Three Advocates Move SC To Stop Deportation Of Rohingya Refugees...

A fresh petition has been moved by three advocates in the Supreme Court praying for direction to the government not to deport Rohingya refugees to Myanmar where they face imminent threat of persecution. The petition has been moved by Roshan Tara Jaiswal, Zeba Khair and KG Gopalakrishnan. The petitioners registered strong objection to the Centre’s decision to deport Rohingya Muslims back to Myanmar where they face threat of persecution. "the proposed deportation by the Government of India of the Rohingya refugees is contrary to the Constitutional guarantees provided inter alia under Article 14, Article 21 and Article 51(c) of the Constitution of India.
“If the Rohingya refugees are deported back to Myanmar, there is an immediate threat of them being persecuted and robbed of their dignity by the incumbent government. Such an act of the government is contrary to the spirit of the Indian Constitution reflected in its Preamble, Directive Principles laid down in Part III,” they said in the petition....

There's a practical problem in that will Burma allow us to return the refugees? Will they create conditions within Burma safe for the refugees to return?
I bet the Western and paid pro-west media here are salivating to film Indians sec. forces "returning" screaming refugees ,our guys using heavy tactics.

What we must tell the Burmese govt. is that they must set up conditions within Burma outside the hot zone,where the Ros can return and live in peace.The attitude of the Burmese govt. that they aren't Burmese citizens is hogwash.The Ros are of Indo-Aryan descent,have been living there for centuries long before the Brits arrived and they facilitated was migration from India when the two nations were linked,Tamilian traders,etc.,who we must remember were also brutally treated by the Burmese during the last century twice.REPCO Bank was set up for this purpose,for affected Burmese and Lankan refugees.India and BDesh must work together diplomatically ,as well as ensuring humanitarian relief work,in forcing the Burmese govt. to take bakc the refugees. THose who have links with terror can be identified and also handed over.

However,within India,a phased round-up of illegals must take place and they must be moved to decent camps close to Burma for swift return when that happens.We simply can't afford tens of thousands of Ros turning into ticking terror timebombs,seduced by Paki and Soothi money,since they're in a desperate state ,easy to induct into the terror outfits.

These petitions are the handiwork of BIFs. They are testing Govt resolve. If they find any weakness they will come back again. All the more reason to deport Rohingyas.

The elephant in the room is "where is the automatic mechanism, processes and procedure" to deport illegals?
How many illegals Beedis are inside India compared to this 40,000 touted as if it is the most pressing issue? Why is the concern about this 40,000 made a test case for all parties concerned now? Is it because the "international aka western shenangians" want the focus and spotlight on them right now?
As usual SDREs and this particular GOI always is in "reactionary mode", instead of setting the narrative.

If there was a mechanism to sneak in surreptiously 40000 into the country, surely there must be a counter mechanism to expel them without fanfare and quietly as a matter of routine?

There is bigger games afoot. At this hour, it is most important to make sure Buddhists across the spectrum are helped. Remember "Buddhism" is export quality "santanadharma". The players have realized, that this export quality "santanacharma" enjoys unparalleled acceptance in "International quarters" and must be taken down to get the core "santanadharma".

Is there is some sort of dream where all the 40000 will be expelled enmasse to some country? The most viable solution would be to deport them in smaller units, to preferably Europe where the bleeding hearts are keen to help them, without any fuss. The other options are to explore mechanisms with Myanmar government to see if they can allow Tibetian refugees, Kashmir pandits (yes there I said it) who are willing to relocate to Myanmar where the conditions probably might be better then squalid camps that they currently occupy.

Probably resettlement of willing Kashmir Pandits, Plausibly willing Ladakhis to Myanmar looks like more practical than in its own territory. And Ladakhis are already worried about the "rape jihad" that is waged and their numbers are already now down to approximately 50%. India can support all these resettlers as it has big heart and huge purse as is evident from sending supplies to Bangladesh. Only the money will be well spent in this case.

The numbers of Rohingyas is tiny compared to the number of Muslims in India. That is not the issue. The idea of BIFs is to ensure the govt is unable to move on core issues and do things in national interest. If they can somehow stall this they will again use same tactics for bigger issues. Given the electoral defeat of the BIFs they see the courts, still steeped in the old order, as the best bet to stall the govt. Thus, it becomes all the more important for the govt to display resolve and deport the Rohingyas.

All the BIF pressure points are being activated. NHRC IIRC has not undergone change since this govt took power and is full of C-system people. Pressure through UN. Settling Rohingyas in Jammu when they are actually Bengalies and should be in WB. All points to a sinister pattern of BIFs using the issue to further disadvantage India.

Making Burma take back the Rohingyas ignores the fact that they are fvcking BeeDees and are part of the fvcking creeping BeeDee invasion across the entire fvcking region.

The difference ONLEE is that Burma is actually confronting this situation and forcing these BeeDees back into BeeDee (400K and counting.)

I would gladly take the 40K Rohingya if it wakes up the GOI and we go after the actual threat to India which is the 20M (and COUNTING) Bangladeshi illegals.

Constitution does not provide any Guarantees to illegal immigrants. It simply says Rule of law must be followed. The Rule of law is that they were illegals and must be kicked out. Only prohibition is that they cannot be raped, murdered or used as slave labour etc, which we are not doing, in any case.

I am not sure who has final say, executive or judiciary in this regard, our BRF lawyer says it's with the former, then why is govt approaching SC?

Well if this matter doesn't come under SC's jurisdiction, why not say so and ask SC to not interfere. Honest query, am not too aware about these things.

There is no need to make this issue a litmus test for the GOI, as it is what the instigators of this mess want. Courts want to feel they actually are running the country.

Start deporting Beedis, all illegals first. The issue with Mynamar 40000 should be happening without fuss and fanfare already. Need to strengthen, the Myanmar, as they are doing what is right by their people and their civilizational priorities and ethos.

There should be no contention in deporting all the illegal beedis. The courts can stick to what it is competent at like length of the skirt, or quantity of hookahs that can be smoked in the vicinity of Delhi.

MadhuPurnima Kishwar is a classic of how many SDREs operate. Go bonkers when one of the perceived pet peeves is not addressed immediately as in fast food counter, start berating. Was she also not after the Indian Army not so very recently, due to her frustrations?
There are many who already want to see the back of Modi in a hurry. Her writing him off will not make any difference, other than some more impotent friendly fires on the man in the trenches.

The govt seems to be on right track. Just provide humanitarian aid and assistance to Rohingyas in Myanmar/B-desh but no import of refugees into India.

There should be more talk in media/unofficial arm about the wealthy islamic countries of Saudi Arabia, iran and others to take in these refugees.

Chxxxx Liberals saying that Right to life & liberty means that we have to home & feed the scum. Unfortunately it only means that life & liberty can be taken away per due process of law. The due process of law means kick out the rats without undue mistreatment like murder & rape.

With Myanmar being essentially a satellite of China, doesn't all this put Beijing in an awkward position? What with Pakistan backing the Rohingya doesn't this put them at odds with their Chinese benefactors? Or has Myanmar gotten too independent and this is China's way of punishing them for drifting out of their orbit?

Either way, huge opportunity for India if we have the courage to stand up to our own muslim minority and our faux allies in Bangladesh.

Mynamar isn't a Chin sat. ...yet! Its outreach to India in recent yrs. has paid off v.well.PM Modi's recent visit was a good success. The RO crisis if resolved with help from India and BDesh,which is primarily affected and the "Bengali" state from where the "Bengali" menace has supposedly come from according to Burmese ultra-nationalists,forgetting their centuries old existence in Burma,long before the British era,will further cement the inter-state relationships.I've suggested in another td. a vehicle for S.Asian unity,keeping the Chins out through an entity called SAFE (which omits the Pakis).Both China and Pak can be sidelined using this formula.

Sad indeed that it has taken the Rohingyas to get people to look at the far greater crisis of the creeping BeeDee invasion. GOI should have been on this decades ago in the interest of the nation. We are talking about an invasion of 20 MILLION BeeDee illegals!!!

Now only because gori news orgs are crying over these fvcking BeeDee Rohingyas being kicked out of Myanmar do we look at the actual threat.

That is what I have been warning about. The real target is to stall any future action on illegal elements in India starting with Bdeshis in Assam and WB and turning India into a vulnerable state unable to defend itself from demographic aggression. Similar to make India militarily unable to deal with aggression since the 90s.

Al-Qaida man on mission to ‘recruit Rohingya youth’ held in Delhi - Rajshekhar Jha, ToI
In the biggest breakthrough made by Indian intelligence this year, the special cell of Delhi Police has arrested 28-year-old Samiun Rahman, a British national who police said was al Qaida's key recruiter in India.

Rahman, who has family roots in Bangladesh, was allegedly setting up base in Delhi, Mizoram and Manipur to radicalise and recruit Rohingya refugees to wage war against India as well as to fight the Myanmar army.

He was described as a battle-hardened mujahideen who had fought for the Qaida's al-Nusra front in Aleppo, Syria, before being sent to Bangladesh as a recruiter.
Rahman was arrested from Vikas Marg in east Delhi while trying to establish contact with a recruit, police said.

Rahman was earlier arrested in Bangladesh on charges of terror financing and was released in April 2017. He was thereafter contacted by Nusra commander Mohammad Jowlani who directed him to go to India and recruit Rohingya refugees, police said.

They said Rahman was in touch with top Qaida and al-Nusra commanders for instructions through secure messaging app called 'protective text'. He told interrogators that he had tapped around 12 Rohingya refugees living in Kashmir, northeast, Delhi, Bihar and Hazaribagh (Jharkhand).

"He was setting up a base in Delhi and two northeastern states and preparing the recruits to carry out strikes in India and fight the Myanmar army. He was being assisted by al-Qaida cadre in Delhi, Hazaribagh and other places in India, who are being identified," said deputy commissioner (special cell) Pramod Kushwah.

Police found Rahman was carrying a voter ID card in the name of Shumon Haq, a resident of Kishanganj, Bihar. "We have recovered US $2,000, a laptop, a 9mm pistol and magazines apart from Indian and Bangladeshi SIM cards. Rahman has also been to Morocco, the Islamic Republic of Mauritania, Turkey and for terror activities. He has been taken on remand for interrogation," Kushwaha told TOI.

Officials said the special cell had got wind of Rahman's activities two months ago and was tracking him since then. The tip-off was on one "Raju bhai" from al-Qaida who was recruiting people and trying to set up a base in Delhi to carry out terror strikes in India.

A special team comprising ACP Govind Sharma and three inspectors Kailash Bisht, Ravinder Tyagi and Pramod Chauhan was formed and surveillance mounted on the suspect on social media networks.

Last month, cops found that Rahman had crossed over from Bangladesh and rented a house in Kishanganj, Bihar. A team was sent there and a watch kept over his activities. A few weeks ago, cops found that the suspect had come to Delhi/NCR.

On Sunday, the team zeroed in on the suspect at Vikas Marg (near ITO), while he was waiting to a contact,
and arrested him. "A case under sections of Unlawful Activities (Prevention) Act, 2008 and Arms Act has been registered against him and investigations have begun to unearth the entire 'al-Qaida' module developed by him," Kushwaha added.

During interrogation, the accused tried to mislead the cops by claiming to be Shumon Haq. However, he broke down during sustained interrogation and revealed his real identity. His antecedents were then confirmed with the Bangladesh police.

During interrogation, he revealed that he crossed into to India in July this year. His task was to raise funds and incite youths to fight for the cause of Rohingya Muslims and facilitate their entry into Myanmar from northeastern states.

He had stayed at various madrassas in Kishanganj and Hazaribagh and Delhi/NCR to tap vulnerable youths. He has confessed that he was in contact with his outfit members via secured apps as well as social networking sites such as Facebook, Whatsapp and Telegram. He was also cultivating youths on these networks.

Generosity of Christist majority Europe abused yet again by Mohammaddens who were so generously provided refuge. Both the individuals detained in the London Parsons Green bomb attack turn out to be Mohammadden refugees from the Middle East, Iraq and Syria in this case, who were foster parented by the same fellow Abrahamic Christist couple.

I hope that our Supreme Court makes note of this case of Mohammadden refuges turning against their generous Non-Mohammadden hosts when it comes to passing judgment in the case of the Bengali speaking Mohammadden illegal migrants from Myanmar who illegally entered India and are fighting deportation from India. Looking forward to our Supreme Court agreeing to the deportation of these illegal Begali speaking Mohammadden immigrants from Myanmar that is sought by our Government:

Sadly I doubt there is a solid national consesus on this principle of Indian’s first given the communal minority Mohammadden appeasing vote bank politicking style of political parties like the 4th generation Nehru Gandhi family dysnasty led Congress Party. As a reminder our former Prime Minister Manmohan Singh’s statement at the 52nd meeting of the National Development Council dating back December 2006 (Muslims must have first claim on resources: PM):

"We will have to devise innovative plans to ensure that minorities, particularly the Muslim minority, are empowered to share equitably the fruits of development. These must have the first claim on resources"

Even BD minister accepts Rohingyas are a security threat - The Hindu
The State Minister of the Ministry of Foreign Affairs of Bangladesh, Mohammed Shahriar Alam, said in Kolkata on Monday . . . . "For Bangladesh, it is obviously a security threat. We have had incidents in the past. We are registering the Rohingya population for the first time and work has begun about a weak ago. We do not reject the idea that they are linked with foreign terrorist organisations"

Suu gave a v.good speech on telly this morning,outlining Burma's history since independence,the decades of internal conflict,the struggle to restore democracy,her govt. less than 18 months old (Dec) and the efforts earlier taken by it (Kofi Annan) in resolving ethnic matters.She also said that there were sev. other minorities as well as Ro Muslims affected,including Hindus.It was a mistake to think that only Muslims were affected.She gave details of the Ro attacks against the sec. forces,casualties suffered and said that her govt. had to restore the rule of law in the country and combat terror.While doing this,she said that it was her govt.'s duty to maintain human rights,etc.,and avoiding collateral damage.She invited the various foreign diplomats to assist her govt. in the same in resolving the crisis.

I feel that India and BD should work with the Burmese govt.,keeping outsiders firmly at arms length to avoid mischief-making,and encourage all "Muslim" loving entities with vested interest in keeping Burma aflame,to take as many Ros into their countries if they so wished,otherwise to keep their gobs shut! She should invite the Saudis and the OIC,to take the entire Ro population if they so wished.Did not Israel airlift a massive no. of Falasha Jews from Ethiopia?

Our internal handling of the Ros should be humanely but firmly.Women and little children aren't terrorists.They're collateral damage,much like manuy of our tribals caught up in our Naxal terrorism.The Ros should be rounded up and placed in camps as close to the Burmese border as possible for eventual repatriation. Those found involved in anti-Indian/terror activities deported immediately.The Burmese govt./junta will give them a nice warm welcome! Under no circumstanced should we permit/allow any Ros to stay in border areas other than those bordering Burma.Those in J&K immediately deported from there whether they have UN cards or are there as illegals. Those Kashmiris found assisting them to be prosecuted as aiding and abetting terrorism.

India must lead for a few reasons:
  • It is in India's interests to stabilize the region. Myanmar is our backyard
  • We must send back the Rohingyas in India to Myanmar
  • Even the Rohingyas in Bangladesh are a security threat for India
  • We must enhance our influence in Myanmar through this issue. Modi's strong support for Myanmarese Army which were attacked by Rohingya terrorists and later at the Conference in Indonesia where we dissociated ourselves from the statement are already good deeds.
  • The many C-17 loads of relief material sent to Bangladesh proves our concerns for refugees without minimizing in anyway our security concerns or our efforts to push them back
  • We must help Myanmar in 'management' of the Rohingyas because penetration of ISI, LeT, AQIS, JMB & ISIS in the Arakan is a threat for us

Horrible suggestions,Sir.

The crux of the problem is Bangladesh. Their 20M in India is a threat us just as their 1M migrants in Burma AKA "Rohingyas" are a threat to Burma.

If we want to lead and gain influence in Burma, we need to:
1) remove the 20M illegal BeeDees from India,
2) support Burma in removing their BeeDees,
3) pressure Bangladesh to ensure that creeping invasion of BeeDees stop

Without number 3 we cannot have peace in the region. The relentless invasion by BeeDees will destabilize not only Burma but our entire NE and WB.

Pressuring Burma to take back muzzie invaders because of the baying of the Western press will guarantee that we lose influence entirely there to Cheen.

Remember, Burma did not push these invaders to India. They are pushing them back to Bangladesh. The Rohingya arriving in India are part of a general invasion of India by 20 MILLION Bangladeshis.

However, a new security dilemma for Bangladesh is the problem created by Rohingya refugees. At least 74,000 Rohingyas crossed the border into Bangladesh after Myanmar began a military crackdown in northern Rakhine State. The crackdown followed attacks on border guards on October 9, 2016, in which nine Myanmar Policemen were killed and four were injured when hundreds of armed Rohingya men with knives, slingshots and rifles attacked three separate police posts along the Rakhine border with Bangladesh. Highlighting the Rohingya crisis as an important issue, Foreign Minister Abul Hassan Mahmood Ali stated in the Parliament on June 15, 2017, "Twenty to 25 percent people in Cox’s Bazar are now Rakhine Muslims. Such huge presence of Rakhine Muslims in the area will pose a threat to the national security in future. The Rakhine people have been engaged in various misdeeds, including drug smuggling on bordering areas and arms and human trafficking. They've become a national security concern for Bangladesh." The Minister further noted that some 33,000 Rohingyas, registered as refugees, were living in two camps run by the United Nations High Commission for Refugees (UNHCR) in Cox's Bazar. It is estimated that some three to four hundred thousand unregistered Myanmar citizens (Rohingyas) have been staying in five Bangladeshi Districts, including Cox's Bazar.

A second wave of refugees swept in after the incident of August 25, 2017, in which hundreds of Arakan Rohingya Salvation Army (ARSA) insurgents armed with machetes and rifles attacked 30 security posts in the Rakhine State, killing 12 Policemen, a soldier and an immigration officer. In response, the military unleashed what it called "clearance operations" to root out the insurgents. On September 14, 2017, the United Nations International Children's Emergency Fund (UNICEF) claimed that up to 400,000 Rohingya had fled Myanmar for Bangladesh since August 25, 2017, with thousands more arriving every day. Separately, UNHCR Assistant High Commissioner George Okoth-Obbo and International Organization for Migration (IOM) Director Mohammed Abdiker Mohamud in a joint press conference held in Dhaka on September 14, 2017, stated, “The Rohingya influx towards Bangladesh may reach 10 lakh (One million) this year if the refugees fleeing violence in Myanmar’s Rakhine State continues.”

Denouncing Myanmar for the atrocities and calling upon the international community to mount intensified pressure on Naypyidaw to stop the atrocities and take back the refugees, Bangladesh Parliament on September 11, 2017, passed a resolution:
A handful of people of a shadow group had staged the attack which we (Bangladesh) also condemned, but should the entire community of one million populations be punished for that?

Further, in a statement issued on September 13, 2017, the 15-member United Nations Security Council (UNSC) acknowledged the initial attacks on Myanmar Security Forces, but "condemned the subsequent violence," and called for "immediate steps to end the violence in Rakhine, de-escalate the situation, re-establish law and order, and ensure the protection of civilians.”

Disturbingly, terrorist outfits are looking to cash in on the Rohingya crisis.The terrorist formations both at home and abroad are fishing in troubled waters, trying to provoke their followers to go to Myanmar and fight the country’s military in the name of ‘protecting Islam’ and saving the Rohingya people who face brutality at the hands of the Myanmar Army. On September 3, 2017, in a video message released by al Qaeda’s al-Malahem Media Foundation, Khaled Batarfi called on Muslims in Bangladesh, India, Indonesia and Malaysia to support their Rohingya Muslim brethren against the “enemies of Allah.” Similarly, on September 12, 2017, Pakistan based Jaish-e-Mohammed (JeM) Chief Maulana Masood Azhar declared, “All of us must do whatever we can for the Myanmar Muslims. Just say your prayers and get up to help them. You don’t need to show off what you are doing: just do it, and never stop." On the home front, Hefazat-e-Islam (HeI) Secretary General Junaid Babunagari issuing an ultimatum on September 9, 2017, threatened to siege of the Myanmar Embassy at Dhaka on September 19, if the atrocities against Rohingya Muslims in Rakhine state of Myanmar continued. Similarly, Hizb-ut-Tahrir, pasted posters on the street walls in Dhaka, Chittagong and other cities of Bangladesh, condemning the oppression on Rohingyas and urging countrymen to raise their voice.

Bangladesh has taken giant strides against terrorism and Islamist extremism. However, the scope for a coalition of terrorists with the radicalized elements among the Rohingyas who have been forced across the Bangladesh-Myanmar border could create new headaches for authorities. The Rohingya crisis is no longer only a humanitarian calamity but a potential threat to the internal stability and security of Bangladesh as well.

chola, however horrible my suggestion may be, this is what Aung San Suu Kyi herself has said today,
Aung San Suu Kyi today that Myanmar stood ready "at any time" to verify the status of the 410,000 Rohingya Muslims who have fled violence in the last month to aid the return of those eligible for resettlement.
There is absolutely no doubt that the Bangladeshis in India must go back or be pushed back into Bangladesh; there can also be no doubt at all that the Myanmarese who have illegally entered India must go back or be pushed back into Myanmar either. It is that simple for me.Whether Bengali-speaking Myanmarese Rohingya Muslims have indeed a place in Buddhist Myanmar or not is for Myanmar & Bangladesh to sort out. If they came from Rakhine, they go back to Myanmar. I do not see any horror here.

Clubbing the Rohingyas along with illegal Bangladeshi immigrants in India will muddy the waters though the root cause of the problem for Myanmar and India's NE states could be just the same.

While we have to have a strategic mindset, the eclectic strategic fabric is stitched together by assorted tactical bits and pieces. Rohingyas are tactical and must be contained within the tactical realm as far as we are concerned while managing Bangladesh is strategic, IMHO.

The rohingyas are 1/5000th of the problem in India. Using our limited diplomatic weight on Burma instead of Bangladesh because of the liberal Western press will NOT make us any safer and will obliterate our influence in Burma at the same time.

Cheen is offering UN support while we pile on with the West. How do you think the Burmese will react?
