Jaitley not the only BJP leader victim of call snooping

The snooping row surrounding Bharatiya Janata Party leader Arun Jaitley appears set to explode into a bigger controversy after the main conspirator reportedly claimed that attempts were made to access the call detail records of over 60 persons, including that of top BJP leaders.

As per reports, private detective Anurag Singh attempted to extract CDRs of over 60 persons including Nitin Gadkari, Vijay Goyal, Lalit Modi, and Sudhanshu Mittal.

Mittal, while confirming that he was in touch with Anurag Singh, told a news channel, "We have been victimised. Our CDRs have been accessed."

Anurag Singh was remanded in judicial custody by a Delhi court on Feb 26. He was earlier accused of tapping the phone of former Samajwadi Party leader Amar Singh in 2005.

The other three accused -- constable Arvind Dabas, Neeraj and Nitish -- are also in judicial custody.

This is a government of spies like James Bond and when any government functions in a mafia style then the people of this country does not forgive it. This is a serious crime," said BJP spokesperson Mukhtar Abbas Naqvi.

However, Water Resources Minister Harish Rawat on Friday termed the attempt to tap phones of BJP leaders as an internal operation of the BJP.

"According to information this phone tapping of BJP leaders is their internal operation. A part of their personal tussle," Harish Rawat said.

Sadhvi Pragya Singh Thakur, an undertrial in the 2008 Malegaon blast case, was allegedly attacked by a Nigerian inmate in Byculla jail on Tuesday. According to Sadhvi's lawyer Navin Chomal, the Nigerian inmate had been mentally harassing her for a while.

On Tuesday, the Nigerian inmate stripped and was making lewd gestures at her. When the Sadhvi protested, the inmate launched an attack on her.

"The Nigerian woman who is imprisoned in the barrack adjacent to Sadhvi's, has been mentally harassing my client," alleged Chomal.

He added that the inmate provoked the Sadhvi on several occasions. "They used to strip in front of Sadhvi to provoke her. On Tuesday, when the Nigerian woman repeated her indecent gesture, Sadhvi protested. They attacked her in return. Luckily, my client managed to escape to her barrack. Rita Jaiswal, one of her close inmates, was injured in the attack." Sources revealed that Sadhvi was shifted to another cell after the attack.

Chomal has now made an application before the MCOCA court for an investigation of the incident. "Instead of transferring the Nigerian woman to another cell, they have isolated Sadhvi," he complained.

Sadhvi was arrested by the Maharashtra Anti-Terrorism Squad (ATS) on October 10, 2008 for her role in orchestrating the 2008 Malegaon bomb blast. On the other hand, the Anti-Narcotics Cell arrested the Nigerian national for drug trafficking.

The other side - Inspector General of prisons Surendra Kumar denied the incident had taken place saying, "All the allegations are baseless. I met Sadhvi today."

History - Sadhvi was arrested in connection with the Malegaon blast, which killed seven in the communally-sensitive textile town in Nasik district on September 29, 2008. A probe had revealed that some right-wing Hindu groups orchestrated the blast.

Double decker train on trial run stoned

The maiden trial run of the brand new double-decker train between Chennai and Bangalore witnessed a rather unpleasant welcome, with miscreants damaging its glass window by pelting stones, in Vaniyambadi on Sunday.

However, the occupants, all senior Railway officials, were not injured in the incident, which was reported around noon.

According to Railway sources, miscreants pelted stones on the train when it was passing through Vaniyambadi in Vellore district.

“The stones landed on a compartment occupied by Railway officials who were part of the inspection team. A glass window was damaged, but none was injured,” an official source said.

However, the train continued its journey towards Bangalore, halting in a couple of stations. The train is expected to return to Jolarpet junction on Sunday night and proceed to Chennai the next day, completing the first trial run on Monday.

The trial run was conducted with 11 passenger coaches, of which two were occupied by Railway officials.

Recently, the Southern Railway received the coaches to commence the operation of double-decker train services from Chennai to Bangalore, as per the announcement in the Railway budget last year. “This stretch is prone to stone-pelting incidents. Safety of passengers is at stake,” a Railway official observed.

Puttur notary, advocate and Dakshina Kannada district Congress minority unit chief secretary Nooruddin Salmar has been remanded in judicial custody for allegedly assisting in the conversion of a Hindu girl from Ankatadka, Paltady and helping his friends take her to Kerala.

Nooruddin was caught when he was trying to help Mohammed Althaf, the second accused in the case, to reportedly escape in his car. The Kasargod police arrested them near Perla. The prime accused in the case is Aziz, a poultry trader from Ankatadka.

The girl, a resident of Paltady, had left from her home on February 19 and escaped to Bellary. Aziz is said to have given the girl Rs 10,000 and asked her to convert to Islam. She was then taken to Kasargod by accused Rahiman, Mansoor and auto driver Manoj, and from there to Ponnani by train.

The girl then called Puttur rural police and informed them that she was in Ponnani. The girl's father filed a complaint in Puttur rural police station on February 21. It is said that Aziz and the girl had an affair, and after the family's intervention, it was decided that Aziz and the girl would not meet or talk to each other anymore.

Meanwhile, based on the information obtained on tracking the phone number the girl had called from, the Puttur rural police led by SI Jagadish Reddy under the direction of DySP Sadananda Warnekar left for Ponnani and brought the girl back. On the basis of her statement, the police filed complaints against Aziz, Rahiman, Mohammed Althaf, Mansoor and Manoj.

Though Nooruddin was only accused of helping the accused escape, investigations later revealed that he was the mastermind behind the plan to convert the girl, said DySP Sadananda.

Accused Aziz, Althaf and Nooruddin were taken for medical examination and produced in Puttur court. Puttur lawyers' association filed a bail plea for Nooruddin's release. B Narasimha Prasad and Mahesh Kaje argued on his behalf and said that Nooruddin should be granted interim bail as he was an advocate of the Puttur court.

Assistant public prosecutor C Thammana expressed a strong objection to the bail plea. He said interim bail can be granted to old people, patients and women but in this case interim bail cannot be granted to the accused.

Justice Venkatesh Nayak who upheld the decision of the public prosecutor, denied the bail and remanded the accused in judicial custody for 14 days. Along with Nooruddin, the court also awarded judicial custody to Azeez and Mohammed Althaf.

A few people objected to the photographers who were clicking pictures of the accused. Meanwhile police officials intervened and dispersed the crowd. Strong security was deployed in the court premises under the guidance of M Sudarshan, Puttur town police inspector and K Suresh Kumar, rural police circle inspector.

Controversial Uttar Pradesh Minister Raghuraj Pratap Singh alias Raja Bhaiya was on Sunday booked for an alleged conspiracy to kill a senior police officer, Deputy Superintendent of Police Zia-ul-Haque .

The slain police man's wife had filed a police complaint, accusing Raja Bhaiya and his men of killing her husband. She alleged the minister was harassing the police officer as he was investigating a recent communal clash in Pratapgarh. Raja Bhaiya is a Cabinet Minister in the Akhilesh Yadav government and holds the Food and Civil Supplies portfolio.

Last month, he was divested of the prison department in a reshuffle. The minister has criminal cases against him. Zia-ul-Haque was among the two persons killed in Ballipur village of Pratapgarh district on Saturday during clashes that followed the murder of a village head.

Amidst a veil of secrecy and tight security, Sadhvi Pragya Singh Thakur attended her father’s funeral on Monday and promptly set off for jail in Bhopal. The Special Judge (NIA) Bhopal, Vijay Kumar Pandey, on March 3, 2013, gave special permission to Sadhvi Pragya to attend her father’s funeral on March 4, and ordered her to return to jail on March 5.

Bail is normally granted to undertrials and even convicts to attend family funerals and weddings. In fact, on October 19, 2012, Chief Justice of India Altamas Kabir headed the Bench that granted bail to journalist Syed Mohammad Ahmed Kazmi who was arrested on March 6, 2012 for alleged involvement in the Israeli diplomat car attack case, on grounds that bail is a right.

Advocate Ganesh Sovani on Sunday, March 3, 2013, submitted an application for grant of interim bail so that she could attend the funeral on March 4, and observe the 13-day mourning period with her family. As it was a holiday, he contacted special public prosecutor Rohini Salian and requested her presence before the Special MCOC & NIA judge on Monday, March 4. But during the hearing, Salian sought two days time to get instructions from NIA higher-ups in Delhi to respond to her interim bail plea. The Special National Investigating Agency (NIA) and Maharashtra Control of Organised Crime Act (MCOCA) Court will now hear the interim bail plea to enable the Sadhvi to observe the remaining mourning period with her family only on March 6.

It bears recalling that a benevolent Indian judiciary permitted Italian marines Massimiliano Latorre and Salvatore Girone to fly home for Christmas last December despite being arrested for the murder of two Indian fishermen off Alapuzha coast on February 15, 2012.

But different standards have always been applied in the case of Sadhvi Pragya, who has been denied bail persistently for five years despite suffering from cancer. More pertinently, Sadhvi Pragya has been languishing in jail despite the police or intelligence agencies failing to frame charges against her in the 2008 Malegaon blasts. When she developed cancer in jail and experienced ill-treatment in custody, she informed the Registrar (Judicial), Mumbai High Court, in January 2013 that she would not take medical treatment for her malady unless released on bail. Despite the poignancy of the situation, the National Investigation Agency again opposed Sadhvi Pragya’s bail application in February 2013; it offered to get her admitted to Tata Memorial Hospital in Mumbai, which she declined.

Now, despite the death of her father, the judiciary does not seem inclined to give her bail, hence the surreptitious permission to attend the cremation ceremony.

Despite the complete absence of any evidence – primary, circumstantial, corroborative, forensic, or even contrived through facilities like brain-mapping and lie detector tests during prolonged police custody – the myth was assiduously maintained with help from an obliging media which reported all leaks as gospel truth and a judiciary that refused bail and gave the Maharashtra Anti-Terror Squad excessive leeway in its fishing expedition.

There have, of course, been stories galore, such as alleged ‘eyewitnesses’ who ‘heard’ both sides of a conversation between principal accused Ramji Kalsagre and Pragya Singh Thakur, wherein Ramji told Pragya her motorcycle was used in the Malegaon blasts and assured her that it would not be traced to her.

Then, Ajay Eknath Rahirkar was said to have financed the conspiracy, and had coordinated with Jagdish Chintamani Mhatre and Rakesh Dattaram Dhawade to purchase arms. But since no guns were used in the attack, citizens can only wonder at the quality of our investigating agencies.

The flip side is that even the investigating officers find it difficult to keep track of their ‘stories’. Hence, the sleazy photographs of women, once ‘found’ on the computer of Varanasi sanyasi Dayanand Pande, have quietly disappeared.

Curiously, as an aside, it is interesting to notice that, on the one hand, the government and its supporters argue that declines in violence are the result of the ‘success’ of ‘policies’ and ‘strategies’ (neither of which appear to have been defined in any distinctive terms, or to have been implemented on any measurable parameters); on the other, at the first sign of trouble – the Hyderabad blasts, for instance – they insist that it is necessary to create the National Counter Terrorism Centre (NCTC) if terrorism has to be fought successfully.

But if recent improvements in trends are the consequences of ‘good policies and strategies’ – obviously implemented by existing institutions – the NCTC is, evidently, not necessary. On the other hand, if the NCTC is, indeed, necessary, then the declines in terrorist violence would need to be attributed, not to any great strategic coherence or operational effectiveness, but to extraneous factors for which the government cannot claim credit.

Various institutional innovations, prominently including the Multi Agency Centre (MAC) and the Joint Task Force on Intelligence (JTFI) in the IB, and the Crime and Criminal Tracking Network and Systems (CCTNS), which were to provide the core of augmented CI-CT capabilities, remain mere shells, years after they were sanctioned, with no measurable impact on ground level capabilities of the state.

The arrest of Reaz Qadir Khan, a naturalised American citizen in Portland, Oregon, in connection with t the 2009 suicide attack at the Inter-Services Intelligence headquarters in Lahore that killed 30 people and wounded more than 300 others, is yet another wake up call regarding the security set up in Maldives.

Over the years, both the Lashkar-e-Tayiba and the Al Qaeda have set up strong launchpads in Maldives. These groups have identified the policing problems in the island nation and also the lack of expertise to check slush funds.

The interrogation of Asif Ibrahim, an operative, who was arrested by the Kerala police also confirms the setting up of the Maldives base.

Ibrahim, who is an accused in the 2007 Male Sultan Park blast said that the operational unit for the India-Maldives terror base was based out of Kerala. It is a cycle where in money comes in from the Gulf and then is sent in to Maldives.

He told the House that some plainclothesmen entered the coupe he was travelling in the Vaishali Express and pulled him out of the compartment "like a criminal".

He claimed that some men in uniform came a few minutes later and detained him at Ghaziabad Railway station for more than three hours.

"I was pulled out like a criminal. Even my identity card of Member of Parliament was snatched. Is this the way to treat an MP. I seek your protection," he said.

Adityanath said the incident happened at 7.30 pm last evening and Senior Superintendent of Police, Ghaziabad, informed him at 10.30 pm that he has been held to prevent him from proceeding to Ambedkar Nagar, where a Hindu religious leader was murdered.

New Delhi: Talks between India and Denmark on expediting the extradition of prime accused in Purulia arms drop case Kim Davy to face trial here failed to make any headway on Thursday as the European country asked for a fresh proposal which will be examined by their justice department. "The talks were held in a cordial manner and there was a discussion on extradition of Kim Davy," Union Home Secretary RK Singh told reporters.

However, sources in the delegation said the Indian side expressed their disappointment over sending a fresh proposal and conveyed that this would delay in bringing the accused to justice. It was conveyed that it took nine years for Denmark to decide on the earlier extradition request and the fresh proposal appeared to be a delaying tactics yet again.

The visiting Danish delegation headed by Deputy Permanent Secretary in the Justice Ministry Jens Christian Bulow assured India that any fresh proposal might be expeditiously processed. CBI reiterated its earlier offer asking them to handover Davy to India so that he could stand a trial here and, if sentenced, can serve the prison term in Denmark, the sources said.


The Home Secretary also said there was a provision in the law whereby prisoners can be transferred to their country for serving the prison term. The Indian delegation comprising officials from Home, Law and External Affairs Ministries and CBI was led by Special Secretary (Internal Secretary) in the Home Ministry S Jayaraman.

India has also made an option to try Davy in a special court within the Indian Embassy in Copenhagen. After a Denmark court had turned down the extradition plea and the authorities in Copenhagen refused to go in for appeal, India, in a bid to put pressure, scaled down its diplomatic relations with that country last year.

The case relates to an incident on the night of December 17, 1995, when an AN-26 aircraft dropped arms and ammunition in West Bengal's Purulia district. The consignment had hundreds of AK-47 rifles, pistols, anti-tank grenades, rocket launchers and thousands of rounds of ammunition.

Five Latvians and British national Peter Bleach were arrested in connection with the incident. However, Davy, a Danish citizen, and the prime accused in the case, had managed to escape. Since then, the Indian government has been pressing for his extradition to India with the Danish government.

The extradition order was passed by Danish government on April 9, 2010. However, Davy had approached a local court challenging the order of the Danish government. The court set aside the order.

Thereafter, an appeal of Danish government was also set aside by the High Court in Denmark on the ground that if Davy is extradited to India for prosecution, there would be a real risk that he would be subjected to treatment in violation of article 3 of the European Human Rights Convention.

The arrested Latvian crew members were released from a prison in Kolkata in 2000 after requests from Russian authorities while Bleach was given a presidential pardon in 2004 following requests by British government.

Six months later, on February 25, 2013, I was released. But even before I could get over the police hostilities I had endured, I was told about the the media onslaught during my time in jail. I had been dubbed the "mastermind" of the plot. Some of my former colleagues told me that a senior police officer, who was not even investigating the case, misled journalists that I had joined Deccan Herald with the sole purpose of blowing up the Metro station opposite my office. The media blindly, mindlessly, reproduced his words. Similarly, going by the police's words, the media said "radical literature" was seized from my office computer. That computer had an Urdu poem about Republic Day, written by Sahir Ludhianvi, a Leftist ideologue, who was part of the Progressive Writer's Association.

Honestly, after our arrest, I was prepared for such reportage. That I was called a "mastermind", for example, did not surprise me. But some stories were painfully insensitive. A news channel "broke" the story about my father in Pakistan who "guided" me from there. My father died of a heart attack in 2006. I even have his death certificate. Can you imagine how it feels to deal with such bulls**t? Another news channel said I had Rs 50 crore in my bank. If I had so much money, I would certainly have owned a newspaper.

The way the police and the media reacted to my alleged involvement in the so-called plot has convinced me that there is an institutional bias against Muslims. When you put all the facts together — that I was picked up for simply sharing a room with a suspect, that an Urdu poem on my terminal was interpreted as a fanatical text, that so many other Muslim youths have languished in jails for terror-related cases only to be let off for want of evidence — how can you expect me to feel otherwise?

Throughout my life, I have never been discriminated as a Muslim. I have always believed that Muslims must stop feeling as if they are victims of the system, and must strive towards educating and empowering themselves. But my six months in jail as an educated, empowered Muslim, paints a contrasting picture — that I was discriminated against because I was Muslim. These are two extremities. And though one positive extreme gives me hope, as does my faith in the judiciary and democracy, the other extreme puts me in despair. I am trying to find a middle ground to this dilemma.

People’s Democratic Party chairman Abdul Nasir Maudany on Sunday said the interim bail granted to him by the trial court did not in any way connote a new sunrise in the justice delivery system of Karnataka to him.

He was delivering “khutba” (sermon) at the wedding ceremony of his daughter here. {First of all, he is not on bail. He is on parole until March 13, that is for a few days. One of the parole conditions is not to speak to the media or his supporters. He has blatantly violated both the conditions. His parole must be therefore immediately cancelled}

Detained in a Bangalore prison in connection with a serial bomb blasts case since August 2010, Mr. Maudany was granted interim bail for five days by the trial court to attend the wedding.

Flanked by CPI(M) State secretary Pinarayi Vijayan and Indian Union Muslim League leader E.T. Mohammed Basheer, Mr. Maudany said the bail was granted because of a precedent. There was no alternative for the court as two others detained in the case were earlier granted bail for four days.

“Compared to the agony being endured in the Bangalore prison, the situation for me was thousand times better at the Coimbatore jail.” Mr. Maudany said adding he could not see even a faint ray of justice coming to him from Karnataka.

He said, “Several other innocent persons, some of them very young, falsely implicated and arrested in terror attack cases, who are detained in prisons all over the country, are enduring untold torture and suffering more than me.” His advice to them was not to lose faith in God.
