I had to read The Chindu (a new paper I generally refuse to read) to understand the full context. This is what the Chief Justice said. "Article 35A gave special rights and privileges to permanent residents and virtually took away the rights for non-residents. These rights included the right to equal opportunity of State employment, right to acquire property and the right to settle in Jammu and Kashmir".

The Chief Justice is clear in his observation that fundamental rights of Indian citizens, which were available to them else where, is not given to them when it comes to J&K. So the CJI is right in observing that 35A was an Article which took away fundamental rights (of Indian citizens in the state of J&K).Articles 14 to 30 in Part III of Constitution of India is what is generally considered to be the fundamental rights available to Indian citizens. Articles 32 to 35A were more related to right to constitutional remedies, and Article 35A actually put a block on seeking such remedies when it comes to the state of J&K.

Indian Constitution allows reasonable classification, but not class legislation. Article 35A, IMHO was a kind of class legislation by which a large class/group of Indians were denied their fundamental rights just inside the state of J&K (which was available for them in rest of India).

the govt should not forget that it takes just one very ugly incident to cast a black cloud over India's global reputation

limit your exposure and do not tempt fate by being needlessly over ambitious, especially when media hyped international players are involved

the plate is already full for the forthcoming state elections, and also for 2024, so don't overload it by diverting your attention to frivolous activities

Some how I was under the impression that the right to settle in any part of India is not a fundamental right, as it is in the US, and that in some states of the NE (Mizoram?), Indian citizens can not settle and acquire property. Is this correct? or am I just imagining things in my old age.

Your understanding is not really correct. Art 19 (1)(d) states that citizens of India have the right "to move freely throughout the territory of India" and Art 19(1)(e) states that"to reside and settle in any part of the territory of India". So Indian citizens have rights to move and settle down in any part of Indian territory. Union or States can place reasonable restrictions and have state specific laws but that should be mainly on the interests of "the sovereignty and integrity of India, the security of the State". It cannot be on religious grounds etc. Art. 16 of CoI talks about equality in matters of public employement. No citizen shall, on grounds only of religion, race, caste, sex, descent,
place of birth, residence or any of them, be ineligible for, or discriminated against"in respect of, any employment or office under the State."
. How ever states can have reasonable restrictions. For example for certain jobs in KA, the government can say that the candidate should know Kannada language at 10th Std level.

The problem with Art. 35A is that it allowed the state of J&K to define 'permenant residents' of the state, and then provide special rights and privileges to them. No state in Indian Union have such a right given to them by a special provision in the Constituition. This was once again the idea of Shri. Bandit-ji.

The Sixth Schedule of CoI exclusively deals with - "Provisions as to the Administration of Tribal Areas in the States of Assam, Meghalaya, Tripura and Mizoram.". Here the tribal area would have autonomous councils which also have some law making powers. These provisions were mainly to protect the indegenous tribal communities and their unique way of life. My personal opinion is that sooner or later this too should go. These tribes have any way came out of their true tribal life style any ways, and have adjusted to the main stream society.

Plus, special provisions for tribals are also somewhat linked to forests, etc. and need to be saved. Moreover, these constitutional provisions are correctly made and not done by a Presidential Order like 35A.

There need to be re-evaluation of Tribal provisions. When a tribe come out of their true tribal life style and joined main stream why they continue need the special rights and protection and how long?

When I was living in Ranchi, a part of Bihar then in the 60s, it was not legal to buy land from Adivasis of that area (Chhota Nagpur). This was done to protect the tribals, who were rumored to sell their land for a bottle of desi alcohol. However, the corrupt always found ways to circumvent the laws. There are many such laws in India that actually help the goons instead of the poorer section that it was supposed to help. If there are laws that prohibit people from settling and owning property, you are actually undermining the idea of the Union of India.

AFAIK, this restriction is only in tribal, ecologically sensitive, and environmentally precarious pockets

Be that as it may, the jihadi cashmeris are not disallowed from owning land in the rest of India, and this one way religious appeasement narrative is very unhelpful and unfair

Right ! Thats because Bandit ji had gone to UN which suggested a plebiscite, which means no demographic change in J&K therefore no one outside was allowed to settle by the 3 family gangs, and they used every trick in the book for that. But the real benefit was that it allowed them unlimited loot and plunder. BTW, Pakis had no such qualms in PoK, one would be hard pressed to find a real Kashmiri there though they keep crying for plebiscite.

another speculation on WA - Bill for one country one election - all states and country goes for election at the sametime, and then there is 5 years to govern, rather than for electioneering and BIF gang setting country on fire every few months before an election.

Even though the above approach has merit, it has one fatal flaw. The dharmic side has to win every lok sabha, the BIF has to win any one to do the damage (just like terrorists, they have to succeed once to kill you, you have to succeed every time to be alive). Now the dharmic side may think they are unbeatable, but have been proven wrong multiple times when the BIF have bested them(like previous to previous Bihar election when BJP was supposedly winning 48 hours ago, or recent Karnataka election). The great thing about these loses are that the dharmic side has taken the right lesson, made correction and gone to win the next round. These multiple elections gives it a chance to do course correction and win the real prize(LS). By clubbing all elections together, that warning and course correction may not exist.

Unfortunately BJP folks don't do deep thinking

They can also do. 50% states go to election after 2.5 years and another 50% and nation goes after 2.5 years

What happens when a state Govt. falls? Presidential rule until 2,5 year mark hits.

That will give them time to course correct. But these guys won't get the message
