A Delhi court on Saturday allowed the accused in the December 16 Indian gangrape case to bring two more witnesses in their defence and fixed August 22 for start of hearing the final arguments in the case.
Additional Sessions Judge Yogesh Khanna, while fixing the date for final arguments in the case, directed the counsel for accused Vinay Sharma and Pawan Gupta to close their evidence on Monday without making any "delay or excuses".
"I am fixing Thursday (August 22) for final arguments, so now conclude your (accused) evidence before it," the judge said, adding no further chance will be given to them.
The court's order came on an application filed by Vinay who had sought to call three new witnesses to establish that the prosecution witnesses, whose statements were recorded by the court, were "false" and were "tutored".
Vinay's counsel had said the prosecution was allowed to bring their witnesses during recording of defence witness' testimonies.
"If they were allowed to bring new witnesses, we should also be given an opportunity to produce our witness in the interest of justice and fair trial on behalf of the accused," the counsel added.
The counsel for Pawan Gupta had also sought the court's direction to bring one witness as he could not depose earlier for the reason that his son-in-law expired at that time.
The court had already concluded recording statements of the defence witnesses in the case but it observed the accused should be given a last chance in the interest of justice and for a fair trial.
The court, while allowing two defence witnesses, said "this is the last opportunity for you (Vinay and Pawan) to close your defence evidence in the case".
The judge, in his order, also said the prosecution will first put forward its points and it will be followed by the arguments of the defence counsel.
Vinay had claimed that on December 16, he had gone to a music event organised by the Church in the DDA district park at Hauz Khas in south Delhi and co-accused Pawan Gupta was also present there. However, his claim was refuted by prosecution witnesses.
The court has recorded the statements of 85 prosecution witnesses.
According to the prosecution, Ram Singh, Vinay, Akshay, Pawan Gupta and Mukesh had allegedly gangraped the girl in a moving bus. The victim died of injuries on December 29 last year while undergoing treatment in a Singapore hospital.
During the trial, Ram Singh was found dead in Tihar Jail here on March 11 and court proceedings against him stand abated. The sixth accused, a juvenile, is facing inquiry before the juvenile justice board here.

The tiral in Delhi case is not yet concluded and criminals are yet to be punished. In between there were many such cases. This Mumbai gangrape is just one out of more than 20000 cases per year. However this is exceptional in the sense that the rape was committed by strangers. most of them seem to have criminal records and they were quite confident and fully aware of the surroundings . They even seems to have asked the victim and her friend whether they had permission to photoshoot the property and that they are trespassing. They wanted to put victim in defensive position. Probably theu would have committed such crimes earlier. Being from the nearby locality, they might have been patronised by local gundas and politicians.

And one of them allegedly happens to be Juvenile.MUMBAI: A second accused in the brutal gang rape of a 23-year-old photojournalist was on Saturday arrested from south Mumbai even as police launched a manhunt for three others in the case, which sparked a wave of protests.
Accused Vijay Jadhav was picked up in the wee hours from Madanpura area by the crime branch.
On Friday, an unemployed youth from south Mumbai identified as Chand Babu Sattat Shaikh alias Mohammed Abdul (19), was arrested in the case. He had named all the four co-accused out of which three — Qasim Bengali, Saleem and Ashfaq— are still at large.
According to Mumbai Police Commissioner Satyapal Singh, more than 20 teams, including 10 from the elite Crime Branch, have been formed to track down the perpetrators amid mounting public pressure and anger.
Singh Friday, said police was trying to gather "clinching evidence" to ensure that the culprits get maximum punishment for the "shocking crime".
The victim, an intern with an English magazine was gang-raped allegedly by five men on Thursday evening when she and her male colleague went to the deserted Shakti Mills compound in Lower Parel area for taking photographs in connection with a story on city chawls.
The five accused, whose sketches were released on Friday, tied up the victim's friend and raped the woman in a chilling reminder of the December gang rape in Delhi.
The young scribe, who resides in western suburbs, has been admitted to Jaslok Hospital and is said to be "composed and stable". Preliminary reports suggested that she sustained multiple internal injuries.
"We cannot give you any further information keeping in mind patient confidentiality," Dr Tarang Gianchandani, acting CEO and director (medical services) of Jaslok had said on Friday. "We are doing the needful... she is under strict observation."
Condemning the assault, journalists took to streets to lodge protest. Scribes from various streams, sporting black bands on their arms and mouths, gathered in large numbers at Hutatma Chowk in south Mumbai on Friday demanding that at all necessary steps be taken to ensure that safety and security of journalists and common citizens is not compromised
At 10 pm on Thursday, the 16-year-old who has been accused of raping a photojournalist inside an abandoned textile mill, came to his home in Dhobi Ghat with packed pav bhaji, giving no indication of the crime he had allegedly committed barely three hours back.
The boy, who occasionally earned some money by butchering chicken, had dinner with his grandmother and brother in their tiny shack and went to sleep.
Around 10 am on Friday, he got a call on his phone from a neighbour and friend, asking him to meet near gate number 5 of Dhobi Ghat. Bleary-eyed and groggy, he walked about one kilometre to reach the spot where he found Mumbai Police officers waiting for him.
Known as raat ke baadshah (rulers of the night) across their neighbourhood, the juvenile and his brothers would emerge outside only after sunset, neighbours said. "Recently, they had been caught for petty thefts by the railway police," one neighbour said.

We have very high tolerance for criminals and crimes while ethics and morality take a back seat in everyday life. That is the reason why Congis have taken the decision to overturn the judgement of SC in disqualifying convicted MLA/MPs by passing a shameful amendment. We will tolerate them, the criminal politicians and bureaucrats and this is what we would get in return. No safe place for anyone.

If one checks the Overall conviction rates from Crime Data , one would find that Prosecution and conviction rates are much below par . The national average is 19.45 and All states Average is 18.3%. For murder it is 36.6% and for rape it is 24.2%.Mizoram has good conviction rates in rape cases at 82%., UK 63% and Sikkim 50%. All other states have Low conviction rates.MUMBAI: The conviction rate for crimes against women in India is depressingly low, but Maharashtra's record is even more abysmal than the national average. In cases of rape, for instance, Maharashtra's conviction rate of 16.1% is about two-thirds of the 24.2% that the country averages.
The conviction rate for rape among the bigger states ranges between 10% and 16% for Gujarat, Karnataka, Andhra Pradesh and West Bengal while it is lower than 10% in Jammu & Kashmir. All other major states fare better than Maharashtra.

perhaps they are living under some constitutional loopholes (which is a given).. may be soon or later, they might seek some reservation for minimum 10% quota for jobs.
see they are jobless, so they have to have to be accommodated under our system of living. next would be jailed caste that would seek quota.

Law needs to be changed. I wonder why Kabir was advocating otherwise. Security Agencies have a lot to think how to overcome those terrorist who are underage i.e. below 19 years. Politicians should also fear they as they could become soft targets with little consequence for the perpetrators. A very potent age, impressionable and full of energy.

MUMBAI: The family of the first accused arrested in the gang rape of a young photojournalist here today said he is a minor, a claim, if found true, could see him escape a stringent prison sentence and spend just three years at a correctional facility.
Sarnabai, grandmother of Chand Babu Sattar Shaikh alias Mohammed Abdul, who was arrested on Friday, has produced a certificate before the police which showed his date of birth as 26 February 1997.
The police, however, claim Chand was aged about 19 and dubbed it as attempt by his family to save him. They also claimed Chand had tampered with the document to escape stricter punishment under the anti-rape law which provides for imprisonment of not less than seven years and may extend up to life.
"He is a very good boy. He cannot do such a bad thing. He is only 16 years old. I have document to prove that and I will show it to the court," Sarnabai told reporters at her shanty at a Dhobi Talao slum.
She said Chand had left home at around 5.30pm on Thursday, the day of the incident, and when he returned home at 8pm, he was shivering because of fever.

The prosecution in the December 16 gangrape case today told a court here that the brutal assault meted out to the victim and her male friend by the alleged rapists was with a motive to "eliminate" them so that neither was left alive to narrate the horrific ordeal.
Special Public Prosecutor Dayan Krishnan in his submission before Additional Sessions Judge Yogesh Khanna said that the intestine of the 23-year-old paramedic was damaged with an iron rod, which left her bleeding profusely and finally resulted in her death.
"The victim's (girl) intestine was so damaged that it was impossible for her to survive. The system on which the human body works was completely destroyed by the accused persons by using blunt object (the rods). The injuries were done deliberately with an intention to eliminate the victims (the girl and her male friend), with a clear intention to murder them," the prosecution said during his final arguments in December 16 gangrape-cum-murder case.
Krishnan, said accused Ram Singh (since deceased), his brother Mukesh, Vinay Sharma, Akshay Thakur, Pawan Gupta and the juvenile, who has been tried by the Juvenile Justice Board, attacked the victim's male friend with a intention to kill him at the spot.
"There cannot be a clear case than this. They wanted to kill both the victim and her friend by trying to run the bus over them. The accused had the clear intention to eliminate them so that there will be no victim to tell the story of the December 16 horrific night," he submitted.
"There was no doubt in any mind of the accused that they wanted the victim to keep alive. The intention of the accused was also to eliminate the complainant (girl's male friend)," he added.
According to the prosecution, Ram Singh, Vinay, Akshay, Pawan, Mukesh and also the juvenile had allegedly gangraped the girl in a moving bus after luring her and her 28-year-old male friend who was also assaulted.
The victim's friend, a software engineer, had fractured his limbs during the scuffle. The girl succumbed to her injuries on December 29, 2012 while undergoing treatment in a Singapore hospital.
During the trial, Ram Singh was found dead in Tihar Jail on March 11 and court proceedings against him stand abated. The sixth accused, a juvenile, has been held guilty by JJB of robbing the carpenter while the verdict in the gangrape case is likely to be pronounced on August 31.
Krishnan in his submission also said that the girl and her friend were dragged with their hair from the back of the bus to the front and were thrown out of the moving vehicle.
"Later they tried to crush them under the wheels, but it was their fate which kept them alive. The modus operandi of the accused shows their conduct, that they were on roads to satisfy their lust," the prosecution said.
Relying on the testimony of the youth and the three dying declaration given by the victim, Krishnan said "the statements themselves speaks of commission of injuries by the six and rape by all of them".
Explaining the scene after the crime, Krishnan told the court that there is clear evidence to prove that the accused in pursuance of their plan had distributed the looted articles among themselves, which was recovered from their possessions during the probe.
He also said that there is electronic and medical evidence to establish that each one of them was present in the bus and had committed the crime.
"The entire sequence of facts reflects criminal conspiracy hatched by each of the accused, as they reside in the same locality and knew each other prior to the incident.
"Ram Singh and Akshay Thakur were in possession of the bus, being its staff," Krishnan said, adding that there is no doubt on their being in the bus.

Well, the criminals in this mumbai case seem to be repeat offenders. This is not an opportunistic crime that they all happened to congregate at the same time and got caught in the vortex of crime. The criminals most probably have lot of precedents indulging in other rapes. Their modus operandi would have been honed and when presented an unfortunate opportunity jumped on it. It could even be pre-planned.
This case is probably coming to light, only because the victim/s happened to belong to the press. If the victim was not from press, there is a good chance, this would be page 7 news in a short one two sentence/s, if lucky. There is precedent set by the press to suppress naming and shaming the criminals even after conviction. There is no analysis of what goes wrong with the criminals (no spotlight nada/zippo on these criminals and their background) when the criminals are convicted. There should be hall of shame, naming and shaming and a thorough analysis in the press. Instead these presswallahs indulge in using fake names before conviction and forget about these offenders once convicted.
Why naming and shaming is very important?
Because it will act as a deterrent to opportunistic criminals, only seasoned criminals might be not bothered about it. The press and the govt in cohorts actively suppressed outing of the criminals when criminals are from special interests group be it either someone close to the politicos/admins etc., or vote bank enhancers. Life should be a living nightmare for the criminals, but instead they get immunity from scrutiny and sometime renders them to become legally sanctioned criminals by getting elected to legislative bodies, due to vested interests.

NEW DELHI: Arrest of a 16-year-old in the Mumbai gang-rape case ( how the age of the arrested is changing oveer the time is interesting to note. Toilet does not even doubt this age)has once again brought the issue of involvement of juveniles in serious crimes to the fore. Government data shows crimes by juveniles — specially rape and abduction of women — has seen an exponential rise in the past decade. While rape by juveniles has recorded a 143% spurt, abduction of women has jumped by 380% even though overall rise in juvenile crimes recorded under various sections of the Indian Penal Code (IPC) has been only 50% against figures for 2002. Even theft (64.5%) and murder (86.4%) have recorded smaller jumps compared to rape and abduction by juveniles.
It has also been observed that the share of teens — aged between 16 and 18 — in juvenile crimes has steadily increased. From 48.7% in 2002, it has gone up to 66.5% in 2012. In 2011, it stood at 63.9%.
Maharashtra, in particular, has had a poor show as far as controlling juvenile crimes are concerned. With 4,570 cases of juvenile crimes, Maharashtra was second only to Madhya Pradesh (5,446) and together with states like Assam (2,345), Chhattisgarh (2,180), Rajasthan (1,880) and Andhra Pradesh (1,593) accounted for 64.5% of all juvenile crimes. It also ended up with maximum juvenile arrests — at 4,221 — in the 16-18 age group.
In cases of rape by juveniles too, Maharashtra was among top five states in 2012 with 89 cases, next only to Madhya Pradesh (249), UP (110) and Rajasthan (102). Delhi — notorious for its attitude towards women and infamous for the December 16, 2012 gang rape involving a minor accused — recorded 57 rapes by juveniles last year.
Given that the alleged accused in the Mumbai gang rape have turned out to be petty thieves, Maharashtra has more reasons to worry as it accounts for maximum thefts by juveniles accounting for 19.8% of all juvenile thefts in the country.
A Mumbai Police officer explained, "Controlling juvenile crimes is a challenge as it is not merely linked to law and order but also the socio-economic dynamics of the society. Most juvenile criminals come from extremely poor backgrounds, start with stealing and then slowly start indulging in bigger crimes, including robbery, murder and rape. So many of them go back to their old ways even after getting caught and spending time in juvenile homes. It's not just the fear of the law that will stop this."
Data from National Crime Records Bureau (NCRB) backs the analysis. More than 78% of juvenile criminals came from families earning less than Rs 50,000 a year.

anyone rapes is not a juvenile. PERIOD. how long does it take to prove this? when we have old brain cells governing the nation, nothing gets time to been processed by their degrading brain cells. heck, they don't even know if they are part of a big terror or crime or scam gang cells. they just do their job, because someone who is paying them in black, tells them to do so.
castration should be an immediate punishment followed by lifetime jail.

^^^ When we ask for mutilation and other punishments we expose the same rot within us and the cycle of torture continues. Sorry to sound preachy but what happened to Delhi rape accused "Ram Singh" in Tihar jail is a travesty. He was raped and tortured by other inmates in prison. That is hardly the action of a civilized society. And will not remove the root of the problem and the sickness.
The "Nirbhaya" rapists and "Mumbai" rapists have the same anger, sense of injustice and opportunism in them demonstrated by the "rapist" Tihar inmates. We cannot cheer such demons along.They also rape innocents.
As a society there are only two paths
- What is the most civilized/ deterrent penalty (since there is no remediation for such criminals"
- As a society what can we do to take this out by the root (which is a larger issue)

There is complete awareness of what civil society has to do. There are things that are already on the law books, even a minimal implementation by what passes for governance these days would generate some confidence in justice being rendered.
Since the governance hasgone to sleep, nay has chosen to sleep with the enemy in many cases where justice should have been pursued vigorously, general populace gets some relief when justice is rendered by other means. Unfortunate, but true, when governance pursues anti-thesis of justice, then common man starts to look at vigilantism as last resort that can deliver some semblance of justice.
In the case of Delhi rape victim, the rape victim's brother expressed that one is down and four more to go. It is easy for unaffected parties to proclaim that looking for relief by alternate means is incorrect.
It is even more easy when one is as distant away from the ramifications of such henious crimes to declare from the ramparts of red fort that "some have first right to resources', while ducking under the cover of darkness to receive the dead body of Delhi crime victim, so as not to even allow the decency for victim's family to mourn and go through the grief - all this when one's progeny is safely tucked away abroad.
With such exemplary decency shown by the titular head of governance to the victim and civility shown to the victim's family, is it any wonder that people are grasping for justice- any justice rendered by other means (obviously not palatable to`others). But for the victims and by extension mango man who does not have the luxury to safely tuck one's progeny away, justice by any means is welcomed. Beggars are not choosers etc., applies.

Mumbai gang-rape: fourth accused Kasim Bengali arrested
As outrage over the 22-year-old photojournalist’s gang-rape in Mumbai continued to spread across the nation, Mumbai Police have arrested the suspected leader of the gang of five, Kasim Bengali, on Sunday taking the number of arrests to four, according to television reports.
The photojournalist was raped on Thursday by five men who pretended to be railway officials and accosted her and her male colleague when they had gone for a photoshoot in the deserted Shakti Mill compound at Mahalaxmi.
Announcing the arrests, Mumbai police commissioner Satyapal Singh said, “We should soon be able to arrest the remaining two accused.”
The police caught up with Vijay Jadhav, alias Nanu, 18, at a video parlour in the Madanpura area of south Mumbai early on Saturday morning.
They picked up his friend, Siraj Rehman, alias Ashfaque, in the evening from Govandi.
On Friday, they had arrested Chand Abdul Sattar Shaikh, 19, whose grandmother has claimed that he is a minor.
Shaikh and Jadhav were produced before the holiday magistrate court at Bhoiwada in central Mumbai separately and were both remanded in police custody till August 30. Rehman will be taken to the court on Sunday.
The case was formally transferred to the Mumbai crime branch, which is believed to be closing in on Kasim Bangali, the suspected leader of the gang of five, and Mohammad Saleem Ansari, the fifth accused.
The police suspect the attack was planned as the victim had gone to the Shakti Mills on previous occasions as part of her assignment. They believe one of the accused noticed her at the time.
The survivor, who is undergoing treatment at Jaslok Hospital, was shifted to the floor that comprises VIP suites.
“She is very brave and is coping with the reality,” said Dr Tarang Gianchandani, medical director and acting CEO of the hospital. “She has been eating all her meals and is co-operating in the treatment.”
The case will be the first major test for the new anti-rape law, which provides for the guilty to be kept behind bars throughout their lives in gang-rape cases.
“Where a woman is raped by one or more persons constituting a group…they shall be punished with rigorous imprisonment for a term of not less than 20 years and which may extend to the remainder of these persons’ lives,” says the Criminal Law (Amendment) Act 2013, which came into existence in April following the outrage over the Delhi gang-rape.
But much will depend on the swiftness of the police in arresting the accused and preparing the charge sheet. “The trial shall as far as possible be completed within two months of filing the charge sheet,” the new law states.
In Delhi, Congress president Sonia Gandhi said, “It is a heinous crime… I am saddened and pained.”
The gang-rape resonated in the Lok Sabha, too, with members voicing concern that such incidents continue despite stringent laws. Parliamentary affairs minister Kamal Nath said a report has been sought from the state government and home minister Sushilkumar Shinde will make a statement in the House on Monday

MUMBAI: The Mumbai police on Saturday made two more arrests — Vijay Jadhav (19) and Siraj Khan (26) - in connection with the gang-rape of a 22-year-old photojournalist that has sparked nationwide protests, taking the total number of accused nabbed to three. But the number could easily have been four — one of the accused, Qasim Shaikh (20), escaped because he was unwittingly alerted by a police constable.
Investigations have also revealed that the five accused had planned to kill the photojournalist as well as her male colleague in case they had resisted use of force.
Late on Thursday evening, Qasim, after having committed the crime along with four of his friends, was watching TV at his hutment in Agripada when a constable named Mujawar called him on his mobile phone. So this fellow was known to a police constable, probably a budding politician
"The policeman asked him where he was and said he wanted to make some inquiries," Qasim's mother, Chand Bibi, told ToI.
Qasim immediately changed his shirt, borrowed Rs 50 from his mother and left. He has been untraceable since.
"I kept asking him where he was going in the night, but he said he'd return soon. Hours later, some policemen came to my hutment and, after having inquired about him, warned me not to inform him of their visit," Bibi said.
Qasim has three previous cases of assault and theft against him.
While Chand Shaikh, the first arrested accused, and Vijay Jadhav were produced before the holiday court in Bhoiwada on Saturday and remanded in police custody till August 30, Siraj Khan, initially identified as Ashfaque and believed to be the eldest of the five accused, will be produced before the court on Saturday.
Jadhav was arrested at 3am Saturday from a video club at Dagad chawl in Madanpura, where he had slept after watching a 9pm movie. Khan was picked up at around 4pm from a slum in Govandi where he had fled after the incident.
Jadhav lives with a friend at the latter's tenement at Ramji Barucha Marg, behind Dhobi Ghat at Agripada. Khan lives in Madanpura. Khan is homeless and lives on a footpath at Agripada.
Police said investigations had revealed that the accused had decided to kill the photojournalist and her male colleague, who accompanied her to the abandoned mill complex, in case things got out of hand.
During interrogation, Chand Shaikh told police that Jadhav and Salim (the fifth accused, who is still on the run) had hatched the rape conspiracy.
Chand said that on Thursday evening, Jadhav and Salim were on one side of the deserted Shakti Mills compound at Mahalaxmi, while he, Khan and Qasim (the second accused) were on the other side.
At around 5.30pm, Jadhav and Salim saw the survivor and her male colleague entering the mill compound.
The rape survivor has told the police that she had almost finished taking pictures when two of the accused accosted the two. They told the girl and the boy that their boss had seen them taking pictures on private property without permission, and that they would have to meet the boss. The girl asked the accused to give her the boss's mobile number so that she could talk to him, but the accused told her she had to come along with them.
"At this point, Jadhav and Salim called up Chand on his cell phone and asked him and the other two friends to come over to the other side. As soon as they reached the spot, the five planned the sexual assault," said a police officer.
The five decided to use fictitious names in front of the girl and the boy to conceal identity. While Salim used the name Sajid, Khan became Ashfaque, and Chand was called Rupesh (this was the reason Chand, during interrogation, gave Siraj Khan's name as Ashfaque to the police).
The rape survivor said in her statement, "One of the accused told my colleague that a few days ago, a man had been murdered at that spot and that my colleague was the murderer. I pleaded with them to let us go, but they shouted at me and threatened me. They then took both of us deep inside the mill compound. We offered them our camera and I-phone (worth Rs 30,000 each) and pleaded with them to leave us. They just told us to take off our belts. They then tied my friend's hands with the belts. Three of the accused stayed with my friend, while the other two took me behind a wall."
The survivor, at that point, got a phone call from her mother. "The accused threatened me with a broken bottle and said I should tell my mom everything was fine. I did what they asked me to. My mother again called me, and the accused again made me tell her everything was ok. Since it happened twice, the accused then snatched my phone and switched it off," she said.
When police questioned Chand what their plan was in case the survivor had raised an alarm, Chand said they may have killed her male colleague in order to scare her. If that did not help, they would have killed the girl herself, he said.
Chand said that since they succeeded in subduing the girl, they felt they could get away by clicking her pictures and threatening her that they would make the photos public if she complained. They never thought she would approach the police

महालक्ष्मी में लेडी फोटोग्राफर के साथ हुए गैंग रेप के मामले में मुंबई क्राइम ब्रांच ने दो और आरोपियों विजय जाधव और सलीम उर्फ सिराज को गिरफ्तार किया है। जाधव को मदनपुरा से और सिराज को महालक्ष्मी से पकड़ा गया। मोहम्मद अब्दुल उर्फ चांद नामक आरोपी को शुक्रवार को अरेस्ट किया गया था। उसे शनिवार को कोर्ट में पेश किया गया। कोर्ट ने उसे 30 अगस्त तक पुलिस कस्टडी में भेज दिया। इस केस में अभी दो आरोपी कासिम और सलीम फरार हैं।

क्राइम ब्रांच के एक अधिकारी के मुताबिक, इस गैंग रेप कांड की अब तक की छानबीन में यह सनसनीखेज बात सामने आई है कि इन आरोपियों ने शक्ति मिल कम्पाउंड में और लड़कियों के साथ भी रेप किया है, लेकिन ज्यादातर लड़कियों ने बदनामी के डर से शिकायत ही दर्ज नहीं कराई। इस अधिकारी के मुताबिक, शक्ति मिल कम्पाउंड में एकांत के क्षण गुजारने के लिए ज्यादातर कपल्स आते हैं। इन आरोपियों को यह बात काफी समय से पता थी, इसलिए ये भी वहां अपना ठिकाना बना लेते थे। बाद में वे कपल को या तो ब्लैकमेल कर उनसे रुपये वसूलते थे, या फिर वे लड़कियों के साथ सेक्स करते थे। चूंकि अभी तक किसी भी केस में किसी ने इनके खिलाफ पुलिस में एफआईआर दर्ज नहीं कराई, इसलिए इनकी हिम्मत बढ़ती गई। इस अधिकारी का कहना है कि यह केस सार्वजनिक इसलिए हुआ, क्योंकि लेडी फोटोग्राफर ने हिम्मत दिखाई और वह अपने दोस्त के साथ पुलिस स्टेशन तक पहुंची।

According to this official , most of the couple come to Shakti Mill Compound to spend few moments of solitude together. These accused were aware of this for a long time and they also made the place their hideout. Thereafter, they would blackmail the couple and extort money or rape the girls. Since none had registered FIR with police in any other case so they became emboldened. The officer said that this case became public because the Lady Photographer showed courage and reached the police station with her friend.

एक के बाद एक तीन फिल्में देखी
शुक्रवार सुबह इन्होंने अखबारों में जब यह खबर पढ़ी, तो इन्हें घबराहट हुई। इसके बाद दोनों अपने घरों से निकले और सीधे मराठा मंदिर गए, जहां डीडीएलजे फिल्म 900 हफ्ते बाद भी लगी हुई है। दोनों ने वहां सुबह 12 से 3 बजे का शो देखा। इसके बाद दोनों मदनपुरा के विडियो पार्लर गए और वहां एक और फिल्म देखी। शाम को छह बजे दोनों वहां से निकले और अलग-अलग रास्ते चले गए। रात करीब नौ बजे विजय जाधव फिर मदनपुरा के इसी विडियो पार्लर आया और एक नई फिल्म देखने लगा।
पुलिस की रेड
इसकी टिप जब मुंबई क्राइम ब्रांच को मिली, तो वहां रेड डाली गई। इसी में जाधव पकड़ा गया और उससे पूछताछ के बाद फिर सिराज की महालक्ष्मी से गिरफ्तारी हुई। जाधव से पूछताछ में पता चला कि वह सातवीं तक पढ़ा हुआ है। उसके पिता बीएमसी में हैं। उसके खिलाफ मुंबई सेंट्रल और दादर में रेलवे परिसर में भंगार चोरी के कई मामले दर्ज हैं। जाधव से पूछताछ में यह भी पता चला कि इस रेप कांड का सरगना कासिम था। उसने लेडी फोटोग्राफर के साथ दो बार रेप किया।
बालिग और नाबालिग पर विवाद
शुक्रवार को गिरफ्तार मोहम्मद अब्दुल उर्फ चांद को जब शनिवार को कोर्ट में पेश किया गया, तो उसके परिवार ने दावा किया कि वह नाबालिग है, जबकि पुलिस का दावा है कि उसकी उम्र 19 साल है। चांद का नाबालिग होने का दावा यदि यही पाया गया तो उसे जेल न भेजकर बल्कि बाल सुधारगृह में भेजा जाएगा, जहां उसे अधिकतम तीन साल के बाद छोड़ दिया जाएगा।
बचाने का प्रयास
चांद की तरफ से उसकी दादी ने पुलिस के समक्ष जो प्रमाण पत्र पेश किया, उसमें चांद की जन्मतिथि 26 फरवरी 1997 बताई गई, लेकिन पुलिस का दावा है कि चांद बालिग है और नाबालिग बताकर उसके परिवार द्वारा उसे बचाने का प्रयास किया जा रहा है।

Referring to the claim made by Chand's family that he was just 16 years of age, the police chief said at the time of his arrest in 2011, the records mentioned he was aged 18 years. "None of them is a juvenile. Still, if need arises, we will go for an ossification test to determine his age."
When asked what evidence police expected to gather with the help from forensic experts from outside when, by its own admission, the accused had forced the victim, an intern with an English magazine, to clean up the place after the crime, he said, "no matter how much the accused may try, some evidence is always left behind".
"We have collected scientific evidence from the scene of the crime. More can be collected with the help of forensic experts (from outside)," Singh said.
Singh said police have identified 272 deserted places and dilapidated buildings like the Shakti Mills premises and notices would be sent to their owners or court-appointed receivers to provide for security to prevent such incidents.
"Instructions in this regard would be issued soon. Failure to comply with the directions would invite action," he said.

"We were analysing Qasim's CDRs while trying to trace him, and were going through the contacts he has had the most number of conversations with over the past few months to get an idea of his close friends. A number that figured nearly 60 times in the CDRs of the last one month belongs to a constable with the Agripada police. We made further inquiries after his arrest and learned that he was an informant," a Crime Branch officer said.

Under Juvenile Justice Act, person can face a maximum sentence of three years confinement at a reformatory home.
The case against the juvenile offender had sparked a lot of public outrage with demands being raised to bring down the age to be declared juvenile from 18 to 16 years.
The debate started after it was found that the juvenile accused was just a few months short of turning major at the time of the incident.
In fact, during the pendency of the trial, the juvenile accused attained majority. Yet, he was tried as a juvenile as the law treats a person as a juvenile if at the time of the commission of offence he/she was below 18 years of age.
The doubts that were raised that he was an adult at the time of the incident were put to rest after the board declared him a juvenile on the basis of his school certificates. Though the trial ended in the first week of July, it had to be deferred by the board four times on the ground that the Supreme Court is to decide on maintainability of a PIL seeking fresh interpretation of the term 'juvenile' in the statute.

In the first conviction in the December 16 gangrape case, the juvenile accused was on Saturday found guilty of murder and rape of the 23-year-old girl but he got away with a maximum of three years imprisonment mandated under the juvenile law.
The juvenile who was six months short of 18 years -- the age of majority -- was, however, acquitted by the Juvenile Justice Board of attempt to murder of the paramedic’s male friend, who was the sole eye witness to the incident that shook the nation.
The verdict came under attack from the mother of the victim who said it was not acceptable to her.
“There was no need for these proceedings. We have been fooled. I don’t accept the judgement. What was the need for keeping us waiting for the whole day,” the victim’s mother said after the verdict.
The Board, presided over by Principal Magistrate Geetanjali Goel sentenced the minor to three years in a probation home, the maximum punishment that can be awarded under the Juvenile Justice Act.
The eight months already spent by the juvenile in custody during the inquiry will be considered as period already served and would be deducted from the three years sentence.
The Board had on July 11 also convicted the accused, a cleaner in the bus in which the victim was raped on the fateful night, in another case of robbery.
It awarded him the sentence already undergone by him in the probation home for robbing Ramadhar, a carpenter who had boarded the bus but was thrown out before the gangrape victim and her friend were assaulted.
On the night of December 16, last year, the 23-year-old victim, a paramedic student, was gangraped and brutally assaulted by six persons in a moving bus. The victim later succumbed to her injuries in a Singapore hospital on December 29, last.
The four adult accused are being tried by a fast-track court in Saket here. Another accused Ram Singh was found dead on March 11 in his cell in Tihar Jail and the trial against him has been abated

Watching SP goons defending Bhatkal, 2 years for Rape and Murder i again go to the root causes and it is a basic lack of common sense and ideological blinkers that cause people to be unable to comprehend Right from Wrong. A simple amendment as we have proposed on the other trhead like >16 Adult crime = Adult punishment could not be carried out. The Judiciary was lazy, reeling under Psecularitis and Pnamonia. The Legislature was lazy and callous in enacting a provision to make the necessary amendments. Our Media was lax as it focussed more on Niku antics, trying to put down NM. It is really true that now Ishrat is Desh Ki beti, Bhatkal Desh ka beta, Dawood Desh ka Bhai..par Modi hai Desh ka Dushman. Everyone who was a part of this system that could have bought about the changes to law but didn't falls under the ambit of the Adharmic. The Katju's and Kabirs are the real idiots in this nation. I only am getting abuses for them at this juncture..Shame and shame. But well done BRF..for offering so many solutions exhaustively over 4 months. And when we do have a better set up in place, we shall see many of those being implemented.

In respect of Juveniles Law is not yet changed. Kabir was vociferously opposing the idea of reducing the age or at least making some crimes punishable as is the case in UK ans USA. Subramaniam Swamy has gone to SC challenging this Juvenile Act. Actually it runs counter to IPC wherein those below 16 are treated as minor and awarded lesser punishment. The woman, a resident of Old Shahadara in Delhi, said in her complaint that she had come to meet her friend.
"The woman said that between 7 and 8pm, five men, including the two PAC constables entered their room, overpowered her friend and then raped her," a police officer said.
"On getting information about the rape, police swung into action and arrested four of the accused. Two of them were identified as PAC head constable Banshi Ram Sharma and constable Subhash. Other two accused were Arun Kumar and Bunty, their friends. Their fifth accomplice Jeetu is on the run," the SP said.
PAC 49 battalion circle officer's jeep, which was used by the accused, has been seized, he said.
A case under sections 376 (rape), 392 (robbery), 323 (voluntarily causing hurt) and 334 (voluntarily causing hurt on provocation) has been registered at Noida's Sector 39 police station, and further investigations are on in the case, police said.

What more does the mother want? The fellow has been let off for rape, murder, attempted murder of the friend and the robbery of the other passenger.
Why did the judge give concurrent sentences? He/She could have given three different sentences for the different victims.
I think deep down there is a political connection we are not understanding.
The extreme solicitousness of the trial judges towards the accused is there to see.

That is why it went over their heads that Afroze is getting 2 years only..he will be out and maybe get a SP ticket and in 30 years time may be a big leader. "When the judgment was being delivered by the JJB, presided over by principal magistrate Geetanjali Goel, the victim's younger brother tried to attack the minor," the sources at the board said.
They said victim's brother, who was waiting for the board's decision since morning, suddenly moved towards the juvenile and tried to slap him, after the order was pronounced.
However, the boy was brought under control by those present inside the court room, including the prosecution, defence counsel and the 23-year-old victim's father and mother.
The victim's brother had accompanied the parents to hear the verdict of the board.
After coming out of the JJB, he broke down and expressed disagreement with the quantum of the sentence awarded to the juvenile accused.
"The accused has been sentenced to three years, which is very less for him in comparison to the crime he committed. He should be hanged here only," he said in tears.
Without waiting further, he forced his way along with his parents by pushing the iron gate where policemen were posted.

Most of the sentences given in India run concurrently. Law) CrPC) provides for all sentences to run consequtively exception is made for trial judge to prescribe concurrently sentences. It seems that exception has been made a Rule and Rule is given go by. The reason and its impact is there for all to see.ramana wrote:What more does the mother want? Why did the judge give concurrent sentences? He/She could have given three different sentences for the different victims.

(b) the aggregate punishment shall not exceed twice the amount of punishment which the Court is competent to inflict

That is distressing to learn. I know the recommendations were reluctant to go all the way in removing the line between juvenile and adult but I thought that some modifications were being made. If not it should be done right away to prevent more problems.

The bihar govt as well as the delhi govt do not want to antagonize the minorities.
That's why bhatkal and the juvenile get the kid glove treatment

Asaram Bapu case smells straight out a copy of fake case made out against Jayendra Saraswati.
The timing is also almost perfect. With the coming general election - congress has tried to prove itself more secular that the other by implication possibly the most followed Hindu saint presently in the country.
Now BJP and others are in a dilemma that if they opposes this arrest and the charges, it becomes an easy prey to being labeled a Hindu extremist and in their own view will loose some non-hindu votes they hope to garner.
The timing is also almost perfect. With the coming general election - congress has tried to prove itself more secular that the other by implication possibly the most followed Hindu saint presently in the country.
Now BJP and others are in a dilemma that if they opposes this arrest and the charges, it becomes an easy prey to being labeled a Hindu extremist and in their own view will loose some non-hindu votes they hope to garner.

Asaram bapu or I don't care who, whoever is accused of rape and there is prima facie evidence has to be investigated thoroughly. The minor girl seems to have vividly described what happened. India has lots of fake sanyasins.Not only Hindu saints, but ulemas, Fathers, monks etc have been found to be morally deviant. Everyone must be punished in an exemplary manner.

SS-ji; AFAIK, there is NO rape case against Asaram Bapu, only a case of sexual assault/molestation. The initial FIR filed in Delhi did include rape, but when Jodhpur police went through the statement of the girl who is accusing Asaram Bapu, they realized the case for rape was not made out.
I personally think the media is deliberately sensational in hawking this as a rape case, given such a scenario, will you blame me, to prima facie, support Asaram Bapu?
