In her statement to the police, the victim said the men tried to molest her and harassed her. The police have registered a case under Sections 506 (criminal intimidation), 509 (outraging the modesty of a woman) and 34 (common intention) of the Indian Penal Code (IPC).

(1) at least three of the accused are going to claim not guilty [now there are several angles by which they will try to do this, but in all of them the blame will have to be put on the "male friend" - which in turn means that prosecution will have to find at least one "states witness" from among the remaining two, but because of his potential complicity the case would go weaker. ]
(2) and the 6th one probably is going to the juvenile court and could be out in months
Overall, an excellent strategy to save the faces of all concerned - perpetrators, police, state, except the two targets, of course.

They might plead not guilty and try pin all the blame on the juvenile. The juvenile will get away in a few years either way whether he is fully or partly blamed. So why not these 5 or 3 of them plead not guilty and try lessen the sentences by putting it all on the juvenile.

If he is a child, then the owner of the bus services should be also booked under Section 12 of India's Child Labour... or at least till such time, all the rapists are considered as adults. If the child labor law says it is 14 years, then how the hell for a rape he is minor? WTF!!
So, they can be dealt with as pre-adults, with equal footing as for adults, perhaps with only lenience for less crimes. This delhi case far above any crime one can do. He is in with all types of violence., and he is dangerous to live in a free society.The Factories Act of 1948: The Act prohibits the employment of children below the age of 14 years in any factory. The law also placed rules on who, when and how long can pre-adults aged 15–18 years be employed in any factory..

The gist is basically, everybody is innocent until proven guilty, i.e. the accused rights are invoilable. Once the rights of accused are violated, the judges consider that as a serious offence and anything to be proven, the bar will be set beyond and above the violations. Media circuses influences the witnesses, the judge and creates an atmosphere against the accused, thus violating their rights. It creates an atmosphere of prejudice against accused. It can result in lower punishments and higher levels of validations of proof.
In short, if you want those rapists to be severely punished, media circus regarding that case should have stopped yesterday. As it stands today, defence can claim an atmosphere of prejudice. The identification parades are severely liable to be compromised.
and yes, media black outs of some sort are very very normal. In high profile cases in US where the jury exists, the jury is made to stay in hotels without any connection to outside world.

The brutal rape was an unexpected side effect to their enterprise.

Media is banned from the court but the judge has said she would have a daily report for the media. Media in the court room is not a good idea as DDM is very capable of twisting the facts and create an anti -India atmosphere.

I have always thought the real administrative incompetence is by Sonia Gandhi. She has never had a clue what she is doing administratively. Even Dr JJ called her a kitchen level talent once IIRC. She is smart politically however, esp. in divide and rule, must be that Italian blood. I have always thought the BJP committed a political blunder but not letting her become PM. It has allowed her to take on the martyr mantle and avoid taking responsibility for her incompetence.

^ Completely agree. The plan could not have been without approval of SG. Do not see logic behind reports that Shiela Dixit was behind her transfer, as emergency supply of passport, visa is not possible without diplomatic help sought from Singapore, all this needed approval from the highest level. Victim's family being a simpleton rural one doesn't understand all this politics , questions raised behind air transfer. Even yesterday her father told AAjtak, it was apparently doctor's decision to fly her abroad

1. Accused have found lawyer who will defend them seriously
2. That Accused would plead not guilty.
3. That he has blamed the lone witness for the incident. he has not denied his presence at the scene of the crime.
4. That he has not denied presence of the accused ( at least not in media) at the scene of the crime. I think that he would deny later in proceedings.
5. Dying declaration of the girl is more damning.
6. Forensic evidence neatly tie the accused to the scene of the crime
7. Doctors , treating the girl, would be able to describe the nature of crime in graphic detail
8.Postmortem report would certainly indicate the cause of death was injuries inflicted by them
9.DNA reports would also indicate that samples recovered from accused and the scene of the crime and that on the Girl matches
10.Injuries and bite marks would indicate that victim resisted and tried to save herself.
Chargesheet must be containing many other details. The accused will be heard and will be given due justice. Sadly Juvenile might get scot free unless age is confirmed by other means and test is ordered by the Board.

they have been offered Rs 20 lakhs from UP govt and Rs 15 lakhs from Delhi govt, but so far no payment has been made. They sold a large part of land they owned to support education of this girl. Even at his age of 55 years her father has worked double shifts as daily wager at IGI airport

This is a step the defense must take. He is playing to the prejudices of the judges and courts.
