I was just wondering that an announcement from Shri. A. Shah that the CAA rules are getting formulated and would be implemented by end of January would now get things more interesting. CAA & rules benefit every one including Sikhs facing prosecution in Muslim majority countries. This could perhaps lead to more 'chatter on the air' and more details on the back stage coordinators may also come out.

I do not live in India and therefore cannot quite understand the law. Could someone please help me understand. Is there is legal provision that allows the SC to establish any committee and secondly is there a legal provision for the SC to stay a law.

somebody should point out to these "self esteemed folks" that the SC also invited the protesting farmer unions to join the committee/ share their concerns. they have chosen to not attend. they cannot go around saying only repeal of the laws completely will work on one hand and then complain about one sided nature of the committee while not participating on the other. Standard commie tactic only.

This could also be setting a stage where they can later claim that it was a one sided committee that decided and so these protests were not wrong. Didn't we have the Aakar patel braying about the SC a few post back already.

hizzonners seem to have stepped back just short of the precipice. That's why the committee chosen by the court is so bland and unappetizing to the protestors.

as it says in many of the really old maps used by seafarers, when they don't know what lies ahead because no one has explored beyond that point, they indicate such areas by writing on the maps "here be dragons"

one thinks that hizzonners may have just caught a glimpse one such dragon in the distance.

as I said before, in this tango, there is only one globally acknowledged alpha.

CJI Bobde has said that SC has the right to stay the implementation of any law for greater good in this case potential for violence on Republic Day. He also said SC cannot abrogate/strike down a law that has been passed by the Parliament and signed by President and is within the Constitution. The Farm laws meet these requirements.

Supreme Court decision to stay a perfectly constitutional law passed by Parliament is weird to say the least. On the face of it, it is a continuation of the unwarranted intrusion of the judiciary into the executive branch.

But, I am wondering if we are seeing a new realignment of governance system of executive power-sharing between Parliament and the Supreme Court, something that is blatantly unconstitutional, but at the same time may be still a pragmatic adjustment considering the political climate.

Looking at the so-called farmers agitation, things are at a stalemate. The agitators won't move, and it is unthinkable for the government to surrender.

The Supreme Court intervention provides a kind of a cover for both parties--the agitators will grumble but there is no other avenue open to them short of going to war against India. So they can say that they respect the Supreme Court and go home.

The government is unhappy at the intrusion of SC but trusts / hopes that the Supreme Court will provide a way for it go forward and get out of the stalemate, in a way that is not too crazy--a few cosmetic or meaningless adjustments to the law (e.g., no land of any farmer will be sold off, which is an absurd and meaningless concern anyway) by some BS committee and all the nuisance will go away.

The cost is an inflation of the Supreme Court's role, something that will eat away at the foundation of the system, but it provides a temporary fix.

I am also looking at previous cases that should have been handled politically or at the local level, like the RJB case, and. before that the allegations of Modi doing the 2002 riots. Supreme Court "solved" those cases in a way that gave cover to a political and administrative system that was not strong enough (or didn't feel strong enough) to take the right action on its own. Seems like there is a pattern.

You didn't answer ramana's question.

Under the democratic constitution, YY has the right to do what he is doing. This is the same democratic constitution that made it possible for Modi to come to power and for Hindus to get some representation after a long time. So, Modi has to proceed with care, "without killing the snake and without breaking the stick."

What Supreme Court is doing isn't under the basic structure doctrine. It is an over application of what's called "plenary powers doctrine".
That those plenary powers - for SC to do "complete justice" in a matter before it - are too broad is because SC interpreted them to be so :D

there is no legal provision nor is there a case for the court to stay any law passed by parliament if there is no challenge or any evidence of infirmities in the law

establishment of a committee by staying a legally sound and unchallenged law is unheard of.

but knowing our hizzonners, they may cite this as a legal precedent for embarking on future constitutional adventures


there is evidence of some strange behavior too in the earlier days. nothing much seems to have changed since then. It's called "pass the parcel"

when AP division was planned, a case was filed in the SC to stop it. SC said there's no such news so we can't admit this case.

During the state division arguments, the court said let the test pass and then we will see

After the division of the state, they said since it got divided nothing can be done.

BTW, the state was divided by the congi govt at the center despite the state legislature passing a resolution saying that they did not want a division. The state too had a congi govt which passed the resolution against the division.

and as the BIF wanted it, the divided state of AP is under the firm grip of the EJs and is today largely converted to xtianity. There is the continuation of the colonial great game in play even today in India pushed by the BIF which can be seen from connecting the dots.

This was during the congi mafia regime when the NAC ruled supreme and the BIF were pulling all the puppet strings

the arrival of Modi has thrown a massive spanner into the works hence earned him the wrath of the very same forces which have pulled down trump in the US.


BTW, this exchange below will have serious ramifications on the executive judiciary relations going forward

the SC went and negated his excellent report almost in toto.

effectively the SC negated its own report because it had appointed lodha to commission the report on behalf of the SC

Defence budget 2021 is set to reflect the modernisation plan of the Armed Forces for the next 5 years which is likely to attract the highest ever hike in the upcoming budget for the sector and a 2-year roll-on acquisition plan is also being made. Indian Defence forces are moving ahead with pace to become 'Atmnirbhar' with minimum dependence on foreign weapons, equipment and technology. In order to achieve self-reliance, Defence budget can be hiked to reach 6 lakh crore figure.
Chief of Army Staff General MM Narawane said on Tuesday that, "We had got the biggest chunk of the national budget that was,15 per cent of the national budget last year but this year situation being more demanding due to the ongoing tensions with China along the LAC, we expect to get a higher budget this year."

General Narawane also emphasized on the need for technological advancements that require a high budget. In view of the challenge of the China People's Liberation Army in Ladakh and the continued treachery of Pakistan along the Line of Control, a long-term outline of military preparations is being prepared in the Ministry of Defense's Military Department. After the creation of the post of Chief of Defense, the defence budget of this time will be allocated on the basis of the joint modernization roadmap of the three armies.

According to defence sources, in view of the ongoing tension along the border, there may be an unprecedented increase in the budget for the situation of war on two fronts. The Chief of Defense Staff has been supervising a 5-year Safeguard Modernization Plan. Not only this, a two-year annual roll-on plan is also being made under the Integrated Capability Development Plan to make arrangements to counter the enemy in the capacity of the three armies.
Talks are going on with the Finance Ministry to create a Defense Modernization Fund which gets carried out to next year in case it is not spent without getting lapse. The Ministry has emphasized that military procurement and construction of infrastructure facilities such as roads and bridges etc. goes on for a long time, so it is not possible to spend the budget in a year.

There have been indications that not only will the budget be arranged for the expenditure in the defence sector for one year but also according to the estimate of the next five years in the budget. It is estimated that this time there will be an unprecedented increase in the defence budget, giving a strong message to China.

A provision of Rs 4,71,000 crore was made in the defence budget for the year 2020-21, but in this,Rs 1,33,000 was only for pension. So there was only Rs 3,23,000 crore left for defence expenditure. There was also a provision of about Rs 1,00,000 crore for defence modernization.

The Ministry has sound reasons for more defence budget this time. The target is to complete the work of the integration of the three armies in the next 3 years. For this, these three new commands have to be created:
1.Defense space agency
2.Defense Cyber ​​Agency
3.Military Forces Special Operations Division.
Two other commands whose blueprints are being prepared by involving the three armies are:
1.-Air Defense Command
2. -Sea Command

The Defense Ministry is also continuously working on reducing its pension budget which has increased from Rs 1,17,000 crore to 1,33,000 crore. Initiatives have been taken to increase the age of retirement of soldiers. According to defence sources, work is also underway on a scheme for the officers of the Short Service Commission so that the expenditure of pension on this head can also be eliminated.

However, India's defence budget remains nowhere compared to China. China has a defence budget of about $ 45 billion which is five times more than India's defence budget. Officially China's defence budget was said to be 167 billion dollars, but according to an estimate by the International Institute of Strategic Affairs, Sipri, the Chinese budget is more than 254 billion dollars.

Two major steps are also being taken for the in-house resources of the defence forces. A Defense Renewal Fund will be created in which funds will be raised from the monetization of defence sector land. Secondly, Rs 40,000 crore will be raised in the next 8 years through National Building Construction Corporation Limited on the lines of self-financing to build 80 thousand houses of soldiers.

Apart from this, the Ministry of Defense has leased land from governments in many states and the state governments require land for roads and other facilities.
These plans will be instrumental in strengthening the defence forces with the spirit of 'Atmnirbhar Bharat' .

Basic Rule: Supreme Court is 'Right' because it is the 'Last Word'. Supreme Court is not the 'Last Word' because it is 'Right'.

On the farmer issue, wasn't this issue a law enforcement problem to begin with, and after SC's interference, still remains a law enforcement problem? The only difference is that now GoI could clear the farmers from dharna site at the directive of SC instead appearing to do on its own. Not sure GoI achieved anything by bringing in SC (or at least dragging the issue it knowing well that it would go to SC). Perhaps there is some deep math beyond the reach of aam abdul. Not saying that clearing the farmers with little damage is any easy task. BIF forces will continue to spin the clearing of farmers as Modi gvt. using force on poor, helpless farmers. In the past, political parties have found it to be expedient to approach SC on many things that were, in principal, not in the purview of the SC. Bringing SC to the party is a doubled edged sword. In their response (below) they are actually saying that GoI's inaction is forcing them to do something (knowing probably well it is not their bizzness). I was really hoping for those angel hawkers who magically appear to distribute free food/snacks to protesters, eating of which causes masses to rush to nearest toilet; clearing the protest sites. I thought pizza would do, but it didn't :D

Twitter, which has been facing a massive backlash across the world for stifling the freedom of speech by banning the sitting President of the United States Donald Trump over ideological issues, on Tuesday ironically posted a tweet condemning the Ugandan authorities blocking social media apps in the run-up to an election in the African country.

According to the reports, the Uganda government on Tuesday through the Uganda Communications Commission (UCC) has ordered internet service providers to block access to social media applications and websites. It was reported that Twitter and Facebook were trying to interfere in the elections by blocking certain pro-government voices.

The decision to ban social media companies comes as retaliation after Facebook had arbitrarily deleted some government-linked accounts.

Facebook claimed that it removed the accounts for seeking to manipulate public debate ahead of the election, adding that they were tied to the Ministry for Information and Technology. Uganda struck back at Facebook and Twitter by banning them from the internet after they started censoring Uganda officials ahead of the elections.

Following the decision to ban to social media apps, the President of Uganda Yoweri K Museveni said, “these platforms should be used equitably, if you want to take any parts, then you can’t operate in Uganda, because Uganda is our country, we can’t accept them to decide who is good and who is bad.”

“I apologize that the Government of Uganda has closed Facebook in Uganda, this is very unfortunate but inevitable. If they are to operate here, they have to be equitable,” President Museveni added.

Taking to Twitter, the Ugandan government said, “We demand that Facebook & Twitter write directly to the individuals that lost their accounts. Since Facebook cited MoICT of Uganda in their statement, let them write to us so that there’s a chance for a fair hearing. Accounts lost on Facebook belong to the Government of Uganda employees.

Twitter outrages over ban, claims violated ‘human rights’
Following the temporary ban on social media apps in Uganda, Twitter ‘tweeted’ to condemn the Ugandan government’s action to stop tech giants interference in the elections.

Just days after arbitrarily banning US President Donald Trump, after months of stopping posts about alleged election fraud in the US, and literally carrying out a witch hunt against the outgoing US President to favour his opponent, Twitter flaunted its hypocrisy by claiming that ban on social media apps was nothing but ‘censoring speech’ and basic ‘human rights’ in an election.

The under-fire micro-blogging site posted a tweet saying, “Ahead of the Ugandan election, we’re hearing reports that internet service providers are being ordered to block social media and messaging apps. We strongly condemn internet shutdowns- they are hugely harmful and violate basic human rights and the principles of #openinternet.”

Twitter also said that earlier this week in close coordination with their peers, they had suspended a number of accounts targeting the election in Uganda. If we can attribute any of this activity to state-backed actors, we will disclose to our archive of information operations, it added.

“Access to information and freedom of expression, including the public conversation on Twitter, is never more important than during democratic processes, particularly elections,” Twitter claimed in a tweet exposing its own hypocrisy over the issue of free speech on the internet.

Big-techs election interference in US Presidential elections and banning of POTUS Trump

Allegations of election interference by Big-tech became a huge issue in the run-up to the US Presidential elections last year after social media giants such as Facebook, Twitter along with Google began to censor and manipulate the accounts linked to conservatives and Republican party supporters, thus giving an unfair advantage for the radical left and Democrats to further their propaganda in the US elections.

Addition to that, Big Tech such as Facebook, Google and Twitter have made it very clear that they have Democrat-leaning bias and they work towards unjustly silencing Republican voices on their platforms.

After censuring his content, Twitter and Facebook also took an extreme step of banning the sitting President of United States – Donald Trump from its platforms citing that he had incited violence ahead of the Capitol Hill protests that erupted in Washington DC.

Facebook WhatsApp and Twitter need to be regulated and taxed according to the ad revenues they generate. The data needs to be kept locally. If they are not amenable put in restrictions.

Well for starters, they are equating themselves with the Americans and see them more allied with India., going down that lane , they might as well be replaced by India !!.. the Chinese give them the diplomatic middle finger every time they do this., and that too to their face. From a distance, the Nikita Tomar murder case of Faridabad seems like an open-and-shut case.

A viral video clearly showed the key accused Mohammed Tausif shooting Nikita in point blank range. Yet, fighting the murder case against Tausif legally in court is proving to be an onerous task for Nikita’s family.

Nikita’s father Moolchand Tomar recently turned to local social organisations requesting for support. He told the organisation heads that he was on the verge of giving up the legal fight as he just could not do it all alone.

Two weeks ago, Tomar lost his job for taking too many offs for court hearings.

Tomar told the gathering he had no idea that proving the charges was going to be so challenging. “I am told that everything hangs on the testimony of witnesses and they can be bought with money. The other party [Tausif’s side] is powerful and has hired some of the most expensive lawyers,” said Tomar.

“I am also told that even if he gets convicted by the district court, he can go to the high court. How am I going to continue the fight? I have already exhausted all my resources,” he said.

Tomar said that two months into the court case, he has realised that the legal system works in far more complicated ways than he had assumed and the process is way costlier than he had imagined. “We need a lawyer at every step. Every trip to the court needs money. I don’t want to take any names but even policemen ask for money for doing their job,” he said.

The activist said that it is being repeatedly observed that the government gives prompt monetary relief to victims belonging to Muslim community, but does not extend the gesture to Hindus, especially “savarnas” (non-Dalits).

To make his point, Gaud cited the 2015 case where two Dalit children were allegedly burnt to death by members of an upper caste community in Sunperh village of Faridabad, and the 2017 case where a 16-year-old Muslim boy Junaid was allegedly killed by some fellow passengers belonging to Hindu religion over a seat-related dispute in a train.

“In both cases, prominent opposition leaders like Rahul Gandhi visited the families. The Khattar government gave the families jobs and compensation. How is it that the state government is able to help those victim families immediately but not families like Nikita’s? Why are savarna Hindus repeatedly ignored?” he said.

Brij Bhushan Saini said that Hindus in general are ignored by various state governments. He cited the 2015 case in Uttar Pradesh where a Muslim man named Mohammed Akhlaq was allegedly beaten up by a crowd of Hindus for slaughtering a cow. The then Akhilesh Yadav government gave the family four flats in Greater Noida and about Rs 45 lakh.

You are correct. It is a state v/s "Tausif" case. And Sr. Tomar is a prosecution witness. A murder trial in India goes for ages. Trials gets postponed for pretty much any reason. The accused have much more loop holes available. And if the state government itself is "secular" then they too can deliberately delay the case. And in this time period witnesses will lose interest, they can be paid money and turned hostile and there are multiple levels of appeals where this drama can go on and on. For a person who is not rich, or need to work every day to make a living; they cannot afford to be in courts day after day.

For your reference is a classic case from Kerala; Sister Abhaya murder case. Case happened in 1992, and it is three weeks back in 2021 that a CBI Special court (equal to a Sessions court) have found two accused guilty :rotfl: . Here too "secularism" by successive governments had a good role in the delays. And note; the guilty still have provisions to file appeals in High Court and Supreme Court where again there can be review of every single witness statement, material evidences etc. (though witnesses generally will not be summoned again).

The Narendra Modi government is set to launch a new flagship programme to provide piped water supply and tap connections to all households in urban areas with less than one lakh population, reports The Economic Times.

Named as Jal Jeevan Mission (Urban), the union government is expected to earmark Rs 1.35 lakh crore for the mission which will be implemented over the next five years.

The Union Budget for 2021-22 may include this mission and the housing and urban affairs ministry would be the nodal agency.
