Police Report on Kasargod Riots Annoys IUML

KOZHIKODE: By terming the recent riots at Kanhangad as communal, the police have reportedly displeased the Indian Union Muslim League (IUML) leadership. The party’s Kasargod district committee has been putting pressure on the police officials to dilute the incident by withdrawing Section 153(A) of IPC from the cases charged against the accused in the riots and label the cases as political, sources said.
The IUML leaders have already approached Chief Minister Oommen Chandy in this regard and two IUML MLAs of Kasargod have been putting pressure on the officials to defuse the issue. Sources maintained that IUML was the only party which expressed protest against charging Section 153(A) in Kanhangad riots while the CPM, Congress and the BJP vouched for strong action against the guilty.
It was the stringent action taken by the police during the riots that evoked a strong resentment among the IUML leaders. Realising the communal angle in the riots, police took as many as 130 cases on non-bailable charges under Section 153 (A) (Promoting enmity on grounds of religion, race, place of birth, residence, language and doing acts prejudicial to maintenance of harmony). Of around 780 accused, the police have arrested nearly 200 till now.
Besides, Kannur Range DIG S Sreejith submitted a report to the DGP saying that an analysis of cases in the last 10 years has revealed that the ‘branding of conflicts with communal angle as mere political issues at the behest of political parties has proved counter productive’. The report said that the entire coastal belt of Kasargod was highly vulnerable to communal riots and it proposed the setting up of special control room and special patrolling units in Kasargod to gather intelligence and prevent riots of communal nature.
In fact, a detailed analysis of the list of cases during the last 10 years corroborates the DIG’s observations in the report. As many as 1,113 cases have been registered in the district during the period where the complainant belongs to one community and all the accused belong to another community. However, the number of cases registered under Section 153(A) and other relevant sections are just below 300. Most importantly, none of the accused has been convicted in the last 10 years in all the 1,113 cases. Of the 11,444 accused, only 4,833 have been arrested, which clearly shows that the other 6,611 are at large, unfettered and poised to spread communal violence.
While 427 cases have been charge sheeted, around 65 cases were withdrawn during the period. The total number of policemen in the district is only around 1,400.
When contacted, IUML Kasargod district general secretary M C Khamaruddin stuck to the party’s stand and alleged that it was the police who were creating the problems. “It’s the police who are branding the issues as communal. Police officials are behaving like they have some aversion towards the IUML workers. Though mosques were attacked during
Kanhangad riots, not even a single temple was attacked. However, police charged cases under section 153 (A) only against IUML workers. Even purely communal attacks made by other party were not registered under the section,” he said.
However, DIG Sreejith, in his report, made it clear that ‘politicisation of cases and intense parleying at the behest of political parties have in turn encouraged riotous behaviour and it’s high time that the glaring communal problems be addressed correctly rather than shrouding those cases under political clouds.”

Having lived in M'lore in the 80's it was clear the orthodox Islamists were present very much in KA. In fact in KL those days one could rarely spot anyone in a purdah. I would guess that northern KL is getting infiltrated from Southern KA by such elements. I have not been to M'lore so would not know the ground situation now. But the pro-pakistan elements were strong in M'lore. Despite the fact that our immediate neighbors were enlightened Muslims and there were many others like them, but orthodox still on many counts. The KA-KL difference was quite glaring in the 80's for one community. New Delhi: A car belonging to the Israeli embassy was gutted after it suddenly exploded in the VVIP area of Delhi on Monday. A female diplomat is said to be among the four injured.
The Innova SUV car, bearing diplomatic number 109 CD 35, went up in flames after it exploded near a petrol pump, metres away from 7 Race Course Road – PM’s residence. Another car in the vicinity was also damaged.
The injured from the embassy was identified as 42-year-old Tayi Yehosh. She is among the four injured in today’s blast.
The blast occurred at 3.16 pm at a busy traffic intersection on Aurangazeb Road after an unidentified motorcyclist stuck a magnetic device to the rear of the Toyota Innova vehicle.
The first major targeting of an Israeli official in the Capital came hours after police defused a bomb targeting an Israeli embassy car in Tbilisi, capital of a former Soviet republic, coinciding with the fourth anniversary of Hezbullah commander Imad Mughniyeh.
Delhi Police Commissioner BK Gupta did not want to hazard a guess on whether it was a terror attack and maintained it was definitely a device targeting the embassy Toyota Innova vehicle.
He said, “According to an eye witness a motorcycle-born person attached something to the rear of the SUV belonging to the embassy. There was a mild explosion after which the car burst into flames. The case will be investigated by special cell of the Delhi Police.”
Meanwhile the Ministry of Home Affairs while confirming the bomb attack said, “At 3.20 pm today the Israeli embassy SUV was targeted.” “Initial reports suggest that a foreign substance was attached to the rear of the vehicle,” the Union Home Secretary added.
While condemning attack in Delhi today, External Affairs Minister SM Krishna said, “Have spoken to the Israeli foreign minister Avigdor Lieberman and have assured them that the law of the land will take its due course,” he said. “India very strongly condemns such incidents. The culprits will be brought to justice at the earliest. We will keep the embassy posted of the all developments,” he added.
Nonetheless, the Israeli Prime Minister Benjamin Netanyahu straightaway blamed Iran and its Lebanese protege Hezbollah. Netanyahu also said Israel had thwarted similar attacks in recent months in Azerbaijan and Thailand.
Addressing lawmakers of his Likud Party, Benjamin Netanyahu said, "In all those cases, the elements behind these attacks were Iran and its protégé Hezbollah." He warned that such incidents would not be tolerated and that Israel would get back at the perpetrators of the crime.
Speaking to a TV channel, Alon Ushpiz, Israeli Ambassador to India too spoke in the same language, “We are all aware of the statements coming from the Israeli PM. This is not a co-incidence. Iran is going after the Israeli people on daily basis.” Nonetheless he assured that they felt ‘very secure’ in India and that they had ‘full confidence’ in the Indian authorities.
Security near the Israeli embassy and its consulate in Mumbai and missions of Western countries was tightened following the car bomb attack.
The blast created a flutter among security agencies including elite SPG guarding the Prime Minister. A high alert was immediately sounded and the entire area has been cordoned off.
The Centre has ordered tightening of security of diplomatic missions, especially of Israel, US and other Western countries, across the country.

In the past four years alone, the Home Ministry has rejected at least 42 requests to sanction the prosecution of military personnel found by the police to have engaged in crimes such as murder, homicide and rape in Kashmir, data obtained by The Hindu reveal.
Last week, two Supreme Court judges said the Armed Forces (Special Powers) Act (AFSPA) — which makes the Central government's sanction mandatory for prosecution — ought not to cover cases in which crimes such as murder or rape were committed. “You go to a place in exercise of AFSPA, you commit rape, you commit murder, then where is the question of sanction?” Justices B.S. Chauhan and Swatanter Kumar said.
Thirty-one of the cases in which sanction was denied relate to rape, culpable homicide or murder. The others involve a wide variety of crimes, ranging from criminal trespass to illegal confinement. In not a single case, The Hindu found, had sanction been granted.
India is one of the few countries that is continuing to do business with Iran, defying US + EU sanctions. Delhi Police and security agencies suspect the role of Lebanese and Palestinian nationals in the well rehearsed and pin-point terror strike.
The person who executed the task with clinical precision was military trained because handling of the ‘Sticky Bomb’ requires expertise. It involves speed, precision and simultaneous activation of the bomb by a remote device. Delhi Police Commissioner BK Gupta on Tuesday clarified that no timer had been recovered from the debris of the bomb from the blast site. He has also not ruled out the possibility of a second person being involved in activating the bomb with a remote device.
Delhi Police Commissioner said that they were treating the incident as a terror attack, until proven otherwise. Those who carried out the attack were following the movements of their target for quite some time. Segregating the target by identifying the particular vehicle could not have been possible without detailed reconnaissance.
Investigators are amazed at the accuracy of the operatives though the result was not spectacular. They chose a vehicle that was not fitted with any jamming device and those behind the attack were aware that once the Diplomat’s car passed the Aurangzeb Road crossing, it would enter the Prime Minister House security zone and jammers would be in place and that could scuttle their plan. The attacker chose to target the Innova car after it slowed down to pass the crossing. And also the attacker knew that the woman Diplomat would be coming out of the embassy at a particular time to collect her children from the American school, the sources said.
Agencies are trying to figure out the nature of explosives that were used in the bomb. Experts are of the opinion that it was a sophisticated incendiary device that was used for the first time for any terror attack in India and that was a major cause of concern. There is a very strong possibility that a RDX or nitrate-based compound was used in the bomb. It was a low intensity blast as the fuel tank of the car did not explode.
Agencies say that the records of all the entry ports of the country were being scrutinised to zero-in on the individuals belonging to countries in conflict with Israel. Hizbollah is based in Lebanon and its agents are known to be highly trained in guerilla warfare. Israel Prime Minister Benjamin Netanyahu had termed Hizbollah as a proxy of Iran on Monday while reacting to the terror attack on the car of the Israeli Embassy. Agencies are scanning the immigration records of the Foreigners Regional Registration Office (FRRO) of Delhi, Mumbai and Southern States to identify the Iranians, Lebanese and Palestinians who had entered India during last few months. “We have not got any evidence against Iran so far. The target of attack was the Israeli nation,” the Police chief Gupta said.

In a related development the Director of National Investigating Agency (NIA) SC Sinha visited Tughlaq Road Police Station on Tuesday to inspect the damaged Innova car.
Was the red motorcyclist a red herring?Footage from some 30 closed circuit television cameras (CCTV) installed in the high-security zone in New Delhi show the Israeli embassy Toyota Innova before it was destroyed in a targeted attack on Monday. But there is no recording of a man on a red motorcycle who an eyewitness claims stuck a magnetic bomb on the vehicle and sped away.
“We can see the Innova car but not any motorcycle near it,” a senior police officer said.
Police said they have recovered magnetic strips from the mangled remains of the Innova and the bomb was probably not more than the size of a “palmtop” or a “brick”.
The attack on the busy Aurangzeb Road in broad daylight injured four persons, among them Israeli diplomat Tal Yehoshua-Koren.
“The bomb cannot be stuck on a moving vehicle. It has to be stationary. The bomb exploded 5-7 seconds after it was stuck. The traffic signal was red at the time of the explosion. After sticking the bomb, the motorcyclist removed one of the bollards (plastic dividers) on the road and fled,” Police Commissioner B K Gupta said.
Another police officer said they were probing whether the bomb was stuck on the Innova at Khan Market or near the embassy.
“The woman diplomat had come to the embassy in the morning but the Innova remained parked outside. She emerged in just 20 minutes. The car did not go inside. She then went to Khan Market around 1 pm from where she left at 2 pm. There is a high possibility that the bomb was planted at Khan Market or near the embassy,” the officer said.
Police sources said they examined footage from CCTV cameras outside the house of DLF chief K P Singh, Claridges Hotel and Khan Market but did not notice any motorcyclist of the description provided by the witness.
“We have asked for CCTV footage for the past 7-8 days from the Israeli embassy. We sought footage from the Canadian embassy as it was also close to the incident spot,” Gupta said.
He said Indian security agencies were seeking information from Georgia, where a similar attack was averted on Monday, and Thailand where bombs exploded today.
All police stations in Delhi have been asked to report any abandoned “red motorcycle”.
Five persons on red motorcycles were stopped on Monday night but let off later. Another person who was captured by a CCTV outside the Israeli embassy presented himself before investigators. A courier boy too was stopped by police and questioned.
After the attack, a witness told police that a man wearing a brown jacket and riding a red motorcycle stuck the bomb on the Innova and sped away. There was an explosion seconds later.
Police said the bomb was a combination of explosives and gel and had the capacity to blow up a truck. Fire spread rapidly inside the Innova, helped by an aerosol can on the back seat. But the fuel tank did not catch fire.
Two men, who were in an Indica behind the Innova and were injured in the explosion, told police that they did not see any motorcyclist. “I did not see any motorcyclist near the car,” Manjeet Singh said.
The key witness seemed to be an individual who was driving a bit behind the vehicle which was blasted. He too had suffered minor injuries. Gurgaon: In a surprise departure from norms, investigators of the NSG post-blast study team were not allowed to gather vital data of the terror-struck and burnt Israeli embassy SUV citing "diplomatic reasons".
NSG's National Bomb Data Centre (NBDC) is the central nodal agency for monitoring, recording and analysing all bombing incidents in the country and it acts as the vital repository of all domain knowledge in this regard.
