I have note on the Hijab controversy, States Ruled by Secular Parties before the Assembly elections must impose a 2 day Hijab day. All Media, Government, School and College women Staff, Teachers and Students above 14 must wear Hijab for 2 days with Muslim men appointed in Vice and Virtue department with wipes to discipline them. Similarly these vice and Virtue men outside Clubs, Bars etc

If people are voting for so called Liberal secularism, let them feel what they are voting for.

This is how district by District 40% of Subcontinent now has blasphemy laws. With many groups cheering the Islamists letting the few brave take the fall.

Like the Sindhi, Punjabi and Bengali Hindu (some of them not all) lost their homeland due to this Secularism and now preaching we are one people. We can never be one people with countries with Official Religions and dont have atleast 10% of population with a different religion, no country without 15% people following a different religion

Three-judge full bench of Karnataka High Court to hear hijab pleas today
One of the judges on the bench Ms. Justice Khazi Jaibunnisa Mohiuddin itself is not wearing a hijab/burqah. While that being the case; how can it be mandated that this is a mandatory religious requirement? I feel the uniform/dress code of the judiciary itself should be taken up as a point in argument. Certain areas have certain dress codes. And as seen in this image the protestors are not wearing hijab any more but the shuttle cock burqas.

Hijab controversy: More to do with UP than Karnataka? Is it entirely a coincidence that Owaisi has brought the hijab issue to the UP elections? - The report insinuates that Owaisi may be working on behalf of BJP :lol:.

Sharia should be recognised as the de facto legal codex for all Muslims in India. That should include everything from bank interest to witness requirements in rape cases, strictures against fraternizing with non Muslims, education in madrasas. Of course chopping of hands and stoning of the usual miscreants.

I personally would not extend these liberties to include pedophilia or marriages of minors. But whatever turns on their god. Muslims have every right to live in the seventh century. I really don’t see why Hindus, Christians or Martians should object.

Why don’t Hindus look to their poor, uneducated, downtrodden before going off to save world?

The minority rights now are weapon against Hindus. They slowly became super citizens. Particularly after RTE. Unfortunately BJP not seriously looking into that legal and constitutional inequality. One way to level the field is the given constitutional rights to Hindus same as minorities. If Hindus fail thereafter create their own institutions then it will be their problem.

a) does this mean Muslim women be identified and left but kafir can be abused?
b) does this aayath give permission to Muslim men to abuse kafir as they are not in hijab, so will court allow it to?
c) is it not for identification which is against the sprit of uniform? we need uniform to stop discrimination between rich/poor, religion, cast etc.

The Hijab case now being heard by Hon. Karnataka HC is now taking lots of twists and turns. The petitioner's advocate pleaded that this case was not related to Constitution, Fundamental rights etc and was asking for an verdict for the immediate issue (i.e the hijabis being kept outside the class). He cited the Karnataka Education Act and Rules to prove that uniform was not mandatory especially in PU colleges etc. But now looks like the Division Bench has said that they will have to consider the Constitution, Fundamental rights etc as it was passed up by the Single Bench because of the same reason only.

At least; I got a feeling that the peacefools now realise that things are going out of hand and are now looking for some escape route. Updates from Bar & Bench

Please don't underestimate the collective wisdom of the collegium. They can come up with an interpretation of the constitution which talks of equality but treats majority unfavorably and doesn't grant them similar rights to those of minority.

Why the argument is not that hijab will segregate students into Muslims and kafir. This will lead to differentiation of minds if young kids hence result in morality problem?

Their bravado and subjacent threat of violence aside, the last thing the male dominated muslim society wants is an open, mediatised public debate on hijab. They know its hard to defend on any grounds, they know such a public debate will encourage muslim women to come out, speak about it and rebel.

I suspect if there is a huge media debate that pierces the veil of this "its religious so you cant question it" stand, the plea will be quietly withdrawn. The fundamentalist muslim society is shit scared of its practices to be publicly brought out, discussed and debated.
Looks like the plaintiffs are scared to let this become a debate on hijab itself... they have started diluting and pleading on the grounds of "girl's study will be disturbed". If that is the concern, it shouldn't be hard to choose between "wearing hijab in class" and "continuing studies without hijab in class as before", right?

Keep watching, all kinds of taquiyaa arguments will be coming...

most important is what are we aiming for? we want a divided India? at the age of kids itself segregate them as kafir and Muslims? do we need such society? why we need to poison the minds of kids?

The bench denied interim relief, asked all parties to maintain calm, to stick to the uniform rules, avoid wearing bhagwa scarfs or head scarfs and asked the govt to resume classes, until the bench continues the hearings on Monday.

From Deccan Herald which is a pro-Congress secular news paper.
'Purdah is not essential but covering of head by scarf is obligatory,' Adv Kamat refers to Holy Quran. Even accepting this; the purpose can be easily achieved by a shawl draped over one's head. In fact this was very common for Muslim girls in KL before the Arab-isation began. And they too often did it only when elders were present.

The case is now adjourned to Feb 14th and till then it is [Hijab row] No religious garments till we decide the case, will pass interim order: Karnataka High Court.

Don't know if this would also allow for lot of of background manouvering.

If the anti-hijab side looses; then it is also going to have a national impact. High Court verdicts have pan-India significance, and one verdict from a state HC can be used as reference in other states. So if the hijabis win; it would only add more communal disharmony across the country. If our judicial establishments want that to happen then so be it. If Hijab is allowed, there would follow more demands and then more communal fissures.

The Muslims are comparing their religious mandates with those of Sikh religion. The common understanding is that for Sikh men; the five Ks are mandatory (and you miss one you are not a true Sikh). Where as for Muslims they don't have any mandatory dressing requirements at all. These requirements were introduced in last 15-20 years only, and I am sure people from KA and KL can prove that all these Arab fancy dresses were never there in the state. The crux of this case is to prove that hijab (which has a distinct style) is mandatory. Even Adv Kamat has only been able to argue that covering of head is obligatory as per Islamic laws. Covering of head can be achieved without a hijab, burqah, niquab etc.

Kapil Sibal has already filed a Supreme Court case just in case KA verdict comes unsatisfactory. Insisting full bench hear the case. He is blackmailing court that exams are approaching and an immediate is action needed. Amazing how these scoundrels get courts attention when lakhs of cases are waiting.

How easy it is for BIF to trigger unrest in India using a piece of cloth...

Exactly this is my point. If Muslim/gov/mullah we're so much worried about women wishes, choice and needs, then they will be fighting for halal, TTT. Unfortunately that is not the case.

The Enforcement Directorate has attached assets worth Rs 1.77 crores of alleged journalist Rana Ayyub under the Money Laundering Act. The ED has, in its attachment order said, “Rana Ayyub has cheated the general Public Donors in a pre-planned manner and with the intention to cheat the general public donors”.

The order says that Rana Ayyub’s scam started right from the time when she collected the money and started withdrawing it from the savings account of herself and her family members. The ED order further says that a “Fixed Deposit amounting to Rs. 50 Lakh was booked from her saving bank account through net banking and opening a separate Current bank account and subsequently funds were transferred from her saving bank account and bank account of her sister and father and did not utilize for the purpose for which it was raised by Ms. Rana Ayyub through launching campaigns through Ketto.org”.

Terming the funds raised and misused by Rana Ayyub as “proceeds of crime”, the ED order stated that Rana Ayyub knowingly indulged in “Proceeds of Crime including its acquisition, possession, use and projecting it as untainted property and therefore, she has committed the offence of money laundering as defined under section 3 of the Act, 2002 which is punishable under section 4 of the Act”. The actions by Ayyub are considered scheduled offences under the PMLA, ED said.

Lawyers for the plaintiff were articulate but they had nothing much to go on and tried to compromise with AG, but neither he nor the beach was willing.

They were caught in a love triangle between essential practice and religious right and freedom of expression.

If they say hijaab is an essential practice (which means they have to demonstrate it is so, which is far from easy) therefore must be allowed, then namaz is also essential practice so should that be allowed in the classroom as well? If not an essential practice then there is no case. Additionally, carrying a kripaan is essential practice for Sikhs. But they have accepted to let go of it in modern times, so why can't muslims let go of hijaab? If everyone brings essential religious practices to school then how can classes run?

If religious right then a school is a secular place, practice your religion at home. At best you can cover your head with school uniform dupatta or scarf, which anyone can, so can't ask for exceptional treatment for something everyone can already do. So no case.

If freedom of expression, then it has to be tempered as per law and subordinate to rules of the school. Can't have black hijaab or burqa which are not part of uniform.

Can't argue "but why bindi is allowed", that's not object of your case, moreover bindi is not clothing, so not uniform, you can also wear if you wish.

"Then what about sikh turban?" Well they gave up the well established essential practice of kripaan. What essential practice are you willing to give up among namaaz, kalma, hajj, zakaat and roza? Hey but wait a second, hijaab is not in the list? So why is it an essential practice?

Get a bowl of popcorn if you plan to watch the proceedings live on Monday.

The above are very good points. Yesterday Madhukishwar had a good discussion on this topic. Vashi sharma talked about the context in which the burqa came up and reasons. The history of hijab should be discussed in every channel. This may scare the hijabis and put them in backfoot.

This brings some interesting points
1) so umar has power to compel Allah to get aayat.
2) what did Umar saw when Sauda was going to toilet that Allah gave this aayat

Narrated Um `Atiya: We were ordered to bring out our menstruating women and veiled women in the religious gatherings and invocation of Muslims on the two `Id festivals. These menstruating women were to keep away from their Musalla. A woman asked, "O Allah's Messenger ' What about one who does not have a veil?" He said, "Let her share the veil of her companion."Sahih al-Bukhari 351

Youth Congress chief files plea in SC over Karnataka 'hijab' row
The plea, filed by Youth Congress president B V Srinivas and a journalism student, contended that there is a direct infringement of fundamental rights and also as events are happening in multiple states and likely to spread further, it would be better and proper that the apex court takes cognizance of the issue.



The plea said that different high courts in different states may pass conflicting orders.

"Everyone has the right to wear clothes/ head gear of their choice and practise their own religion, its customs and traditions. If a small girl child is seen wearing ’hijab’, it can be 'not out of her own choice' but for older and adult girls and women wherein it is their choice, the right must be protected. Belief in religion is one thing but religious fanaticism is another facet altogether.

The amount of mental gymnastics by Hindus on this forum and elsewhere on hijab issue is mind numbing. Pakistan was created to solve these problems and is the the only solution for all the peacefools living in India. Why do we have to keep reacting like stupid to every provocation?
BTW I think this issue will help BJP in the UP/UK elections. WhatsApp is flooded with all such messages and calls for unity etc on both side. Congoons are being clever by half here.

So what if the Burqa or Hijab is mandated by the Quran? All this hair splitting using the Quran as a reference is ridiculous, when India is supposed to be a constitutional republic -- the only thing the courts should be interpreting is the constitution, not arbitrary religious texts. Seriously, for such a serious issue, the KA govt. cannot get a decent AG to argue the case. :roll:

President had it right when he questioned the capability and intelligence of the people in the Indian Judiciary. The collegium is the last hope for Rahul Gandy and his minions to subvert the elected govt.
Without diluting it to the slightest degree, can a better way be found to select judges for the higher judiciary? For instance, there can be an all-India Judicial Service which can select, nurture and promote the right talent, right from the lower levels to the higher levels.

What is their religion ? How should it be professed, practiced and propagated? They will show you (some version of) the Koran. They will show you the Bible. What will hindus show? We have a million sacred texts ! And even more undocumented traditions :) :)

In a weird sort of way, its actually a good thing our judiciary swings in and out of the ambit of the constitution, because much as we respect our constitution, its has deep flaws that were carried over from the colonial era.

Judiciary doesn't operate in a vacuum though sometimes they compel us to think otherwise. Change of public opinion and public expectations will influence the judiciary and we just have to keep building that societal pressure by all lawful means so that dharmic agenda can be achieved.

Two different issues. Uniforms lead to job losses in the textile sector. Teenagers love to wear latest fashionable designs and material.

So as per the great knowledge of justice, temple is a secular place so don't divide the country by religion please allow hijab. But Schools where kids do not know what is God and religion can ware burkha and get differentiated as momins and kafirs...
