2G: CBI to Supply UASL Policy File to Swamy
The CBI was today directed by a Delhi court to provide a certified copy of a file relating to 2G spectrum allocation to Janata Party chief Subramanian Swamy who alleged the document would prove the "complicity" of the then Finance Minister P Chidambaram in the scam.
Swamy, in an application filed before the court, said the file, relating to the Unified Access Services Licences (UASL) policy regarding sale of equity (lock-in period), was seized by the CBI on October 22, 2009, during the investigation.
Swamy, who is seeking prosecution of Chidambaram in the 2G case, said "these documents, with endorsements and signatures of P Chidambaram prove his complicity in the instant scam."
Special CBI Judge O P Saini, however, asked him to inspect the court records after which he said the file was not placed on record by the CBI along with the charge sheets filed by them.
"Ahlmad (court staff) has reported that this file was not placed on record of this court along with the charge sheet by the CBI. Complainant (Swamy) submits that he may be allowed to take the photocopy of the said file from the record of the CBI itself.
"After hearing the complainant, I am satisfied that a copy/certified copy of the aforesaid file would facilitate the prosecution of this complaint case. Accordingly, the CBI is directed to supply photocopy/certified copy of the file to the complainant at the earliest," the judge said.
The court permitted Swamy to have a copy of the file from the CBI after he said that this file was necessary for the case.
Speaking to media persons outside the court after the proceeding for the day concluded, Swamy said the file, which the CBI would provide him in pursuance to the court's order, was "very crucial" for the case.
"I will study this file. This file is very crucial for the corruption angle of 2G spectrum scam because according to A Raja in file noting, which I have submitted in the Supreme Court, it was P Chidambaram who told him that he can permit Swan Telecom Pvt Ltd and Unitech Wireless (Tamil Nadu) Pvt Ltd to sell their licences (shares) to blacklisted companies Etisalat and Telenor respectively and therefore this file is crucial and I have asked for the date.
He said that on the next date of hearing, he would argue for Chidambaram to be made an accused in the case.
During the hearing, Swamy told the court that he had applied to the CBI for a certified copy of the file through a letter written to them on October 10.
He said that in the reply, the CBI's Joint Director Hitesh C Awasthy told him to approach the special court, before which the proceedings of the case are going on, for the file.
Along with his application, Swamy also annexed the CBI's seizure memo, according to which the agency had conducted searches at the office premises of Access Services Cell of the Department of Telecom here on October 22, 2009.
During the search, 59 documents were seized by the CBI which included the file relating to the UASL policy regarding sale of equity (lock-in period).

2G scam: Attorney General supports chargesheet against Ruias
Essar Group's Ravi Ruia and Anshuman Ruia are likely to be named in the fresh chargesheet that the Central Bureau of Investigation is set to file in the 2G spectrum scam case.
Sources said attorney general G E Vahanvati on Wednesday endorsed the stand of both CBI director A P Singh and investigating officer Vivek Priyadarshi to name the Ruia duo for allegedly being part of the criminal conspiracy to secure 2G spectrum through their front company by suppressing vital information.
As per the CBI manual, the agency's director will now take a final decision taking into account the AG's opinion which endorsed Singh's view and disagreed with the director prosecution. With this, the agency is likely to file its last chargesheet in the 2G spectrum scam against the Ruias and their employee Vikas Saraf for allegedly misleading the government.
The latest chargesheet is also likely to name NRI businessman and promoter of Loop I P Khaitan and his wife for fronting for Essar. Khaitan is Ravi Ruia's brother-in-law.

She is arguably the most powerful woman in the world today, perhaps one of the most powerful women in history. She is the political leader of the world’s largest democracy, soon to be the largest country in terms of population. Yet she has been recently hospitalized for a serious illness abroad, and we don’t know what the illness is or how sick she may be. Sonia Gandhi is India’s most Catholic sovereign.
In early August, the Congress Party of India, which has ruled the country for almost its entire history since the end of the British Raj, announced that Mrs. Gandhi, the party leader, was abroad for health reasons. The illness was not revealed. She returned a month later, and no more details were provided on her status or why she had sought treatment overseas. She resumed her duties as party leader and the de facto boss of India today. She has made very few public appearances, but when she has been photographed she has looked agile and fit.
Prime Minister Manmohan Singh, we are told, does know what ails his boss, but very few other Indian officials are in the know. Gandhi guards her privacy carefully. What is most astounding is that the Indian press, among the most vibrant in the world, has chosen collectively to give her space.
Gandhi is without question the power behind the throne. She has led the party as its president since 1998 and engineered its surprise electoral victory in 2004 and its even more stunning victory in 2008. She is also chairman of the ruling coalition. India’s economy has grown on her watch, modest reforms have been introduced and the civilian nuclear-power agreement concluded and signed with America. Relations with rival Pakistan have modestly improved despite the November 2008 terror attack on Mumbai, the worst terrorist incident in the world since 9/11. Sonia probably deserves the bulk of the credit for holding back from a military response to the attack and giving diplomacy a chance.
She was born Eduige Antonia Albina Maino in the province of Veneto in Italy on December 9. 1946, and she grew up in a modest village in the Piedmont near Torino. Her father was a Mussolini supporter who had fought with the Italian army on the eastern front with the Nazis in World War II. She remains a Catholic but celebrates Hindu festivals and traditions. In 1965, she met her future husband in Cambridge, England, where she was studying English and he was enrolled at university. She was waiting on tables in a Greek restaurant when love struck(Guess Subramanian Swamy was right about 'lady janes lovelies'). By all accounts it was a romance. Rajiv and Sonia had a son and a daughter. He became prime minister in 1984 after his mother, Indira Gandhi, was assassinated by her Sikh bodyguards. He was assassinated in 1989 by a female Tamil terrorist.
The murders of her mother in law and husband affected Gandhi tremendously. She was very close to Indira, and some suggest she tries now to take on the appearance of her role model. Security has been intense for her since Rajiv’s death. I remember changing cars twice when visiting her bungalow in New Delhi in 1998. Both vehicles were part of her security detachment, but apparently even they were not judged safe enough. At first she was reluctant to take power, but she finally agreed. Now power seems natural to this remarkable woman.
Media speculation has suggested she was treated for cancer in New York in August, but that is not confirmed. She has yet to give an in-depth press interview since returning from her trip, and instead she is focused on her job and her children. Her son Rahul is widely seen as the next Gandhi to take power. It is the most powerful democratically elected dynasty in history. The founder, Nehru, was India’s first prime minister and ruled from 1947 until his death in 1964. His daughter Indira served as PM from 1966 to 1977 and then again from 1980 until her murder in 1984. Her son, Rajiv, was in office for five years. Collectively, the three ruled India for 39 of its first 42 years as an independent state. The Roosevelts and Bushs seem short timers in contrast.
It is all but inconceivable that the American press would give our most powerful politician the privacy that India has afforded Gandhi. Despite the cutthroat nature of the Indian media and its penchant for the sensational, the press has behaved as if it were in an older era. It is refreshing.

Wow!!! Simply WoW......that has to be the most open assessment of SG and the political set-up in the congress, and by extension, India camp. The US Admin knows which levers to push and from what I feel, the more nationalist babus in the GOI, try and work to negate the -ve coming from this arrangement. It seems, that it no India which has come close to US but G family....we can read the comments from amul baby to US Ambassador about "Saffron Terror" in this context. G Family may have more support and confidants in US Admin then GOI.

Sukhram convicted in 1996 telecom scam
NEW DELHI: Former telecom minister Sukhram in PV Narasimha Rao's cabinet has been convicted for awarding a lucrative contract to a private telecom firm for supplying cables to the government at inflated rates after receiving a bribe of Rs 3 lakh 15 years back.
Special Judge RP Pandey, who convicted 84-year-old Sukhram also on charges of misusing his official position in awarding the contract and causing loss to the state exchequer, is likely to decide on quantum of sentence to him on Saturday.
The corruption case dates back to 1996, when the telecom ministry under Sukhram's stewardship had awarded private firm Haryana Telecom Limited (HTL) a contract worth Rs 30 crore to supply 3.5 Lakh Conductor Kilometers (LCKM) of Polythene Insulated Jelly Filled (PIJF) cables to the telecom department.
Sukhram had been put on trial along with HTL chairman Devinder Singh Choudhary who had died during the trial.
"Sukhram also obtained (illegal) gratification other than legal remunerations from Choudhary as a motive or reward for showing the favour to the said firm (HTL)," the judge said.
The court convicted Sukhram, brushing aside his defence counsel argument that had he caused a huge pecuniary gain to HTL, he would not have taken a paltry sum of Rs 3 Lakh. The court termed the argument as "devoid of merit."

Besides Ghosh, the case was registered against former director of Bharat Sanchar Nigam Limited J R Gupta, the agency said.
Immediately after registering the case, CBI teams conducted searches at the official premises of Vodafone in Mumbai, Airtel in Gurgaon and residences of Ghosh and Gupta, it said.

Particularly damning is the fact that the rationale given by the government in this note for not charging an increased spectrum price was not public interest, which is now cited ad infinitum by it to defend its policy decision of spectrum allocation at cheap rates. But far from mentioning terms like increase affordability or teledensity, or level-playing field as the stated objectives, the note quite bizarrely mentions the term “historical reasons” which too has not been defined or spelt out as the reason for not charging a market-determined entry fee.

The ongoing trial in the 2G case has been shifted to high-security Tihar Jail from Patiala House courts following an order by the Delhi High Court, a decision opposed by former Telecom Minister A Raja, DMK MP Kanimozhi and other accused. {Need a clapping emoticon}
The short announcement of the High Court's administrative order by Special CBI Judge O P Saini at 3.30 pm today in the packed courtroom left the accused, their relatives and lawyers unhappy as they felt Tihar would not be easily accessible.
"Accordingly, from November 24, that is, coming Thursday, the trial shall be held at Tihar court complex," the CBI Judge said while referring to the High Court's order on the issue.
"I do not know what is happening in this country," Raja, who has been in Tihar jail since February 2, said. Kanimozhi also reacted on similar lines.{This must qualify for Quote of the Year}
"Do we understand that no accused is going to get bail till the trial concludes," one of the defence lawyers said, adding that the decision would be challenged in High Court.
Earlier, defence lawyers, including Mumbai-based Majid Memon, had raised the issue that the present courtroom at Patiala House here lacked the adequate space, air-conditioners and other facilities and had sought shifting of the trial to a more spacious place like Vigyan Bhawan in Lyutens Zone here.
"It is true that I myself had said the arrangements at the Patiala House courts complex are inadequate but we had not suggested that the trial be shifted to such an isolated location at Tihar Jail," Memon later told reporters.
The judge had earlier received complaints that the presence of relatives of accused and the onlookers have led to paucity of space in the courtroom.
The judge, however, had refused to intervene saying the trial was open for all and also refused the plea of accused that scribes be also kept out.
The defence lawyers opposed the High Court's November 21 notification saying that shifting of trial to Tihar would create a lot of inconvenience as everybody will have to get an entry pass to attend the proceedings.
"We are contemplating a meeting with Acting Chief Justice A K Sikri for reconsideration of the decision and examine other alternatives in the Patiala House complex," Memon said.
The announcement drew sharp reaction from an otherwise calm Kanimozhi who said that shifting of the trial would inconvenience lawyers.![]()
"We engage senior lawyers, they will have to come all the way to Tihar Jail for this case only. It will be a problem for them," she said.![]()
Raja too said that the move would create problems for the lawyers as they would have to rush from the Supreme Court and High Court to the Tihar Jail for the trial.![]()
"The shifting of the trial to the Tihar Jail would create lot of problems as we would not be able to properly have legal consultation with our counsel. Till now, the lawyers could reach Patiala House courts from the Supreme Court or the High Court within 10-15 minutes, but it would not be possible for them to reach Tihar Jail as they would have to leave all their other cases," Raja said.
All defence lawyers also took the similar plea saying that it would not be possible for them to leave their other cases for attending the day-to-day trial in the matter at Tihar.
The judge said tomorrow, the proceedings would be held at Patiala House courts here.
"The witnesses have been served with the address of Patiala House Courts only and it may not be possible to communicate the change to them at this stage," he said.

The ongoing trial in the 2G case has been shifted to high-security Tihar Jail from Patiala House courts following an order by the Delhi High Court, a decision opposed by former Telecom Minister A Raja, DMK MP Kanimozhi and other accused. {Need a clapping emoticon}
The short announcement of the High Court's administrative order by Special CBI Judge O P Saini at 3.30 pm today in the packed courtroom left the accused, their relatives and lawyers unhappy as they felt Tihar would not be easily accessible.
"Accordingly, from November 24, that is, coming Thursday, the trial shall be held at Tihar court complex," the CBI Judge said while referring to the High Court's order on the issue.
"I do not know what is happening in this country," Raja, who has been in Tihar jail since February 2, said. Kanimozhi also reacted on similar lines.{This must qualify for Quote of the Year}
"Do we understand that no accused is going to get bail till the trial concludes," one of the defence lawyers said, adding that the decision would be challenged in High Court.
Earlier, defence lawyers, including Mumbai-based Majid Memon, had raised the issue that the present courtroom at Patiala House here lacked the adequate space, air-conditioners and other facilities and had sought shifting of the trial to a more spacious place like Vigyan Bhawan in Lyutens Zone here.
"It is true that I myself had said the arrangements at the Patiala House courts complex are inadequate but we had not suggested that the trial be shifted to such an isolated location at Tihar Jail," Memon later told reporters.
The judge had earlier received complaints that the presence of relatives of accused and the onlookers have led to paucity of space in the courtroom.
The judge, however, had refused to intervene saying the trial was open for all and also refused the plea of accused that scribes be also kept out.
The defence lawyers opposed the High Court's November 21 notification saying that shifting of trial to Tihar would create a lot of inconvenience as everybody will have to get an entry pass to attend the proceedings.
"We are contemplating a meeting with Acting Chief Justice A K Sikri for reconsideration of the decision and examine other alternatives in the Patiala House complex," Memon said.
The announcement drew sharp reaction from an otherwise calm Kanimozhi who said that shifting of the trial would inconvenience lawyers.![]()
"We engage senior lawyers, they will have to come all the way to Tihar Jail for this case only. It will be a problem for them," she said.![]()
Raja too said that the move would create problems for the lawyers as they would have to rush from the Supreme Court and High Court to the Tihar Jail for the trial.![]()
"The shifting of the trial to the Tihar Jail would create lot of problems as we would not be able to properly have legal consultation with our counsel. Till now, the lawyers could reach Patiala House courts from the Supreme Court or the High Court within 10-15 minutes, but it would not be possible for them to reach Tihar Jail as they would have to leave all their other cases," Raja said.
All defence lawyers also took the similar plea saying that it would not be possible for them to leave their other cases for attending the day-to-day trial in the matter at Tihar.
The judge said tomorrow, the proceedings would be held at Patiala House courts here.
"The witnesses have been served with the address of Patiala House Courts only and it may not be possible to communicate the change to them at this stage," he said.

Krishnan - Thanks for the "clapper" above...Janata Party President Subramanian Swamy today released a set of documents to prove that Union Home Minister P Chidambaram discussed with former Telecom Minister A Raja in may-June 2008 the issue of pricing of the 2G Spectrum at 2001 rates.
Releasing Finance Ministry documents dated July 4, 2008, he told a press conference here that Chidambaram, then the Finance Minister, and Raja had agreed upon fixing the pricing of 2G spectrum.
The documents also show that they discussed spectrum usage charge and also the pricing for 3G bandwidth. The new 2G licences were distributed in January, 2008 by Raja who is facing prosecution.
"I am releasing these documents to demolish any argument that meeting between Chidambaram and Raja did not take place. There is no ambiguity (that they met)," said Swamy, a petitioner in the case on the multi-crore scam, who has sought making Chidambaram a co-accused.
"It has been agreed that the base price of 2G spectrum shall be determined by taking the entry fee of Rs 1,650 crore determined in 2003-04 for pan-India operation of UASL licensees as a price of spectrum for 6.2 mhz of bandwidth for GSM operators", the document said.
This was the 2001 rate adopted by NDA government, Swamy said.
"The document shows it (pricing) was an agreement. It comes clear," he said and claimed the two had met four times.
