced before the international Press in Islamabad that RAW officer S B S Tomar “is on board the hijacked Indian Airlines plane and he is guiding, directing and controlling the five or six hijackers”.

"Cocaine smugglers turn to South Asia for new routes, markets"

DHAKA/NEW DELHI (Reuters) - Police who seized Asia's largest known shipment of liquid cocaine at a Bangladeshi port late last month say it was headed for India, the latest sign that drug cartels are increasingly plying their trade in South Asia.

It isn't clear whether India was the final destination for the cocaine, worth as much as $14 million, or whether it was a transit point for other markets in Asia and Europe.

"They wanted to redirect it to India when it got stuck at Chittagong," Bangladeshi police official Mohammad Kamruzzaman said. Kamruzzaman said they found correspondence that said the shipment was headed for "any port in India".

One thing is clear - big drug busts in the region are becoming more common.

Over the past three months, Indian and foreign police sources said larger than usual amounts of high-purity cocaine carried mainly by South American and African drug mules have been seized in India.

Multi-kilo hauls have also turned up in Kathmandu.

Drugs dont come to India unless there is a agent or a group which is receving it

The global drug cartel look for new market based on economic growth and younger demographics

India is the target based on these indicators

Indian agents have been coopted to arrange the receipt. Need to look for the Indian group who are in this

Very important to kill the drug cartels and treat it on par with dreaded terrorist groups in terms of their impact to national security. Potato. With billions running through hawala, do you expect the trade to be curtailed? Only thing that will help is license production and legalization. This will drop the street price and put the foreign drug lords out of commission.

Mob beats up 2 Delhi cops for flagging traffic rules
Two traffic cops were beaten up by a mob and forced to flee after they had flagged down two youths on a bike for jumping a traffic signal and riding without helmets in northeast Delhi on Monday morning.

When asked to pay the challan, the youths allegedly called up their relatives, who soon gathered at the spot. In a video recorded by a passerby, the traffic policemen, identified as head constable Jai Bhagwan, 55, and constable Manoj Kumar, 25, are seen getting punched and kicked after being pinned down to the ground. The cops were also allegedly hit with helmets.

The attack took place around 10am at the Bhajanpura-Gokulpuri crossing on the Wazirabad Road. The bike riders — identified as Shahnawaz Ahmed, 25, and Amir, 18 — were apparently returning from Ramzaan prayers. They were later arrested.

A local youth, on his way to tuition classes, recorded the scuffle on his mobile phone. He said the mob was being led by the elderly man who coaxed people to join the youths in beating up the policemen.

"He kept saying that the policemen were trying to implicate his sons and asked bystanders to join them in beating up the cops," the youth told TOI, requesting anonymity.

In the video, Manoj is seen trying to rescue his colleague from the mob. But the crowd then turns on him, chasing the cops and pushing him to the ground. Manoj's mobile phone and the e-challan machine were also damaged in the violence.

In the video, a group of three to four men are seen surrounding Manoj, who is then punched and kicked. As Manoj gets up and tries to run away, the men chase him and hurl more blows.

As more passersby gathered at the spot, the mob dispersed. The cops then called up the police control room and were admitted to the LBS hospital for treatment.

Senior police officials said Sagir Ahmed, Shahnawaz and Amir were arrested from the locality within an hour and a search has been initiated to nab the others. They said Ahmed claimed to be a local religious leader while Shahnawaz and Amir worked at a shop in Gokalpuri.

What's cooking on the Italian marine's case? Local Malayalam visual media was reporting that GoI has started giving some "concessions" to Italy and the Italian marines. The marines are accused of firing at some Keralite fishermen and killing them.
1. Italian marines case may take international arbitration route
2. The courts have also extended the tenure of stay for a Marine, who moved back to Italy on health grounds.

Off course, any reports about concessions by the GoI may cause some uproar in Kerala, not because of any travesty of justice or any high funda stuff, but purely it is Modi at the helm. People will happily forget that the case happened 3-4 years back, and nothing has moved an inch from then on (when the "able" MMS & Co were ruling the country).

Mob beats up 2 Delhi cops for flagging traffic rules

Thanks to proliferation of smart phones, now rampaging Muslims mobs cant get away with their hooliganism (even they can blame DP for high-handedness and have dragged minority commission et al). I wish Delhi has MCOCA type law and use that law to press charges for such coordinated criminal attack on police officers.

^^ IIRC, the day of reckoning will come for these hooligans when the dam bursts. The Coimbatore massive flareup in 98 had started over a few peaceful stabbing a traffic cop over a signal violation and the incident led to the pent up anger over the peaceful antics of all the years before bursting open the floodgates.

Such quick assembling groups are organised on whatsapp and other SM and are increasingly becoming common across the country. They can be seen in operation in cities like bangalore and are very quick to aggressively assemble and get violent at the drop of a hat. Wallets, gold chains, phones, watches, finger rings are routinely snatched in such meelees.

This specific type of use of whatsapp groups to commit violence by " peaceful groups" etc is a new and recent phenomena and can peak during times like ramzan, fridays etc, when the cops tend to look the other way.

The Coimbatore massive flareup in 98 had started over a few peaceful stabbing a traffic cop over a signal violation and the incident led to the pent up anger over the peaceful antics of all the years before bursting open the floodgates.
Coimbatore is in even worse shape these days as far as violent muslim extremist consolidation goes..in 20 years the problem has only become worse. Question is whether the jihads are much better armed these days than they were 20 years ago -- either way, the state police are not in control of the situation, just as they were not in 1998.

As Sonia Gandhi is now not going to weep over the arrest of these goons - with a different CG - expect Delhi police to give them a piece of their mind in the hawalat.

Coimbatore is very close to Kerala and several Malayali muslims with strong Arab inclinations (due to Gulf indoctrination) are spoiling Coimbatore. Coimbatore native muslims are getting increasingly converted into violent wahabi idealogies, especially the younger generation. In fact, it is a trend all over India. In TN, it is becoming difficult to see muslims who do not wear full black burqas that cover everything except the eyes, even during hot summer!

IIRC the Indians killed were christians. The church being the loyal minion of its masters in the west quickly jumped in and "mediated" between the members of the bereaved family and Italy, they got 1cr. each as blood money. I very much doubt whether the family itself will be up for the fight since their loyalties have been bought. We aren't exactly defending honourable people here.

I agree with you. But in that case GoI be better prepared to clearly prove that:-
1. Money was exchanged between the church and the relatives of the dead fishermen.
2. GoI did feel that all crucial witnesses would turn hostile, and this case is not going to go for a negative verdict against the Italian marines.

Or else the "secular media" would walk away laughing loudly, "secularism" is saved, the kin has received huge money and the media again gets a chance to pillory Modi-led GoI (for being not nationalistic, or strong enough).

Mehhhh I can prove that right here without much sweat.

Point 1

Church not to intervene in Italian Marines case By Cithara Paul - NEW DELHI Published: 25th August 2013
After facing flak for its earlier intervention in the Italian marines case, the Indian Catholic Church has now flatly refused to help bring four Italian marines, who were to depose as witnesses in the killing of two fishermen off Alappuzha coast, to the country.

The Italy’s refusal to send the four marines to the country to depose would be a big setback, as it would further delay the probe. The National Investigation Agency (NIA) had summoned the four marines, who were onboard the Italian vessel Enrica Lexie when their colleagues Massimiliano Latorre and Salvatore Girone allegedly shot dead two Indian fishermen on February 15, 2012.

To save its face, the Central government is learnt to have tried the ‘Church route’ to get the marines to depose. Towards this end, the Centre had deployed two Catholic civil service officers -- one from the IAS and the other the IFS. But Catholic heads in the country, it is learnt, have decided not to intervene. “The government had approached us through emissaries, who happened to be Catholics. But we have decided not to meddle in this matter anymore,” said one of the senior priests from the Catholic Bishops Council of India (CBCI), the official decision making body of Catholics in the country.

In March, the CBCI was accused of brokering an out-of-court deal between the families of the slain fishermen and the Italians, after two Italian Catholic priests paid a secret visit to the families.

After the meeting, the victims’ families signed an agreement with the Italian Government and settled the case for a compensation of Rs 1 crore for each family and withdrew the petitions and submissions against the marines. “We already have burnt our fingers in this case without doing any wrong. Just as we owe our spiritual loyalty to the Pope, we have our loyalty to our nation too  . Those who got killed were also Catholics,” said the priest.

The Church said the matter has to be settled at the earliest. “We are not bothered whether it is out-of-court or through court. All that we demand is that the victims should get justice,” said the priest. :rotfl:

“The government seems to be quite content even if they depose through written statements or video conferencing. There is a huge difference in the government’s approach now,” said the priest.
Point 2 and some other highlights

Families drop charges against killer Italian marines by Prakash Thiruvananthapuram, April 20, 2012
The Kerala High Court on Friday allowed the referral of the suit seeking compensation for the killing of two fishermen by Italian marines to a Lok Adalat.

The request for the transfer was made jointly by the Italian government, owners of Enrica Lexie -- the merchant vessel on which the marines were posted -- and the legal heirs of the two victims after they informed the court they had reached a settlement.

The Italian government and the ship owners told the court that the victims' families would be paid Rs. 1 crore each and the heirs submitted before the court that they had withdrawn the criminal charges against the marines as part of the agreement.

According to sources, for the past few days, Italian Foreign Minister and Italian Foreign affairs officials were in constant touch with counsel of the dependents of the deceased fishermen Valentine Jelestine and Ajeesh Pink.

The Italians first approached C Unnikrishanan, counsel for Valentine's wife Dora, with the offer to settle the compensation claims through talks. After initial rounds of discussions with him, the counsel for Ajeesh's two dependent sisters, V M Syamkumar was also roped in. Along with the counsel, priests of the two parishes where the fishermen resided also participated in the discussions. Initial offer was Rs. 35 lakh each, which was finally scaled up to Rs. one crore each.

There is a big mismatch between the Centre's stand in the Supreme Court and the direction it gave to Kerala in the case of firing by Italian marines at Indian fishermen off Kerala Coast.

While the Centre maintains that its stand in the matter hasn't changed, Chief Minister Oommen Chandy has shot down the Union Government's suggestion that Kerala had no authority to register a case against Italian marines.

"We have sought the advice of the Centre at every crucial moment and we had taken steps accordingly," he said.

"The incident took place in the territorial waters of India and we have registered the case against the marines after proper legal vetting," he added.

DGP Jacob Punnose clarified that the case had been registered against the marines as the IPC empowers the state to take action against a foreign vessel that rams into an Indian registered vessel.

However, the legal opinion is divided. A section is saying that since the incident occurred in the territorial waters of India, the state has no jurisdiction in the area, only the Centre has. Going by this argument, the two marines can sue the state government for confining them illegally.

But legal experts argue that under the IPC, the state can take action. "There is no doubt that Kerala can proceed against the marines under the IPC," said Radhakrishan a leading lawyer in marine law.
For the purpose of making my fellow BRFites nauseate  , from the commie mouthpiece

A mess over Italian marines by RK Nair February 26, 2014
It is just as well that India has dropped a plan to prosecute two Italian marines accused of killing two Indian fishermen under a tough anti-piracy law. Better late than never.

But the Indian government needlessly put everyone, including itself, through the wringer, botching up ties with Italy, if not the European Union. Italy last week withdrew its Ambassador as a result of the recent turn of events. That was perhaps the wake-up call.

To recap, on February 15 two years ago, an Italian oil vessel opened fire on a fishing trawler in Indian waters, killing two fishermen. The incident seemingly occurred some 20 nautical miles off the Kerala coast. The two Italian marines on the vessel, Chief Master Sergeant Massimiliano Latorre and Sergeant Salvatore Girone, belonging to the San Marco Regiment of the Italian Navy, were arrested. Italy wanted to try them under their laws, but India insisted on holding their trial here, and seems keen to prosecute them under – believe it or not-- our terror law.

Now, this is just an accident. The marines mistook them for pirates, probably Somalian, and took their lives. The Italian government paid a compensation of Rs 1 crore to the families of the fishermen. Still, we insist on going over the top. This sort of jingoism does our world stature no good at all.

And, what’s more, such accidents are nothing out of the ordinary.

A fortnight after the killing of the two fishermen, a Singapore flag-bearing ship owned by an NRI group rammed a fishing boat in the same waters, killing five fishermen. The incident was quietly buried and it's not known if, and to what extent, the victims' families were compensated. A few years earlier, a Chinese trawler involved in a similar incident off the Kerala coast was let off after payment of Rs 5 lakh as compensation.

Then why this special treatment to the Italians? Even if we do not read too much politics into it, what is obvious is that the bureaucracies at the Ministries of Home, Defence and External Affairs have not worked in tandem and thought through the implications of their actions.

But, such obduracy in international matters does the country no good. India was vociferous about the ill-treatment of one of its diplomats in the US recently, risking its ties even here. We must act with more restraint.
So any other doubts remaining about the case ???

IIRC, the mallu muslims are pretty much a lost cause . Even a cursory glance of even FB pages of most of these "educated" guys should give a glimpse into the pent up bile.

Even TN has dark days ahead since recent visits to TN were almost like a visit to Kerala itself ( esp in peace dominated areas). By contrast, i guess Kannada( excpet costal Mlore/Bhatkal janta) and Telgu ( except old city) peacefuls look a lot more sober

I am not very convinced about this happening. There would some "human rights wallah" who would pick this up, then file an appeal in a lower court and another hearing starts. If I get it right, this is what exactly happened with the murderers amongst the Veerappan gang who were to be executed at Hindalga prison. Some thing similar also happened with the Rajiv Gandhi killers now camping at Vellore prison (Perarivalan et.al).

In the case of Yakub Memon, the entire judicial machinery route has been taken with all appeals getting thrown out. His mercy plea also has been thrown out by the President, and with all that done there should ideally be no more options. Cooking up some thing new, and then taking it through the judicial machinery is only going to make this an infinite loop.
