On my way to the office I was asked for a lift by a young DP officer who was on his way to one of the CWG venues. We began chatting. He was very young not more then 25 years old. The responsibility and challenges faced by him and his fellow officers are enormous. Upon reaching the venues I wished him to have a Good day he questioned me on that. To which, I replied that a quite day at work for him is a good day for all of us.

There seem to be far too many Pakis roaming aroun in North India, I'm even doubtful of the so called athletes they are sending to Delhi for CWG. Hope they are triple checked because one them could easily be a terrorists contact.Pak national detained at Metro stn
New Delhi: A 35-year-old Pakistani national, who had arrived in the capital four days ago on a pilgrimage, was detained by the CISF at a Metro station in west Delhi on Monday after a woman passenger complained that he was clicking her pictures on his cellphone without her permission. The man was later handed over to the Metro police and was questioned by several other security agencies.
The incident was reported around 1.30pm when the Metro train from Dwarka Sector 9 to Noida City Centre — on Line 3 — entered the Rajouri Garden station. Confirming the incident, an officer of the special cell of Delhi Police said all his travel documents — including passport and visa — were found valid.
Sources said the Pakistani national had arrived in the city from Lahore on Thursday with a group of around 65 others for a pilgrimage to Hazrat Nizamuddin dargah. The group is staying in a hotel at Paharganj.
‘‘The man is being questioned by a joint investigating team consisting of several security agencies. We have not found any objectionable photograph on his mobile,’’ said an investigating officer. ‘‘The police in Paharganj have been directed to go to his hotel and verify his credentials. TNN

NIA currently only has powers to investigate terrorism related crimes. And if I am not mistaken it can take suo moto action on such cases. As per the recent law regaring NIA, crimes of terrorist nature has to be reported to NIA by the jurisdictional state police. CBI on the other hand have rights to investigate any crime in any state, but there again they can only interfere after a State Govt. orders them to do so, or based on a court order.ramana wrote:Its high time that GOI decides to let the NIA have jurisdiction on crimes crossing state boundaries.
Another challenge which NIA would face here is that it would not have the know-how to deal with the local crowd (which differs from state to state). NIA does have people from local state police forces on deputation. But they cannot maintain all the infrastructure to do their work in each and every state.
Even though most of the major Acts in India are drafted at the Central Govt., and is valid all across India (except for the state of J&K), the law enforcement is primarily a state subject (under the state list). So the onus for the law enforcement is mainly with the various state governments. IPC is an all-India law. A CBI (a central police organisation) and a state police uses the same legal provisions when filing a charge sheet. For example Sec.302 IPC (for Murder charges) is used by CBI and the state police. More than IPC, it could be the various police acts and jurisdictional boundaries etc. which may be causing the problem. Like for example can CBI conduct an investigation in Karnataka, without taking Karanataka Government sanction. If I am not miskaten in US, FBI does have such powers.is so vast that crimes of all sorts get covered and it is under local police jurisdiction.

News has just came in that Supreme Court have thrown out the petition asking for the stay on Ayodhya case verdict (by Allahabbad HC).

Let us see now when the Allahabad HC plans to give its verdict. One of the judges in the HC is supposed to retire day after tomorrow. It seems the apex court also would now decide what needs to be done next. Whether the verdict can be given, or a new judge would join the panel of judges and go through the case from page #1.

4-member gang fires at Mantri office in Bangalore
The weekend mood was shattered on Saturday evening when a four-member gang on two motorcycles fired at Mantri Developers’ head office on Vittal Mallya Road. No one was injured though six rounds were fired at the company’s office at around 8.45pm.
Eye-witnesses said the four youths first arrived on the scene and asked one of the security guards for Sushil Mantri, the chairman and managing director, Mantri Developers, a leading builder who is also the sponsor of the ongoing Karnataka Premier League (KPL).
On being told that Mantri was not in the building three of the youths pulled out firearms and fired a total of six bullets at the office board displaying the company name, and around it. (Kyaaa ishtyllee)
The police said while one bullet hit the board, the remaining five harmlessly hit a window and the building. (Oh Diyaar)
One of the four suspected to have been involved in the firing was arrested later by the South-East division police at a check-post in Hulimavu, set up to check drink driving. While the police nabbed the rider, the pillion managed to make good his escape while the police were questioning his partner.
The name of the arrested man has been withheld to ensure smooth investigations. The police suspect Ravi Poojary’s gang to be behind the firing as they found an envelope with a letter saying “Contact RP” along with an international phone number.
Interestingly, just last month, Sushil Mantri had reportedly received a threatening call demanding money. Police said Mantri has been receiving phone calls from Ravi Poojary’s gang members over the last one year. Mantri had complained to Cubbon Park police, after which security was provided to him. Six security guards were present in the Mantri office building when the firing took place.
Alok Kumar, joint commissioner of police (Crime) told DNA that the city police have relayed a message to Interpol to arrest Ravi Poojary.
Poojary, according to sources in Mangalore police, is holed up in Australia at present. The police pressed sniffer dogs into service and collected evidences including empty cartridges of the bullets fired at the site.
Ravi Poojary is alleged to be an underworld don from Mangalore, known to be operating from foreign countries. According to the police, he has been targeting leading builders and businessmen, demanding a cut from their profits after threatening them. His prowess in 'dealing' with hafta collectors reportedly impressed international underworld don Chota Rajan, whose business he ran when Rajan faced threat from Dawood Ibrahim’s lieutenant Chota Shakeel

Some interesting things to be gleaned from the article:
The first part proving the ability of the cyber cell to crack such emails is something most are aware of, but the interesting thing is the second part - the ability to track the mobile phone right to its seller. User tracking is no great shakes and has been used for some time but the ability to track the seller, that too in Manish market, is pretty neat. It seems techint is improving but me thinks humint is what made this happen.Using GPRS, the accused IM cadre surfed into a server based in Norway. The email was already saved in draft folder of [email protected] and was accessed using the GPRS phone at 13:37 hours on September 19 and sent to various media houses. Meanwhile, the police have detained two shop owners from Manish Market because the email sent to various media houses after the firing in Delhi was sent from a second hand mobile phone which was bought from their shop.

Why fore warn anyone, maybe some idiot wahabi would still have made contact and got traced??
Why so friendly with the media? All media is not trustworthy.
Except the stupid bombay ATS, very few talk to the media. Do we have a problem with someone being turned or suborned in this organisation??

Sachin, its an inadvertant mention of the word "Centre", its primarily States. You are correct that L&O is a state subject and even though most of the Laws are enacted by States onus to implement lies primarily on the states. Besides, for focussing attention on specific types of crimes under specific acts , specialised agencies are created which get the power of police , as given under Cr. P.C. , is bestowed upon them. CBI functions under Delhi Special Police Establishment Act and it needs sanction of concerned State Govt to prosecute and also cases are refered to it by the State then only it takes up them for investigation. But certain cases are taken by itself where person being prosecuted is a Central Govt Employee under Prevention of Corruption Act. But once sanction is given it does not get supervised by the States.
NIA now got NIA Act and has the authority to take specific cases related to terrorism and interstate connection etc based on orders of MHA. FBI has more jurisdiction and on federal crimes ( crimes committed in violation of any federal act).
Any new central Law will have to implemented by State police and that is why they become blue -eyed boy.On the other hand it imposes severe strain on the state machinery which is already under stress. Resources have to be managed by State. Centre does not provide any financial support nor does it take into account any additional requirements and demands made upon Police and Judiciary etc. Only in recent years have they provided some grant for revamping various aspects of police organisation under Modernisation of Police Scheme. It is a case of too little and too late.
There is a need to have separate machinery to enforce central Laws in , at least some specific cases. DO you know that we do not have any detention centre when foreign aliens are detained for various reasons. Once sentence is served there is no option but to keep them in prison even though no order is there for custody. Now only a decision has been taken to provide detention centres in each state and that would take years to build with sufficient organisation strength to man it.
Acts provide for special courts ( again state jurisdiction) and no resources . As mundane as a Family court , juvenile courts and what not remain vacant and poor judicial magistrate has to manage , sometimes more that one court. Besides due to resources problem ( excluding splurge in some well known areas) posts are not filled up. That adds to strain and then we blame you know whom.
So the suggestion was whenever centre decides to criminalise an action by some one it must provide required resources finance, manpower and more courts for them. Can't just shrug off saying L&O is a state subject.

I totally agree with you. I haven't been happy with the way things have been going on in the ATS and Crime Branch for some time now, ATS especially. Too much media exposure and leaks to be effective. That being said, the problem is the primacy of Mumbai Police itself. With the CP being nearly equal to the state DGP and Crime Branch usually being led by Joint CP level person similar in rank to the ATS chief, the ATS is finding it difficult to establish itself. If you recall the ATS was setup as the nodal force to deal with all terrorism cases in the state, somewhat like the NIA. But given that most of their work gets done or leads to Mumbai, friction with CB was inevitable. Ironically, the staffing of ATS with many Mumbai cops is what makes it difficult to function according to their mandate (When Maria took over as ATS chief, he took along his team from CB leading to Roy complaining about lack of experienced personnel-just for point of reference only). The idea of having different cops posted to ATS was to enhance cooperation with local forces. But since ATS is a posting and not a career, the Mumbai chaps don't want to run afoul with the CB as they will want to work with them in the future! This results in somewhat of an under performing force making the neta apply some size 14 shoes after any incident. This is what leads to the race to be the first one to 'crack' the case. This is also what leads to the regular media leaks to showcase the 'performance' of each force leading to some embarrassing situations.
Another problem with the ATS is that they are not a very cohesive force, in the sense that each sub unit of the ATS dealing with the different areas of the state is head by a DIG level person. Now each area head tries to 'perform' to improve his career chances leading to what was observed during the Baig-Bilal fiasco

The ATS needs to be overhauled and made a career force rather than just a posting force only, similar to IB or R&AW. This will ensure that there is always a nucleus of officers available for proper execution of the responsibilities. The recent setup of state intelligence academy is a small step in this direction, but more needs to be done. If anything, I would like to see the ATS in a similar mould as the Special Branch was in 80's & 90's but in a state wide arena. ATS will have to be made a behind-the-scenes force assisting local cops deal with issues larger than the general law & order situation. The other easy way out, which some netas have made noises about, is to make CB for Mumbai and ATS for rest of state, something which will seem to satisfy everyone, though it will be an unwise move in my opinion. Since most of the leads originate outside of Mumbai but target Mumbai, you can only imagine the fiasco and turf wars such a move will create.

H S Phoolka, a well-known advocate who has been less than charitable about the role of former prime minister Rajiv Gandhi and senior Congress leader Kamal Nath in the 1984 anti-Sikh riots.
Justice Hosbet Suresh, who is part of a campaign against POSCO.
Ram Puniyani, who has opposed the hanging of Parliament attack convict Afzal Guru.
Apart from Subramanium, the drafting committee includes Teesta Setalvad, Maja Daruwala, Najmi Waziri, P I Jose, Prasad Sirivella, Usha Ramanathan and Vrinda Grover. Farah Naqvi and Harsh Mander are the conveners of the drafting committee and joint conveners of the advisory group.
The advisory group includes Abusaleh Shariff , Asgar Ali Engineer, Gagan Sethi, H S Phoolka, John Dayal, Justice Hosbet Suresh, Kamal Faruqui, Manzoor Alam, Maulana Niaz Farooqui, Ram Puniyani, Rooprekha Verma, Samar Singh, Saumya Uma, Shabnam Hashmi, Sister Mary Scaria, Sukhdeo Thorat, Syed Shahabuddin, Uma Chakravarty, Upendra Baxi and NAC members Aruna Roy, Narendra Jadhav and Anu Aga.
“We will try our best to finish our task by November 15 as fixed by the working group,” NAC member Harsh Mander told The Indian Express. The NAC will have its next meeting on September 24.
The key guiding principles laid down for the proposed Bill include a shift from empowering the State, to seeking action and accountability of State/ public officials, need for an independent national authority to ensure effective compliance with the law “without disturbing the federal structure”, and definition of communal & sectarian violence to cover both isolated incidents as well as mass crimes, against people based on religious, caste, linguistic, regional and other identities.
The guidelines also stress the need to remove prior sanction requirement for hate speech (Sec 153A & 153B IPC) and statutory obligation on government to lay down national standards for the entire spectrum of provisions for victims.
The guidelines also underline the need for amendments in CrPC and Indian Evidence Act to meet extraordinary circumstance of communal and sectarian violence to protect victims' rights and advocated specific provisions for victim-witness rights to be made under this law.
Meanwhile, the NAC on Monday could not finalise the draft food security Bill and decided to hold another round of consultation on September 24.

DR MANMOHAN SINGH TOUCH TASKS TO IDENTIFY
NEW FACES- IN SPY ORGANISATIONS,

NEW DELHI: Prime Minister Manmohan Singh has to fill up five top and sensitive posts in the next four months. An immediate urgency is to find successors to Chief Information Commissioner (CIC) Habibullah Wajahat and Prasad Rao, head of National Technical Research Organisation (NTRO) handling cyber terrorism, as they retire this month end.
Three other sensitive posts to be filled up by January are those of the chiefs of the Central Bureau of Investigation (CBI) and two intelligence agencies -- Intelligence Bureau and Research and Analysis Wing (RAW).
The Prime Minister has to also look for successor to Cabinet Secretary K M Chandrasekhar (62)who was given fourth extension until next June in view of the Commonwealth Games he is overseeing and explore possibility of taking a younger face in place of his principal secretary TKA Nair, a Punjab cadre IAS officer who was pulled out of his retirement to serve him since 2004.
Dr Manmohan Singh is moving cautiously in making the new appointments to avoid the kind of criticism he faced in selection of the Central Vigilance Commissioner (CVC) early this month as Lok Sabha Opposition leader Sushma Swaraj, a member of the selection committee, made an issue over appointing Telecom Secretary P J Thomas to the post despite her opposition.
Insiders say Dr Manmohan Singh has quietly consulted three governors who were at the helm of affairs in the government until recently as he wanted their inputs on who can be the best candidates for the top posts falling vacant in the sensitive organisations.
CIC SELECTION TRICKY: Wajahat, the founder CIC under the Right to Information (RTI) Act, had resigned in August last year to be the first CIC of his homestate Jammu and Kashmir, but his resignation was kept in abeyance. He, however, cannot be given any extension as the RTI Act fixed the upper age limit of 65 that he reaches on September 30 and hence the government is under compulsion to find the successor.
The Prime Minister's worry is that Sushma Swaraj is also a member of the 3-member selection committee that includes himself and the Law Minister and as such there will be fireworks if consensus eludes on choosing the new CIC. An informal consultation has already begun but those pushing the files are under strict warning of no name dropping.
Since the RTI Act gives immense powers to the CIC to put the government into extreme difficulty, sources said the Prime Minister had a meeting with Sonia Gandhi to explain to her that she should not go by her NGO advisers to press for someone from the civil society and not a former bureaucrat to occupy the position.
RETD HAND FOR NTRO: Both serving and retired Intelligence Bureau (IB) are in the race to head NTRO. Former IB Chief P C Haldar, who is now the government's interlocutor in talks with Assam's extremist outfit ULFA since after retirement in 2008, and N C Padhi, an operational spy man of IB who retired three years ago, are looking forward to be rehabilitated in this technology intelligence organisation.
Padhi could have become the IB chief but for then National Security Adviser M K Narayanan's antipathy. Narayanan has moved out to the Kolkata Raj Bhawan and hence Padhi hopes to get a chance, though insider say Narayanan is among the governors the PM still consults while making appointments to the sensitive positions.
If the Government prefers to put NTRO under a service police personnel with enough intelligence experience, there are three serious contenders. Topping the list is Sardar Nischal Sandhu, who is IB's Special Director I, and competing with him is his immediate next colleague Ajit Lal.
Sandhu, a 1973 batch IPS officer of Bihar cadre, has vast experience of serving in IB and RAW and is known as a man of operations with grip on the ground realities in Jammu and Kashmir. He would have been the first head of the National Investigation Agency (NIA) but that was scuttled because it would have brought him in clash with IB Chief Rajiv Mathur as both have equal standing in the IPS cadre. R V Raju got the NIA post as he is two years junior to Mathur and thus does not destabilises the hierarchy balance.
Ajit Lal is junior to Sandhu so far as the cadre goes as he belongs to the 1974 batch of Himachal cadre. He is due for retirement in September next year while Sandhu retires only in January 2012.
NEW IB CHIEF: There is, however, speculation that the PM would prefer a retired hand to handle NTRO and in that eventuality Sandhu, who is No 2 in the IB, is all certain to be its new Director in the new year as present incumbent Rajiv Mathur, a 1972 batch Bihar cadre IPS, retires in December.
In that eventuality, Ajit Lal would have retired at least four months before Sandhu's due retirement age, while Sandhu may continue in the agency with two years of extension alike those in other key posts in the government. Even Mathur is reported to be trying for extension.
CADRE MAN FOR RAW?: The Research and Analysis Wing of the Cabinet Secretariat is always headed by the IPS officers but there is excitement among the RAS (RAW Allied Service) officers that successor to their secretary K C Verma may come from their cadre for the first time. Verma is due for retirement in January.
Though the vacancy occurs only three months from now, the lobbying has already begun to grab the post. Ranjit Mathur and his junior Sanjiv Tripathi, both belonging to RAS cadre, are vying for the top post. Sanjiv is son-in-law of Gauri Shankar Bajpai, who was RAW secretary in 1991-92.
The Prime Minister has been advised by the three governors, two of them former IB chiefs, to tread carefully in deciding the RAW boss as they point out how seven RAS cadre seniors had gone on a protest leave in when IPS officer Avadhesh Mathur (1975) was shifted from IB to RAW as its special director general. The protest was over an "outsider" and that too a junior being thrust upon them while at least three of them, P M Hablikar, Sharad Kumar and Chakru Sinha, were seniors as they belonged to 1973 batch of RAS.

There are at least three contenders to occupy his chair from within the agency. They include Balwinder Singh, an Andhra cadre IPS who may lose the chance because of the charges of bias levelled on him recently by Gujarat IPS officer Geeta Johari embroiled in the Sohrabuddin killing probe. A P Singh, who is also with the CBI and belongs to Bihar cadre, is tipped to get the coveted post.

Delhi Police gets hi-tech devices from IAF, Navy

To reinforce its security apparatus and add more teeth to policing during the Commonwealth Games, the Delhi Police is in the process of procuring hi-tech gadgets from Indian Armed Forces. In view of the frequent intelligence inputs that terrorist outfits may attack using the air route, the Delhi Police has received a Special Radar Vehicle from the Indian Air Force (IAF) that is equipped with sophisticated machinery based on advanced technology.
According to a senior police official, the Special Radar Vehicle will be used for receiving air surveillance information and connecting it to the Command, Control, Communication, Computing and Intelligence centre, commonly known as C4i, of Delhi Police. The C4i centre has been set up on the fourth floor of the police headquarters and it will remain functional during the Games. The heavy camouflage truck has been stationed at the premises of the Delhi Police Headquarters and is connected with the C4i. Sources said that the Indian Navy will also be providing a radar vehicle to the Delhi Police before the Games and that will also be connected to the C4i.
Joint Commissioner of Police (Northern range) Karnal Singh said that the Special Radar Vehicle will be used for receiving air surveillance information. “The radar vehicle installed with modern equipment will function as a relay point between the visual media infrastructure in place at various Games venues and the C4i. The camouflage vehicle has been requisitioned from the Indian Air Force and we will be getting one more radar vehicle but from different department. For the functioning and monitoring of these special equipment a volunteer from the concerned departments will be available in the C4i,” said the Joint CP.
Meanwhile, the Delhi Police has also got the delivery of its much-awaited Mini Remotely Operated Vehicle (MROV), commonly known as ‘Robo-Cop’ that will be used for identifying and defusing bombs without risking its personnel during the Commonwealth Games.
The remote-controlled robot will pick up any object suspected to be an explosive, take it into isolation and defuse it-minimising the danger not just to the public but also to BDS officials. It will place the suspected object inside a Total Containment Vehicle (TCV), a device that was extensively used by the National Security Guard (NSG) in the wake of 2008 serial blasts in Delhi.
The MROV, which costs over `1crore will be moving around the city and (sometimes) stationed at venues during the Games and it will be available with the security wing of Delhi Police. Two jammers have also been procured and it will be installed at the main Games venues.

These two sentences ( US is still "considering" privacy issues and not tapping aggressively whereas India is just blindly going ahead) made me stop reading the psy-ops article..NEW DELHI — In the United States, law enforcement and security agencies have raised privacy concerns with a new proposal for electronic eavesdropping powers to track terrorists and criminals and unscramble their encrypted messages.
But here in India, government authorities are well beyond the proposal stage. Prompted by fears of digital-era plotters, officials are already demanding that network operators give them the ability to monitor and decrypt digital messages, whenever the Home Ministry deems the eavesdropping to be vital to national security.

Its unhealthy to air so much about service appointments. Seems like there is confusion. And bringing back retired people smacks of lack of expertise. Maybe need to do away with retirement age restriction in the security services cadres?

Got out of work early today. I'm in Mumbai, and most of the streets are deserted, and very little traffic. I believe most of the country is like this today.
The judgement itself is 8000 pages long. The Waqf Board's petition has been thrown out and some news channels are reporting that they will approach the Supreme Court. The decision that the land will be split three ways with the current idols staying where they are is the surest news out right now.
I'll be just as interested to read the ASI report that has formed the basis for the decision.

On behalf of the defendants separate written statements were
filed alleging that structure is not a mosque and it was constructed
after demolishing the temple against the tenets of Islam. The A.S.I.
report was obtained which proved the earlier construction
of religious nature.
On the basis of the report of the Archeological Survey of
India massive structure of religious nature is required
to be maintained as national monument under the Ancient Monument
Archeological Site and Remains Act, 1958. The Apex Court in
Rajiv Mankotia Vs. Secretary to the President of India and
others, AIR 1997 Supreme Court page 2766 at para 21 directed
the Government of India to maintain such national monuments.
Thus, it is mandatory on the part of the Central Government to
comply with the provisions of Act No. 24 of 1958 and ensure to
maintain the dignity and cultural heritage of this country .

GIST OF THE FINDINGS by S.U.Khan J.
1. The disputed structure was constructed as mosque by or under orders of Babar.
2. It is not proved by direct evidence that premises in dispute including constructed portion belonged to Babar or the person who constructed the mosque or under whose orders it was constructed.
3. No temple was demolished for constructing the mosque.
4. Mosque was constructed over the ruins of temples which were lying in utter ruins since a very long time before the construction of mosque and some material thereof was used in construction of the mosque.
5. That for a very long time till the construction of the mosque it was treated/believed by Hindus that some where in a very large area of which premises in dispute is a very small part birth place of Lord Ram was situated, however, the belief did not relate to any specified small area
within that bigger area specifically the premises in dispute.
6. That after some time of construction of the mosque Hindus started identifying the premises in dispute as exact birth place of Lord Ram or a place wherein exact birth place was situated.
7. That much before 1855 Ram Chabutra and Seeta Rasoi had come into existence and Hindus were worshipping in the same. It was very very unique and absolutely unprecedented situation that in side the boundary wall and compound of the mosque Hindu religious places were there which were actually being worshipped along with offerings of Namaz by Muslims in the
mosque.
8. That in view of the above gist of the finding at serial no.7 both the parties Muslims as well as Hindus are held to be in joint possession of the entire premises in dispute.
9. That even though for the sake of convenience both the parties i.e. Muslims and Hindus were using and occupying different portions of the premises in dispute still it did not amount to formal partition and both continued to be in joint possession of the entire premises in dispute.
10. That both the parties have failed to prove commencement of their title hence by virtue of Section 110 Evidence Act both are held to be joint title holders on the basis of joint possession.
11.That for some decades before 1949 Hindus started treating/believing the place beneath the Central dome of mosque (where at present make sift temple stands) to be exact birth place of Lord Ram.
12. That idol was placed for the first time beneath the Central dome of the mosque in the early hours of 23.12.1949.
13. That in view of the above both the parties are declared to be joint title holders in possession of the entire premises in dispute and a preliminary decree to that effect is passed with the condition that at the time of actual partition by meets and bounds at the stage of preparation of final decree
the portion beneath the Central dome where at present make sift temple stands will be allotted to the share of the Hindus.
Order:-
Accordingly, all the three sets of parties, i.e. Muslims, Hindus and Nirmohi Akhara are declared joint title holders of the property/ premises in dispute as described by letters A B C D E F
in the map Plan-I prepared by Sri Shiv Shanker Lal, Pleader/ Commissioner appointed by Court in Suit No.1 to the extent of one third share each for using and managing the same for worshipping. A preliminary decree to this effect is passed.
However, it is further declared that the portion below the central dome where at present the idol is kept in makeshift temple will be allotted to Hindus in final decree.
It is further directed that Nirmohi Akhara will be allotted share including that part which is shown by the words Ram Chabutra and Sita Rasoi in the said map.
It is further clarified that even though all the three parties are declared to have one third share each, however if while allotting exact portions some minor adjustment in the share is to be made then the same will be made and the adversely affected party may be compensated by allotting some portion of the adjoining land which has been acquired by the Central Government.
The parties are at liberty to file their suggestions for actual partition by metes and bounds within three months. List immediately after filing of any suggestion/ application for preparation of final decree after obtaining necessary instructions from Hon'ble the Chief Justice.
Status quo as prevailing till date pursuant to Supreme Court judgment of Ismail Farooqui (1994(6) Sec 360) in all its minutest details shall be maintained for a period of three months unless this order is modified or vacated earlier.

Gist on some point
1. The area covered under the central dome of the disputed structure is
the birthplace of Lord Rama as per faith and belief of Hindus.
2. Disputed structure was always treated, considered and believed to be
a mosque and practised by Mohammedans for worship accordingly.
However, it has not been proved that it was built during the reign of Babar
in 1528.
3. In the absence of any otherwise pleadings and material it is difficult
to hold as to when and by whom the disputed structure was constructed but
this much is clear that the same was constructed before the visit of Joseph
Tieffenthaler in Oudh area between 1766 to 1771.
4. The building in dispute was constructed after demolition of Non-
Islamic religious structure, i.e., a Hindu temple.
5. The idols were kept under the central dome of the disputed structure
in the night of 22nd/23rd December 1949.
Other Original Suits no. 3 of 1989 and 4 of 1989 are barred by limitation.
