Asad Umar presents amended finance bill for 2018-2019 - Our Correspondent

ISLAMABAD: Finance Minister Asad Umar on Tuesday presented an amended finance bill for the year 2018-2019 on the floor of the National Assembly.

Addressing fellow parliamentarians, Umar said that the country is engulfed in a severe economic crisis, emphasising that the deficit can reach a mark of 7.2% if present conditions prevailed.

“Rupee depreciation has hit the common man most,” he added.
Umar stressed upon the importance of pulling the country out of its debt burden and said that it is the new government’s top priority.

Asad Umar rejects concessions for former Sindh governor

He warned the import cover at present is less than two months, which may build pressure on the rupee.

There was a loss of Rs450 billion in the power sector in one year, Umar informed the Lower House. This loss can climb to Rs2.9 trillion if not curbed.

He asked for recommendations from fellow parliamentarians and assured that they will be deliberated upon.

“Increasing employment, enhancing economic stability and supporting imports are our top priority. Circular debt has reached Rs1,200 billion. We will have to make tough decisions to cope with the current financial conditions.”

The finance chief also said pensions will increase by 10%.

“Foreign loans have risen from Rs60 billion to Rs95 billion.”
Lamenting the current foreign debt, Umar explained that when the rupee depreciates, the gas rates also fall simultaneously.

“It’s the time to take decisions.”

Recounting current hurdles the government has to face, Umar said that all steel mills have been shut and all loans of the national flag carrier have to be paid by the federation.

Umar said, “Improvement will not come from merely going to the IMF but it will come when there is employment, improvement in the agriculture sector and increase in exports.”

He said they had to take a lot of measures to improve governance, electricity and gas issues.

“But for everything to take effect, it will take time, and time is something we don’t have. Hence we have to take emergency measures.”

The minister also said, “We have increased the burden on affluent people.”

Highlights of the revised Finance Bill

• Rs6-7 billion subsidy has been announced to protect farmers

• Rs4.5 billion is being released to construct 8,276 homes

• The minimum pension is being increased by at least 10%

• The export industry is being given a relief of Rs5 billion in regulatory duty

• A subsidy of Rs44 billion is being given to support textile industry

• Banking transactions other than cash by non-filers to be taxed at a higher 0.6% withholding tax

• Taxes on tobacco products have been increased

• High-end cell phones will have a duty imposed on them

• Cars above 1800cc will have 20% duties imposed on them

• The tax exemption limit that had been increased from Rs400,000 to Rs1.2 million rupee is being maintained

Not a unipolar world: Closeness with China ‘recipe for confrontation' - Arsalan Altaf

ISLAMABAD: With Washington growing increasingly wary of the influence exerted by Beijing and Moscow, Islamabad’s recent tacit shift towards its northeastern neighbour’s ‘iron friendship’ embodied by a multi-billion dollar project could, in fact, be pitting it in the centre of another global conflict.

This was suggested by the former foreign secretary and Pakistan’s former ambassador to the US Aizaz Ahmad Chaudhry while speaking at a two-day international conference on ‘Global Peace amidst War and Conflict’, which opened on Monday.

Chaudhry said that the world was changing at a rapid pace, pushed by the emergence of some eccentric personalities in the foreign policy theatre and with it, statecraft.

Army chief arrives in China on three-day visit

“Uni-polarity is fading away and we are moving towards a more disorderly world,” he remarked while chairing a session on geopolitics and transforming statecraft.

With the United States terming China and Russia as its major security concern ahead of terrorism, Pakistan’s strong ties with China was ‘a recipe for confrontation’ at some point.

On Afghanistan, the ambassador said talks and dialogues were the only way forward, as espoused in the brief ceasefire during Eidul Fitr.

“A negotiated way out is the only way forward. I do not think there is a military solution to Afghanistan,” he remarked.

Pravin Sawhney, who edits and publishes the Force magazine in India, said that New Delhi was faced with a strategic dilemma between a fading superpower and an emerging one which was right at its doorstep: whether to strengthen its ties with the US by developing naval interoperability or to abide by the April 2018 Wuhan understanding reached with China on regional connectivity and cooperation.

He said India could only become a geostrategic power if it made peace with China and Pakistan, two of its neighbours with whom it has territorial issues.

“I believe the key to India’s rise rests with it making peace with Pakistan. The rest will follow,” Sawnhey added.

He acknowledged that the army and the new government in Pakistan were on the same page in reaching out to India and proposing talks on all issues.

“It is high time both the countries sit across the table to discuss Kashmir,” Sawhney said, noting that Pakistan’s military was matched with India’s, at least at the operational level.

“They were matched before the nuclear tests and remain matched till today,” he said.

To a question, Sawhney said with the multi-billion dollar China-Pakistan Economic Corridor (CPEC) seeing an influx of hundreds of Chinese into Pakistan for work, the possibility of Chinese casualties arising out of any potential India-Pakistan conflict was a far greater source of deterrence for India today than nuclear weapons.

Marvin Weinbaum, who is a director for Pakistan Studies at the Middle East Institute in the US, said that diplomacy was the prime instrument for resolving global and regional issues such as the Afghan conflict, Kashmir issue, and China-India border dispute.

“The need for diplomatic efforts is nowhere more pressing than in Afghanistan where instability threatens the entire region,” Weinbaum stressed.

Former ambassador Ali Sarwar Naqvi said the foremost challenge confronting Pakistan was to put its own house in order, sustaining achievements in countering terrorism, and improving the economy.

“Pakistan finds itself adrift in an environment of challenges. We have faced such challenges in the past and I am confident we can meet them now as well,” he said.

LAHORE – Pakistan International Airlines (PIA) air hostess mysteriously disappeared in Canada’s city Toronto on last Thursday. According to PIA spokesperson, national flag carrier’s air hostess Fareeha Mukhtar boarded the PIA flight PK-789 from Lahore but as soon as it landed in Toronto’s Pearson International Airport, the crew member disappeared mysteriously and never boarded the return flight.Mukhtar was supposed to return to Lahore on PIA’s PK-782 flight on the very day but never boarded the plane despite leaving for the same with her colleagues.
“A missing report has been lodged with the Canadian police and an investigation is underway regarding the air hostess’ disappearance,” the spokesperson added.The airline has issued a show-cause notice in her name and is planning to initiate a disciplinary action against Fareeha Mukhtar, added the spokesperson.
It is pertinent here to mention that Fareeha Mukhtar was suspended in 2015 over her involvement in phone smuggling.The officials had also barred her from international flights.
When will the sorry saga of this decrepit airline end ! Pilots- not sober - trying to get on board and endangering the lives of passengers, luckily UK authorities were alert and caught him .
Stewards and air hostesses caught smuggling contraband from UK (phones ) in order to support their families "back home" .
Stale food served to passengers.
Pilots sleeping in first class cabins and leaving the cockpit in charge of novice assistants .
And now this ! Am pretty sure that she has a "solid network" of Paki Ayeshas and Abduls- who may be her relatives and friends - in Toronto, ready to help her keep in hiding and violate Canadian Immigration Law ( I am "assuming" here that she is not a victim of "foul play" !). Obviously, her family in La-Whore ( or wherever else in Pakiland ) may be knowing more about this ! Remain tuned ! The story is not yet over :twisted:

Govt’s apathy causing animal deaths at Islamabad zoo :roll:

Earlier it was reported that an elephant Kaavan suffered from isolation, mental illness, and was physically beaten by zoo employees.
An online petition to shut down the zoo has been filed by the body care2, where 117,249 have signed to support the cause up till now. The animal rights activists are demanding a proper set up of the zoo located in the capital.
Not sure if "Human Rights" "Minister", Madame Jalebi ( AKA Shireen Mazari) is also responsible "Minister" For Animal ( And Bird !) Rights as well :twisted:

Has Imran Khan delivered an inswinger at Pakistan military?

NEW DELHI: Recently sworn-in prime minister said Pakistan would grant citizenship to all Afghan and Bangladeshi refugees born in the country.

Pakistan is home to over 1.39 million UNHCR-registered Afghan refugees and more than 200,000 ethnic Bangladeshis, including many Rohingya. UN surveys suggest that around 60% of Afghan refugees were either born in Pakistan or were minors when their parents migrated to Pakistan.

This is a marked departure from the country’s previous stand wherein it saw the refugees as unwelcome and has consistently pushed Afghanistan for repatriation. In fact, only a day earlier, Khan’s foreign minister had "underlined the need for dignified, sustainable repatriation of Afghan refugees to their homeland through a gradual and time-bound plan”.

Pakistan military, which has been fighting Pakistan Taliban - comprising Afghan natives - has been particularly against giving rights to the refugees. Human Rights Watch reports that the security establishment’s harassment of Afghan refugees had spiked since the Pak Taliban’s attack on Peshawar's Army Public School in 2014 that killed more than 140 - many children of soldiers.

Thus, Khan’s announcement in Karachi came as a surprise to many. Has the military changed its stance or has PM Khan truly become politician Khan, for there is a political play here. Citizenship to Afghans could benefit Khan’s PTI, as many of them are Pashtuns, and Pashtuns in Pakistan had supported PTI.

By embracing Bangladeshis and Afghans, Khan also gets to project himself above other Islamic parties in the assembly, many of whom have their own “vote banks”; granting the refugees citizenship would help Khan's claim as the leader of all.

Malaysia's Axiata scraps $940 million Pakistan deal after regulatory issues
A unit of Malaysian telecoms firm Axiata Group (AXIA.KL) has called off a $940 million deal to buy 13,000 telecoms towers in Pakistan after regulators there failed to provide all approvals for the transaction announced a year ago.
Axiata subsidiary edotco Group Sdn Bhd said in a statement on Monday that it will not proceed with the purchase of Deodar, a unit of Pakistan Mobile Communications Ltd (PMCL) that owns the towers.
“The patience ran out with the bearish sentiment toward emerging markets. A decision had to be taken”

Sarfraz miffed by skewed Asia Cup scheduling
Sarfraz Ahmed, the Pakistan captain, hasn't taken the Asia Cup scheduling too kindly, given it will leave his team travelling back and forth from Abu Dhabi to Dubai for the Super Four stage of the Asia Cup. This will also be the case for Afghanistan and Bangladesh, while India have been exempted from the 90-minute trip.
However, a late tweak has been made by the organisers to ensure India will continue to be based in Dubai, irrespective of where they finish in the pool.

"Naya Pakistan" Gets Tough With Income Tax Non - Filers !

FBR bans buying and registration of local and imported vehicles for non-filers

ISLAMABAD – Federal Board of Revenue (FBR) has imposed a ban on the purchase of four-wheel vehicles, regardless of engine capacity for income tax non-filers.A new section 227C has been added to the Income Tax Ordinance through Finance Act, 2018 to increase the number of filers. The FBR clarified that all motor vehicles regardless of their engine capacity would fall within the newly incorporate section 227C of the ordinance. According to the new section, non-filers will not be allowed to book, register or purchase a new locally manufactured motor vehicle or first register an imported vehicle.The facility will only granted to those who are tax filers and appear on the Active Taxpayers List (ATL).Moreover, any motor vehicle registration authority or auto manufacturer will not accommodate income tax non-filers. However, the ban does not imply on purchasing motorcycles and rickshaws.
Previously, when this ban was announced in budget 2018-19, the public raised objection over it, and later in July 2018, the government gave non-filers a relaxation to buy or import cars under 1000cc.
As they say. Where there is a will, there is a way . Some options :
- Greasing the palm ( AKA baksheesh !) works in most of the cases
- High enough sifarash - may make the official think twice about rejecting the application ( "Bajwa is my nephew") ( " I am Imran's third cousin !)
- The benami option is always available. Ganja Sharif is a good example . Ownership of the the London Apts are not traced to him yet. !

like his announcement of Islamic Farewell State, and Abdullah Haroon's announcement of a "larger than Kuwait" oil find in Balochistan !

The NA speaker invited the European Union to join China-Pakistan Economic Corridor.

Governor Madina-tul-Munawwara Prince Faisal Bin Salman received the Prime Minister on the airport.
The Prime Minister will pay his respects at Roza-e-Rasool ( PBUH grave -for the uninitiated !) and perform Umra.( a must in Saudia !)

Eternally sick, tired and exhausted of all that ‘is’, the change-Seekers wanna escape from ‘here and now’. Dreaming of a land where ‘things that are not’ are ‘in abundance’ they turn a blind eye and decide not to pay any heed to slight signs of ‘same old, same old’ that are everywhere and for everyone to see.

People in general, PTI voters in particular and specifically the tigers ( or cricketers !) of Imran Khan demand that the government of PTI be treated ‘differently’ than the last one by us journos and muckrakers.
Lest we forget, days in power, PM Khan invited and asked the ace anchors to give his government three months before bombing it with criticism. Demanding exceptionalism dominates the mindset of PTI supremo and its followers. They don’t want to be treated like their predecessors. They want to do what they want to do while we journos take long, long naps. Now, read the above lines again and answer these few queries: What do we journos get paid for? Did any one of those who visited said okay and applied for a three month leave without pay since he won’t be able to do his job-to point out the lags and mistakes of those in power? Does PM Khan know that in the hierarchy of society, we the journos are placed one notch above the courtesan ( second oldest profession :roll: ) and one step below a thief?
The present dilemma of PTI reminds me of an encounter I had few years back. I visited a good friend of my father, an intelligent, accomplished government officer. The man hailed from a humble background, made it big in the world ( Ishaq Dar :roll: ) because he studied and worked hard, landed himself in a good government job, and climbed up the ladder.
After initial ice breaking, he asked me what I plan to do in life. I told him that I am still figuring it out. ‘You see,’ he said in a very dramatic tone. ‘There are only two kinds of people, young man those who sit on my side of table and those who sit on the other side. You are like my son, you are educated and intelligent. I want to see you on my side of table. This side has authority, power to make things change, and most importantly once here you’ll enjoy the best things in life without much struggle,’ he said.
Imran Khan and company have in the past been on ‘this’ side of the table. They opposed sans thought, protested sans deliberation, and yelled at top of their voice at each and every deed of their opponents in power. Now that they are on ‘that’ side of the table. Now that they have power, they’ll know how dice rolls and how unmanageable things actually are.
The Kaptaan had a poor attendance record in the NA !
We may get done with past, dear reader, it never gets done with us. Back in his ‘un-powerful’ days IK left no stones unturned to discredit his foes. Combining guts and sheer wanton, he cursed the body he presently holds sway on. Strange yet befitting of Khan, who has boycotted an entire election in 2008 and sat in protest in front of the present one for good 120 days, he now has what he had been striving for precisely because of Parliament.
A quote can sum PM IK: ‘Do I contradict myself? Very well, then, I contradict myself; I am large — I contain multitudes’. No, dearest sirs and ma’ams, Imran Khan didn’t say this. Wazir objected to the aforementioned ad campaign after Finance Minister Asad Umar’s budget speech in Parliament House.Federal Minister for Defence Pervez Khattak held the same opinion as of the PTM leader and issued an apology for the advertisement.
“This advertisement is akin to provoking the people,” Khattak said. “[We have] asked the Punjab government to immediately stop this advertisement.”
Minister of State for Interior Shehryar Afridi also held the same stance adding that “targeting a particular community flares tempers, and we oppose all such measures”.Mohsin Dawar, another PTM MNA, however, said that “the apology should come from the government of Punjab”.
Dawar is right ! I would go further and put Imran (a so-called Pashtoon) on the hot seat and ask HIM to apologize !
On September 15, Information Minister Fawad Chaudhry had claimed that the ad in question was already off air.“This advertisement was immediately taken off as soon it was brought to our attention,” he said on Twitter. “It was aired hardly a few times before channels were directed not to air such advertisement. I urge people not to circulate this rejected version.”
In the eyes of the Pakjabi dominated GOP, none except the Pakjabis are considered as "Pak" . All others ( Sindhis, Mohajirs, Balochis and Pashtuns ) plus the minorities ( Ahmedis, Hindus, Christians, Budhists and Parsis ) are considered Na-Pak !

Prime Minister Imran Khan arrived in Saudi Arabia on Tuesday on his first official visit as the prime minister. After his plane landed in Madina, the prime minister, in an apparent show of respect for the holy land, was seen coming out of the plane wearing only socks on his feet.
Imran has gone "sufi-istic" under the influence of his Third Wife - The Peerni - who follows the Barelvi Line of Malsi ( like Khadim Rizvi of TLP !)
Foreign Minister Shah Mehmood Qureshi, Finance Minister Asad Umar, Information Minister Fawad Chaudhry and Adviser to PM on Commerce Abdul Razak Dawood, who are also part of the visiting delegation, were all seen walking with their shoes on.
Even the Saudi officials receiving the prime minister, which also included Madina’s governor, were all wearing shoes.
The Saudis are strict Wahabis , followers of Abdul Wahab a 19th century "religious leader" , while the Barelvis believe in Sufi-ism, which also integrates many strains of Hindu-ism ( including visiting Dargahs bare foot !)
It is pertinent to mention here that PM Khan had walked barefooted the last time he had arrived in Madina with his wife Bushra Imran, before the general elections 2018.
Moreover, PM Khan boarded a VVIP plane for the tour, contrary to austerity claims made earlier that the prime minister will not use special planes for foreign tours.

Lahore High Court has enforced stricter measure to ban underage driving. The decision was the outcome of a petition filed by a citizen in the court. Court’s decision of 13th September 2018 said that in case of violation, parents will be the ones to be punished.

The case was heard by Justice Ali Akbar Qureshi on Wednesday. He remarked that underage children are not allowed to drive any vehicle, be it a car, motorbike or rickshaw and held parents responsible for the potential non-compliance. He said that if any violation is reported, the parents or guardians will be punished and sent behind the bars.
Is he just making it up to show " his "authority" in this matter or is he citing legal precedent and /or Pakistan Criminal Code and/or Sharia and/or Hadith and /or fatwa. :mrgreen:
Traffic Police authorities have been given directions regarding the implementation. Chief traffic officer has conveyed the directions to the personnel in the department and has given orders for strict action without any kind of discrimination.On first violation by an individual, parents will be required to come to the police station to sign an affidavit for taking responsibility of ensuring a second violation does not occur. They will be sent to jail on second violation of the ban.Like the rest of the world, Pakistan has its regulations regarding the minimum age limit to acquire a driving license. The implementation hasn’t been strict in our country and it has been violated openly so far. The prescribed age limit to acquire a learner’s permit to drive is 18 years.
The decision by Lahore High Court is in the interest of the people of Punjab. It is imperative that other provincial High Courts in the country also take such measures for the greater good of the people of our country. :((
Like everything else in Pakistan, implementation of the "directive" depends on many factors :
- forget about "affidavit" on 1st violation ( leave aside jail on the second violation !) if the underage boy or girl is the son, daughter , father, mother, cousin , nephew , uncle, aunt, even a servant of a General, Brigadier (or even a mere Captain in the Paki Fauj ) or a Minister, Deputy Minister in the Paki Govt !!!. We are referring to the sifarish factor here !
- If the judge/ magistrate is not honest ( as is the case with "most" judges and magistrates ) the law will not be implemented

With due respect to Justice Saqib Nisar, the Chief Justice of Pakistan, it seems to me that of late he has not been exercising the self-restraint expected of a judge of a superior court, and particularly of the chief justice of the apex court of a country.
Good to know that Katju is concerned about the "health" of CJP Nisar :mrgreen:
Justice Nisar seems to be obsessed with the idea of constructing dams in Pakistan to alleviate the problem of water shortage in the country, so much so that it seems to have become a bee in his bonnet.
Does Katju know that CJP Saquib has threatened legal action against Anti- Dam agitators :roll:
There is an unwritten code of conduct for judges that a judge should only speak through his or her judgments and generally exercise restraint. But Justice Nisar, in his zeal for getting dams constructed, has not only advocated this goal in his orders and utterances in court, he has also been propagating it on TV channels and in public meetings. He said on several occasions that the Kalabagh Dam guarantees the survival and security of Pakistan. He has favoured building the Diamer-Bhasha and Mohmand dams, and has ordered an account opened in banks to collect donations. He applauded eunuchs for donating Rs 2 lakh for this purpose, and has ordered that bad debts be recovered and the money used to build dams.
Paki Pakjabis- like Nisar - are known for their "robustness" :mrgreen:
Not content with this, he has gone further and issued threats, saying that anyone who hinders the construction of dams will be tried under Article 6 of Pakistan’s constitution as a traitor and enemy of the country. He has given a ‘last warning’ to those who criticised the Supreme Court of Pakistan for collecting donations to construct dams and said that “no matter how high he is we will take him to task”. Strange language coming from the chief justice of a country.
Katju is pushing the "dam envelope" too far IMHO :mrgreen:
Article 6 of Pakistan’s constitution says that anyone who abrogates, subverts, suspends or holds in abeyance the constitution, or attempts to do so, by use of force or show of force or by any other unconstitutional means, shall be guilty of high treason.
This provision was directed against army generals like Pervez Musharraf who staged a coup d’état and abrogated/suspended the constitution. How can it be used against persons who oppose the construction of dams? Will someone become a traitor if she says that building dams is not the correct way for solving the water shortage problem and that there are other ways ?
No doubt judges in Pakistan too are concerned about the water shortage in the country and they can ask the executive to find ways and means of resolving the problem. But it is not open to judges to themselves dictate how to resolve the water shortage, since that can only be done by technical experts. Possibly there may be other ways to solve the problem.
As Justice A.S. Anand, a former Chief Justice of India, once said, the judiciary can act as an alarm bell to ensure that the executive becomes alive to its duties, but it cannot perform those duties itself.
Obviously, CJP Saquib has too much on his (legal) plate right now. And it is nice to know that fellow judge Katsu is "concerned" about him . Why not "invite" Nisar to India for a bit of R&R ( Imran will be in Dubai for his "own R&R" in two days !) :mrgreen:

Prime Minister Imran Khan has appointed his close aide Zulfiqar Hussain Bukhari, aka Zulfi Bukhari, as his special assistant on overseas Pakistanis and human resource development, the Pakistan Tehreek-i-Insaf (PTI) announced. He will have the status of a minister of state in his role as special assistant.
"The Prime Minister has been pleased to appoint, with effect from [Sept 14, 2018], Sayed Zulfiqar Abbas Bukhari as Special Assistant to the Prime Minister on Overseas Pakistanis and Human Resource Development, with the status of minister of state," read a notification issued by the cabinet division.
With each passing day, the Kaptaan is "dusting up his old rolodex" and calling up favours owed to him , from his "oat sowing days" in Bartania :mrgreen:
Bukhari is a close aide to the prime minister and was in charge of the PTI chairman's campaign in NA-53 for the July 25 elections. A dual British-Pakistani national, his name was placed on the Exit Control List (ECL) by the interior ministry in August on a request of the National Accountability Bureau (NAB).
Now, Imran is PM, so that issue will be forgotten . Talk about "nepotism" during Ganja's reign :mrgreen:
He is accused of owning off-shore companies in the British Virgin Islands and owning assets beyond his known source of income, sources in NAB had earlier told Dawn.
The accusations against him get serious after each paragraph !
Bukhari had come into the limelight earlier this year when he was stopped by the Federal Investigation Agency (FIA) at Nur Khan Airbase while accompanying Khan to Saudi Arabia because his name was on the interior ministry's blacklist. However, the ministry allowed him to travel abroad minutes later.
Imran had nothing to do with this :mrgreen:
Upon his return, Bukhari filed a petition before the Islamabad High Court seeking the removal of his name from the blacklist. The court accepted his petition and ordered removal of his name from the blacklist.
Again do not blame Imran for the "ordered removal" :mrgreen:
A week later, the court was informed by the interior ministry that Bukhari was placed on the blacklist as a precautionary measure in response to a request from NAB to include his name on the ECL, because the subcommittee tasked with approving the inclusion of names in the ECL was dysfunctional at the time the request was sent.
The IHC subsequently allowed the interior ministry to proceed with NAB's request to place Bukhari on the ECL.
So, there is some sort of a "hidden tug of war" between the Isoo High Court and the "dreaded" NAB :mrgreen:
The induction of Bukhari into the federal cabinet takes its strength to 29. Out of the total, eight cabinet members belong to coalition parties.
Left unsaid in all of this is the apparent violation of the so-called dual nationality rules of Pakiland . Much was said about the same , a couple of months ago. Lists were prepared , names of violators were identified and the Ganja Regime was roasted over the coals . Now, that a New Badshah is in town , and he is also a favourite ladla of the fauj, all this is now conveniently forgotten. Is there any mai-ka-laal who dare challenge the Kaptaan on this .

PS: The above "gentleman" Bukhari is not the only yaar of the Kaptaan, who has been taken care off . There is this Aneel Mussarrat - another Brit Paki ( he has some "dushman" connections as well !) who has been allowed to "sit" at the Kaptaan's power table :mrgreen:

I don't think the Germans are that stupid, they are probably making the best of a hardship posting by doing useless stuff that costs them nothing but panders to and massages the Paki delusions and ego, while keeping the barbarians out when it comes to real stuff like visas.

ISLAMABAD: Former president and Pakistan Peoples Party co-chairman Asif Ali Zardari on Tuesday filed a review petition in the Supreme Court, challenging its Aug 29 order in the National Reconciliation Ordinance (NRO) case in which the court had sought details of his and those of assassinated former prime minister Benazir Bhutto’s foreign assets.Terming the seeking of details of Ms Bhutto’s assets disrespect to a martyr, Mr Zardari argued in the petition that such details had nothing to do with the case and that it was out of context and against his fundamental rights.
Doubt that this "defense strategy" will work . AAZ knows that he is now cornered by the Deep State !
A three-judge SC bench headed by Chief Justice of Pakistan Mian Saqib Nisar ( so the Pakjabi Saquib is involved here as well !) which is seized with a petition filed by the Lawyers Foundation for Justice president Feroz Shah Gilani asked Mr Zardari in the Aug 29 order to submit an affidavit highlighting details of foreign assets and bank accounts, including Swiss accounts, belonging to him, his slain wife, children (Bilawal, Bakhtawar and Aseefa Bhutto-Zardari) and other dependants.
Mr Gilani’s petition seeks recovery of public amount allegedly wasted against the backdrop of the NRO in 2007. He nominated :roll: Mr Zardari, former president retired Gen Pervez Musharraf and former attorney general Malik Abdul Qayyum as respondents in the case.
Moved by senior counsel Farooq H. Naek, the review petition argued that the Aug 29 order had erroneously shifted the burden of proof to Mr Zardari, asking him to prove his innocence. This is something that Mr Zardari has done time and again and even he has been acquitted multiple times on merit.
Also Mr. Zardari had to flee Pakiland a couple of times to escape the "wrath" of the Paki Fauj by his "reckless statements" against them :mrgreen:
The actual burden of proof, the review petition argues, remains on the party which has brought the case before the court. The Aug 29 order prime facie aimed at seeking to gather information which would somehow incriminate Mr Zardari, it added. This is against the spirit of Article 13 of the Constitution which provides protection against double punishment.
IMO, the screws are tightening slowly and surely against AAZ. Just like Ganja . But this "guy" is much much more "resourceful" than Nawaz !
The Aug 29 order has also failed to take into account the practical difficulties that would occur in attempting to gather information required to be furnished in the affidavit sought under the order.The record is likely to have been shredded and no longer available, especially when it comes to old property documents and details of their sale and purchase price, it says.
Thus, the petition of Mr Gilani does not fall within the purview of Article 184(3) of the constitution, the review petition says, adding the Aug 29 order is asking for the details for a period spanning over a decade. Even under income tax law the limitation prescribed for assessments by Section 121 of the Income Tax Ordinance 2001 is five years and anything before the same is exempt from assessment.Moreover, under Section 60 of the Election Act 2017, a candidate is only to furnish a statement of his assets and liabilities for the preceding year whereas under the Aug 29 order the affidavit to be supplied covers the period from Oct 5, 2007 till date, which is unheard of.Even under the election law a candidate is only supposed to furnish details of his spouse and dependent children whereas the order seeks details of the children who were not dependant, the review petition says.

The government has deep problems to fix. Less than 1 percent of the nation’s 200 million people file tax returns, foreign-currency reserves have plunged by a third this year to below $10 billion, the current-account deficit stands at more than 5 percent of GDP and the rupee is down 12 percent against the dollar this year.

With a funding gap of more than $12 billion, the austerity measures announced so far are limited, and Khan’s spending will remain under scrutiny.“There will be checks on him,” said Umbreen Javaid, the chairwoman of the political science department at Punjab University in Lahore. “Khan is going to have a very tough time.”

IHC orders release of Nawaz Sharif, Maryam and Captain Safdar, suspends Avenfield reference conviction

ISLAMABAD – The Islamabad High Court has suspended the conviction of former premier Nawaz Sharif, his daughter Maryam Nawaz and son-in-law Captain (retd) Safdar in the Avenfield reference.
The IHC announced its much-awaited verdict on a slew of petitions filed by the Sharif family against their conviction in the Avenfield reference, on Wednesday and ordered the accused to submit surety bonds worth Rs 0.5 million each.
A two-member bench of the IHC comprising Mian Gul Hassan Aurangzeb and Justice Athar Minallah heard the case with the latter announcing the verdict, much to the relief of former ruling family.
The Pakistan Muslim League Nawaz loyalists bowed down in gratitude before Allah Almighty as soon as Justice Athar Minallah suspended the conviction of Sharifs in the short verdict in packed courtroom no. 3.
The august court accepted the appeals filed by the former ruling family and consequently the accused would no more be incarcerated till the court announces the final verdict on the appeals.Soon after the landmark verdict, Pakistan Muslim League Nawaz President, Shehbaz Sharif took to Twitter and quoted a verse from the Holy Quran as an expression.
The two-member bench remarked that according to the investigations, the ownership of London flats is difficult to be attributed to former premier Nawaz Sharif.

The NAB prosecutor argued that there was no proof regarding the transfer of 12m AED adding that till 2012, Maryam Nawaz was the beneficial owner of the said properties.Akram Qureshi argued that Maryam Nawaz acted as a facilitator in making assets beyond means.
Provide any evidence substantiating ownership of London flats by Nawaz Sharif,’ observed Justice Athar in point-blank remarks.The NAB prosecutor asserted that to conceal the ownership of London flats, a fake trust deed was forged by Maryam Nawaz to save her father.‘Nawaz Sharif is difficult to be traced in the case,’ remarked Justice Athar Minallah and wondered if the trust deed was bogus, how could the sentence be handed out to the accused.
The NAB prosecutor continued that the onus of proof rests with the accused as they should establish ownership of the pricey flats. On the issue of Qatari prince, the NAB official highlighted that the Qatari royal was contacted more than once for recording the statement.‘Qatari prince was even allowed to record his statement in his homeland if he was reluctant to visit Pakistan,’ added the NAB official. Akram Qureshi inquired that the august court would ask each and every question from him? To this, the court replied that the NAB prosecutor had failed to provide any evidence, substantiating Nawaz Sharif’s link with the Avenfield apartments.
Khawaja Haris should also be quizzed, Sir!,’ pleaded the NAB prosecutor. Justice Minallah replied that Khawaja Haris was also quizzed earlier and he was being asked questions to clarify some issues. Justice Minallah remarked that the supreme court had asked the Sharif family to produce a money trail, which they failed to do so.‘They [Sharif] argue that they did not transfer money from Pakistan,’ said the NAB Prosecutor.
The court questioned whether Maryam Nawaz assisted Nawaz Sharif in the purchase of London flats.
The NAB prosecutor argued that Jati Umra is the address of Maryam Nawaz adding that Maryam Nawaz admitted being dependent on Nawaz Sharif in his statement.‘Maryam also owns Nescoll and Nielson firms,’ claimed the NAB prosecutor.When Justice Minallah inquired from the NAB prosecutor that according to them, Maryam’s grandfather had no business entity outside Pakistan, the prosecutor replied that the business entities were looked after by Tariq Shafi.
‘It is not available on record that Tariq Shafi had any association with Mian Muhammad Sharif,’ added the NAB official.
The court wondered whether Gulf Steel Mills still exists to which the NAB prosecutor replied in the affirmative.On the issue of Calibri font, Justice Minallah observed that the said font existed at that time, but was not available on a commercial level.Justice Mina Gul Hassan ‘supposed’ that even if the trust deed was forged, how could Maryam be sentenced on assets beyond means.
‘Can any sort of sentence be handed out on the basis of assumptions,’ asked Justice Minallah.
According to the directives by the supreme court, NAb should have conducted a comprehensive inquiry into the case.‘Where are the documents regarding the source of income of the Sharif family,’ asked the court.Justice Mianallah asked the NAB official that according to him, the onus of proof does not rest with the anti-corruption body as the properties in question were based outside Pakistan.Akram Qureshi replied in the affirmative to which Justice Gul Hassan inquired whether such practice was opted in any case related to a public representative.
‘Hakim Ali Zardari and Ahmed Riaz Sheikh were prosecuted in the same manner’ replied the NAB official. Upon this, Justice Athar Minallah asked that the bench was inquiring about any prime minister or president.‘Whether NAB can impose a sentence on any individual for providing bogus documents,’ asked the court.Upon this, the NAB official replied that NAB can convict any individual for acting as a facilitator.
During the last hearing of the case, Justice Athar Minallah remarked it was assumed that the upscale London properties were in possession of children of Nawaz Sharif, with him being the actual owner. At the onset of the hearing, Justice Athar Minallah remarked that the second verdict in the Panama Papers case was a binding on all the judges as it bears signatures of all, however, the interim order was not of a binding nature.Upon this, the NAB prosecutor replied that the second verdict was a continuity of the first one.Justice Aurangzeb observed that in the first order, Nawaz Sharif was not disqualified and it was a minority judgment.
‘It is not a case of trivial importance, it goes beyond the transfer of money and extends to a network of companies,’ replied the NAB official.Qureshi continued that the completion of inquiry in the case in such a short time was not possible and so the commentary of the august court on the matter would not be appropriate.‘Children are usually dependent on the parents, Sharif’s children were in possession of London flats,’ NAb prosecutor argued and added that father is the natural guardian of kids and owns the land and consequently the onus of ownership rests with the owner.
Long story short. Ganja has long been convicted in the court of public opionion ! In court of law, he has been set free, because the prosecutors did not do their proper homework :mrgreen:

ISLAMABAD – Pakistan Tehreek-e-Insaf (PTI) leader, Senator Faisal Javed said the conviction of the Sharif family stands and the Islamabad High Court’s (IHC) verdict was a suspension of their sentences.“The conviction stands and they remain criminals. Their destination remains Adiala,” Javed cleared.
Time for the Kaptaan to cut short his visit to Saudia and sort out this "messy matter" :mrgreen:
