Madani's arrest: Senior Karnataka officials in Kerala
Two senior police officials from Bangalore will hold discussions with the police top brass in Kerala today on the issue of arrest of PDP leader Abdul Nasser Madani in connection with the Bangalore serial blasts case. Joint Police Commissioner of Bangalore Alok Kumar along with Deputy Commissioner Omkarayya have reached here, fuelling speculation that the arrest of Madani was imminent.
What I can make out of this dilly-dallying is that Kerala Govt. still does NOT want to give an impression that they arrested Mahdani. Which means that the commie govt. still feels that if the K.P goes and arrests Mahdani, it would have a negative effect on their vote banks. So the K.P provides all possible help, except the task of actually physically marching up to Mahdani and say that "you are under arrest". So Anwarsseri is now pretty much under police control and the stage is set. The Karnataka Police Inspector and his 3 member team after seeing all this hulla-balloo may also have felt that he is not the right person to make the arrest. Like in any hierarchial organisation he would have asked for help from senior IPS afsars.
So now we have two possibilities.
1. Karnataka Police team with their senior officers arrest Mahdani and take him away.
2. Mahdani runs to the nearest court (with the K.P allowing him to do that) and surrenders. The court can then hand him over to police custody.
Looks like Kerala Police is expecting some trouble here. Additional forces from Kollam and Thrissur A.R Camps have also been asked to move into Anwarsseri.
Mean while....
One more arrest in the 'hand chopping' incident. One Niyaz arrested in Ottapalam Railway Station from a train.
PDP meeting to decide what Mahdani has to do next, is banned. Because Cr.PC 144 is in place

I have been watching live the Madhani arrest drama. I wonder if any other person accused of terrorism-related charges, with an NBW against him and a court order to produce him before the Hon'ble Court by tomorrow would have been given so much lattitude.
The Kerala Government has made it clear that they would only 'facilitate' the arrest but it is up to the Karnataka Police to do the actual deed (as Sachin says). Also listened to a statement by the Cardiologist (part of a medical team) who examined him. He said that Madhani has elevated blood sugar (285, and he is a known diabetic), mild fever, normal BP, sinusitis (for which he is already under medication), spondylosis (known problem) and had complained of chest pain yesterday. He says the ECG was normal and blood samples have been taken for further tests whose results will be known in a few hours.
All these should have nothing to do with an arrest. He could have been arrested and taken to a hospital for check up and even admission there if needed. We are sending a very wrong signal by treating this guy with kid glove. He is conducting press meet and dicatating how he would surrender before a court, how he would not be responsible if his cadres indulged in violence, how the police are planning to eliminate him and how he is trying to prevent a communal conflagration in the State etc. Indeed, he is warning what would happen if he is arrested. A pathetic state of affairs.

"Eliminating him??" That should be the joke of the decade. But all these nautanki which is going on, is only going to give more fantastic ideas to potential trouble makers. Once people with arrest warrants start dictating terms on their arrests, it is better that the police force is asked to sit inside the PS killing mosquitoes. I must add that certain Visual Media outlets have also been giving undue coverage to these theatrics of Mahdani. If they could just keep away for some time and come back when the police is making the arrest it may be beneficial for every one.
The magistrate's court at Sasthamkotta is the jurisdictional court. Latest news says that bandobust has been arranged for in that court as well, as Mahdani may go and surrender there.

Bah, better that the truth come out unvarnished and plain for all to see. And the truth in Yindia long has been that the law is not (even in theory let alone in practice) applied equally across communities in Yindia.
The kid-glove handling of the madhani types, the kashmiri-sunni stone throwers, the naga bloackade-mongers against the iron fist shown the amarnath protestors, the kandhamal rioters, and the prosecution (persecution?) of cops involved in the sohrabuddy case is yet to register in general aam public consiousness (and perhaps never will).
Things will get worse before they maybe will get better. People unless shocked into confronting what they would otherwise brush under the enormous carpet of daily worries only, can't care less anyway. We have along way to go before demanding action and accountability from our gubmints only.

In Malayalam there is a saying "ഗണപതി കല്ല്യാണം നാളെ..നാളെ.." (gaNapathi kallyaaNam naaLe..naaLe..;Ganapathi's marriage is getting postponed every day to "tomorrow"). The same is the case with Mahdani's arrest
. This arrest drama is now going down to the level of a farce. Conflicting signals are coming out from each and every corner.
* The Kerala Home Minister says that now Karnataka Police have to make the arrest.
* Karnataka Home Minsiter blasts the Kerala Government for being un-coperative. He also says that their are other ways to get hold of Mahdani if Kerala plays spoil sport (this statement was shown on Asianet News channel yesterday evening).
* After meeting DCP Alok Kumar from Bengaluru Police, Southern Range IGP A.Hemachandran tells the media that the arrest warrant would be executed.
* Mean while the "emir of Kerala" (as Singha puts it) is planning to surrender at the Karunagappalli courts, since the judge/magistrate at the jurisdictional court is on vacation. PDP workers asked to reach the court in large numbers. Kerala Police puts up a heavy bandobust in the court complex too.
* Kerala Police (especially the folks on the ground) are totally irritated. For 3 days many of these folks are put up at the same place doing nothing. They say now there are only 50 chaps inside the orphanage and there are 200+ policemen out side. Mahdani can be just dragged out and taken away. Kerala Police now also feels that they will find things uncomfortable when they have to goto Karnataka to investigate cases. Fat chance that they will get a positive response.
Personally I feel that, the current CPI(M) led state government is really not having the guts to go ahead and arrest Mahdani. Short term political goals may be one reason behind it, or the classic CPI(M) gutlessness when dealing with RoP may be another reason. The state government is allowing Mahdani to try out every trick in the legal world to avoid the arrest. Mahdani's anticipatory bail plea in SC would be taken up today, secondly he has also filed a petition to quash the entire charge sheet in a Bangalore court. The Kerala State govt., is playing the fool and giving Mahdani enough and more time for all this. Just like any other event in Kerala, this too has become an event for the various news channels to have 24/7 "breaking news" updates, for some arm-chair generals to appear on TV and give their "expert" opinion etc.

. The Bengaluru police did a 'chanakian' move and whisked Mahdani off through the cargo building entrance. The waiting cameras could only catch Jt.CP Alok Kumar coming out with a glee on his face.
* The general feeling is that more than K.P, it is the political establishment at Kerala which tried to delay the arrests. Every single oppurtunity was given to Mahdani to try his various tricks out hoping that some other external force (eg: courts) would save Kerala Govt. from having to arrest Mahdani.
* It is with the arrival of senior officers from Karnataka Police which turned the table. The senior leadership of K.P also gave a professional advice that the arrest warrant has to be executed. A veiled threat from the Karnataka Home Minister that he would have to resort to some other means to get the arrest done, also helped in the process.
* The police then started off a wave of confusion. They put up extra bandobust in a local court and PDP fellas and the media thought that Mahdani would surrender there. A few Karnataka policemen were also there for extra effect.
* Mahdani calls for a press meeting, and two Special Branch CIDs also get in as press reporters. They give an upto date report to the higher ups.
* The police gives an ultimatum to Mahdani that at 1:15 PM he should be out of the orphanage campus or the police would break in.
* Mahdani comes out a minute later from the fixed time, police men barge in and his vehicle is surrounded. The arrest is done, and Mahdani's driver is asked to get out of the vehicle. A police driver gets in, along with the two senior officers from Karnataka Police

Kasaragode's sympathy with the Ummah is a known case. But see the rest of Kerala, people are least bit bothered about Mahdani doing a break-dance at the police lockup in Karnataka. In Karunagapally PDP workers tried to start a riot, and they were beaten black and blue by the police. The police may also have given stern warnings to the PDP head-honchos that if they incite riots they may be facing some unpleasent music. The raids and arrests happening in the 'professor hand chopping' case, the RoP rioters may also be thinking that the police are now taking a very hard stand against their terrorist tactics. Some of the relatives of the accused in the 'hand chopping' case tried to scuttle the investigation by filing a case. The usual tactic of "oh.. the police is harassing us, especially women and children" drama. Hats off to KP! Kudos to the cops who have the most difficult job. This job was done well.

Two more points to Sachin's excellent summation:
- As soon as Madhani came out, the Kerala Police, headed by Ms. Harshita Attaluri, stormed into Yatheemkhana and took charge of it
- Ms. Harshita also announced that the Karnataka Police have arrested Madhani (The Kerala Government was perhaps particular that this must be announced to clear itself of the arrest)

Despite the many kaala daals in the police forces, they do tend to pack a solid strong punch when they get their act together. I wonder just how much more effective they would be if only they were not shackled by the politicians. Internal security and intelligence would be leagues better.

Just to put in record. Mahdani was given category B security and around 3 policemen were also detailed to escort him. When things got hot, these 3 policemen were pretty much trapped inside the Anwarsseri Yatheemkhana. In a way they were now like hostages. When Mahdani called for a press meeting on Sunday evening, the media and the PDP fellows were all listening to him, these three policemen jumped over the wall and made their escape.Karna_A wrote:Kudos to the cops who have the most difficult job.

There are potential problem areas for Kerala Police which would come up later. Karnataka Police says that Mahdani had been to a terrorist training camp organised at Coorg, in Karnataka. Two witnesses have said that they did notice a one-legged bearded man arriving at this camp. Thadiyantavida Nazir also says that Mahdani had visited this camp.
Mahdani would counter this argument by saying that he was given police protection and the policemen are expected to be with him at all times. So it is not possible that Mahdani could make a visit to the camp with these policemen around him. Kerala Police would now have to check up what exactly happened on that day. Were the policemen on escort duty actually with Mahdani at that time?
It is an open secret that police men on prisoner escort, picquet post duty (eg. in mental hospitals) take unauthorised breaks from the duty. In case of Mahdani's escort team also this could have happened. Mahdani was in an ayurvedic treatment centre at that time, and the police men have decided to take an unauthorised break (hoping that Mahdani would stay put in the treatment centre).

Now, cops need to prove Madhani guilty
Bangalore police are facing a “technical problem” in proving that PDP leader Abdul Nasser Madani visited Kodagu to plan the 2008 serial blasts in Bangalore.
Information available from the Kerala Home Department has revealed that Madani did not visit Madapur, which was mentioned by the city police in their chargesheet.
The Kerala government provides Madani B category security.
The Kerala CID and other police agencies in the state record and submit details of every minute that the leader spends outside his home town.
Under the B category security, he is provided an armed police sub-inspector round-the-clock along with a person to screen visitors at his residence and four armed personnel for security cover.
A senior police officer of Bangalore said the investigating team was facing a technical problem in proving Madani’s visit to Kodagu.
In addition to this, the police are worried about how to get the confession statement of Madani if he does not cooperate with the police during interrogation citing ill health.

SSridhar, Karnataka Police should not rely on Kerala Police for gathering any evidence etc. The arrest warrant itself was executed after putting lots of pressure. The Kerala Home Minister's statement clearly means that he (and his commie pals) feel that Mahdani has been unneccessarily targetted by a BJP ruled state. In this drama Kerala Govt. would act out the role of a poor person who had to take part in an action forced on him by vested interests.
When Mahdani submitted his anticipatory bail plea in Karnataka High Court he had levelled the same arguments. His lawyers had produced the reports submitted by the Kerala Police security team with Mahdani regarding his movements. I am sure the court would have seen these documents and further evidences which Karnataka Police may have discovered (which we may not be aware off). And then the court threw out the bail plea. His another argument was that the stringent sections using which he is now arrested (and denied bail) were part of an amendment which was not there when the crime had taken place.
There are means and ways to track a person's movement these days. A mobile phone is all that is neccessary. A mobile phone which is switched on can pretty much give a kind of route map a person followed during certain days

When Mahdani submitted his anticipatory bail plea in Karnataka High Court he had levelled the same arguments. His lawyers had produced the reports submitted by the Kerala Police security team with Mahdani regarding his movements. I am sure the court would have seen these documents and further evidences which Karnataka Police may have discovered (which we may not be aware off). And then the court threw out the bail plea. His another argument was that the stringent sections using which he is now arrested (and denied bail) were part of an amendment which was not there when the crime had taken place.
There are means and ways to track a person's movement these days. A mobile phone is all that is neccessary. A mobile phone which is switched on can pretty much give a kind of route map a person followed during certain days

Loopholes in the Madhani chargesheet will hurt Bengaluru police
Another point deals with the mobile phone which the police claimed belonged to Madani. The police said that Madani made calls from his phone to stay in touch with prime accused Nasir whereas the phone company claims the number is registered to Soofiya Madani.

^^ agreed ramana garu. I was more referring to he drama played during arrest of madani. Looks like we are still in Katta panchayat age. Wife could be or could not be associated and it is a matter of invetigation. But if she is found , prima facie, guilty of cognizable offences then the arrest drama would be fun to watch.No matter what seriousness many people attribute to Law and order, arrest would be decided by Katta panchayat , just like her husband. and it would be fun in a dark sense not in light sense of fun and games.

Saar. Wife is already facing another set of criminal charges. When hubby was in Coimbatore enjoying the hospitality of T.N Govt., wifey gets all upitty and decides to burn down a TN State Transport Corporation bus. This was done by a team at a small town of Kalamasserri, Ernakulam Rural Dt. The team (of men) who did the crime is pretty much identifed and they have already named Sufiya as the master-mind. The NIA is investigating this case, and the charge sheet would be submitted pretty soon. Sufiya is out on bail, with very severe restrictions imposed. She had to take special sanction from the court to reach Anwarasseri where hubby Mahdani was holed up and wondering how to evade the arrest. Infact the fun would start when Mahdani tells the Karnataka Police that the calls came to his wife's mobile phone, while wife tells the Tamil Nadu police that the call was meant for Mahdani

The Indian Mujahideen operative who planned IPL blasts
The blasts at the Chinnaswamy Stadium in Bengaluru [ Images ], which created panic among the spectators who had gathered there to watch a game of the Indian Premier League [ Images ] on April 17 this year, were planned and carried out by the Indian Mujahideen [ Images ], according to the city police.
According to the Bengaluru police, Indian Mujahideen operative Salman alias Chotu was the mastermind behind the blasts. Incidentally, Salman was arrested by the police a month before the blasts.
Bengaluru police officials told rediff.com that investigations into the case point to Salman's involvement.
Salman, a wanted accused in many cases, is one of the main operatives of the terror outfit, say sources in the Intelligence Bureau.
According to IB sources, Salman was trained in Pakistan and he played a role in the serial blasts in Jaipur [ Images ] on May 13, 2008. He planted the bomb at the Manak Chowk area, say sources. The blasts had claimed 60 lives in Pink City.
Salman was later roped in for bigger terror operations and he played a role in the Delhi [ Images ] serial blasts as well. He was arrested by the Delhi police in March this year.
He will be initially interrogated by the Rajasthan [ Images ] police before the Bengaluru police can get access to him.

One law enforcement officer said, "He had a ton of books," including jihadist books and publications written in Arabic. Some focused on espionage and other diagrams seemed to explain how certain US military weapons can be taken apart in the field.
The title of one book was "Spycraft" and another was titled "New Voices of Islam" and police noticed mentions of "infidels" in some of the writings that could be made out clearly.
"It definitely raised our concerns," said one law enforcement official involved in the arrest. "Not your everyday passenger would have this sort of stuff and it definitely poses a concern for anyone involved in airport security," he said.
The books and radical Muslim material was found in stacks, packed in Kumar's carry-on luggage, according to the police report.
Officers also found a pair of brass-knuckles in the luggage he had checked with his airline to be carried in the cargo hold of the aircraft. In Texas, brass-knuckles are prohibited by law so he was booked on a felony charge of Possessing a Prohibited Weapon in a Prohibited Place (airport).
FBI agents were called to the secondary screening area where Kumar was being detained. Agents are now checking his name on terror watch lists and 'no fly' lists, but there is no indication that his name has appeared on any of those lists.
In addition to the brass knuckles and the jihadist publications, police confiscated more than $10,000 in cash that Kumar is accused of carrying on his trip.
Federal law requires anyone carrying $10,000 or more to declare the currency to Customs agents, but law enforcement officials said there was no such declaration for Kumar.
One federal prosecutor said his office was still researching how that law applies in this case since only about $8,000 was in US currency. Several thousand dollars more were made up of foreign currencies, so the prosecutor wasn't sure if Kumar would face charges related to the stacks of cash.

Can the wife of an alleged Maoist be “punished” for the activities of her husband? The Ministry of Communications & IT is seized with the question with human rights activists protesting against the eviction notice issued by the Department of Posts to Anju Shakeel, wife of Abdul Shakeel Basha, an alleged Maoist arrested last June. Reportedly on the wanted list of the Gujarat Police, Basha was picked up from his house which happens to be a government house allotted to his wife five years ago.
Basha, who is in a Surat jail now, worked for the homeless and ran an NGO called Haq in Delhi. He worked closely in Gujarat with Harsh Mander, member of the Sonia Gandhi-led National Advisory Council (NAC).
His wife is said to have petitioned Minister of State Sachin Pilot against his department’s eviction order last week. When contacted, Pilot declined to comment.
But a Ministry official said: “Accommodation was given to her on temporary basis and it was extended every six months. This time, the extension was not given. The fact is no unlawful activities can be allowed from government accommodation and Basha had been arrested from her official residence.”
In the eviction notice dated August 10, Anju Shakeel was given 10 days to vacate her house. She declined to answer any questions, but sources said she has asked Ministry officials for a reprieve citing her “lower backbone disorder” and “acute diabetes.” Her mother lives with her.
“Whether her husband is involved (in Naxal activities) or not has to be decided first. It has to be proved. Which law allows you to evict someone because her husband is alleged to be involved in something? It is draconian and unjust,” Mander told The Sunday Express. He said that Basha had worked with him from 2004 to 2007. He was involved with Nyaygraha, a campaign for legal justice for victims of 2002 Godhra riots launched by Mander’s NGO Aman Biradari.
“There was a time when Muslim youths were picked up under POTA in Gujarat. There was not a single Hindu (arrested under POTA) as if terrorism was something that happened to one community only. Now we find that a whole set of people engaged in social assertion are paying the price. It raises disturbing questions. Dissenting social activists have been picked up. It is hard to believe that it is a coincidence,” said Harsh Mander. He said he is helping Basha with his legal defence. Basha had been arrested under IPC sections dealing with waging of war against the state and under the Unlawful Activities Prevention Act. Police claimed he was involved in a conspiracy to begin Maoist operations in Gujarat and parts of north Maharashtra.
