In the latter case, Dems will gain two senators for ever. GOP wants to claw back that advantage by bifurcating CA maybe vertically. That way they also have more presidential electoral votes on top of senators.
As for the EO on Birthright citizenship issue, Prof. Turley and Dupree were saying that they want this issue to come in front of the SCOTUS just before mid-terms. They want to use it as a wedge issue. One argument they are putting up is that when 14th amendment was ratified the situation was different from what it is now.
One person on FNN is saying that there are ~250K birthright citizenships from birthright tourism by the parents. There are also a large number of high-officials from CCP who used this route to have an anchor baby or three in the US.
No saar, constitutionally, federal congress cannot bifurcate a state without the states consent Both the state legislative bodies in CA are dominated by Democrats and even state Republicans wont commit political suicide for such a cause.
Birthright Citizenship issue is a slam dunk lost cause. Trump could try to amend the constitution and see how much support he has for this issue. 27 of 50 states have republican dominated legislatures, but it is a huge fight that will derail the presidency. I think Trump simply did it to show some symbolism and to rally the MAGA crowd. It will just fizzle, but he will get two news cycles of attention.
