Anonymity not a fundamental right, says Centre in Twitter case

The government’s stand came in response to a petition by Twitter, which opposed the Centre’s orders to block accounts 39 accounts last year. The government contended the social media company was “not taking effective steps to prevent the spread of fake news or deliberate misinformation, and as such, misinformation content relating to sovereignty and integrity, national security or public order related issues are on the rise.”

^ This point. SC recognized the right to privacy when upholding Aadhar. Interesting argument that such a right does not extend to those not known to be Indian citizens.
Furthermore, there is no fundamental right of anonymity under Part III of the constitution. The only right guaranteed is the right to remain silent. As fortiori (as a result), the petitioner (Twitter) cannot defend Article 19 rights (freedom of speech and expression) of its unverified, untraceable and anonymous users. The said right is only available to an identified citizen of the country,

Bappi Lahiri's 'Jimmy, Jimmy' becomes new anthem for Chinese to protest Covid lockdowns
BEIJING: Millions of Chinese suffering the dreaded lockdowns have turned to Hindi cinema legend Bappi Lahiri's superhit song "Jimmy Jimmy Aaja Aaja" from 1982 movie "Disco Dancer" to express their anger and frustration over the country's stringent zero-Covid policy.
In the Chinese social media networks Douyin - the Chinese name for TikTok, the song composed by Lahiri and sung by Parvati Khan is sung in Mandarin "Jie mi, jie mi", which translates into "Give me rice, give me rice", by people in the videos mockingly showing empty vessels to show how they are deprived of essential food items during the lockdowns.
The video has so far managed to escape Chinese censors that are quick to remove any post deemed critical of the country's regime.
Indian movies have always enjoyed huge popularity in China, starting from the days of cinema legend Raj Kapoor in 1950s and 60s to the recent years when films such as "3 Idiots", "Secret Superstar", "Hindi Medium", "Dangal" and "Andhadhun" performed exceptionally well at the Chinese box office.
Observers say Chinese have found a smart way of using "Jie mi, jie mi" to make soft protests in their bid to highlight the public plight over the zero-Covid policy, which has literally cut-off China from the outside world.
China has been bogged down with zero-Covid policy under which dozens of cities, including Shanghai which has a population over 25 million, were under lockdown for weeks with people confined to their flats.
Scores of videos have surfaced in which security officials can be seen severely cracking down on people protesting the lockdowns.
In the latest protests, workers engaged to assemble Apple Inc.'s newest iPhone staged a walkout from a factory in central China's Zhengzhou following a virus outbreak and complaints of unsafe working conditions.
Reports said workers started leaving the Foxconn factory after some of them fell ill in mid-October and received no treatment.

Leaked Documents Outline DHS’s Plans to Police Disinformation
THE DEPARTMENT OF HOMELAND SECURITY is quietly broadening its efforts to curb speech it considers dangerous, an investigation by The Intercept has found. Years of internal DHS memos, emails, and documents — obtained via leaks and an ongoing lawsuit, as well as public documents — illustrate an expansive effort by the agency to influence tech platforms.
The work, much of which remains unknown to the American public, came into clearer view earlier this year when DHS announced a new “Disinformation Governance Board”: a panel designed to police misinformation (false information spread unintentionally), disinformation (false information spread intentionally), and malinformation (factual information shared, typically out of context, with harmful intent) that allegedly threatens U.S. interests. While the board was widely ridiculed, immediately scaled back, and then shut down within a few months, other initiatives are underway as DHS pivots to monitoring social media now that its original mandate — the war on terror — has been wound down.
Behind closed doors, and through pressure on private platforms, the U.S. government has used its power to try to shape online discourse. According to meeting minutes and other records appended to a lawsuit filed by Missouri Attorney General Eric Schmitt, a Republican who is also running for Senate, discussions have ranged from the scale and scope of government intervention in online discourse to the mechanics of streamlining takedown requests for false or intentionally misleading information.

New Twitter
owner Elon Musk has pulled more than 50 of his trusted Tesla
employees, mostly software engineers from the Autopilot team, into his Twitter takeover, CNBC has learned.
Musk, who is CEO of automaker Tesla and reusable rocket maker SpaceX, completed the $44 billion acquisition of Twitter on Oct. 28 and made his mark there immediately. He fired the company’s CEO, chief financial officer, policy and legal team leaders right away, and has also dissolved Twitter’s board of directors.
According to internal records viewed by CNBC, employees from Musk’s other companies are now authorized to work at Twitter, including more than 50 from Tesla, two from the Boring Company (which is building underground tunnels) and one from Neuralink (which is developing a brain-computer interface).
Some of Musk’s friends, advisors and backers, including the head of his family office Jared Birchall, angel investor Jason Calacanis, and founding PayPal chief operating officer and venture capitalist David Sacks, are also involved. So are two people who share Musk’s last name, James and Andrew Musk, who have worked at Palantir and Neuralink, respectively.
Among the dozens who Elon Musk enlisted specifically from Tesla are: director of software development Ashok Elluswamy, director of Autopilot and TeslaBot engineering Milan Kovac, senior director of software engineering Maha Virduhagiri; Pete Scheutzow, a senior staff technical program manager, and Jake Nocon, who is part of Tesla’s surveillance unit, as a senior manager of security intelligence.

The moderation team that has been fired/laid off/asked to stay away until Elon decides what to do with the company or its policies were all majorly driving the moderation policies that seemed to overtly favor one group over the other.
It was well know that Twitter had suspended many handles in Indian context under dubious pretexts, (the same moderating team or rules also would have applied). i doubt if it would change in any way in the long run, but right now it seems to be a fight in the Khan land about who gets to censor the speech and Elon not playing ball - whether it is to increase his negotiation leverage going forward or just power tussle between the "free speech" bearers and the other side needs to be seen.

Sure and that comes with the job. Now elon needs to decide what kind of moderation is needed. Also, social media by and large pushes right wing(western context, not Indian) stories as it has been proven time and time again that is what will keep the public engaged. The moderation team that has been fired/laid off/asked to stay away until Elon decides what to do with the company or its policies were all majorly driving the moderation policies that seemed to overtly favor one group over the other.
Elon is not fighting for free speech as his own companies do not adhere to free speech. But he's using the "fighting for free speech" excuse as a cause to raise his profile which is directly tied to many of his finances.
India/BJP need to take advantage of this mess from Elon and demand concessions from him and also use this pretext to move to Indian social media platforms. This timing is ripe for a change and get our say in SM world.

Jay,
The problem is basically the Biden admin trying to police speach on social media platforms covering multiple topics.
Even if you say that prosecution and persucation has not been happening. and I will agree with you on the facts as they stand.
The fact that the government has the access and ability to silence speach on what is public square of the modern time is disturbing.
That is why the original poster stated that they want to get rid of free speech.
The moderation policy of individual social media platform should be for social media platforms to decide.

Biden comments: ELon Musk needs to be probed cos his control over twitter is unacceptable https://www.rt.com/news/566249-biden-mu ... -security/
It is worth looking into whether Elon Musk’s takeover of Twitter is a threat to US national security, President Joe Biden said at a press conference on Wednesday.
As Biden discussed midterm election results, Bloomberg’s Jenny Leonard asked him if he thought Musk was a “threat to US national security” and if the federal government should “investigate his joint acquisition of Twitter with foreign governments, which include the Saudis.”
“I think that… Elon Musk’s… cooperation and or… technical relationships with other countries, uh, is worthy of being looked at,” Biden replied. “Whether or not he is doing anything inappropriate, I’m not suggesting that. I’m suggesting it’s worth being looked at, and uh, um, and that’s all I’ll say.”
Asked “how?” Biden laughed and said, “There’s a lot of ways.”
