Waiting for India's request in Hasan Ali case: Swiss govt

NEW DELHI: Amid a raging controversy over black money allegedly stashed by stud farm owner Hasan Ali in Swiss banks, Switzerland has said it is awaiting a "complete" request from India for help in this case since 2007.

Switzerland's Federal Office of Justice (FoJ) had last told Indian authorities in August 2010 to complete their request and the request has not been completed so far, an FoJ spokesperson told PTI.

Hasan Ali investigation uncovers money trail

ED had issued a show-cause notice to Khan in 2008 for foreign exchange violations regarding the $8.04 billion in his UBS account. The income-tax department in Mumbai also issued a notice and raised a demand of Rs40,000 crore against Khan for not disclosing funds in several foreign bank accounts, including the one in UBS. That amount has been raised to Rs50,000 crore, owing to charges because of non-payment.

The I-T department first raided Khan’s residence at Koregaon Park in Pune in January 2007 and seized documents that revealed his $8.04 billion UBS account in Zurich. The department said Khan concealed his income and had not filed income-tax returns since 1999. The department also raided his properties in Mumbai and Hyderabad.

All decisions on spectrum allocation since 2003 by successive governments, including the UPA, were procedurally wrong, concluded the one-man committee, which probed into the procedural lapses following the telecom scam.

Unveiling the report of the Shivraj V. Patil committee, Telecom Minister Kapil Sibal said in New Delhi on Friday that the findings on procedural lapses are being sent to the Central Bureau of Investigation, {this is again an attempt to dilute the ongoing Raja case. There is a huge attempt to get Raja off the hook which raises suspiciion about somebody bigger than Raja being involved in this. All attempts are therefore being made to scuttle the 1.76 Lakh Crore scam. First, Sibal called the CAG report rubbish and even went to the extent of arguing that there has been no loss at all. Now, this report and he is faithfully forwarding it to the CBI. The CBI will get the cue and extend the scope of investigation and make the whole issue infructuous.} which is looking into criminal culpability in the scam.

Addressing a press conference a day after the arrest of former telecom minister A. Raja, Mr. Sibal said his predecessor had said that he was “not deviating from the previous policies (the NDA government) but the problem was that the previous policies were wrong.”

Quoting the report, Mr. Sibal said the committee found that original spectrum allocation was “bad” and procedures were not followed both during the NDA government till 2004 and the UPA government up to 2008.

It also said the Department of Telecommunications (DoT) did not follow the advice of the Law Ministry or the views of the Finance Ministry over pricing of spectrum.

A Delhi court on Saturday issued notice to the Central Bureau of Investigation, asking it to file a detailed report on whether its probe in the 2G spectrum case covers the aspect of national security as raised by Janata Party president Subramanian Swamy in his private complaint seeking prosecution of former Telecom Minister A. Raja.

“Issue notice to the CBI to file its detailed report of the investigation being carried out by it and whether it covers the aspect of national security as raised by Subramanian Swamy in the present case,” Special CBI Judge Pradeep Chaddah said.

Dr. Swamy, meanwhile, submitted before the court that he is intending to move an application to implead some other persons, including Tamil Nadu Chief Minister M. Karunanidhi, as accused in this complaint.{That's a big news}

Koda's judicial remand extended

RANCHI: A vigilance court on Tuesday extended the judicial custody of former chief minister Madhu Koda and his aide Binod Sinha till February 15.

Special vigilance judge B K Khan extended the judicial custody in the case related to irregularity in allotment of work to different companies under the Rajiv Gandhi Gramin Vidyutikaran Yojna. While Koda is lodged in jail for more than a year, his aide Sinha was arrested from Delhi in September last year.

The judicial custody of two former ministers, Enos Ekka and Harinarayan Rai, was also extended by the special CBI court in disproportionate assets case. Special CBI judge S K Dubey extended the custody till February 15. Both the former ministers are in jail for more than a year.

BANGALORE/NEW DELHI: Hard on the heels of its explosive investigations of the 2G spectrum allotments made in 2008 by the Department of Telecommunications, the Comptroller and Auditor General (CAG) has started inquiries into a 2005 agreement between the Indian Space Research Organisation's commercial arm Antrix Corporation Ltd. and Devas Multimedia Private Ltd.

The agreement relates to ISRO's launching of two satellites for Devas but automatically bestows on the latter a large hidden benefit: unbridled use of 70 MHz of the scarce S-band spectrum over a 20-year period.

ISRO is under the Department of Space (DoS), which is directly in the Prime Minister's charge.

Business Line learns that according to preliminary CAG estimates, this spectrum largesse to a private customer could have caused the exchequer a loss in excess of Rs. 2 lakh crore. According to the contract with Devas, Antrix would have earned $11 million a year per satellite for 12 years.

By comparison, the presumptive loss incurred in the allocation of 2G spectrum by the DoT, as estimated by the CAG, is Rs 1.76 lakh crore.

Topping the recommendations of the task force is enactment of a law that declares the government of India as beneficiary of all monies, assets and bank accounts held abroad by the Indian nationals without declaring the same to the Indian authorities.

Such nationals be allowed to reclaim the assets by proving with evidence before an impartial tribunal that the assets held outside India are acquired by them by proper means and the non-declaration is merely a technical offence.

The task force said such an asset restoration provision will shift onus of proof on the person who has held undeclared wealth abroad and the government will not face the charge of expropriating the assets without the due process under the law.

A solution to Parliament stalemate may be in sight with Mukherjee, Congress' key troubleshooter, meeting the Opposition parties.

Sources told CNN-IBN that the Finance Minister said is the meeting that no price was bigger than running Parliament.

The unbelieveable sweetness of the deal is Antrix will be responsible for obtaining all necessary government approvals, frequency clearance and funding for satellite.

Not just that, Antrix will lease to Devas Additional Sattelite capacity above and beyond PS2 satellite, and Antrix takes all the risk, insuring PS1 satellite and& also provide re-launch vehicle service for the PS1.
