Issuing the guidelines for appointment of MDs and WTDs, the RBI said MPs, MLAs and representatives of municipal corporations will not be eligible to hold such positions in the primary urban cooperative banks (UCBs)
The Reserve Bank on Friday prescribed educational qualifications and 'fit and proper' criteria for managing directors (MDs) and whole-time directors (WTDs) of primary urban cooperative banks and barred MPs and MLAs from these posts.
Issuing the guidelines for appointment of MDs and WTDs, the RBI said MPs, MLAs and representatives of municipal corporations will not be eligible to hold such positions in the primary urban cooperative banks (UCBs).
It further said the MD/WTD should be a post graduate or have qualifications in finance discipline. He or she could be either chartered/cost accountant, MBA (finance) or have a diploma in banking or cooperative business management.
The person should not be below 35 years of age or more than 70 years, it added.
"The person shall have a combined experience of at least eight years at the middle/senior management level in the banking sector (including the experience gained in the concerned UCB) or non-banking finance companies engaged in lending (loan companies) and asset financing," the notification said.
Besides MPs, MLAs and representatives of municipal corporations and local bodies, persons engaged in business, trade or having substantial interest in any company too will not be eligible for appointment to such positions.
Regarding the tenure of appointment, it said the person can be appointed for a maximum of five years and will be eligible for re-appointment.
However, it said the MD or WTD will not hold the post for more than 15 years. After that, the person, if necessary, may be re-appointed after a three-year cooling period.

During a meeting with his party on Wednesday (June 2), NCP chief Sharad Pawar approved a plan to set up a task force to prepare an action plan against a recent change in the law that has brought cooperative banks under the supervision of the Reserve Bank of India (RBI).
The proposed task force will be headed by Balasaheb Patil, NCP leader and Cooperation Minister in Maharashtra’s Maha Vikas Aghadi (MVA) government.
NCP spokesperson Nawab Malik said the Centre was trying to weaken the cooperative banking sector through changes to The Banking Regulation Act, 1949, and the NCP would stop its “game”.
Malik said Pawar had worked to boost cooperative banks, but the central government was now taking away its rights, and making private banks powerful instead.
How has The Banking Regulation Act been amended?
Cooperative banks have long been under dual regulation by the state Registrar of Societies and the RBI. As a result, these banks have escaped scrutiny despite failures and frauds.
The changes to The Banking Regulation Act approved by Parliament in September 2020, brought cooperative banks under the direct supervision of the RBI.
The amended law has given RBI the power to supersede the board of directors of cooperative banks after consultations with the concerned state government. Earlier, it could issue such directions only to multi-state cooperative banks.
Also, urban cooperative banks will now be treated on a par with commercial banks.
And a cooperative bank can, with prior approval of the RBI, issue equity shares, preference shares, or special shares to its members or to any other person residing within its area of operation, by way of public issue or private placements.
It can also issue unsecured debentures or bonds with maturity of not less than 10 years. This essentially means non-members can become shareholders of the bank, and this will allow the RBI to merge failing banks quickly.
What triggered the need for the changes in the law?
India has some 1,540 urban cooperative banks, with a depositor base of 8.6 crore and deposits of at least Rs 5 lakh crore.
Finance Minister Nirmala Sitharaman told Lok Sabha last year that the financial status of at least 277 urban cooperative banks was weak, and around 105 cooperative banks were unable to meet the minimum regulatory capital requirement.
Also, Sitharaman said, the net worth of 47 banks was in the negative, and as many as 328 urban cooperative banks had gross non-performing assets of more than 15 per cent.
According to RBI’s latest financial stability report, the gross non-performing asset ratio of urban cooperative banks deteriorated from 9.89 per cent in March 2020 to 10.36 per cent in September 2020.
Not only do these banks have high levels of bad loans, they also have a small capital base — something that the changes in the law has tried to address by allowing these banks to issue shares with RBI’s approval.
Political interference in staff appointments is also a problem with these banks, which has added to inefficiencies.
But why is the NCP opposing the new laws?
Almost a third of India’s 1,500-plus urban cooperative banks are in Maharashtra — the state has 497 operational urban cooperative banks and 31 district central cooperative banks, with total deposits of Rs 2.93 lakh crore.
A large number of these banks are controlled by NCP leaders. The new law brings them under the direct regulation of the RBI, which will increase their accountability and put them under scrutiny that they have so far escaped.

1) High profile arrests: a Robert Vadra is still roaming around, rather than counting bars in a prison. The aam-aadmi in India is disillusioned with the "system" because he knows that, if you have money/power, the law will not touch you. The only way to break this mould of thinking is to ruthlessly go after *only* the big fish. Do it enough times & the average Indian will start having hope in his nation/civilization
2) In our white collar justice system, we seem to be missing the ingredient called punitive damages. It means that, if a Vijay Mallya steals 9000 Crores, not only will that money be recovered, but the courts will levy punitive damages which will be 5X that amount. This is to punish his behavior and serve as a deterrent to others. He should become bankrupt, his family should beg in the streets and he must rot in prison till he dies. Rinse, repeat for the Sonia gang and other family-mafias. Anyone else contemplating the theft of public money should pee in their pants.

with the pliant media, international press, academia and judiciary, any high profile arrest can be converted into victim card.
plus arrest is no garuntee, the person stays in jail. with judiciary dragging its feet for 10-20 years and with easy bail to high profile cases, the person most likely stays out of jail.

Oil minister Dharmendra Pradhan on Thursday conveyed to Opec India’s concern over rising crude prices which are hurting economic recovery by creating inflationary pressure by sending fuel prices soaring.
Pradhan reiterated his request for phasing out production cuts imposed by Opec and its ally Russia to prop up prices after they had crashed in 2020 as the pandemic wiped out demand.
According to statements issued by Opec and the oil ministry, Pradhan emphasised that crude prices should remain within a “reasonable” band for "smart" recovery. This will be in the collective interests of both consumers and producers and will encourage a consumption-led recovery, the statements quoted him as saying.

RBI bars MPs, MLAs from holding MD post in urban cooperative banks

In a crackdown on political interference, the Reserve Bank of India has barred MPs, MLAs and members of municipal corporations or other local bodies from holding the office of managing director (MD) or whole-time director (WTD) in urban cooperative banks.
These directions are applicable to all Primary (Urban) Co-operative Banks (UCBs). The RBI had exempted UCBs with a deposit size of less than Rs 100 crore from the requirement of seeking prior approval of the Reserve Bank for appointment / re-appointment / termination of appointment of MDs or WTDs.
Under the propriety criteria, the person to be nominated as MD or WTD shall not be engaged in any other business or vocation; shall not hold the position of a Member of Parliament or state legislature or municipal corporation or municipality or other local bodies; and shall not be a director of any company other than a company registered under Section 8 of the Companies Act, 2013.
In addition, he shall not be a partner of any firm which carries on any trade, business or industry; should not have substantial interest in any company or firm as defined in Section 5 (ne) read with Section 56 of the Banking Regulations Act, 1949; and shall not be a director, manager, managing agent, partner or proprietor of any trading, commercial or industrial concern.
In addition, the person should not be of unsound mind and stands so declared by a competent court; should not be an undischarged insolvent; should not be convicted by a criminal court of an offence involving moral turpitude; and should not be a director of any other co-operative bank or a co-operative credit society.
The person shall submit a self-declaration form on personal integrity.
While the exempted UCBs are not required to obtain prior approval, they are required to formulate a board approved policy based on all the other provisions of these directions for appointment / re-appointment / termination of appointment of MD or WTD.
These banks shall immediately report the appointment / re-appointment / termination of appointment of MD or WTD to the respective regional offices (Department of Supervision, Central Office, in case of UCBs under jurisdiction of Mumbai office) of the Reserve Bank.
The UCBs shall review the ‘Fit and Proper’ status of the existing MDs in terms of these directions and confirm the same, with the approval of board of directors to the concerned regional office within a period of two months from the date of issuance of the circular.
In case the present MD does not satisfy the prescribed ‘Fit and Proper’ criteria, the UCB shall initiate the process for appointment of a new MD immediately. If a UCB had appointed a WTD, the bank shall follow the same procedure to comply with these directions.

RBI bars MPs, MLAs from holding MD post in urban cooperative banks

fadnavis had done the exact same thing that the RBI has done, quietly and silently, and at the state level, by undercutting the managements of all such banks and sugar cooperatives and he had also neutered the long established maratha dominated statewide APMC lobby.
The RBI has pushed through stringent regulations, with the same fadnavis's core, but this includes a lot of bells and whistles to avoid criticisms and comparisons of same to same.
The end result, unsurprisingly, is exactly the same: painful political neutering.
Fadnavis had brought in govt nominees on the boards of all these corrupt organizations so as to drastically curtail the powers of the entrenched managements and hence the ability of the corrupt managements to siphon off money via non performing "loans". Their powers of patronage dried out after they were emasculated, financially as well as politically. Their almost imperial control over the distribution of water, to favor the sugar lobby was destroyed overnight, thus allowing lakhs of poor farmers to make a go of their small agricultural holdings because the water was now more equitably distributed, It also gave them sustenance by allowing these hitherto marginalized farmers access to loans, seeds and fertilizers. This is the infamous farmer's "suicide" belt.
that is why the marathas ganged up against fadnavis/BJP and as always, the maratha lobby grabbed all the power for themselves. They quickly reversed most of the changes that fadnavis had brought in, which was the real reason that they ganged up to grab the power.
Now all the three aghadis are in the industrial vaccum mode of their govt's life, desperately hoovering up what ever spoils of power that they can carry away so as to be able to finance their next elections against the BJP
This RBI move not only knocks the wind out of the onion merchant's sails but also cuts off the main mast and other auxiliary masts on which the sails of their endemic corruption are rigged, pun intended

The headline is misleading.
Paramjit Singh Sarna is a member of SAD(Delhi) - soft front end for the Congress party.
Manjinder Singh Sirsa is associated with SAD(Badal)-BJP. So two totally different parties to be in-fighting.

To this, a Muslim Twitter user questioned if this is how Sikhs would pay back to the Muslims who had stood by them in the farmers’ protest against the Modi government. He also expressed his disappointment with Sikhs for taking a ‘Muslim girl’ back who had left Sikhism for Allah and Prophet Muhammad.
This user has a point. This happened in India not Pakistan.

not to rain on the parade, but what is preventing people from appointing their spouses or immediate and extended family members to these posts if they can't directly take the role on. i am trying to play devils advocate and see if any loopholes will and can be utilized?
