HC allows POTA convict to walk free after 10 years in jail
New Delhi: A POTA convict, who was awarded a 14-year jail-term for role in Hizbul Mujahideen funding and has been incarcerated for a decade, will be able to walk free after Delhi High Court modified the sentence saying maximum punishment for the offence was "severe and harsh" on him. :-?

A division bench of justices Sanjiv Khanna and Siddharth Mridul upheld the conviction of Zafar Umar Khan, a Jammu and Kashmir resident, under the stringent anti-terror law Prevention of Terrorism Act (POTA) and the Arms Act but directed that he would be released on the sentence undergone for the offence under POTA.

The court noted that the tragedy of losing a young son, who fell to the bullets of militants, would have adversely impacted Khan's personal life and there "is nothing on record" to suggest that he himself had carried out any terrorist attack.

"The appellant (Khan) has been in detention since May 13, 2003 and has suffered incarceration for nearly 10 years... We are, therefore, inclined to modify the order of sentence and direct that Khan would be released on the sentence undergone for the offence under the POTA (sentence of nearly 9 years and 10 months)," the court said.

It uphold the conviction and sentence under the Arms Act and asked the convict to pay fine of Rs 10,000 each for the offence under Section 22(2) of POTA and the Arms Act.

"We feel that the maximum sentence of fourteen years for offence under Section 22(2) POTA is considerably severe and harsh on the appellant," the court said and considered the prosecution version that Khan lost his son to bullets of terrorists and his uncle also died under suspicious circumstances.

"He was aggrieved as suitable ex gratia payments were not made on his son's death. The tragedy of losing a young son would have adversely impacted appellant's personal life," the court said in the judgement. Oh yeah I am quite sure the victims of terror attacks enjoy each and every moment of there life after the attacks

Khan was arrested on May 13, 2003 for receiving the cash amount of Rs four lakh from a man as a 'hawala' transaction under the directives of terrorist group Hizbul Mujahideen.

The court observed saying "the evil consequences and pernicious effect of being involved in funding or passing on money for the purpose of terrorism cannot be understated. Terrorism affects the very fabric of the society and results in needless violence and loss of lives." But still for the sake of "justice" it's all ok ok to fund terror activity it's not s big deal you know

"It is noticeable that the appellant got involved with the terrorists in the month of November, 2002 till he was caught and arrested. There is nothing on record to suggest that he himself had carried out any terrorist attack. His guilt is reflected in the confession statement from which he has not retracted. So emotional !!!! :roll:

"The appellant, therefore, can be given the benefit that he has repented and would not indulge in any such activities in future," the bench said. :rotfl:

The trial court on January 4, 2011 had awarded 14 years jail to Khan and took into account his confessional statement which confirmed that he had received the cash amount.

Khan was nabbed by Special Cell of the Delhi Police near Vir Bhoomi in the national capital in May 2003, with four lakh, a pistol and nine live cartridges.

I have been frantically looking for the contact phone number of the alphabet soup IB in Chennai, but all I see through Google are tender documents with postal address in Dilli.

A road side tea stall vendor understood the severity of Dilsukhnagar bomb blasts and importance of internal security. He spent Rs3500 to purchase a handheld metal detector and hired a old man to check every new customer's bag and vehicle before serving them tea.

When will the city, state and central govts do their duty?

You should be able to find Q branch, DIB, state intel officer phone numbers and email quite easily. IB is harder to get ahold of. I'd speak to Q branch if the matter is TN related as they work closely with IB

4 ‘moral police’ held for attack
As many as four were arrested and were produced before court in connection with the moral policing act that took place in Kaup on Wednesday.

Sources in the police department said that the four accused Jalaluddhin, Tousif, Mobin and Nasir were arrested and were produced before the court. All are localities and are from Ucchila and Kaup. They attacked two Hindu boys while returning from Rajatadri in Manipal along with their classmates.

There were two Muslim girls and the group attacked the students and thrashed the boys severely. The sources added the accused have agreed against the crime and it is said that they indulged in such violence owing to the presence of Muslim girls in the student group.

The terror modules in Hubli and Bangalore were handled chiefly by Zakir alias Ustad, says the NIA charge sheet. However, the agency has failed to nab him yet.

The charge sheet alleges that Shoaib Ahmed Mirza alias Chottu received three illegal firearms from an unknown person on the instructions of Zakir in June 2012 at the Bangalore Islamic Foundation Trust (BIFT) library.

Shoaib, Abdul Hakeem Jamadar, Riyaz Ahmed Byahatti, Ubedulla Bahadur, Wahid Hussain, Mohammed Sadiq Lashkar and Mehboob Bagalakote had trained in firearm shooting on the outskirts of Hubli and Dandeli. One of the three weapons was found to be defective and hence returned to the same man on the instructions of Zakir.

During investigations, NIA claims Wahid Hussain and Ubedulla Bahadur led them to Bidnal village in Hubli and places in Dandeli where they trained in weaponry.

The police have also seized two used cartridges from Bidnal village. However, the agency has failed to identify the man who provided weapons — a major missing link in the case.
The charge sheet alleges that the accused, in furtherance of their conspiracy, planned to commit dacoity /robbery of jewellery shops in Hubli to raise funds for their terror activities.

The charge sheet says the accused had treated the amount to be raised as Mal-e-Ghanimat (spoils of war).
All digital evidence collected were sent to the Central Forensic Laboratory, Hyderabad, and opinion obtained. NIA has said it served notices to e-mail service providers and obtained details of e-mail accounts of Mohammed Akram, Dr Nayeem Siddique, Dr Zafar Iqbal Sholapur, Ubedulla Bahadur, Riyaz Ahmed Byahatti, Shoaib Ahmed Mirza and Zakir.
The agency has also sent a request to the US to obtain further details under the Mutual Legal Assistance Treaty.

Syed Tanzeem, who was arrested on November 4, 2012, and against whom charge sheet hasn’t been filed yet, was also a part of the plot, alleges NIA.

It says Syed Tanzeem was a member of the Popular Front of India and was introduced to Shoaib Ahmed Mirza by Dr Touseef.

On Shoaib’s instructions, Tanzeem located and surveyed the movements of their target, Pratap Simha, for killing him.

‘ISI moulded two accused’
The National Investigation Agency (NIA) charge sheet in the Bangalore terror module case has alleged a terror conspiracy in Hubli and Bangalore handled by an elaborate network in Riyadh, the Kingdom of Saudi Arabia, consisting mostly men of South Indian origin.

Of the 15 arrested from Bangalore and Hubli, Abdul Hakeem Jamadar (Bangalore) and Dr Zafar Iqbal Sholapur (Hubli) were the kingpins of the module in Karnataka. The two men had visited Pakistan through Iran in 2011-12 on their regular passport.

The charge sheet – a copy of which is with Deccan Herald – says the duo wanted to go to Afghanistan and fight with the Taliban against the American and NATO forces. But Abdul Rehaman alias Farahatullah Ghori, accused in the Gujarat Akshar Dham massacre, intervened and took them to Karachi.

“The two met some of the senior ISI officials Hamid, Mustafa, Abdul Wahed and also LeT operatives like Riyan. These officials motivated them to collect intelligence and carry out espionage activities in India,” says the charge sheet. They were also trained for the same.

The two had acquaintances with Shoaib Ahmed Mirza alias Chottu, Riyaz Ahmed Byahatti, Ubedulla Bahaddur, Wahid Hussain, Mohammed Sadiq Lashkar and Mehboob Bagalakote, as all of them were members of the Popular Front of India and were actively taking part in its activities at its unit in Hubli. The gang came under the influence of Zakir alias Ustad who motivated them to carry out jehadi activities in the State.
Ustad, in the course of the investigation, was identified as Mohammed Shaheed Faisal, who studied engineering at MS Ramaiah College of Engineering in the City between 2004 and 2008. He was a native of Bangalore. NIA, based on the inputs from the accused, drew his portrait and Ram Reddy of Combat Sports Academy, BTM Layout, identified the man as Shaheed.

Motivated by Zakir and their Pakistani handlers, the accused identified targets to be eliminated in Bangalore, Hubli, Hyderabad and Nanded. In its charge sheet, NIA has mentioned their targets as Pratap Simha; Vishveshwar Bhat of a Kannada newspaper; B Dayananda, the then chief of CCB; D M Krishnamraju, the then DCP (Crime); Nyamegouda, ACP (Ulsoorgate), who have handled terror investigations earlier in the City; Prahlad Joshi, MP, Dharwad; Vijay Sankeshwar, Ganu Jaratarkar of Bajrang Dal in Hubli; Srinivas Reddy, corporator, Saidabad; Rajavardhan Reddy and Raja Singh, leaders of Hindu Vahini; and Sahadev Yadav, corporator from BJP, Kurmaguda in Hyderabad.
He went to the Gulf with the help of Mohammed Abdul Majeed of HuJI, presently in Riyadh, brother of another notorious terrorist Shahid Bilal who was gunned down.

Majeed has also been made an accused in the case. He introduced Akram to Siddique bin Osman (LeT operative), a native of Hyderabad, a wanted accused in the Hyderabad terror case who motivated him to carry out jehadi activities in the country.

He also met Mohammed Bhai, an LeT operative wanted in the Sai Baba Temple blast case, Furkhan Bhai of Hyderabad, Dr Imran, Motu Doctor, Dr Osmane Ghani Khan, all natives of Karnataka working for LeT.

Ustad alias Zakir was also present at these meetings held in Riyadh and Dammam where the terror conspiracy was etched out in great detail.

Gist of story above in English..
Riots erupted in Udgir city yesterday (16th march 2013) when Muslims tried to hoist the green Islamic flag over the fort of Udgir (which was won over by Marathas in 1760 after battle of udgir). They removed the saffron flag which has been there on fort since 1760 and replaced it with green flag. When Hindus protested, in preplanned manner Muslims rioted in the city. They attacked Police-station first and assaulted police officers. POlice arrested 100 Muslims and 8 Hindus for rioting.

On 14th and 15th of March, Muslims had organized an Ijtema (A congregation typically organized by Tablighi Jamaat) in udgir and abour 150,000 to 200,000 Muslims had gathered in town. The fort encloses a Samadhi of a Hindu saint "Udaagir Baba" (local Hindus hold this shrine in high regards) was desecrated by hoisting green flags here. Hindus have appealed the government to act else they will start fasting. ( :rotfl: :evil: :eek: :roll: :(( mixed feelings really - Really?? A fast??)

Hindus tried to put back the saffron flag on fort and on the samadhi shrine but Muslim mobs did not allow them and police tried to stop and maintain status-quo by firing tear-gas, but nothing really stopped them.

(1) Amaresh is one of many HIndu jihadis, who are willing to take violence to Hindus to prove their allegiance to the faith - people like Nilim Dutta also come to mind. For this allegiance, they can get away with anything - in fact, a common chain snatcher like Nilim had the Home MOS interfere on his behalf, due to these traits.
(2) Amaresh openly threatens violence and possibly gets away with some (and has been doing so for some time). After he joined Congress, his Father In Law got mysteriously declared innocent and released for a rape and murder conviction.

The first one worries me more - this category of people, including Mridu Rai, Shivam Vij, Amaresh etc, are very dangerous for India.

Hindus have another deadly weapon in their arsenal if attacked by Muslims -- sing Ram Dhun while playing manjeera. It seems Gandhi's ghost is still haunting the brains of Hindus.

On a serious note, the Muslims have also captured Prithviraj's fort Taragarh at Ajmer.

Simply put, it argues that the Election Commission of India has no power to disqualify a candidate on the basis of his or her poll expenditure accounts, even if those have been falsified. It holds that the ECI’s power to disqualify a candidate “arises only in the event of failure to lodge an account of expenses and not for any other reason…” The government is, in the process, calling for a radical and dangerous change in the way polls are conducted in India. Jharkhand govt bows to Maoist diktat
RANCHI: The war between Maoists and security forces has now spilled over into building plans. The former has threatened to blow up all double and multi-storey buildings, forcing the Jharkhand government to amend building plans in rebel-dominated areas.

Sources said that a number of building plans were changed as Maoists, in the last few months, have targeted such buildings, including panchayats and health centres, as they were apprehensive that security personnel would use the first floors as transit camps.

Caught in a bind, the government is making plans for construction of single-storey buildings to save the property from damage, says a source. "After a review of attacks, we realized it is better to change the building plan than get it damaged as was done by rebels in Latehar district," he says.

The rebels have in the past shown that they mean business. They have blown up a health centre in Serangda village and a panchayat building in Pochra village. "As the two buildings were located at strategic places and forces stationed there could easily keep an eye on movements, the rebels targeted these buildings," says a source.

Sirjee, the SC upholding the case after due consideration of evidence has no bearing on your feelings? May be you could please explain why you think that he merits release?

It was due to the interference of Bal Thakeray that the TADA charge was unfairly removed.

Other similar accused were tried under TADA except this guy.

Unless it was a typo, Habal is talking about Sunil Dutt and not Sanjay.

By all accounts Sunil Dutt was an honourable man and can't be held responsible for the actions of his junkie, terrorist sympathiser of a son.
