October 28, 2022

Coimbatore. One of the six accused in the Coimbatore blasts case has confessed to the charge during interrogation. He has said that he had met two people in a Kerala jail who had links with the ISIS group involved in the Easter bombings in Sri Lanka. According to police sources, Firoz Ismail admitted that he had met Mohammad Azharuddin and Rashid Ali, who are lodged in a jail in Kerala. Further inquiries are being made to ascertain the motive of this meeting. Police said the five accused were taken to their homes and searched.

Morbi Incident is really Tragic and Sad...

Though an accident but opposition has already started targeting Gujrat Model, Infra and Governance. Somehow i believe its part of overall strategy to weaken Modi's narrative of growth and good governance. If true this can be really problematic for not only BJP but for en-mass as this can be played out widely...

But like someone says in the comments, how about framing and notifying CAA rules first, eh?
Even then they will be left to the interpretation of those-who-can't-be-questioned!

Two cases below for illustration

Pocso Act overrides Muslim personal law, says Karnataka HC
The Protection of Children from Sexual Offences (Pocso) Act is a special Act and it overrides personal law, the Karnataka high court observed in two recent judgements while dealing with bail petitions filed by two accused who are Muslims.

In both cases, the basic argument was that under the Mohammedan law, the normal puberty age, i.e.,15 years, is considered as the age of marriage and hence there is no case under Pocso Act. However, Justice Rajendra Badamikar refused to accept the said argument.

"The Pocso Act and IPC are substantive acts and they prevail over personal law and under the guise of personal law, the petitioner cannot seek regular bail," the judge observed in his order while refusing bail to a 19-year-old accused from Chikkamagaluru.

...

In the second case, Bengaluru East police registered a case following information provided by a medical officer. On June 16, 2022, a girl visited the primary health centre for a check-up and it was revealed that she was pregnant and just 17.

The accused husband argued that he had married her under the Mohammedan law and hence no offence could be made out under the Pocso Act. Justice Badamikar declined to accept the argument and pointed out that under Pocso Act, the age for involving in sexual activities is 18.

"However, it is also evident that the girl is capable of understanding things. Though she asserts that the marriage was solemnized without her consent, there is no evidence to show that she raised any objections and prima facie, it is evident that she is also a consenting party though she is under the influence of her parents," the judge added. "As the girl is pregnant, she requires support and the petitioner can take care of his wife," the judge further said in his order granting bail to the accused.

The UK press have been highlighting a few things. I have no idea if these are true or no but something for people more local to look into.

1. The bridge was recently renovated and repairs performed. However, the company that did the work has no construction experience. They manufacture clocks, LED TVs and e-bikes.
2. Who awarded the maintenance contract to a company with no building experience.
3. The bridge was licenced to have 125 persons at any one time. There were about 500 people on it when it collapsed.
4. There was some indication of a group of people trying to sway the bridge. Was this just high spirits or is there something sinister.

Also mentioned that nine people have been arrested; they are mostly officers of the company that performed the maintenance and were also responsible for its operation.

I can't fault with people. For tragedies like this, its 100% fault of officials or whoever was responsible for overseeing its safety. Either they were bribed off, or whatever it could be. Can't really blame the people. You cannot expect them to be well-behaved and build all infra around that understanding. there will be idiots around who would want to do stupid things.

Now would be the time for the government to come out with an explanation of how old bridges are maintained. There was also the bridge failure of a very old bridge in Maharashtra a few years ago. Instinctively I feel that many of these bridges need to be decommissioned and replaced, but it needs a systematic look.

Gents. I was of a memory of an old documentary I had seen where in WW, troops were specifically asked to brake their march / formation whole crossing the roped bridge.

Therefore, what if, this tragedy is a combination of all of the above; people misbehaving, old age, corruption and Physics.

Most people on the bridge were standing and enjoying the scenery, some were walking and some others were actively and wilfully shaking and destabilizing the bridge by inducing a side to side swaying motion by pushing and pulling on the support wires for reasons unknown.

A well designed and built bridge should resist the abuse people pile on them, with a big safety margin. From the video, and photos in the press, the bridge deck appears to be inadequately stiffened, and way too narrow, 2m large but 230m long. People walking on bridges, even effect of wind can generate harmonic oscillations which if not damped properly will reinforce and gain in amplitude. The entire bridge starts oscillating a) in longitudinal horizontal waves (deck distorts side to side like a snake crawling) or b) longitudinal vertical waves (deck and cables move up and down like a series of bumps) and when any part is weak and starts to fail, this creates c) longitudinal torsion and the bridge snaps very quickly.

It looks like a) and c) happened in the present case.

The bridge was about 130 years old, built by the britshits and it had served its purpose well

the contractor who had taken over the bridge was a cl0ck manufacturer who only saw money. He had taken over the contract for 15 years and obviously, the yours and my hissa, the ever ubiquitous standard Indian "terms and conditions" applied.

https://indianexpress.com/article/citie ... d-8243682/
Morbi Deputy Superintendent of Police P A Zala, the officer investigating Sunday’s bridge collapse case in which 135 people died, told a local court Tuesday that the cable of the suspension bridge (Jhoolta Pul) was “rusted” and “had the cable been repaired, this incident would not have happened”.
It is a ripe situation for a class action type of suit but who will bell the billi.

I thought this is applicable to every organization including Indian Govt.

https://www.realclearpolitics.com/artic ... 48407.html
What the GOP Must Learn from Elon Musk
Donald Trump may have owned “You’re Fired!” but Elon Musk is teaching America what it means. The GOP should pay attention.

Musk’s greatest undertaking as the new “Chief Twit” involves deploying new business models that enhance corporate value, but his most visible challenge is changing the culture of this large organization without interrupting its business. That’s a notoriously difficult task.

It’s a task at which President Trump failed. Trump often complained about the politicization and corruption of federal agencies – comprised largely of his own executive branch employees – but he had zero perceptible impact on the culture of the federal bureaucracy. He was but the latest in a long line of Republicans who rail ineffectively against the vast administrative state.

Organizational and institutional culture has a way of outlasting even the most reform-minded leadership. What makes Musk think he can succeed?
The answer can be found in his first moves. He immediately removed key members of Twitter’s leadership, including its CEO, CFO, policy head, and general counsel. In other words, Musk took very visible moves to eliminate the highest profile senior people most identified with Twitter’s culture.

He then denied the rumors that he intended to fire three out of every four employees – without providing details about his actual intentions. The combined message is exactly right: Twitter culture is about to change in a significant way. If you’re competent in your job and on board with the shift, we’d be pleased to have you stay. If not, thanks for your past service.

In an organization the size of Twitter, culture may be set from the top but it’s enforced from the middle: The people who make hiring, firing, and promotion decisions, select topics for employee training, assign individuals to groups or projects, or allocate space and resources set employee incentives. Their decisions broadcast what sorts of behaviors and attitudes the company rewards and what sorts it punishes far more effectively than any mission statement, document, or speech.

If Musk wants to control the culture, he must vet those mid-level people carefully. If they’re more committed to the old program than the new, they’ll render change impossible. Dismissals will need to be significant. Most rank-and-file employees, however, are almost certainly like most people in most places. They elevate personal welfare above ideology. They’re more concerned with retaining a plum job that pays them well to deploy their skills than with ideology. If the culture and incentives shift, their behavior will follow.
On Day Two, however, Musk followed his positive lessons of Day One with a negative lesson. He got into a tiff with Hillary Clinton about the San Francisco home invasion in which House Speaker Nancy Pelosi’s husband was attacked and hospitalized. Clinton, typically, made it a partisan issue, blaming the “Republican Party and its mouthpieces.” Musk responded with an intemperate response linking to a site with a history of promoting unfounded theories – this one implying that a drunk Paul Pelosi had gotten into a fight with a gay prostitute. Musk’s rapid retreat (he deleted his tweet hours later) highlighted the danger of fighting one conspiracy theory with another.

Nonetheless, Elon Musk has quickly become an excellent role model for the GOP. He moved further toward shifting organizational culture in one day than the collective GOP has done in decades. With near simultaneity, he demonstrated the perils of overreaching – adopting the outrageous techniques of your adversaries to become equally offensive in a different direction. A GOP committed to building a durable coalition strong enough to drain the swamp must learn both critical lessons.

It will be exciting to watch Musk work. Speaking personally, I hope he succeeds. More importantly, I hope that those seeking to reform America’s leading institutions learn from his examples.

Devesh Kumar of Meta Vs The Wire saga denies being ‘mentally disturbed’ as claimed by the portal, says he is cooperating with police
Devesh Kumar said he accepts there were ‘errors’ in the Meta story, but blamed his ‘sources’ for the fraudulent documents based on which the story was published by The Wire
Talking to Times Now on 2nd November 2022, Devesh Kumar said that he is cooperating with the police in this case, and informed that police have seized two computers and a phone from him in the case. He denied facing any mental health issues, responding to a claim by his former employer The Wire. It is notable that The Wire put Devesh Kumar under the bus after it was forced to retract the Meta and Fog stories, claimed that Devesh Kumar had defrauded them by supplying fake evidence, and also alleged that he is mentally disturbed. He said that The Wire has used the wrong language for him in the complaint filed against him with the police.

Devesh Kumar said, “No. I am not mentally unstable. This is the first time something like this is happening in my life. I am not troubled. The people of ‘The Wire’ and I are facing several difficulties right now. I was nervous and stressed. But the language that has been used is wrong, according to me.”

However, he refused to divulge any details about the matter. He added, “The investigation is currently ongoing. I don’t think I can reveal any details on this. At least not without consulting the police. For now, my statement is the same as that of ‘The Wire’, which tells the overreaching story of what happened.” Devesh also refused to reveal any detail about his background like his educational background. TheWire and SV are , * I think * , few step ahead of what’s being reported. They are in fact preparing for Amit Malviiya’s defamation court case. The mentally unstable line put forward by The Wire on Devesh Kumar seems to be their defense…..coached by lawyers to include this angle up front to add legitimacy during trial ? Possibly.

Because court judgements are often dealing with lot higher stakes. And the verdict/resolution thats come after a long, tedious and expensive process needs to be correctly understood to be faithfully enforced by those those involved, so that justice is finally delivered.
Not to say other official business is not, but disputes that go to court are a "meta business" ie business of businesses. The verdicts have impact on the specific case and set precedent for an unknown number of similar cases in the future.

The time spent in formulating laws, judgements and govt statements is very little when compared to the enormous resources expended by various interested and stakeholder entities in ensuring that they build in loopholes that are later exploited by clever high paid lawyers to serve specific ends.

Even foreign countries pushing for predatory local market access in India using their mega corporations and associated leveraged supply chains while cordoning off their own markets citing human rights abuses, regulatory mechanisms and/or other non tariff barriers to raise high minded NGO led impediments to preclude Indian companies from expanding into their markets.

The international arbitration ploy used by entities like amazon against local companies like reliance to block their mergers or prevent even buyouts of other players is a case in point.

Often, such calculatedly complex judgements with malice aforethought and padded with obtuse and bombastic word play is a cover to create deliberate opportunities for "creative reinterpretation" and legal loopholes for clever bottom feeding lawyers to squeeze through.

That is why "judgements" in simple high school english are sufficient to convey with unmistakable clarity what these hizzonners have to say without entering into the realm of verbal calisthenics.
