Gujral was one of the greatest Pappi Jhappi Foreign policy advocates. He was of the firm belief that a few hugs at high places and others would gush and all would be hunky dory. Pappi Jhappi FP topper Indian PMs would be: 1. Nehru 2. Gujral. 3. MMS. Though MMS competes hard with Gujral. Gujral at least once growled at UK after a kick. IG/RG had some character spunk as far as FP went. Though it didn't go far enough. But i wouldn't call them the Pappi Jhappi crowd. They showed some mettle. IMO ABV was more of a Pappi Jhappi than these 2(IG and RG).

^ Jassu is producing some small fart soundbites that Modi should be less aggressive towards the Paki's..when NM has hardly touched upon his Paki policy. Just like Jassu Bhai told Officials to park their vehicles a mile away from the South Block Offices, NM would do well to keep Jassu atleast 5 km away at all times from South Block.

This is the "Nice Guy" syndrome and manifests itself in many ways. A common way is the intense need to be recognized and validated by others. Nehru, Gujral and MMS suffer from this disease. I think IG and RG were much better off. When one craves validation from another person, they lose power and cede the position of strength to the other party. I think MMS craves a Nobel.

NaMo doesn't care what goras think of him. He just does what he thinks is right. Big difference from our previous PMs.

Former Gujarat DGP RB Srikunmar, known for his association with social activist Teesta Setalvad for raising issues related riots and encounters against Gujarat Government had alleged master-minded to the conspiracy brand a patriotic scientist Nambi Narayanan as a traitor and fabricated a case against him. Despite his heinous crimes affecting nation’s interest, most of the charges against him were dropped against him by UPA government.

During 1994, Srikumar was Deputy Director, SIB in Trivandrum and was entrusted the investigation in the ISRO espionage case. Srikumar not only branded Narayanan as traitor but also ill-treated him including physical torture and his remaining of jail for nearly 50 days.

In 1999, Government of India initiated disciplinary proceedings against the IPS officer and was served a chargesheet that include physically taking over the possession of the accused persons from the lawful custody of Kerala Police without completing legal formalities and conducted independent investigation disassociating the Kerala Police.

Srikumar was charged that he didn’t prepare written statement of interrogation in respect of two persons interrogated by the team, one of them being Narayanan. Besides, the interrogation statements were prepared by his team they were left unsigned and undated.

He failed to conduct verification about the veracity of the statements of the accused persons as recorded by the team of IB officers without assigning any reasons, which resulted in irreparable loss and humiliation to respectable scientists of ISRO and others, according to chargesheet.

Mathew John, Joint Director, IB (senior of RBS) sent a message stating that disclosures made by the accused persons were a mixture of truth, half truth and untruth. Thus, Srikumar was fully aware of the fact that investigation report prepared by his team was full of contradictions and statements of many accused did not match each other. Despite this, RBS did not conduct verifications of the disclosures made by the accused persons.

Narayanan, an Indian scientist of repute started his career way back in 1966 with Indian Space Research Organization (ISRO), during the tenure of Dr. Vikram Sarabhai was heading ISRO. It was Sarabhai who sent him to Princeton University for further studies. Narayan, who completed his Ph.D, got attractive offers that include one from NASA, but he preferred to work for his country and adhered with ISRO.

It was Narayanan who introduced the Liquid Fuel Rocket Technology in India in early 1970, when former President of India A.P.J Abdul Kalam was scientist and his team was working on Solid Motors. His contribution in the Polar Satellite Launch Vehicle (PSLV) that took Chandrayan-1 to the moon in 2008 was immense. Naturally the above facts suggest that Narayanan was one of the top scientists of India and was never enticed by the lucrative offers. Unfortunately, the fallout of the ISRO spy case led to a brilliant Rocket scientist losing his entire career and in the process, the nation suffered immensely.

It all started in 1994, when a Maldivian woman, Mariam Rasheeda, an alleged spy was arrested in October that year by Kerala Police. On Rasheeda’s ‘Confession’, K Chandrasekharan, an agent for the Russian Space Agency Glavkomos in India was arrested later on. Soon after a team of police arrested Dr. Nambi Narayan and another Maldivian woman, Fauzia Hassan, allegedly Raheeda’s handler.

In November 1994, then Congress (UDF) government in Kerala formed a special probe team headed by DIG Siby Mathews. A week after another ISRO scientist D. Sasikumaran was arrested from Ahmedabad, where he was posted. In the connection of this case, Police arrersted a Banglore based labour contractor S.K. Sharma.

In December 1994, the case was handed over to CBI. The official of central investigation agency questioned senior IPS official Raman Srivastava. The issue also became political as A.K. Antony started attacking his rival K. Karunakaran who was the then Kerala Chief Minister. In March 1995 K. Karunakaran was forced to quit as a Chief Minister over his refusal to suspend Srivastava. Antony took over as CM. Two months later CBI submitted closure report in a special court in Kochi.

By that time in June assembly elections came and Congress (UDF) lost elections; CPM-led LDF Government came to power. The new Government withdrew the consent given to the CBI to probe the case and decided on a reinvestigation by the State Police. In December 1995 Kerala High Court allowed the reinvestigation, which CBI challenged in the Apex Court. Supreme Court quashed the Kerala Government’s order to reinvestigate saying the move was against good governance. All accused were freed of the charges. Meanwhile Hassan and Rasheeda were released from jail.

In the year 2001National Human Rights Commission (NHRC) ordered an interim compensation of Rs. 10 lakh for Nambi Narayanan who sought Rs. 1 crore as damages. Kerala Government got a stay order on NHRC’s order. Nambi Narayanan moved a Division Bench of the High Court. In September 2012, Division Bench of the High Court vacated the stay and asked the Government to pay interim relief to Nambi Narayanan within three weeks. The Bench said the NHRC could continue the proceedings for the final hearing.

Interestingly by 2004 it was clear that ISRO spy case was a fabricated case done at the behest of individuals and enteritis inimical to the success of ISRO and India. Another thing was the many man who was single-handedly responsible for the fabrication of this case was none other than Srikumar.

However, things changed dramatically in the second half of 2004 when the UPA Government came to power.In an obvious quid pro quo, Srikumar was given a clean chit. On 13th December, 2004, MHA issued an order dropping 7 out of the 9 charges without even conducting any enquiry whatsoever. It is amazing as to how charges were dropped even without a written response & on oral submissions without even recording them in writing. In just about one month’s time, the entire process of appointing the presenting officer, enquiry officer, conducting and completing the enquiry, preparing and submitting the enquiry report, consideration of the enquiry report at various levels, and issuing the final order dropping the charges against Srikumar was completed. As a part of the quid pro-quo, RBS was expected to launch a tirade full of lies and untruths against the BJP Government in Gujarat for political reasons. Apparently, Srikumar was honored his part of the deal with his political suitors and he continues to do the same even today.

Intrestinly R.B. Sreekumar, in conversation with Rais Khan, ex aid of Teesta Setalvad, on 4.11.2010 admitted that “Teesta helped me when Charge sheet was given to me.”

The article should have mentioned that Mr Nambi Narayanan was India’s foremost authority and expert on Cry o genic engine technology. Today we are still struggling to develop it for use on Geo-Stationary Satellelite Launch Vehicle GSLV type rockets which unfortunately have not met with much success. Other countries (you know which) have successfully managed to throw a spanner in our progress. Other countries framed our scientist and our sensationalist (so called “free”) media eagerly publicized the matter and defamed the guy and thus literally forced us into relieving him and depriving the nation of his expertise.

Yeh! and this is a "Jhalak" of dirty Congressi mind. From Sanjeev Bhatt, Kuldeep Sharma to SriKumar, find corrupt officers implicated in various charges, offer them a deal to fix opposition leaders who could threaten dynasty.

Meanwhile, i doubt this press coference would have ever happened had D4 were in charge at Delhi.

with the advent of NaMo - attacks on termite queen and her brood has increased. MMS has been on backseat. mainly the dynasty is facing the brunt. In fact Indians have been informed in excellent way thru speeches and SM. One of the many layers that have been ripped of the mukhota of dynasty is this.MMS is just a palin old bureaucrat doing the bidding of termite queen.
Now many Indians think of sonia as mother of all scams. her mask has been ripped for all times depsite all the msm and congis protest.

NaMo has changed the whole contour of the elections- IOW he has stripped congis naked. they dont have any leaf to cover themselves.
He is a one man army demolishing the myth of aura of dynasty.


Overall it is good in the long run for India irrespective of the NaMo and his bid for PM ship.

NEW DELHI: In a startling decision which has ramifications for sensitive cases, the Gauhati high court has ruled that the Central Bureau of Investigation (CBI) was legally not a police force and stripped it of its powers to investigate crimes, arrest suspects and file charge-sheets.

The ministry of home affairs (MHA) had, by a resolution dated April 1, 1963, constituted the CBI as a police force under the Delhi Special Police Establishment (DSPE) Act, 1946. The CBI had drawn its powers to investigate cases from the DSPE Act.

A division bench of the high court comprising Justice IA Ansari and Justice Indira Shah on Wednesday upheld the constitutional validity of DSPE Act but held that "the CBI is neither an organ nor a part of the DSPE and the CBI cannot be treated as a 'police force' constituted under the DSPE Act".

Unless this ruling is reviewed and amended by a higher court, the CBI will not function as a police force and will be unable to proceed further — in fact, not even file FIRs — in high-profile cases like Coalgate, 2G spectrum scam and those related to the Gujarat riots. In these cases, the CBI was directed by the Supreme Court to investigate and report to it.

Once the cover of the law under DSPE Act is taken away, the very existence of the CBI comes to naught. A worried Centre is preparing to rush to the SC on Friday to appeal against the HC judgment.

"We hereby also set aside and quash the impugned (under challenge) resolution dated April 1, 1963, whereby the CBI has been constituted," the HC said.

Interestingly, the HC also limited the application of DSPE Act to Union Territories. This means, even if a new police force was set up validly as per the HC's logic, its power to investigate crimes would remain confined to the UTs.

The bench said, "A careful reading of the preamble to the DSPE Act, 1946, would make it evident that the DSPE Act, 1946, has been made for the Union Territories. This legislative power cannot be exercised by Parliament except under Article 246(4) of the Constitution, which enables Parliament to enact laws on subjects covered by List-II (State List), in respect of Union Territories."

Chargesheets invalid

Allowing a writ petition filed by one Navendra Kumar, the bench quashed the chargesheet filed against him by the CBI but said the alleged offence could be investigated afresh by the regular state police. As a triggering effect, this judgment would render all chargesheets filed by the CBI till date invalid.

The HC had on January 20 this year directed the CBI to produce records relating to the creation of the agency. After scrutinizing these, the HC said that the 1963 MHA Resolution creating the CBI under the DSPE Act did not even receive the President's assent.

"Hence, strictly speaking, the resolution in question cannot even be termed as the decision of the Government of India. That apart, it is apparent from the records that the CBI is a newly constituted body and not the same as DSPE," said Justice Ansari, who authored the judgment on behalf of the bench.

The HC went through the 1963 resolution minutely and relied on Constituent Assembly debates on the role of the force to be created through legislation under Entry 8 of Union List.

It said, "The central government had set up altogether a new body known as CBI by the impugned Resolution... Admittedly, at that time, no legislation was made to set up the CBI and the source of power being traced to Entry 8 of Part-I (Union List), which reads 'Central Bureau of Intelligence and Investigation'."

The HC said: "The word 'investigation'; was, therefore, according to the Constituent Assembly debates, intended to cover general 'enquiry' for the purpose of finding out what was going on and this 'investigation', which amounts to a mere 'enquiry', is not an 'investigation' preparatory to the filing of charge-sheet against an offender, for, such an 'investigation' can be carried on only by a police officer, under the Criminal Procedure Code, and none else".

"This apart, it is the state legislature, which is entitled to constitute a 'police force' for the purpose of conducting 'investigation' into crime," it said.

"From the above discussion, which took place in the Constituent Assembly, it becomes crystal clear that Parliament cannot, by taking resort to Entry 8 of List-I (Union List), make any law empowering a police officer to make 'investigation' in the same manner as is done, under the Criminal Procedure Code, by a police officer while conducting an 'investigation' into an offence for the purpose of bringing to book an offender," it said.

'CBI probe under statutory rules'

What the sc had said on CBI In Vineet Narain Judgment delivered on December 18, 1997:

"In 1994 due to increased workload relating to bank frauds and economic offences a separate Economic Offences Wing was established in CBI with the result that since then the CBI has three investigation divisions, namely, anti-corruption division, special crimes division and economic offences division."

"We are informed that almost all the state governments have given concurrence for extension of the jurisdiction of the Delhi Special Police Establishment in their States with the exception of only a few. The result is that for all practical purposes, the jurisdiction in respect of all such offences is exercised in the consenting states only by the CBI and not by the state police. This is the significance of the role of the CBI in such matters and, therefore, technically the additional jurisdiction under the general law of the state police in these matters is of no practical relevance."

"Once the CBI is empowered to investigate an offence generally by its specification under Section 3, the process of investigation, including its initiation, is to be governed by the statutory provision which provide for the initiation and manner of investigation the offence. This is not an area which can be included within the meaning of "superintendence" in section 4(1)."

"It is, therefore, the notification made by the central government under Section 3 which confers and determines the jurisdiction of the CBI to investigate an offence; and once that jurisdiction is attracted by virtue of the notification under Section 3, the actual investigation to be governed by the statutory provisions under the general law applicable to such investigation. This appears to us the proper construction of section 4(1) in the context, and it is in harmony with the scheme of the act, and section 3 in particular."

Given the ruling, NaMo and BJP should go whole hog and say that this is to stop all investigations into scam. In fact they should be rooting for CBI and actually take the initiative and table an ordinance that brings back CBI with few changes :-).

If Sonia/CongIs disproves, they are not interested in investigating scams.

If Sonia/CongIs approves, the CBI has returned in a non-parrot avatar.

Wow so even Teesta has some part in aiding anti-national elements who take part in subverting strategic programs. Why isn't this story gaining more traction in the MSM or SM? NGO's have become a very powerful force in this country. I agree that this may be BJP's attempt to preempt something.

you missed the biggest one, morarji desai. who promptly informed pak of the name of our agents who were then equally promptly eliminated.

btw, JS didn't say about modi what the headline said, some editor made that up.

Teesta had one of her NGO schools publish a map purportedly drawn by a secondary school kid which had a severely truncated India being dominated by a monstrous Pakistan. There was a poster Amit or some handle like that who was supporting the idea which I in my previous avatar (I was not banned but left in disgust after one highly regarded webmaster made an ad hominem totally disregarding the forum rules which he is supposed to have upheld) questioned without any answer from that poster. May be if she is reading the forum I would love to hear supporting arguments.

US says ready to work with Modi if he becomes PM, blames media for visa row

"We will work with the leader of the world's largest democracy. There is no question about that," a senior US official said on Thursday when asked about the prospects of working with an Indian government led by Bharatiya Janata Party's PM nominee Narendra Modi.

Dismissing visa as a non-issue, the official said it was largely a creation of the Indian media and not at all an issue in the US government.

"Visa issue is a media creation. He has to apply and we will review. He (Modi) has not applied (for a visa)," said the official, who spoke on the condition of anonymity.

daniel craig will one day do a great job on vladimir putin autobiographical film. saw him yesterday in a film about 3 bielski brothers who formed a partisan group in belarus during ww2 "defiance". there were red army partisans in the area also, as in ukraine.

This was almost 8-9 years ago and this Paki Bacca claiming to be IM was disutributing this Sabrangi map without K in Azadi Mela. As far as i remember, coupe of us offered him refreshment :lol: but he decided to go back Home to his dad. :wink:
