Looks like the complaint is before the court because it is about OCI status. Once someone acquires OCI status, it comes with all rights available to citizens except for those proscribed in CAA 2003.
The judge asks if a visa may be granted instead, but there's no information if a visa was applied for and denied after the OCI registration was cancelled.

Article 21 of the Indian Constitution uses the expressions "No person", "right to be liberty" shall be denied "without due process of law". From my limited understanding of the law the expression "due process" has been extended to the right of travel as a manifestation of "liberty". It could quite conceivable be extended to "right of entry into India". And of course the expression "person " has been established as to mean "non-citizens" as well.

He is not an Indian citizen. OCI is a privilege and not a right. He is a Swedish citizen who renounced Indian Citizenship. OCI card can be revoked if anybody indulges in unpatriotic act. This guy clearly is a Paki pasand India baiter who indulges in gratuitous anti-India propaganda. So home ministry has determined to revoke his OCI. He can waste his money and Courts can waste their time how much ever they want. This is the one time, I am very happy with our snail pace judiciary with all its red tape bureaucracy. Let due process of the law take its own due process of time

On Swain, he has enough activities on his record that will deny entry to any foreign national. Stripping him of OCI is the bare minimum, he should be denied visa on grounds of national security. Here is one of his recent attempts at encouraging communal unrest in India. This is just a day or two old, after he raised his case in the court.
Follow due process that the person is entitled to. Does not mean a favorable outcome is guaranteed just that another look is taken at the issue.
Court may also ask why the foreign country has not been petitioned to grant citizenship or visa to the mother on compassionate grounds. Not particularly up to India to resolve someone personal situation.

Visas to foreigners need to be strictly off limits for the courts. Why is the judge entertaining this? This is exclusively the preserve of the executive. Judiciary has no say. Tomorrow, every foreigner denied a visa will file a petition in Indian courts.

The GoI is entirely justified in denying the visa without assigning any reason, if it decides to do so
there is no time bound process for this, the GoI can takes its own sweet time

another option - do nothing. do not give visa. neither reject the visa. just keep pending for years. on inquiry just ask for more documents.
or file some private cases, and keep them pending for years (typical Indian judiciary). link the visa approval to these cases.

Once a person is arrested, he can go to court and get bail. It is easier for them to approach court if they are arrested. It is better to not give visa at all, and drag out the case and claim executive jurisdiction over OCI/visa issual, than issuing one

Don't have to arrest. Just detain him at border control for an extended interrogation period with the immigration guys taking their chai samosa breaks. Finally put him back on a flight back to his homeland. No court, no katcheri. It will hit him in the pocket book.
I remember way back in the 80's transiting through Malaysia was a horrible experience for Indians. For US citizens, they would provide visa on arrival immediately. For Indians, they would make you sit and wait and the immigration guys would go for their smoke and chai breaks without processing the routine transit visa for a long time.

It seems she is down with pneumonia but recovered just in time for Davos. She's facing court cases of corruption for buying COVID vaccines at high prices and 10x eligible population.
She and her minions tried to put lot of pressure on us re Ukraine during the G20 joint declaration and tried to scuttle it like they did in Bali which our folks did not appreciate. She can come if she wants but I'm not sure India really cares anymore.

It appears that a notable industrialist couple weren't invited to the trump inauguration but bought themselves the $1.5 million ticket(s) to gain entry, while the vacuous media "failed" to mention this little tidbit
Some pakis also bought themselves the $1.5 million ticket, like bhutto junior and a senior paki govt minister, who, if rumours are to be believed, both failed to get anywhere near the new president.

Looks like we are following different news sources.
What I can see:
- naxalites under control
- Kashmiri terrorists under control again after a spate of attacks in Jammu
- Khalistanis/farmer protests under control
- Kangladesh under pressure via Arakan rebels
- Waqf act under repeal.
- constant news of demolishing from multiple states - UP, Gujarat, Assam
- illegals being identified all over particularly the nexus of fraud documents is being rooted out.
- frequent drug hauls worth 1000s of crores!
The way I see it Govt. is silently doing a great job.
economy is stagnating - we will see much worse situation in the coming months/years, as the world economy is in doldrums.
Govt is doing pretty good in a lot of areas - building infrastructure for supply chain - freight corridors, ports, airports, metros, trains, railway tracks, highways, shipbuilding yards, PLIs - electronics, boosting temple economy, defense modernization with MII.
plenty of things to cheer about.

Had coffee with his uncle near or about every day for 30 years. He was a complete opposite of this individuals character. Absolutely NO appeasement syndrome.
