I know, you are speaking with tongue-in-cheek but stating the obvious: Canada (or Pak for that matter) can't do much ..(apart from, say providing/requesting a consuel in his trial in India after extradition)..but IMO India already has enough lawyers who will be eager to represent him in the name of human rights and secularism. ..Anujan wrote:Fellow is a canadian national. A local court on Thursday granted pardon to David Coleman Headley, one of the main accused in the 26/11 Mumbai terror attacks case, and accepted him as a prosecution witness.
The court agreed to Headley's plea to turn an approver in return for pardon while imposing certain conditions on him.
The sessions court has asked Headley to disclose all information that he had revealed earlier to the US court.
Headley had appeared before the sessions court here through a video link from an undisclosed location in the US.
Pakistani-American David Coleman Headley is neither in Chicago nor in hospital, his lawyer said today, dismissing reports that the prime accused in the 2008 Mumbai terror attack case was battling for his life in the US city after being beaten by inmates at a detention centre.
“Although I cannot disclose his location, he is neither in Chicago nor in a hospital,” John Theis, Headley’s lawyer, told PTI.
Media reports had said that Headley was attacked by two inmates at a Chicago prison on 8 July and that he was admitted to an intensive care unit of a hospital in the city since then.
“I am in regular communication with Mr. Headley. There is no basis for the report in the Indian press,” Theis said.
The reports had said Headley suffered serious injuries and was rushed to North Evanston hospital, where he was admitted to the critical care unit.
“We are not able to locate information about this individual,” the Metropolitan Correctional Center in Chicago said in a brief email response to PTI when asked about the reported prison incident.

- David Coleman Headley is unlikely to come out alive from his prison sentence. (He has cooperated with Indian prosecutors - testified / questioned by Indian authorities in US - and spilled lot of beans regarding ISI, pak etc), He is convicted (or pleaded guilty) for Mumbai terror .. (as well as other offenses).
-Rana who got convicted for other offenses but he was not convicted for serious Mumbai terror case -- this is why he is being extradited to India (after serving 10-15 years in Jail in USA) for these crimes. (He was trying to Plea bargain and trying to avoid extradition but it did not succeed.

The issue is that extradition by and large is an apolitical issue to be settled by the (governments of) two countries.
Since Tahawwur Rana is not an Indian, the Americans would not be bound to send him back here.
While he is a Canadian (citizen) he was prosecuted in the United States. So it is now for the US government and the judiciary to take a call (on Rana's extradition to India) whether he can be sent (back to India to face trial here).
The legal process (related to his extradition and gathering of evidence and filing of chargesheet) has been completed in India.
A supplementary chargesheet can come when he is arrested (after his extradition to India). Then a supplementary chargesheet can come. From our side, the legal processes have been completed for this extradition.
Now whatever documents the higher courts in the US require, when he goes for appeal or the US government requests, then that can be supplied from our side.
Obviously, he has challenged it (his extradition by the Chicago court) and the case now could go all the way up (to the highest judicial body in the US); like major democracies the US judicial system also involves at least two to three layers of appealing.
So it (Rana's extradition to India) is not going to be resolved very soon. It's not such an easy matter. We may wish that it happens fast, but we are not sure that it will happen.
In fact, the main investigations were done against Tahawwur Rana by the Federal Bureau of Investigation (FBI) in the US.
They arrested him almost a year after the 26/11 (terror attacks in Mumbai), after a thorough investigation which neither Headley nor Rana could get away with.
Headley had plea bargained -- whose terms and conditions nobody knows, and which we may never know because nobody discloses that -- but Headley during the FBI investigations clearly implicated Tahawwur Rana.
With the Chicago court clearing his extradition and Rana appealing against it, the case could through at least two more layers of court proceedings for his extradition to go through.
Even if there is a final judicial order for his extradition, the final order has to come from the (US) government.
As Rana is not an Indian citizen, our leverage on the US system -- whether it's their judiciary or the executive -- is very limited in that sense.
The US system has to listen to the Canadians also. A Canadian national cannot be easily deported to India to face trial by Americans. This is the complication.

Bombay HC Rejects Lt Col Purohit’s Plea for Discharge From Malegaon Blast Case

New Delhi: The Bombay high court on Monday rejected an appeal filed by Lieutenant Colonel Prasad Shrikant Purohit seeking discharge in the 2008 Malegaon blast case in which six people were killed and more than 100 were injured.
The court made the caustic remark that causing bomb blast is not official duty, according to LiveLaw.
The Indian Army officer sought discharge on the ground that the prosecution did not take sanction under relevant provisions of the Code of Criminal Procedure (CrPC). A bench of Justices A.S. Gadkari and Prakash Naik rejected his plea, saying that sanction from the Union government was not needed because Purohit was “not on official duty”.
Apart from Purohit, six others – including BJP MP Prgaya Singh Thakur – are facing trial in the case. All the accused are currently out on bail.
On September 29, 2008, a device strapped to a motorcycle exploded near a mosque in Malegaon. The motorbike was registered in Pragya Thakur’s name, according to the investigation. Though the probe was initially conducted by the Maharashtra Anti Terrorism Squad (ATS), it was taken over by the National Investigation Agency (NIA) later.
According to LiveLaw, the chargesheet accuses Purohit and others of wanting to form a government in exile. “They were dissatisfied with the Constitution of India and had wanted to prepare their own constitution,” the chargesheet says, adding that Purohit was responsible for procuring RDX – an explosive chemical – from Kashmir.
Neela Gokhale, representing Purohit, submitted during the hearing that the NIA had said that Purohit had informed his superiors about attending meetings of Abhinav Bharat, an organisation which worked to create a Hindu rashtra. Therefore, the lawyer claimed that he was on duty “collecting intelligence for the Indian Army” by attending the meetings, according to Indian Express.
But advocate Sandesh Patil, appearing for the NIA, said the document that Purohit’s lawyer referred to support his case was the Army officer’s own and not of the agency. Some other documents that were produced by Purohit were from the Army’s Court of Enquiry and are inadmissible in judicial courts.
The NIA’s lawyer denied that Purohit was on duty when he was attending the conspiracy meetings and cannot rely on Section 197 of the CrPC, according to Indian Express.
Patil also submitted that Purohit cannot be discharged as the trial is at an advanced stage – nearly 300 witnesses have been produced so far by NIA in the trial court – and his conviction or acquittal can be decided as per the merits of the case.
He also submitted that an Army official had recently deposed before the trial court that there was no official communication from Purohit informing his superiors about his alleged plans to infiltrate Abhinav Bharat and collect intelligence.
