Repeal of POTA in 2004,POTA provisions in Terrorist Act 2012

Yesterday, Lok Sabha passed an amendment to the Unlawful Activites (prevention) Act through a Bill which incorportes many of the provisions of defunct POTA which was repealed under much fanfare by media and UPA in 2004. this was also part of election plank of UPA in 2004

LS nod to bill expanding definition of 'terrorist act'

Now that it has been accepted by INC that the provisions which oppossed in 2004 are indeed nessecary to fight Terror and CRPC is not adequate to deal with Terror cases, Who knows if POTA and related appratus were operational a david Headley or an Abu Jundal could have been arrested before Terror attacks

Should victims of Terror acts(relatives and those who lost limbs) after 2004 be brought on to National TV and be apologised to by Mainstream Media presenters and UPA politicians that for the sake of politics they had to suffer these terror attacks?

But we need to see if states has the independence to use it like POTA. They may have created with a provision of clearence from central agencies. For both TADA and POTA it was not the case. The state governments and agencies did use at their will. Need to read the fine print.
