Judging by the august company at that gathering, putting her in jail will only reduce our chances of finding how exactly they all came to communicate with each other to organise at one place. Keeping her out in the open might help track these channels of communication and build some data for the intel types.

IMO, its high time the country get another few nanha jhapads to wake us upto the potential for trouble that non-response (or the perception of non-response) by the state which is constitutionally sworn to protecting the unity and integrity of India, to open sedition, exposes us to.

How long before malcontents among our diverse regions and sub-populations gather courage and ideas to imitate Su.A.R., network among themselves and invite phoren intervention, eh?

And the forces backing the seditionists - SuAR, Binayak Sen etc aren't small - entire parliaments, celebrities, nobel laurates etc signed up in their defense within days after all. Media spotlight etc can easily be managed and focussed when such forces are in play.

And we BRFites, ahead-of-the-curve and all that, are still debating about whether applying the law of the land to seditionists will somehow 'look bad', duniya kya kahegi, propagandu victory for the SuAR types etc? Wow only.

Again, sooner the jhapad arrives onto GOI's backside, smaller will be the damage done. If this wound festers long enough, septic (tank) ho sakta hai....

Here we have wannabe seditionists wanting to be arrested, in fact advertising the fact with fancy prose and all that. And we dutiful oblige them and make them into martyrs! Wow indeed!

But saar can you tell me how many days/months/years we'd be able to keep Su A R behind bars? Could we perhaps send her to Tihar with all the other common prisoners, like thiefs, murderers etc?

Perhaps that could get her to spend her energy in writing a new book, na?

Watching the TV debate about India's "splittists",Gilani,Roy,etc. a few points need to be understood.Those who want them arrested because they denigrate the martyrdom of thousands of troops and para-military forces are mistaken.We need to honour our Veterans (I prefer the word to ex-servicemen) better,by giving their dependants jobs,schooling for their children,housing,medical facilties for them and those wounded and handicapped.In short a generous gsture form the satte that will aloow the families to lose no opportunities in life.A special minister under the Min. of Def. could loook after their affairs and those who retire early can be offered re-employment in a variety of positions,in the border/sensitive areas as mandatory.

Coming back to the "splittists",what did Chairman Mao do with such types? He allowed from time to time,such deviants from the party line to express their views in personally sponsored events,in university debates,party forums,etc.,the best known being the so-called Cultural Revolution.He carefully watched out for those who opposed the party and its Marxist-Leninist ideology and then after they had revealed their deviant thinking in public,"snakes coming out of their holes" was how he described them, he chopped off their heads! We too need to adopt the same policy when faced with these extremists who hate the Indian state.Let the Vaikos,Roys and Gilanis vent their spleen ad nauseum,but when they have been caught directly in anti-national activites supporting India's enemies within and without,then the full wrath of the state can be brought to bear upon them through the courts first,after which they can be put away.

However,Roy is a special case.Her narcissism requires constant feeding and after she exhausted her creativity through writing,finding it far easier to attract attention from the world's media through her so-called human rights activism,which is also more lucrative,her next need is ...and don't laugh at me,is to obtain the Nobel Peace Prize! She sees herself as another Aung San Su Kyi,or a Chinese dissident in the making,with her added qualification of being a Booker prize winner,she has all the right ingredients to the fixers of the western world who select each year a controversial figure for the Peace Prize.Thus Roy revels in her carefully orchestrated antics,joining hands with the vilest enemies of the India state,drawing the required attention of the western media (her current antics have also made it to the western press),like a vulture feasting upon the carcasses of the suffering of India's deprived,so that the masturbation of her ego in public-her "soul-baring",can be exposed in full measure to those of the west who desire to paint India in the worst of pictures.But she lacks one vital qualification,that of martyrdom.She has never been a "prisoner of the state" like those genuine martyrs whom she wishes to emulate.Like an Opus Dei member,she needs the cilice around her thigh to inflict upon her sado-masochistic orgasmic pain,that her "crucifixion" be full in the glare of spotlights and flashbulbs.Her unquenchable lust is to attain the halo of martyrdom and be anointed as a latter day Joan of Arc,the Mother Theresa of the 21st century,with a large pinch of "Princess Di" thrown in for glamour,a veritable cocktail of qualities that makes her the perfect specimen for Nobel sainthood.

Applying different yardsticks for different people will lead to more serious problems. There have been a couple of people who have been arrested already for sedition in Tamilnadu and rightly so too. We have a law on sedition and anybody who violates that deserves to be hauled up so long as that piece of law stays, Arundhathi Roy's martyrdom-aspirations notwithstanding. If GoI, especially the Law Ministry and the Home Ministry determine that SAS Geelani & Arundhathi Roy did not say anything that amounted to sedition, that would be a different matter.

That's a great post. You've captured the essence of the narcissism of this idiot. She is imploring the state to arrest her so that, as you said, she can get the "prisoner of state" tag. Simple logic says, don't do what your enemy wants you to do.

JMT and all that.

PS: Also do note, as I've written before look at the timing. With Ombaba coming in the beginning of Nov, arresting her now would ensure the full glare of publicity for her precisely during the time when the Western especially US media would be looking towards India. I don't think the timing of her utterances or that of Geelani is a mere coincidence. I feel it's all pre-planned to coincide with the visit. If she's arrested you could expect her pals in the US, like Chomsky to ratchet up the pressure in US media.

Thinking aloud.
1. The Central Govt., IMHO did a good thing to BJP's demand to put behind these two separatists behind bars. As most of us here have seen through the trick of Arundathi Roy and Geelani's whole idea is to get behind bars using some pretext or other, to show case their victimhood even further.
2. But can these people be brought before a court of law, and some ridiculous fine (of say Rs.1/-) imposed on them with perhaps some "suspended" sentence as well. The judge can clearly add that he knows that the case is serious, but he feels that this token sentence (in order to ignore the issue) is more than enough? This is considering that some LTTE sympathiers (Movie director Seeman??) have already been charge sheeted for similar cases.

I am in agreement with Amit ji on this. SuAR is intellectually devoid. She just wants limelight. Getting behind bars a few days will make her some sort of heroine in the Western lib press and subsequently get her bigger audiences within to peddle nonsense. Law is meant to be a deterrent. The best deterrence in the case of SuAR is ignorance and redundancy. Thought that letter 'returning pity' was brilliant. As for sedition goes..when we talk to Pakistan in all back channel diplomacy etc..and theories/ balloons floated is there not seditious talks underway as such? The whole goal for Paki's to talk on K is sedition from the Indian point of view. So my take too is ignore this buffoon at the minimum for now. This is clearly a trap.

This ToI report gives some details of the legal aspects of booking her on sedition charges. Dunno how accurate it is, maybe some gurus can have a look?
For, while upholding its constitutionality way back in 1962 in Kedar Nath Singh vs State of Bihar, the SC read down the sedition provision, Section 124A of the Indian Penal Code, to apply it only to those who misuse their freedom of speech to instigate an armed rebellion against the government.

The 1962 verdict was meant to reconcile conflicting interpretations of Section 124A made by two top judicial bodies during the colonial period. While the federal court, the predecessor of the SC, held that sedition was made out only when the words in question had been written or said with the intention or tendency to disrupt public order, the Privy Council in England took the view that such an element of violence was not an essential ingredient of the offence.

Judging the 1898 sedition provision on the touchstone of the free speech guarantee provided by the Constitution, a five-judge bench of the SC, headed by the then CJI B P Sinha, opted for federal court approach of raising the bar for the invocation of Section 124A.

"Keeping in mind the reasons for the introduction of Section 124A and the history of sedition, the section must be so construed as to limit its application to acts involving intention or tendency to create disorder, or disturbance of law and order; or incitement to violence," the SC ruled, in a judgment that still holds the field. On account of this judicially imposed limitation, the police cannot hope to prosecute Roy unless they are able to establish a violent intention or tendency from the tapes of the speeches she delivered recently in New Delhi and Srinagar. This may prove difficult for the police as the closest reference to violence in Roy's speeches was to the trend of stone pelting in Kashmir.
Despite her provocative assertion that Kashmir had never been an integral part of India, the police would be hard pressed to rebut the contention made by Roy that her speeches were "fundamentally a call for justice".

So, it is not just for the executive to take a call on whether it is politically expedient to arrest Roy for her human rights campaign. What is more intractable is the legal challenge before the police to make up for the absence of any exhortation for violence in her speeches despite all the disaffection she can rightly be alleged to have spread.

Amit,yes,the timing is of particular significance,because the US cannot open any talk about Kashmir given India's sensitivities,but are using their stool pigeons like Roy to do so,in order to embarass the govt.,making Kashmir the elephant in the room which cannot be ignored.The Messiah will then in a private room tell his would-be manservant MMS,that he must oblige Pak on J&K in order to bring in "peace and stability" to the region.(ig)Nobel piss prize for him assured,one A.Roy can wait her turn!

Saying it is my personal belief, Radha Kumar said, the constitution has been amended more than 400 times and there is no harm if it is modified further to make it more accommodative.

A case of alleged sedition has been filed in a local court against noted writer Arundhati Roy for her controversial remarks on Kashmir.

The complaint, lodged by one Ashish Kumar Singh in the Chief Judicial Magistrate's (CJM) court of Vijay Kumar in Ranchi, was transferred on Tuesday to the court of Judicial Magistrate (first class) of Amit Shekhar.

Singh, a resident of Ranchi, demanded action against Roy under section 124 of IPC (sedition) for her remarks on Kashmir at a seminar in Delhi last week.

The ultimate method to win back Kashmir is to dismantle terror camps in Pakistan in a dedicated, step by step blitzkreig. Na rahega baans na bajegi baansuri.I think we have had enough talks, and the direction the talks are leading towards is totally the wrong way.

Actually i am not averse to talking about "Azaadi" of J & K one bit. I for one want to know what "Azaadi" means. How do Geelani and Company plan to accommodate the millions of Buddhists and Hindu's and also millions of Muslims who don't want to be a part of the "Azaadi" thing. How do they define their "Azaadi". What sort of constitution do they envisage post "Azaadi"?

The answer is simple. The "Azaadi in J & K"==Sharia==Islamic Rule. That is what SuAR and Co are fighting for. Ladhak will promptly be swallowed by China. Jammu there will be a bloodbath and massive exodus of Hindu's and Sikhs. The Paki Army will quickly move into the Valley. Omar Abdullah will seek asylum in India as moderate KV leadership is eliminated by the Jihadi's from Pakistan. India may at the maximum move into Jammu and organize a plebiscite and win there once it sees China swallowing Ladhak and Paki's doing so the valley. The average Abdul in KV in a few years will say they made a mistake pelting stones for "Azaadi".

That is "Azaadi" for starters.

azadi is defined as the removal of pakistani forces from the parts of J&K it illegally occupies and the attendant removal of chinese forces from those parts that it too illegally occupies. followed by the resumption of governance in the entire state as per the terms of the Indian constitution, and an opportunity for all the peoples of Jammu, Kashmir, Ladakh, and the northern regions to participate fully in the growth of the Indian economy and achieve prosperity, security and enjoy the benefits of a pluralistic democratic state.

I totally agree with you, Lalmohan.The rantings for "azaadi" in J&K is motivated by a handful of kashmiris loyal to TSP.The cries will die down eventually. Geelani has to cough up 1.73CR in Income Tax penalities, so he is distracting the government.He has no agenda for the people of J&K, just a bloody pensioner taking hefty cuts from TSP now and then, and justifies all that by shouting anti-India slogans, and inciting Kashmiri youth against India.the charge of sedition against him will surely hold ground, and he should be tried ASAP.

During his sedition trial in 1922, Mahatma Gandhi had said “Section 124 A, under which I am happily charged, is perhaps the prince among the political sections of the Indian Penal Code designed to suppress the liberty of the citizen.”

The law defines Section 124A of IPC as “whoever by words, either spoken or written, or by signs, or by visible representation, or otherwise, brings or attempts to bring into hatred or contempt, or excites or attempts to excite disaffection towards, the Government established by law in India can be booked under sedition.”

This is a good idea. In fact I recall having a discussion about buying the Taj Mahal cheap with a tour guide for future property development. He promised me that he would look into the matter and act as interlocutor and I showed him my wallet that had Rs 300 and more in it. But both the tour guide and I decided against it. The importance of people like him and me in the scheme of things in India must not be underestimated. The same holds true for the interlocutors and the interlocutees or interlocutiepies or whoever.

If Roy's past record holds true, the Kashmir 'movement' will fail, just as surely as the Narmada dam was built and the Maoists are floundering udner onslaught by the GOI. :)

Why? Roy brings so much negative publicity to a cause that it ends up as cause denigre with the masses, intellectuals, and the political elite. Nobody wants to be associated with a movement that has such poisonous characters as Roy (except other poisonous characters).

However,Roy is a special case.Her narcissism requires constant feeding and after she exhausted her creativity through writing,finding it far easier to attract attention from the world's media through her so-called human rights activism,which is also more lucrative,her next need is ...and don't laugh at me,is to obtain the Nobel Peace Prize! She sees herself as another Aung San Su Kyi,or a Chinese dissident in the making,with her added qualification of being a Booker prize winner,she has all the right ingredients to the fixers of the western world who select each year a controversial figure for the Peace Prize.Thus Roy revels in her carefully orchestrated antics,joining hands with the vilest enemies of the India state,drawing the required attention of the western media (her current antics have also made it to the western press),like a vulture feasting upon the carcasses of the suffering of India's deprived,so that the masturbation of her ego in public-her "soul-baring",can be exposed in full measure to those of the west who desire to paint India in the worst of pictures.But she lacks one vital qualification,that of martyrdom.She has never been a "prisoner of the state" like those genuine martyrs whom she wishes to emulate.Like an Opus Dei member,she needs the cilice around her thigh to inflict upon her sado-masochistic orgasmic pain,that her "crucifixion" be full in the glare of spotlights and flashbulbs.Her unquenchable lust is to attain the halo of martyrdom and be anointed as a latter day Joan of Arc,the Mother Theresa of the 21st century,with a large pinch of "Princess Di" thrown in for glamour,a veritable cocktail of qualities that makes her the perfect specimen for Nobel sainthood.

PS:I suspect that she wishes to also don the mantle of being the female version of Comrade Che!

Defaulter Geelani asked to pay Rs 1.73cr tax

Income Tax department has asked hardline Kashmiri separatist leader Syed Ali Shah Geelani to pay Rs 1.73 crore in tax dues over a period when he had not filed his returns after rejecting his appeal.

The department had raided Geelani's house and other places of his kin on June 9, 2002 and seized Rs 10.2 lakh and 10,000 US dollars in cash, vouchers showing purchase of substantial amount of jewellery, a diamond-encrusted watch inscribed with "From Pakistan Government" besides documents pertaining to purchase of property and vehicles.

Geelani had shown an annual income of Rs 17,100--Rs 7,100 as pension from the state Assembly as a former MLA and Rs 10,000 as agriculture income.

However, according to the assessment made by the Income Tax Department, the monthly expenditure of Geelani allegedly ranged from Rs one lakh to Rs 1.5 lakh as he had 15 servants at his house and his wife had confirmed that she used to get Rs 25,000 per month for kitchen expenses.

The State Cabinet is likely to discuss threadbare the much talked about surrender policy aimed at granting amnesty to the Kashmiri militants, who are currently camping in the terrorist camps in Pakistan-occupied-Kashmir (PoK).

Authoritative sources told the EXCELSIOR that State Cabinet, which is meeting under the chairmanship of Chief Minister, Omar Abdullah at Srinagar tomorrow at around 2 pm, will have detailed discussion on the policy which, if approved and implemented, would facilitate the return of those youths of the State in PoK, who want to leave the guns and return to the mainstream through a proper channel.

Mr Omar Abdullah had raised the demand for such a policy during Chief Ministers’ Conference on Internal Security at New Delhi on February 7, 2010 and the Centre also agreed in principal to facilitate the return of youth desirous to come back from PoK and lead a normal life.
After having threadbare discussion, the Combined Unified Headquarters finalized the policy and then the same was sent to the Union Ministry of Home Affairs for its examination and comments, sources informed, adding the MHA circulated the draft policy to various agencies for their comments and after nearly four months long exercise to make policy fool proof, the MHA returned the same to State Government recently with necessary recommendations.

"Based on the recommendations of the MHA, the State Government has carried out necessary amendments in the proposed policy and the Cabinet will have thorough discussion on the same tomorrow", they said, adding "if there will be consensus on the policy in the Cabinet the same will be approved for implementation". Apart from providing safe package, the policy would have provisions for incentives for the rehabilitation of the returned militants.

It is pertinent to mention here that general amnesty for the misguided youths, who want to leave gun and return to mainstream in Jammu and Kashmir was also the recommendation of one of the five Working Groups set up by the Prime Minister, Dr Manmohan Singh to address various dimensions of Kashmir problem.

While official estimates peg the number of such youth in PoK training camps around 1000, the unofficial figures put the number anywhere between 1500 and 2000. Apart from those having gone there for armed training, there are hundreds of persons, who had crossed the Line of Control (LoC) for economic and social reasons, sources said.

Methinks that aam abduls and the middle class should vent ire in a novel way (in fact, this method seems to be the most 'fashionable' nowadays- ...throw shoes at SAR wherever she goes to attend public functions...

The advantages are many-

1) Ensures good publicity (in fact, it has become the pet way to protest 'peacefully')
2) It takes the limelight away from SAR (and puts it straight back to mango man)since the message gets across that aam abduls (as against a protest from a party like BJP or Shiv Sena where political motivation would be alleged) are frustrated with her antics. Post shoe throwing interviews with the mango can be aired.
3) Unlike booking her for sedition (which is what SAR is thirsting for), which will invite the wrath of the 'goras' and also a Nobel prize later on for undergoing persecution under Indian state, shoe throwing by mangos would deflect it from the State and give it the flavour of a mass movement.

A writer made to feel orphan by the hoi polloi themselves is the 'most unkindest cut of all' for these "creative" types.

Satyagraha (err...I meant fasting) is passe...'shoe throwing' is in!!

Kashmiri Pandits in the national Capital have expressed dismay at the Union Government’s inaction over seditious speeches made by ‘enemies of the nation’, particularly writer Arundhati Roy who has continuously been promoting anti-nationalism.

In a statement on Tuesday, Aditya Raj Kaul of Roots in Kashmir, a frontline organisation of Kashmiri Pandits who have been forced to migrate from the Valley, said the community feels insulted at the Government’s callous indifference to Roy and those of her ilk as “the statements issued by Arundhati Roy successively as a continuation of her earlier comments reveals the insidious nature of her propaganda of hate”.

Coming down heavily on Roy, Kaul said that despite speaking about their plight, she never took pains to visit any refugee camp in Jammu nor did she take on militants who burnt temples and raped women in the State. “We do not need her crocodile tears. We can see through her tricks and are better off without such pseudo-intellectuals who are nothing but apologists of hate and terrorism,” Kaul said. He accused Roy of conniving with the likes of Hurriyat hawk Syed Ali Shah Geelani and Jammu Kashmir Liberation Front chairman Yasin Malik, who forced the Pandits out of their homes and contributed to “anti-India activism”.

Rashneek Kher of the same organisation alleged that Kashmiri Pandits, who protested Geelani’s hate speech at LTG auditorium in New Delhi, were thrashed and their clothes torn by the so-called “supporters of free speech”, yet “pseudo-intellectuals like Arundhati Roy and mobsters like Geelani and his supporters were provided protection by the same authorities”.

“Their inaction has emboldened the separatists and hate-mongers so much so that they are now taunting the Indian state by issuing such statements everyday. If it took no time for the Government to act against Varun Gandhi, why is it so circumspect when it comes to cracking down on Roy?” Kher said, adding, “It is such indecision on the part of the Government that has encouraged them to bite the very hand that feeds them.”

The Pandits also warned the Government saying they would move court against the separatists as well as the state if it continues shielding antinational forces.

“If the Government fails to act against Geelani, Roy and others we will have no option but to resort to legal measures not just against them but even against the state for granting permission to such a programme which is against the spirit of the Indian Constitution,” the statement said.

there is heavy small arms fire ongoing in poonch and uri sectors after pakis violated ceasefire and started escalating. TV was showing jawans hiding behind earthen berms of rice fields and behind tree groves and firing continuously at the pakistan side. tv also showed smoke from a mortar shell the pakis had lobbed somewhere.

this is obviously meant as a 'greeting' for the obama visit.

File as many court cases as possible against SuAR in different parts of India. Do a MF Hussain on SuAR. She will leave India for good and hopefully she will get some Saudi or qatari or purestani Citizenship. :)
IMHO, this is the best way to get rid of her.

It is not about giving publicity to ARoy; it is about sending a message that if you continue to abuse those who give their lives to save your backside, the state will no longer guarantee your safety. Messages can be sent in different ways, some subtle some not so subtle. Let us not go any deeper into this.
