My sympathies to the hon'ble HC bench for having to deal with some really sub par filings, submissions and arguments today by the gaggle of lawyers who have jumped into the complainants wagon. The judges have shown admirable patience and kindness but not lenience.
AG did the right thing to not start arguing today. He needs some time to consider all the arguments made by various petitioners until now and prepare his defence, and argue when the judges are fresh.

at 0.38 hrs the lawyer stated that Quran states women should wear hijab. when judges asked where in Quran he had no answer. more fun is his argument is banning hijab is banning Quran, so he request not to ban Quran and burka. as per lawyer Quran and hijab is same

at 0.45 hrs the male lawyer states I am affected due to not wearing hijab. when judges asks where are you studying he says various institution...

why is Muslim female judge has not spoken any word at all?

@MinhazMerchant
For those asking me to post my original column in English, published in Hindi, Marathi & Gujarati by @DainikBhaskar, here it is in 4 parts.
Real reason why regressive practice of wearing #hijab has spread among Muslim women is reaction to the end of Muslim-first politics policy followed by the Mughals, then the British & finally Congress was abandoned by @narendramodi govt in 2014.

Is it likely that one of the target of raking up Hijab/Burqa controversy now so that during polling time burqa maybe used for polling fraud and the officers will be hesitant to ask to take off burqa?
It is okay to allow hijab or whatever its called for just head scarf/covering, but not burqa. Court should give judgement to that effect. The general coming off of burqa use is a social change and need to come from within community and social debates. It has started. Hindus should avoid any confrontation as of now (even in school for a few burqa idiots) on the subject so as not to derail any progress path of the country that Modi sarkar laid out.

Re: 2021 Strategic and Political Analysis-1
The stirring up go hijab controversy has not happened without some important factors which muslim community was more preceptive to catch than the rest.
The development efforts of NaMo have started getting recognised in a large cross section of muslims, pan India, who have a big proportion of economically weaker people, and therefore end up getting a lot of benefits. So there is a certain recognition of the fact that BJP rule is better for muslims than the ones preceding it.
The realisation is also that left parties who were making a big show of being pro muslim have done actually very little, especially when contrasted with what BJP govt have done at state and center levels.
This realisation could have started expressing itself, especially among rural muslims, sending panic signals among upper caste muslim leaders who see the large rural and even urban muslim popular opinion slipping away from their decades long iron grip. If major left parties realise it, they will become effectively "washermen's dogs" neither here nor there. So to retain any kind of political weight, they need to show they can control muslim popular sentiment and regain credibility as a political swing factor force. Else they too risk falling by the wayside like SP and BSP have, after losing grip on BCs and Dalits.
So a strong muslim agenda item that resonates strongly with urban and especially rural muslims has to be created. One that can spread fast and becomes a muslim unifying factor in the ongoing elections in multiple states. SDPI, and its wings PFI/CFI have lit the match, presumably with internal and external funding which is never lacking.
I believe this is the genesis of the hijab agitation, which was purposefully started in a small town/rural geography and with generous left leaning media help, was quickly fanned into a pan-india issue.
Unfortunately for them, this issue provoked some degree of muslim sentiment consolidation but even greater hindu sentiment consolidation, which naturally favours BJP. Now this miscalculation has been realised, therefore the pan-India hijab agitation has been quickly scaled back.
Though the KA govt seemed to have stepped on a land mine, the muslim leaders did a second miscalculation by going to the KA high court. The KA CJ issued an interim order that can't be faulted and referred to a bench with a lady muslim judge on it. On top of it, KA HC bench proceedings are streamed live for everyone to see, and is going on since 6 days, with no end in sight. Even usually fence sitting hindus are turning now against this agitation since bindi, pagdi etc are suddenly being questioned.
The masterminds behind the agitation are now stuck. Though within the muslim community this issue has become an item of virtue signalling by people who are visibly coming with their hijab/burqa clad daughters to school and turning back with their 'iman' flying high. But despite this bravado, I suspect many are worried how to extricate themselves out of it since the academic year and future of their children is at stake. Plus, they have seriously damaged community ties in the process since school closure has effected all students, and painted themselves as unreasonable, selfish and misguided. If they indulge in any kind of violence now, they will get large scale social and economic boycott from the rest of the society, and they know it. Thats a heavy price to pay for a suddenly self-manufactured issue.
Lets see how the KA AG defends the case here on...

Karnataka HC declines plea to restrain live streaming of hijab row case
but the issue is at least 10K people watch Live.claimed that live streaming was causing a lot of unrest in the society as the observations were taken out of context.
According to him, the live streaming has become "counterproductive and children were put to hardship".
However, Chief Justice Ritu Raj Awasthi said: "Let the people understand what is the stand of the respondents also." As a few more fresh petitions were filed, Justice Awasthi requested the petitioners that the counsels for the fresh petitions can take only 10 minutes so that respondents can also be heard. The full bench of the High Court comprises Justice Awasthi, Justice J M Khazi and Justice Krishna M Dixit.
Re: 2021 Strategic and Political Analysis-1
is this what you are stating?Cyrano wrote:AG seems to be bumbling along... the judges are sharp and catching any loose logic or extraneous statements and not letting anything pass....
Karnataka HC asks, "Was the government order banning hijab premature? On one hand you (State) say that a high-level committee is examining the issue. On the other hand, you issue this order. "
Court says will this not amount to contradictory stand by state
AG says "Certainly not".
Re: 2021 Strategic and Political Analysis-1
Yes, the AG got hot under the collar on that one, and also a few other instances he brought up himself. Like edu dept/school-college devt committees/MLAs sitting on them, constitution art 31.2 vs Art 25, went all over on freedom of conscience etc...
He did not make some essential points at all or clearly enough:
That the petitioners
- are hell bent on violating school code of conduct they and their parents signed voluntarily and at the beginning of the year.
- this insistence on wearing hijab in classrooms even now shows intent to violate the court's interim order as well, and can be seen as contempt of court
- the claim that rules have been suddenly changed is false, and he can demonstrate it
- the claim that they have been wearing hijab in class before Dec is also false and he can demonstrate it. Anyway, not following rules in the past gives no right to continue doing so in the present and in future.
etc...
Lets see how he handles "essential religious practice" point on Monday. He as at least said that he will show its not an essential practice.
I'm in the danger of getting addicted to watching live court proceedings

One good thing is that too many petitions will also delay the final outcome of the case. The AG has said that if petitions and interlocutory pensions just keep coming in, he will need time to prepare a response for all of that.Cyrano wrote:AG did the right thing to not start arguing today. Just like chinis, they never bother with individual nba players, instead choosing to go after NBA itself.
Here's Cena's example
Actor John Cena apologizes to Chinese audience after calling Taiwan a country
The entertainment dumbos don't care if people keep exposing their "hypocrisy" on Twitter. But if you hit their wallet, they'll apologize to you, in Gujrati, on their knees, on Koo instead of Twitter. On Tuesday, Cena, 44, posted a video message that he recorded in Mandarin on Chinese social network Weibo, in which he said that he had done many interviews for Fast & Furious 9 and during one interview, he “made a mistake.”
“I must say right now, it’s very, very, very, very, very, very important,” Cena said. “I love and respect China and Chinese people. I’m very, very sorry for my mistake.”
China is the world’s second-largest film market.
The latest installment in Universal's franchise kicked off with a massive $162 million in eight markets, including China, Korea and Hong Kong. The ticket sales easily mark the best start for a Hollywood blockbuster since Covid-19 hit.

Indians are not together. We have been kept confused about our identity, our destiny and our power. And with that we are kept divided.
What is the way forward to unite us within a democracy where everyone has a right to dissent and for a nation that is still evolving economically. Chinese behavior has been shaped by years of authoritarian rule and is backed by their state muscle which has reached a level where it can't be ignored.
Re: 2021 Strategic and Political Analysis-1
That behaviour isn't limited to chinese. Every sane country reads the riot act to any foreign individual/ org that goes against it's national interest. And it doesn't has anything to do with democracy/authoritarianism either. It's just one does it openly while the other does it with manufactured "justification".CalvinH wrote: Chinese are together and move as one against those who they believe are going against their core identity and objectives.

Take the "land of the free, home of the brave" for example. They aren't as united as the chinese either but treat problematic orgs the same, e.g Huawei and the sanctions on chini orgs related to "forced ooeegur labor". So if tomorrow Jackie Chan gets the sudden urge to support blm or some other social justice issue in US, they will make sure some kung-fu producing studio somewhere gets the freedom fries home delivered.

We need a way to get to the wallets of these drama protestors legally and quickly. For all the local khalistani freedom optics turdeau did invoke emergency and go after the money. When anti-national elements/activity is/are suspected, we need to be able to invoke something like this mareva injunction. This is after 10M$ was repurposed from drama protestors to other charities that the government chose. Based on the fact that donors and takers have to declare the intent and show transparency when using GoFundMe kinds of mechanisms. I shudder to think where the intent and action coincides with all our NGOs
Most importantly we dont need to prove "seditious activity" with the JNU type one time hit wonders. Especially with all these jobless lawyers adding injunctions and jamming the court and its actions. We just need to prove that the money is funny money and it needs to be frozen till satisfactory explanation is provided.
Just for reference, closing of the US border bridges led to 300M$ daily loss to the economy by some estimates. 20-30M$ to cause 300M$ × 20 days is a very effective tool

Champ, who hired a private investigator and cryptocurrency expert, found that the organizers’ crypto movements outpaced the government’s attempts to track them
Under the injunction, the named defendants, and those affiliated with them, are restricted from moving fiat and cryptocurrency assets in the bank accounts and cryptocurrency wallets specifically named in the suit. The respondents must now respond to the court and “submit to an examination under oath” regarding their assets and what the assets have been used for. The Mareva injunction is only used when there’s a “high risk” that the defendant will “dispose, encumber or…remove its assets from the jurisdiction during the course of litigation,” says Burgoyne. It effectively freezes their assets until judgment is passed.

+1 imo it's worse for us because of the cash-based nature of the economy and the enormous % of corrupt bureaucracy. So mere "suspicion by security agencies" like NIA or CBI should be enough to freeze the money. But it's probably too much to expect I guess.Kaivalya wrote:.... UK's inflation is at 30-year high.
Canada's inflation is at 30-year high.
USA's inflation is at 40-year high.
Now you know how remarkably well Nirmala Sitharaman has performed to keep the inflation in check in India. That too in spite of non stop verbal attacks on the FM..
Some commented about India's inflation rate. Yes definitely India is also seeing moderate inflation. But much below what we had 8 to 10 years ago.
More importantly, India's per capita income is almost 73% more than what it was seven years ago! Keep that in mind.

Canada's inflation is at 30-year high.
USA's inflation is at 40-year high.
Now you know how remarkably well Nirmala Sitharaman has performed to keep the inflation in check in India. That too in spite of non stop verbal attacks on the FM..

Re: 2021 Strategic and Political Analysis-1
PK was first hired by BJP , and was promptly fired when he took credit for BJP's stellar performance in 2014. PK's downfall will be his ego and his ambition, he is swimming with the sharks and sooner or later he will get eaten up. He wants to insert himself as a future PM candidate, he knows he has no political brand of his own so is working on a backdoor option to be the "agreeable" candidate in case of a fractured mandate. He first tried with JDU until a bigger charlatan Nitish Kumar fired him. He is now trying the same trick with TMC and all indications suggests Momata is almost done with him. He would have loved to join AAP but Kejri maharaj being the king of jackals won't tolerate any competition so back to JDU it is.
What is surprising though is that either PK has not shown any interest in joining INC or someone in INC is blocking his entry. INC has a 130 yr old ecosystem, national presence, governments in multiple states, and a situation where the Gandhi family's future in the party is in question, so it should have been the most natural choice for PK to nurture his political ambitions .

the oldies are blocking him as he is apparently asking for a position that is more powerful than the oldies have managed to achieve so far, like something over all of them but just a little below the royalsAmbar wrote:PK was first hired by BJP , and was promptly fired when he took credit for BJP's stellar performance in 2014. Mumtaz Didi, KCR, Kejriwal (if he wins in Punjab) all have better credentials and would never agree to him or another similar cartoon trying to become the PM. The time when a Gujral and Devegowda could become PM are all long gone.Ambar wrote:PK was first hired by BJP , and was promptly fired when he took credit for BJP's stellar performance in 2014. I dont think they are smirking. Not sure how you are seeing that.Vayutuvan wrote:It is great. But those two women on the left and right should have maintained decorum instead of smirking. Not a good look there. It is a serious issue and should be approached with a great amount of maturity and even understanding.Rony wrote:Subuhi Khan, Supreme Court Lawyer
