Among other things, it also means that the bordering state next to Bangladesh, West Bengal also seems to be doing a very sloppy job on internal security. Preaching communism, having an "intellectual" air around, does not automatically stop these Bangladeshis from coming in illegally. The BSF etc. can try to defend a very porous border, but once these fellows escape the BSF then they manage to settle down comfortably in West Bengal. And then even get some kind of ID cards and fan out to other parts of India (to cause miseries to people there).

Three Lashkar militants meet their 72 in Kashmir gunfight

SRINAGAR: Three Lashkar-e-Taiba (LeT) militants ~~were killed~~ meet their 72 on Thursday after a six-hour gunfight with security forces in Kashmir, triggering widespread protests across the south of the valley.

Mobile phone and internet services were suspended in parts of south Kashmir to prevent rumours and details of the counter-insurgency operation through social media.

Police said the slain militants were all Kashmiris and apparently belonged to south Kashmir.

"Three local militants of LeT have been killed. But a search operation is still going on," a police officer said.

As news of the killings spread, clashes erupted between security forces and protesters who tried to march towards the gunfight site in Arwani village of Anantnag, some 40km south of here.

Clashes between stone-pelting protesters and security forces also erupted at various other places in south Kashmir.
Lashkar-e-Taiba commander Abu Dujana, one of the most wanted militants in the state, was earlier rumoured to be among the gunmen holed up in a house where the militants were holed up.

There were conflicting reports about Dujana. Locals said he escaped from the hideout in Arwani which lies close to chief minister Mehbooba Mufti's ancestral Bijbehara town.

But security officials neither confirmed nor denied if he was among the militants trapped since Wednesday night.
Police said security forces surrounded the village late on Wednesday following a tip off about the presence of militants inside the hideout.

"As security forces tightened the cordon, some gunshots were heard. But after that there was no exchange of fire," the officer said.

He said the gunfight intensified in the morning after militants started firing at the security forces.

Mobile phone and internet services were suspended in south Kashmir Anantnag district as the gunfight raged.

Although authorities did not formally confirm that the mobile phone operations were suspended, but authoritative sources told IANS the action had been taken to check spread of rumours in the area.

Two terrorists killed in Anantnag encounter

SRINAGAR: Two terrorists have been killed by security forces in the 36-hour gunbattle in Bijebhara area of Anantnag district of Kashmir which ended today.

The bodies of the terrorists were recovered from the debris of the house at Arwani in Bijbehara area this morning after security forces blew up the building using explosives, a police official said.

He said one of the bodies was severely burnt.

However, an army official said they were still sifting through the debris and a final statement on the incident will be issued once the operation was called off.

One army jawan was injured in the gunfight that began in the early hours yesterday.

Security forces had cordoned off the area on Wednesday evening following information about presence of Lashkar-e-Toiba terrorists there.

A 24-year-old youth died allegedly after being wounded by a "stray bullet" near the site of encounter.

Arif Shah, a resident of Sangam area of Anantnag district, was hit when security forces were dealing with a group which was indulging in stone-pelting near the encounter site, the official said.

However, locals alleged that Shah was killed in security forces action against protesters.

The decision of Jammu and Kashmir Muslim Conference on 18th July 1947 to accede to Pakistan with respect to defence, foregn affairs and communication; the Pakistan sponsored tribal raid in Kashmir on 22nd October; the establishment of Azad Government of Jammu and Kashmir on 24th October; and the actual accession of Maharaja Hari Singh to the Indian Union with the political support of National Conference on 26th October 1947 with respect to the same three subjects created the circumstances in the former princely state in which perpetual conflict consumed lakhs of human lives over the past seven decades

The above mentioned systematic and phased initiatives through cooperative bilateralism between India and Pakistan can help in evolving an independent KASHMIRISTAN as a ‘buffer state’ between the two present day hostile neighbours. Keeping in view the inter regional physical, religious, ethnic and lingual diversity in Jammu and Kashmir the regional aspirations of the people of the state have to be fulfilled by reorganizing Kashmiristan into six states namely Jammu, Kashmir, Ladakh, Baltistan, Dardistan and Parmistan. The Kashmiristan can be renamed as the Federal Republic of Kashmiristan. The ‘buffer state’ of Kashmiristan can serve as a bridge of friendship between India and Pakistan. It can also serve as a transit zone among Pakistan, Afghanistan, China and India for trans-border transport, travel, tourism, trade and commerce. The historical Silk Route through Kashmir and Ladakh can be revived to facilitate the economic and social integration of the entire the Silk Route Region.

Islamabad is fuming with anger after the World Bank used a map of Pakistan without the territories of Pakistan-occupied Kashmir (PoK) which they call Azad Jammu and Kashmir (AJK) and Giglit-Baltistan (G-B). According to a report in The Express Tribune, Pakistan has decided to lodge an official protest with the World Bank (WB) in this matter. World Bank’s Lead Economist for African Region Vincent Palmade had used the map in his presentation during the official ceremony of a book launch in Islamabad on Tuesday.The book titled ‘South Asia’s Turn: Policies to Boost Competitiveness and Create the Next Export Powerhouse’ was launched during the annual general meeting and conference of the Pakistan Society of Development Economists.Interestingly, the World Bank has defended its decision to use the Pakistani map that omitted PoK and G-B. Pakistan, however, is not satisfied with the explanation and has decided to officially lodge a protest with the World Bank office in Pakistan on this matter.“After consulting with the Foreign Office, we have issued a disclaimer as the WB official has shown an incomplete and incorrect map of Pakistan,” Pakistan’s Planning Commission’s Chief Economist Dr Nadeem Javeid, who chaired the session in which the WB official used the map, said.

Pawan turns tables on BJP, demands Governor’s rule

Making a scathing attack on coalition Government in the State and accusing it of putting premium on terrorism and emboldening the terrorists and anti national elements responsible for present unrest, former Minister and MLA Udhampur Assembly Segment, Pawan Gupta today demanded dismissal of the PDP-BJP Government and imposition of Governor’s rule.
“This is high time for imposition of Governor’s rule in the State otherwise the situation will deteriorate further”, Gupta told reporters here, today.

Terming the present Government worst ever, Gupta said amnesty was granted to Sales Tax evaders which has no justification. This Government has lost confidence of people both in Kashmir valley as well as Jammu region, he added.
He said mishandling of NIT situation and thrashing and humiliating of patriotic students, allowing displaying of ISIS and Pakistani flags, permitting anti national forces to hold seminars, disallowing the Abhinav Gupt yatra, imposition of unconstitutional Jazia i.e tax on helicopter service used by pilgrims, introduction of draconian and obnoxious Land Amendment Bill, enmass release of stone pelters, failure to establish Sainik and KP colonies in Valley and mishandling of Kashmir situation after the killing of Burhan Wani all reveals the incompetence of BJP ministers in the coalition.
Turning tables on BJP and blaming it of total surrender before PDP and divorcing its principles, Gupta said had our elders gone to jail and struggled throughout their life for the same. “The people who were the founding members of Praja Parishad which later into Jana Singh and then rechristened as BJP remained in solitary confinement for over six months in Central jail but they did not compromise and surrender before the then Government only to maintain the pride of Jammu people”. But the present BJP leadership has done quite contrary to that, he added.
He said if Jammu continues to be deprived of its rights and share, then there is no alternative to the people to launch a movement for separate statehood to the region.
He said that Party is run by ideology (Vichar Dhara) and not by an individual but the State BJP has said good by to its ideology just for sake of power. The Party disdained and disrespected the sentiments of the people of the State especially the nationalist people of Jammu as it has not only played as puppet but also as the B team of PDP, he added.
While expressing his surprise over grant of ex-gratia to dreaded militant Burhan Wani’s kin, Gupta said he has gone for record to say that he will send his daughter to join terrorist group.
Gupta said that Congress, NC and PDP had already betrayed the people of Jammu while BJP too has chosen the same path after divorcing its ideology as it is subservient to PDP.

SRINAGAR, India – Indian authorities call the shotgun shells filled with hundreds of small metal pellets a "non-lethal" weapon for crowd control, but that does not make them harmless. They've inflicted a permanent toll on hundreds of Kashmiris hit by them.

Their faces are scarred. Their eyes are damaged or simply gone, replaced with prosthetics. And their psychological wounds run deeper still.

"What I miss most is being able to read the holy Quran," says Firdous Ahmad Dar, 25, a Kashmiri man who lost vision in both eyes after being shot with the pellets during an anti-India protest in the troubled Himalayan region.

The pellets have been in use here since 2010. Soldiers are trained to fire the shotguns below protesters' waists, causing immense pain but — in theory — no permanent injuries. But a police official acknowledged that the rules are "more or less not followed because of the intensity of stone-throwing protests. The officer spoke on condition of anonymity in keeping with department policy.

The latest wave of protests began in early July after Indian troops killed Burhan Wani, a young and charismatic militant commander. As government troops cracked down on angry street protests in the Kashmir valley, shotguns were their weapon of choice.

Health officials say that in the past five months more than 6,000 people, mostly young men, have been injured by shotgun pellets, including hundreds blinded in one or both eyes. Police and hospital officials say the pellets have killed at least eight people, though a prominent local rights group, Jammu-Kashmir Coalition of Civil Society, says the death toll from the pellets is 18.

President-elect Donald Trump’s off the cuff, chaotic approach to foreign policy had at least one thing going for it, even though it was more the feel of a blind pig rooting for acorns than a thought-out international initiative. In speaking with Pakistani Prime Minister Nawaz Sharif, the New York Times reported, Trump said he wanted “to address and find solutions” to Pakistan’s problems.

And what big problems they are.

Whether Trump understands exactly how dangerous the current tensions between Pakistan and India are, or if anything will come from the November 30 exchange between the two leaders, is anyone’s guess. But it’s more than the Obama administration has done over the past eight years, in spite of the outgoing president’s 2008 election promise to address the on-going crisis in Kashmir.

With so much at stake, why is no one but a Twitter-addicted foreign policy apprentice saying anything? What happened to President Obama’s follow through to his 2008 statement that the tensions over Kashmir “won’t be easy” to solve, but that doing so “is important”?

A strategy of pulling India into an alliance against China was dreamed up during the administration of George W. Bush, but it was Obama’s “Asia Pivot” that signed and sealed the deal. With it went a quid pro quo: If India would abandon its traditional neutrality, the Americans would turn a blind eye to Kashmir.

As a sweetener, the U.S. agreed to bypass the global nuclear Non-Proliferation Treaty and allow India to buy uranium on the world market, something New Delhi had been banned from doing since it detonated a nuclear bomb in 1974 using fuel it had cribbed from U.S.-supplied nuclear reactors. In any case, because neither India nor Pakistan is a party to the treaty, both should be barred from buying uranium. In India’s case, the U.S. has waived that restriction.

The so-called 1-2-3 Agreement requires India to use any nuclear fuel it purchases in its civilian reactors, but frees it up to use its meager domestic supplies on its nuclear weapons program. India has since built two enormous nuclear production sites at Challakere and near Mysore, where, rumor has it, it is producing a hydrogen bomb. Both sites are off limits to international inspectors.

Avenues to Peace

As complex as the situation in Kashmir is, there are avenues to resolve it. A good start would be to suspend the Special Powers Act and send the Indian Army back to the barracks.

The crisis in Kashmir began when the Hindu ruler of the mostly Muslim region opted to join India when the countries were divided in 1947. At the time, the residents were promised that a UN-sponsored referendum would allow residents to choose India, Pakistan, or independence. That referendum has never been held.

Certainly the current situation cannot continue. Kashmir has almost 12 million people, and no army or security force — even one as large as India’s — can maintain a permanent occupation if the residents don’t want it. Instead of resorting to force, India should ratchet down its security forces and negotiate with Kashmiris for an interim increase in local autonomy.

But in the long run, the Kashmiris should have their referendum — and both India and Pakistan will have to accept the results.

Supreme Court rejects HC ruling: No sovereignty for J-K outside Constitution of India

Snubbing the Jammu and Kashmir High Court for asserting the state’s “sovereignty” and “sovereign powers”, the Supreme Court Friday said J&K “has no vestige of sovereignty outside the Constitution of India”. A bench of Justices Kurian Joseph and Rohinton Nariman also rejected the J&K High Court’s view that the J&K Constitution was equal to the Constitution of India.
“It is clear that the state of Jammu & Kashmir has no vestige of sovereignty outside the Constitution of India and its own Constitution, which is subordinate to the Constitution of India… they (residents of state) are governed first by the Constitution of India and also by the Constitution of Jammu & Kashmir,” the bench said, referring to the preamble of the Constitution of J&K, 1957.
The bench called it “disturbing” that various parts of a judgment in appeal by the J&K High Court spoke of the absolute sovereign power of the state. “It is necessary to reiterate that Section 3 of the Constitution of Jammu & Kashmir, which was framed by a Constituent Assembly elected on the basis of universal adult franchise, makes a ringing declaration that the State of Jammu & Kashmir is and shall be an integral part of the Union of India. And this provision is beyond the pale of amendment,” the judges said.
The bench also clarified that J&K residents are “first and foremost” Indian citizens. “It is therefore wholly incorrect to describe it as being sovereign in the sense of its residents constituting a separate and distinct class in themselves. The residents of Jammu & Kashmir, we need to remind the High Court, are first and foremost citizens of India… permanent residents of the state of J&K are citizens of India, and that there is no dual citizenship as is contemplated by some other federal Constitutions in other parts of the world,” it said.
The top court pointed out that it was constrained to observe these because in at least three places, the High Court, in its judgment, “has gone out of its way to refer to a sovereignty which does not exist”.
Underlining that the quasi-federal structure of the Constitution of India continues even with respect to J&K, the bench said: “Article 1 of the Constitution of India and Section 3 of the Jammu & Kashmir Constitution make it clear that India shall be a Union of States, and that the State of Jammu & Kashmir is and shall be an integral part of the Union of India.” It said the J&K Constitution has been made to further define the existing relationship of the state with the Union of India as an integral part thereof.
The court said this while deciding a legal question on whether the Securitisation and Reconstruction of Financial Assets and Enforcement of Security Interest Act, 2002 (SARFAESI Act) will be applicable to J&K or the law was outside the legislative competence of Parliament since its provisions would collide with Section 140 of the Transfer of Property Act of J&K.
SARFAESI Act entitles banks to enforce their security interest outside the court’s process by moving a tribunal to take possession of secured assets of the borrower and sell them outside the court process. The High Court had said that the state has absolute sovereign power to legislate in respect of laws touching the rights of its permanent residents qua their immovable properties.
After the State Bank of India appealed against the High Court order, the J&K government submitted in the Supreme Court that this law encroached upon the property rights of permanent residents of the state and must be read down so that it will not be permissible to sell property belonging to a permanent resident of the state to outsiders. It was also argued that Parliamentary legislation would need concurrence of the J&K government before it could apply to the state under Article 370.
But the Supreme Court bench shot down these arguments, saying SARFAESI Act deals with recovery of debts due to banks and financial institutions, which is relatable to a subject under the Union List and parliamentary legislation did not require concurrence of the state government since the Centre had power to make law on this subject.
“Entries 45 and 95 of List I clothe Parliament with exclusive power to make laws with respect to banking… the Act as a whole would necessarily operate in the state,” the bench said, adding that the SARFAESI Act had itself made a special provision for sale of properties in J&K.
The bench, however, made it clear that any provision of the J&K Transfer of Property Act will have to give way to the central law in case the former is found repugnant. “It is clear that anything that comes in the way of SARFAESI by way of a Jammu & Kashmir law must necessarily give way to the said law,” it said, adding that its judgement had no effect on Article 35A, which confers on permanent residents of J&K special rights and privileges regarding acquisition of immovable property in the state.

For most people, even in Kashmir, it is a revelation that people of Uighur origin live in India at all, as they are often mistaken for people from Ladakh or Tibet with similar facial features.

"Kashmir has a long history of trans-Himalayan migration, because of its connection to the Silk Route," said Abid Ahmed, editor at the cultural institution, Jammu and Kashmir Academy of Art, Culture and Languages, in Srinagar. The best documented of these migrations is that of the Tibetan Muslims of Srinagar, who settled in Kashmir after the 1959 Tibetan uprising.

The Uighurs came in two waves. In the first, they came through trade and cultural exchanges between India and Xinjiang province .

Most Uighurs, who came during the 1930s and 1940s, were traders and stayed behind in India after China clamped down on independence movements from the province.

Mehr Chand Mahajan as PM of J&K

Mehr Chand Mahajan was born in a small village called Tika Nagrota in the Kangra district of Himachal Pradesh and rose to the Chief Justice of India,the highest honour the country could offer. Rejected at birth on astrological grounds, he was brought up in a Rajput peasant family up to the age of seven.Though brought home by his parents when he was seven years old,his father saw his face for the first time when he was twelve;under the guidance of astrologers and learned pandits after due process of propitiating the Gods.
After completing middle school in 1905, Mehr Chand moved to Lahore for further studies and graduated from Government College, Lohore, in 1910. He opted for an M.Sc.in Chemistry and was taken in a student demonstrator but, midway during the session, he was prevailed upon to switch to law.His father,Lala Brij Lal,a prominent advocate had established an impressive legal pratice at Dharamshalla with a well stocked library and Mehr Chand was his only son; he was keen that Mehr follow his profession where he could help and steer him to a good start in his career.
Thus,in 1912,this young man,armed with his LL.B degree, started practice at Dharamsala under his father’s guidance. He has worked on various important assignments during his life, but his position as Prime Minister of J&K was a formidable challenge for him.
Prime Minister of Jammu and Kashmir
The biggest challenge and achievement of Mr Mahajan’s career was during the few months that he was the Prime Minister of Jammu and Kashmir from October 15, 1947 to March 1948.Though brief,this was a momentous period in the history of the country. Pakistan had, with the help of the Prime Minister of Kashmir Ram Chandra Kak, already established its operational bases at strategic points like Srinagar, Pahalgam and Gulmarg.Tribal raids were being organised by the Pakistan Government with the acquiescence of the British Governor of the Frontier province. lgnoring the standstill Agreement, Pakistan had stopped the import into Kashmir of essential commodities such as petrol, oils, salt, sugar, food and cloth. Infiltration into Kashmir along the areas touching Pakistan were being organised,and Poonch had been converted into a storm centre.
The Maharaja of Kashmir was undecided on the question of Accession. Mr Mohammad Ali Jinnah, Prime Minister of Pakistan was extremely keen that the Maharaja should accede to Pakistan. Lord Mountbatten advised the Maharaja not to accede to either of the dominions without ascertaining the wishes of his subjects by referendum, plebiscite, election or by representative public meeting. The Maharaja and some of his advisers, going by the British declarations on the status of the states after independence, hoped for an independent Kashmir .In the state itself the leaders of the Muslim conference were keen that the Maharaja should accede to Pakistan while the leaders of the National Conference desired accession to India, till then, had not shown any keen inclination either way ; it would have welcomed the Maharaja’s accession to India but it did not adopt any pressure tactics to influence him. Sheikh Abdullah was keen to acquire power but the Maharaja did not trust him. Pandit Jawaharlal Nehru, Prime Minister of India had,on the other hand,enormous trust and faith in him and with his support, Sheikh Abdullah was aspiring to become Prime Minister of the state sidelining the Maharaja as a mere constitutional ruler.
Such were the tumultuous conditions in Kashmir when Mr.Mahajan took over the reins of administration as Prime Minister. He had earlier met Lord Mountbatten, Mahatma Gandhi, Pandit Nehru and Sardar Patel to seek their advice.On 15th October 1947 he assumed the office of Prime Minister of Jammu and Kashmir and in less than two weeks, on 27th October 1947 The Maharaja of Jammu and Kashmir had formally acceded to India, thanks to the sincere, mature and pragmatic advice by Mr.Mahajan. At the same time he ensured that, before the formal agreement was signed, the Government of India’s troops landed at Srinagar by the morning of the 27 th and started their military operations forthwith to counter the Pakistani attack.
To get the troops from India to move to Srinagar within 24 hours was an unprecedented achievement. on 26th October Mr Mahajan flew to Delhi and went straight to Pandit Nehru’s residence where Sardar Patel was also present. Mr Nehru observed that troops could not be moved on the spur of the moment; necessary preparation and arrangements would take time. Mr Mahajan however, was adamant and ultimately stated, “Give us the military force we need. Take the accession and give whatever power you desire to the popular party. The army must fly to save Srinagar this evening or else I will go to Lahore and negotiate terms with Mr Jinnah. “Such was the sence of duty and moral courage of this great man. As a result of the decision taken that morning two companies of Indian troops were flown to Srinagar immediately and all available planes in the country were requisitioned for the purpose. This thwarted Mr Jinnah’s plans for a massive two pronged attack on Jammu and Srinagar.
Though a pre-eminent judge and jurist, Mr Mahajan was an administrator of exceptional merit. During the communal frenzy that engulfed the entire State of Jammu and Kashmir he maintained law and order with an extremely inadequate police force; he tried to restore some degree of confidence among the Hindu population of the state when their relatives and friends were being butchered and massacred by Pakistani soldiers masquerading as border tribesmen and by local Muslims armed by Pakistan, and he tried to help in the evacuation of Muslims wishing to go to Pakistan. His problem was that he did not have enough men in the state police force nor troops in the state’s Dogra contingent to effectively handle the law and order situation. With the promised support from India not forthcoming, he did the best that could be done within his very limited and meager resources.
A constant irritant faced by Mr Mahajan was the rather unethical modus operandi adopted by Sheikh Abdullah in acquiring totalitarian powers for himself in the state. He was keen that Mr Mahajan should quit and he be appointed instead as Prime Minister of the state with full administrative powers. To this end, he did every thing he could. His pleadings with the Maharaja, however, were unsuccessful since the later did not trust him and was more than a little concerned about the communal slant in his thought and actions. On the other hand, the Maharaja had full faith and confidence in Mr Mahajan’s judgment and sincerity. Sheikh Abdullah, then tried to capitalize on Pandit Nehru’s keenness that the internal administration of the state be democratized and that he play an important role in it. His suggestion was accordingly placed before Panditji. However, the decision reached in consultation with Sardar Patel was that Sheikh Abdullah be designated as Head of Emergency Administration and Mr Mahajan should continue to be the Prime Minister.
Now that Sheikh Abdullah had his foot in the state’s administration, he started methodically to grab as much power as he could and his campaign for the ouster of Mahajan gathered further momentum. To discredit Mr. Mahajan, he started making false and malicious complaints to Pandit Nehru and even attempted to poison Mahatma Gandhi,s mind against him. Mr Mahajan refused to submit to such unethical and unjustified critism. He explained the factual position to Pandit Nehru who regretted that he had been misinformed. To Mahatma Gandhi,he wrote of the circumstances in Jammu and Kashmir that led to communal violence. He also explained that the evacuation of Muslims from Jammu to Pakistan was being carried out under the protection of the Indian army. The state police force was absolutely inadequate to enforce law and order when mass scale communal violence erupted. He questioned Mahatma Gandhi: “May I ask you in the interests of justice and fair play and on principles of ahimsa whether in these circumstances you were right in what you said in the prayer speech…” (as reported in the Hindustan Times of 27th December 1947). He added ” It has hurt us (the Maharaja and himself) more because the speech was made without investigation and without giving us an opportunity to state correct facts and on a hearsay version which was wholly one-sided and incorrect Mahatma Gandhi desired to meet Mr. Mahajan. The two had an hour long discussion and Mahatma Gandhi agreed with his analysis and conclusions. Sheikh Abdullah continued with his scheming manoeuvers but Mr. Mahajan was not willing to be discredited on the basis of false complaints.
Meanwhile, at the suggestion of Lord Mountbatten, India had lodged a complaint against Pakistan in the United Nation Security Council on its open and blatant aggression, much against the advice of Mr Mahajan and the Maharaja.The Maharaja finally agreed to it since External Affairs was a subject on which the State had acceded to India. Pandit Nehru was now impatient to install Sheikh Abdullah as the Prime Minister of the State as he was the head of the National Conference. Though, the Maharaja was not willing to relieve Mr Maharaja he was finally persuaded by Sardar Patel to let him go and Mr Mahajan therefore left Kashmir at the beginning of March 1948.

Kashmiri Parties Want To Block Union Govt From Helping These Refugees In Jammu.

Opposition and separatist parties in the state of Jammu and Kashmir have come together to oppose BJP-PDP government’s decision to issue Domicile Certificate to West Pakistan Refugees (WPRs) living in the state. Syed Ali Geelani, the ringmaster of the Hurriyat crowd, has red-flagged the decision, saying that it is against the Constitution of Jammu and Kashmir and a ploy to change the demographics of the state. Other factions of the separatist camp and mainstream political parties stand with him on the issue.

But who are these ‘West Pakistan Refugees’ and what is their story? We explain below.

In the wake of Pakistani aggression in Jammu and Kashmir in 1947, over 5,764 families, who migrated from the then West Pakistan to escape communal persecution, are residing mainly in the Jammu Division of the state. They have steadily grown into substantive numbers. According to Home Ministry data, 31,619 Displaced Persons of Pakistani-occupied Jammu and Kashmir have settled in the Jammu region of the state.

Most of these refugees, 85 per cent by some estimates, live in inhuman conditions and often suffer discrimination. Though the Central government has undertaken programmes to rehabilitate these families, the hostile and communal atmosphere created by the separatist and Islamist organisations in the state has made life worse for them.

The union government has taken various measures aimed at improving the living condition of these families. Special provisions have been made to facilitate admission to their wards in professional and other educational institutions, bank loans without mortgage for taking up self-employment/business activities, and vocational training for youth.

But without being citizens of the state of Jammu and Kashmir, which enjoys special privileges within the Indian constitution, these families can’t own land, apply for jobs and do not enjoy the same privileges as other citizens of the state. To eliminate these constraints, the government has introduced a scheme to provide permanent domicile certificates to these families.

Mainstream political parties and Islamist separatists have opposed the idea, dubbing it as a conspiracy to alter the demographic composition of the Muslim majority state. This is not the first time that the Islamists have come out in true colours. These factions had reacted similarly when the state government decided to allot a piece of land to the Shri Amarnathji Shrine Board in 2008. The result is, religious minorities in the Muslim-majority valley, Indians or WPRs, live as second-grade citizens with almost no land rights and under the threat of persecution.

Refugees have decided to knock doors of the BJP’s Central leadership to inform them about their state unit’s “nefarious” game plan of denying the rights to them just to keep the coalition partner, PDP, in good humour.
“BJP ministers in the coalition are the main culprits because they have brazenly surrendered before the PDP for power avarice. Instead of taking a clear stand on our plight, BJP ministers are toeing PDP’s line,” chairman of the West Pakistani Refugees Action Committee Labha Ram Gandhi told The Tribune, adding that we had no complaint against the PDP, NC or separatists because they were against granting basic human rights to us, but the attitude of BJP ministers was like backstabbing and betraying.
Refugees have reasons to vent their anger against the BJP because before becoming a part of the government, the party had constantly supported them but after attaining power local unit of the BJP has turned indifferent towards them. “We will start a march towards the residences of the BJP ministers in Jammu and will hold indefinite dharnas there,” Gandhi added. He said a programme in this regard would be announced shortly.
Meanwhile, Gandhi praised the Centrefor adopting a humane approach towards their problem. “The Union Government, especially Prime Minister Narendra Modi, is serious towards solving our issues, but the state BJP ministers are hatching conspiracies against us,” Gandhi alleged. He said a delegation of refugees would visit Delhi next week to talk to the party high command.

A second and third generation of Uighurs far removed from their Chinese homeland find home in Jammu and Kashmir.
Srinagar, Indian-administered Kashmir - On a wintry November morning in Srinagar, the largest city in Indian-administered Kashmir, Mohammad Abdullah sits on the carpeted floor in his living room, with a black and white portrait of his father, Haji Abdullah Karem, hanging on the wall.
My father was among the last Silk Route traders, says Abdullah. Karem, an ethnic Uighur Muslim from the Chinese province of Xinjiang, would undertake the perilous mountainous route that stretches from Kashgar to Ladakh through the Karakoram mountain pass that divides China and India.
Abdullah says his forefathers had trekked the same route, travelling in caravans on top of horses and double humped camels, stopping at the sarais - resting stations for travellers - on the way, bartering silk, spices and pashmina fine cashmere wool.
One such journey to Ladakh located in Indian-administered Kashmir in the 1940s would turn fateful when Karem could not return home after the People's Republic of China took over Xinjiang in 1949. The Communist government blocked the mountain pass, eventually choking off trade.
Karem had left behind a wife and a young son whom he would never see again, said Abdullah, adding that his father lived out the rest of his life in India, married a local Ladakhi woman and fathered four sons and four daughters.
Abdullah, 60, who works for the regional government, lives with his family members in the Rajbagh area of Srinagar, which has remained untouched by the months of deadly anti-India protests that gripped the Muslim-majority Himalayan region.
Uighur heritage
A cluster of identical houses built in the traditional Kashmiri style with low-hanging roofs and a wooden exterior is occupied by his brothers and extended family.
One of the few relics of the past left with the family is Karem's portrait - an imposing looking man wearing a doppa - a Uighur skullcap, squinting his eyes as if shielding himself from the sun.

Four month-long paralyzing strike in Kashmir has hardly subsided when the saboteurs have raked up another issue which is likely to proliferate and revive the strike syndrome in the valley. The beginning of chila-e- kalan on Christmas Eve would be a propitious day to begin the seventy day long chila strike in Kashmir.
The centripetal point for the chila-strike will be the issue of domicile certificates to 1947 refugees of partition of India stranded in Jammu region.
Unnecessarily Infuriated by the rumour of issuing domicile certificates to 1947 tribal incursion refugees, the seditionists, traitors, separatist and pro-Pakistani activists in the Valley have joined hands and threatened to “shed the last drop of blood” if the Government was determined to give these refugees permanent residence certificates.
This opposition reflects two things. One is that the recessionists think that J&K is their ancestral fief on which they alone enjoy exclusive proprietorship. Second is that the State is for the Muslim community only
J&K is not only the Valley, which, however, is just 7 per cent of the total area of the State. Moreover, in the Valley there are religious, ethnic and linguistic minorities also. The State Constitution does not recognize any minority in the State on any count but the Indian Constitution does recognize Muslims of the Valley as part of national minority. The State Constitution does not debar them from enjoying the rights and privileges accruing to them thereof. This is clear dichotomy.
The population of Hindus in West Pakistan at the time of partition was about 1.3 crore. Today, it is less than 0.7 per cent. The Muslim population of India at the time of partition was about 6 crore which has risen to 19 crores now, meaning more than three-fold rise.
The population of the Valley at the time of accession was about 25 lakhs, and today, after seventy years of independence, it is to the tune of 85 lakhs — more than three-fold increase.
In 1982, a member of J&K Legislative Assembly, who later on became the Finance Minister in NC regime, published a 26-page Urdu pamphlet under the tile “Kashmir main aksariyyat ko aqalliyat main badalne ki sazish” meaning the “Conspiracy of converting the majority in Kashmir into a minority.” In this pamphlet he leveled a plethora of charges against the Indian State of trying to change the demographic complexion of the State. In his book “Insights into Contemporary Kashmir politics by Late Pandit Resh Dev, the author has appended the English version of this pamphlet. The rulers in Delhi and those interested in contemporary Kashmir politics must read it to understand the mindset of valley leadership.
In the background of Pakistan sponsored tribal attack on Kashmir in October 1947, several thousand Hindu families from present-day PoK and adjoining areas of West Pakistan were forced to leave their homes and hearths owing to the genocide of Hindus in Pakistan in the aftermath of partition. Many of those families moved to East Pakistan or present Indian Punjab and Delhi and Rajasthan and settled down there. But about seven thousand families of them comprising nearly fifty thousand souls unwittingly headed towards Jammu either because they had relations here and expected some support from them or were unable to undertake the hazards of a long and arduous journey as they had aged and infirm family members and elders to take care of. They strayed into Jammu in search of shelter.
The State Government demanded them to produce proof of their being the residents of J&K State under Maharaja. Obviously, when a man is running for his life he is not expected to look for his property or documents. These refugees could not produce a proof and the Government of J&K arbitrarily labeled them as “West Punjab Refugees/” Most of them are the victims of the tribal attack on the State sponsored by Pakistan Government and supported by the rebellious Muslim army columns of Maharaja’s force stationed in Poonch and Muzaffarabad etc.
Seventy years have gone by and these refugees now numbering about 1.5 lakh are still on the roadside with neither a nationality, nor an identity, nor a country and nor a domicile. The Centre argues it is the business of the State Government and the State passes on the buck to the Centre. Neither of the two is prepared to accept any responsibility though there is no dearth of lip service. This mess is created by the State Government.
As non-State subject, they are not the right to vote in Assembly elections, they have not the right to buy land, they have not the right to apply for a state job, and they are not entitled to any civic facilities. Thus they are living as aliens in Jammu. The J&K Constitution has reserved 18 seats for PoK and GB. The refugees from PoK demand assembly seats in exile neither the State nor the Central Government is prepared to consider it.
Kashmiri youth crossed the border clandestinely, joined Pak-run terrorist camps in PoK and elsewhere in Pakistan, got indoctrinated in fundamentalist ideology, were trained and provided sophisticated weapons, and then they sneaked back into the Valley, attacked the police posts and security forces, killed, looted and raped and again ran away to PoK to avoid arrest at the hands of Kashmir police. After committing all conceivable heinous crimes and brutalities,the J&K Government has opened its arms to receive them along with their Pakistani wives and a dozen of kids in the trail, provided them domicile certificates at the point of entry (especially on Nepal border wherefrom they invariably came so much so that J&K Government opened a police post there on Indo-Nepal border to facilitate their arrival) brought them under police escort to Srinagar, offered them Government jobs, bank loans and accommodation, admitted their kids in schools, exempted them from fees and thus rehabilitated them more than what their own parents could do for them.
We are not against all this munificence and largesse offered to the seditionists by the J&K Government. The point I want to make is that whatever the J&K Government did for the “renegades” all falls under “insaniyat”. But where has that “insaniyat” evaporated in thin air when we find three generations of the Pak refugees denied even the right to identity leave all other rights aside.
Is PoK also enforcing State Subject law with as much severity as our Government is? What about drastic change in the demographic complexion of Gilgit and Baltistan where the Shia majority of population now stands numerically surpassed by Sunnis from Chital, Hunza, and Sawat brought there by Musharraf when he was the Corps Commander of NA.
How have the valley Muslims accepted and assimilated the Yarkandis, Turkistanis, Chitralis, Afghans, Gujjars and Paharis into their fold but are not prepared to accept the Pandits who are the indigenous people of the valley.
Has anybody asked the Divisional Commissioner of Kashmir to give the figures of Bangladeshis, Biharis, Uttar Pradeshis and Oriya Muslims who have come to the valley over the years as laborers, got mixed up, married in the Valley, brought up families and obtained shops, houses and even patches of land. What is their number? How many religious preachers have been imported from Bihar and UP who receive monthly salary to conduct prayers in mosques of Kashmir including Friday congregations in which venom is poured out against India? How come that Valley society has absorbed all this but is rising in revolt against seventy-year old hapless, landless, country-less and identity-less people from Pakistan asking for the elementary right of statehood.
Those Muslims of the State, who migrated to PoK in the aftermath of tribal attack, had their properties secured by an exclusive department called Evacuee Property. Is there any such department or organization in POK that has maintained and protected the property of Hindu migrants? None. The Muslims who migrated from Kashmir to POK in 1947 were given royal treatment in Muzaffarabad and Maulavi Yusuf Shah became the President of PoK. What is the treatment given by the Government to the refugees from POK or Punjab? Make a comparison and one will find how much bigoted the State Governments have been. Be it NC or Congress or PDP or BJP. They are the chips of the same bloc.
Denial of domicile to these refugees is denial of their human rights. The fanatical people in the valley staged demonstrations when Late Mufti Sahib and PM Modi agreed to resettle the displaced community of Pandits in concentrated habitat. The Pandits have as much claim on Kashmir as others have. Their roots are in Kashmir and nobody on earth can deny them the right to live as and where they like in Kashmir.
Nearly 25 thousand Kashmiri Muslims have purchased land and built houses in and around Jammu city. No Jammuite ever objected. More than twenty-five thousand Kashmiri Muslim boys and girls have been brought by their parents and admitted in schools in Jammu. No Jammuite objected to it. How come the valley people think Kashmir valley is their jagir and they will not allow anybody including the indigenous Pandits to come and resettle there as they like.
The people of the valley believe in one way traffic. That will not work. Hundreds of thousands of Kashmiris have business in different parts of the country; thousands of Kashmiris students are studying in professional and non professional institutes in the country; hundreds of thousands of them are receiving scholarships. There is no question of discriminating them. Even monitors have been appointed to ensure that Kashmiri students are not harassed in any way in any educational institute in the country. Kashmiris cannot be thankless to ignore all this and become fanatically frenzied in saying they will shed blood to stonewall issuance of domicile certificates to the refugees from Pakistan. Those who are willing to shed the blood may do so. Gandhi said that Pakistan will be made on my dead body. Both things happened. The march of history cannot be and has not been stopped by anybody.

I may be wrong but just like KP' were living in their own bubble despite all the warning signs till 1990 struck them with Islamic Jehadis inside the living room, Similarly I don't see any Panic or long term plan in Jammu about the changing demographics all around them.
Maybe the fact that Hindus think of rest of India as Plan-B makes them complacent while Islamists want to hold and own any piece of real estate that thy can lay hands on is behind this mindset.
You maynot have each and every muslim as Pro-Pakistani Jehadi but almost all of them would love to have J&K as Sharia driven state with Muslims ruling till perpetuity even with Loyality towards Bharat.

Maybe hindsight is 20-20 but When my extended clan tells me stories and events from 1984 -1990 from Kashmir, It is like even a blind low IQ person would see the dark Jehadi clouds on the horizon.

The homes, farms & possessions of Hindu Pandits of Kashmir were quickly grabbed by muslims as they were booted out by the hundreds of thousands in the 90s.
They became refugees in their own country and are *still* living in slums now for generations.

Bangladesh nor Pakistan are taking these Burma muslim refugees in.
Saudi Arabia does not allow any refugees in. But they sure are quick with the building of mosques in those countries.

If India was a muslim majority region, there sure as hell would not be any secularism.
The situation in Assam is now fast going out of control with more and more Bangladeshis flooding across the border to grab their lands and alter demographics. There are hoards of islamic states but there is only one secular India and frankly there is NO OTHER PLACE for Hindus to go.

Its time to start asking these questions.

There is no "secularism" in any state that has dominance of minorities in the socio political space.

This future, were it to fructify, is very clear.

just look at the NAC, eyetalian kitchen cabinet and the depth of contamination of the baboo(n)dom + media + NGO space and the entrenched storm troopers still fighting a rearguard action.

and as all this was being done, the aam jantha simply watched like a bunch of sheep

Talking of rehabilitating KP's back in Kashmir, I don't know how that is possible given the security situation there as well the fact that most of the Hindus were forced to sell of their property as the hope of returning dwindled while other existential problems took over. Add the ever increasing zeal of Islamist and KM's to make life miserable for any Hindu, you have a deadly cocktail.
Add to the fact that current younger generation has no memory of Kashmir except for family stories and with no economic reason to go back, I wonder what any Govt can offer a rehabilitation plan to make KP's feel like returning (All the noise being aside).
Even if some of the folks go back and i am sure they will, all they can be offered a Govt job and a ghetto kind of living with no guarantee that next 'Sickular' Govt might not dismantle all the efforts and leave them to face Islamic hordes once again.

The best and only option IMO is to carve a area out of Kashmir (a la a city town like Chandigarh) and make it exclusive homeland for KP's and let them with their hard work make it a prosperous city with no fear of Jehadis running it over but that would need long term planning and cojones of steel.
Going back to Kashmir and living like Pre-90 is not a option for KP's.

Why can't KPs join the police service and JAKLI in droves, then settle in the valley as part of security apparatus, if they have domicile they can buy property easily. Start setting up sainik/kp Colonies.
Also who is keeping track of domiciled KPs, their population must have increased manifold by now.

Kashmiris trapped in deadly politics of grief, must abandon macabre heroism

When I thought of “India” as a child, I thought of a distant, stiflingly hot place beyond the hills of my village, from where came cheerful hawkers with cloth-wrapped backpacks, barefoot fortune-tellers with curly hair and unfriendly, uniformed men who stole apples from our orchard.Rather than being right here, India was somewhere out there. Even in school, when lessons on identity were given, they went well when they were about my village, district, state; the moment it came to my country, the teacher either got tongue-tied or the school bell would chime, class was over and we’d be left guessing. As the conflict intensified, we grew up as confused citizens of a country in the making.The politics of hope is a dangerous thing because it can trap people into a flawed reading of history. That is exactly what happened to us. There was a cultural backdrop. We spoke with a cadence of Pashto; our faith was Arab; our mornings began with recitals from Sa’adi Shirazi; we ate in Turkish utensils; our bedtime stories had scenes from Shahnameh. It was easy to make us believe that one more nudge and history would witness a dramatic reversal; a transformative cataclysm — azadi — was just round the corner.

Expectedly, there came a time in Kashmir when bus conductors were asked to prepare route plans to markets across the border. Peshawari prayer rugs started appearing in homes, wrist watches were turned half an hour behind Delhi time, bridges were burnt, so the enemy couldn’t walk over to our side. Most importantly, all men and women whose loyalties were suspect were hung from elm trees. In a complete withdrawal from reality, people gathered around radio sets to listen to official announcements of freedom, reassuring one another that something was about to happen.

ears passed. Thousands of lives were lost. Millions got displaced. In take two, the destruction which the politics of hope brought to Kashmir generated an even deadlier politics of grief. Kashmiris now memorialised the sorrow that was a consequence of the confrontation with a mighty state. Dying became an end in itself. Alienation from the state extended into alienation from one another. An entire generation of Kashmiris sought refuge in the glorification of pain. Rational fear made space for romantic fearlessness. Dissent became more technology-driven and virtual. Growing religious consciousness became a way of life.Every new agitation in Kashmir has had this familiar tetrad of eruption, hope, bereavement, despair. By the time the first stone was pelted in the July uprising of 2016, the outcome was already known to everyone. It is this predictability which has begun to worry Kashmiris now. Revolution cannot be an annual summer carnival. If today, Kashmir is the most unlikely new nation to enter the world map in the future, the blame is not on India. It is a flaw in the fundamental design of the Kashmir project.

Firstly, all these years, Kashmiris have given conflicting signals to the world. For those who compared Kashmir to Palestine, East Timor, Kosovo, the problem is that it is hard to frame the Kashmiri question properly. Is it separation from India, annexation with Pakistan, the search for an Islamic caliphate or a secular democracy? Has it factored in sub-regional and diverse ethnic aspirations? If it is self-determination, then who are these people queued up outside polling stations? If the slogan is “azadi”, why is the Pakistani flag raised? Is it class-neutral or only a proletariat dream? Is it territory or ideology, economics or politics? Today, in Kashmir, it is hard to ask these questions because there are no answers. And because there are no answers, every such question is seen as a provocation or obfuscation of the truth about Kashmir.

The second problem is using violence as an instrument of grievance redressal. For 30 years, Kashmiris have been trying to explain to the world the difference between militancy and terrorism. The sooner it is understood that in a post-9/11 world, no theory of organised violence can be accepted as good enough for justifying it, the better.Thirdly, the indiscipline we saw on the streets during 2016’s unrest has the potential to criminalise society forever. It was not the state as much as people to people violence, the humiliation of bystanders, vandalism against schools, damage to public property by misguided teenagers that exhausted Kashmiris, reducing a mass movement to a movement of mass from one corner of the street to the other corner.

With fresh wounds in the 70th year of J&K’s accession to India, Kashmiris have no choice but to go back to the drawing board and see what went wrong. India is an emerging superpower — it is there to stay. Looking at the crisis in the Muslim world, it will serve us well if we help ourselves out of the time warp we are stuck in, abandon false hope and macabre heroism and work towards a dignified exit from the conflict. One possibility is to accept that in spite of all its infirmities, India is the only country in the world with which a culturally diverse and politically disparate entity like Jammu and Kashmir can find anchor.

Kashmiris need to realize that their destiny is not with Pakistan or the so-called Azadi !
